Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: The applicant contracted with S&EC to complete a stream, wetland and Neuse River Buffer evaluation for the properties in order to identify the natural resources so that the project engineers could design a site plan that would minimize impacts to wetlands, streams and riparian areas to the mammum extent practicable. There are no "permanent loss" impacts proposed. There is one (1) "permanent -no permanent loss" impact to a forested wetland (Impact 1), however no above grade fill. The impact is proposed as permanent -no permanent loss because of the change of wetland function from a forested wetland, to a maintained herbaceous wetland within the permanent maintenance corridor, which is 30 ft. in width. Compensatory Mitigation has been proposed for this impact. Additionally, there is one (1) temporary stream impact for an offsite force main (Impact 5). This temporary open -cut stream crossing is at a near perpendicular angle and will be brought back to preconstruction stream bed elevations and the stream banks will be stabilized post -construction. And finally, there are four (4) riparian buffer impact areas proposed for the project. One (1) associated with the force main stream crossing (Impact 5), and the other three (3) are Stormwater Control Measure (SCM) drainage pipe impacts (Impacts 2, 3 & 4). All other streams and wetlands onsite have been avoided. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Per the project engineer: This project will be approved through the Town of Fuquay-Varina for erosion control. Measure will be installed to avoid and minimize any runoff. Silt fence, check dams, diversion ditches, sediment basins, erosion blankets and standard practices will be utilized. We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The Rutherford project is a residential development. It is important to note that the project is located within the Town of Fuquay-Varina's ETJ, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area in addition to "diffuse flow' requirements at a minimum and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved; and finally 2) the Phase II NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater management requirements.
