PROJECT SUMMARY: The property owner is requesting a permit to: 1) Construct a 1,037' replacement bulkhead, 3) replace a 25' wooden groin, 4) replace 40'x 4' pier, a 187square foot (SF) triangular platform and 193'x 4' shore side walkway in and around a man-made basin, 5) replace 184'x 6' pier with a 20'x 20' platform and 2 tie pilings. Christopher and Tammy Perry Field Investigation Report Page 2 Project Setting The project site is located at the end of Cobb Creek Road, an extension of Rivershore Road, and more specifically described as being 2137 Rivershore Road in Elizabeth City, in Pasquotank County, North Carolina. The applicant's property is zoned Low Density Residential, and adjacent property uses are residential. The lot forms a 1.82 -acre peninsula bounded on the north by the mouth of Cobb Creek, on the east by the Pasquotank River, on the south by a residential lot and Cobb Creek Road, and on the west by Cobb Creek and a small boat basin associated with the property. The property fronts on —1,037 linear feet of shoreline that currently with a failing wooden/timber bulkhead. Located on the east side of the property, along the Pasquotank River, is a 184' x 6' pier with a 20' x 20' platform, stairs and two tie pilings forming a single slip. There is a failing 18' long wooden groin/jetty located at the northeast corner of the property, at the mouth of Cobb Creek, that is a remnant of the original 25' groin/jetty. Located along the creek and boat basin (to the west) is a 193' x 4' (average) shore side walkway/dock with a 40' x 4' pier and a 187sf triangular shaped wooden platform with two mooring pilings forming two boat slips. Normal water level around the basin is on the landward side of the shore side dock in some areas due to erosion and the failing bulkhead around the basin. There is no known submerged aquatic vegetation (SAV) within the proposed work area, and the area is not recognized by current NCDMF mapping as supporting SAVs. Water depths along the existing bulkhead, on the Pasquotank River side range, from -2.49' to -3.79', and - 3.07' at the end of the pier. Water depths along the bulkhead on the creek side range from - 3.93' to -5.93'. The creek width is 41' at its narrowest point and the water body width along the river is 7,900'. Also located on the property is a large brick dwelling and associated brick walkways and drive way. Two drains are in the brick drive that appear to lead to the adjacent water bodies; however, no outlet could be located. Vegetation on the property is limited to domestic grasses and ornamental shrub and trees. The waters of the Pasquotank River along the project site are classified as SB, which are primarily recreational and any use specified by the SC classification applies (including aquatic propagation, fishing, wildlife, secondary recreation and agriculture). The property is located in an AE Flood Zone with an average elevation of -5' above NWL. Development Proposal The applicants, Christopher and Tammy Perry request a CAMA Major Permit to undertake the following development: 1) Construct a 1,037' replacement bulkhead an average of 2.77', and a maximum of 11', waterward of NWL. The 11' maximum alignment will be at the southwest corner adjacent to the pier on the Pasquotank River. The intent of the extended alignment is to straighten the bulkhead alignment and prevent the collection of debris along the bulkhead. The proposed alignment will result in—2,880sf of shallow bottom fill according to the application and plans. Christopher and Tammy Perry Field Investigation Report Page 3 The replacement bulkhead will result in a narrowing of the waterbody from 41' (at its narrowest point) to 39' along Cobb Creek. According to the application and plans there will be—29,325sf of high -ground disturbance associated with the installation of the new bulkhead. The proposed disturbance associated with the installation of the tie backs and anchors will extend —31' landward of the existing bulkhead alignment. The site plan notes that the new bulkhead will be constructed with a combination of 643' of vinyl and 394' "timber". 2) The replacement of a pre-existing 25' x 1' wooden groin (jetty) with a vinyl groin. The existing 18' wall and remnant pilings will be replaced in the original alignment. Shallow bottom disturbance will involve —25sf. 3) The replacement of an existing 184'x 6' pier and 20'x 20' platform with two tie pilings within the same alignment along the Pasquotank River (1 516sf of open water shading). The site is —32' north of the adjacent riparian corridor and —108' north of the closest adjacent pier and mooring facility. There will be no net increase in shading of open water by the proposed replacement structure. 4) Six pilings will be removed from the Pasquotank River waterward of the proposed new bulkhead. 5) An existing elevated slated wooden shore side walkway 193' x 4' will be replaced along Cobb Creek and the boat basin. The total replacement on the high ground side of the replacement bulkhead will be 772sf over high ground. Extending from the shore side dock/walkway will be a triangular shaped platform that will result in the shading of —187sf of open water in the man-made boat basin. (See 11'/2' x 17" labeled CAMA Plan for shore side dock and triangular platform location after bulkhead is constructed) 6) The final aspect of the proposed development will include the replacement of an existing 40'x 4' pier separating the two existing boat slips in the basin. The reconstruction of the pier will be with the existing alignment and shade 160sf of open water. The 11'/2' x 17" CAMA Plan shows the land disturbance associated with the removal of the existing brick dwelling, walkways, driveway and vegetation and is under review by the City of Elizabeth City for a CAMA Minor Permit. Removal will involve a controlled burn bythe Elizabeth City Fire Department and the subsequent removal of associated debris. The proposed removal will result in 12 624sf of high ground land disturbance. Combined impacts of the CAMA Minor Permit and the proposed impacts from the CAMA Major Permitwill total46,717sf (1.072 acres). The amount of leaching is dependent on the type of organic material present in the water bottom substrate, oxygen levels and water movement; however, it is estimated that 90% of the leaching will occur within the first 90 days. The subject property is located at 2137 Rivershore Road in Elizabeth City, Pasquot nk uniy, NC and owned by Christopher L. and Tammy L. Perry. The property is a peninsular landform surrounded by the Pasquotank River and Cobb Creek. Existing onsite upland improvements include a single-family home and associated garage, brick driveway and walkway and block retaining walls. Vegetation around the tract includes maintained grasses, shrubs, and trees. No wetlands are present. Existing water dependent structures include a bulkhead lining the entire shoreline of the property, a pier with platform, a staging pier, and a dock around the existing boat slip basin. Currently, there are three designated boat slips. Proposed Work Proposed work requiring a CAMA Major Permit includes the restoration and replacement of all existing water dependent structures onsite. This includes 1,037 linear feet (LF) of bulkheading, including 643 LF of vinyl bulkhead along the Pasquotank River side of the property, and 394 LF of timber bulkheading around the inside Cobb Creek portion of the property. A total of 2,880 square feet (SF) of backfill below NWL will be required. On the southeast portion of the proposed bulkhead, there is a 56 LF section beginning at the property line and extending to Pier 1 in a straight line that is proposed to remove bends from the existing alignment. This section of bulkhead will step out approximately 10 feet in front of the existing bulkhead, requiring a total of 427 SF of fill below NWL (which is a portion of the 2,880 SF of fill below NWL total). All other sections of the new bulkhead will be an average of 2 feet watenvard of the existing bulkhead. In addition to the bulkhead, an existing 25 LF timber jetty wall at the northeast corner of the property is proposed to be replaced with a new vinyl jetty wall within the existing footprint. Currently, 18 LF of the jetty remains intact (but is beginning to fail), and the outer 7 LF of sheeting has washed away, but the pilings remain. It should be noted that the existing home.that is shown on the plan will be demolished in the near future after The Elizabeth City Fire Department performs a training burn on the building. For the removal of debris, trees, brick walkways and foundation removal work, the owner will be applying for a CAMA Minor Permit, since much of the structure and surrounding land is within the 75 ft AEC. This work is planned for March 2019, prior to issuance of this CAMA Major request. The owner will be building a new home in the future but has no house plans in place at this time. At the time new residential construction occurs, the owner will either modify the CAMA Major Permit or will relinquish the CAMA Major once the bulkhead and pier work is complete and apply for a new CAMA Minor Permit for upland development. All repair and/or replacement of brick walkways will occur at this time as well. We evaluated the bottom conditions and found there to be a clay -dominated bottom along the proposed bulkhead alignment along the river and an organic bottom overlying clay and silt along Cobb Creek. There was no SAV observed and no rhizomes systems encountered. We also reviewed SAV mapping resources obtained from NCDMF and this area is not recognized as having supported SAV. The three existing Piers onsite are proposed to be replaced within their existing foot print. The existing Piers are numbered 1 through 3 on the accompanying site plan. The proposed pier replacement dimensions are as follows; 1) 184 LF by 6 feet wide with a 20 ft by 20 ft platform with stairs to be replaced, 2) a 40 LF by 4 feet wide staging pier, 3) 957 SF of irregular shaped dock that wraps around the existing two slip boat basin on the west side of the property. This pier has been accounted for in square footage due to its shape. Purpose and Need Mr. Perry recently purchased this property and all water dependent structures are aged and in disrepair.
