DeBoer and Carter, 1 Thank you for your PCN and attached information, dated 2/22/2019 (received 2/27/2019 and 3/1/2019 via email), for the above referenced project. I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit 29 (http://saw-reg.usace.army.mil/NWP2017/2017NWP29.pdf). Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file: 1) Figure 2 included in your email submissions of 2/27/20149 shows the boundaries of wetlands and other potential waters of the US you delineated on the subject property. Note that the boundaries of Wetland W1 and Stream S1 were confirmed in the field on 12/14/2018. Stream S2 and Wetland W2 were delineated when the project area limits were expanded to include these areas. Note that the Corps will not require a site visit, and will instead verify the limits of these features via an office determination; 2) However, the delineated limits of Wetland W2 are not shown on any of the Plan Sheets, and furthermore are proposed to be at least partially (if not totally) filled by a shoulder slope for a parking lot, diversion ditch, skimmer basin, etc. according to the submitted plans; a. Update Plan Sheets 1-4 and 7 to clearly show the delineated limits of Wetland W2, using similar hatching/shading as that used for Wetland W1; b. Clearly show the proposed impacts to Wetland W2 on Plan Sheets 1-4 and 7 and update the PCN accordingly, OR revised Plan Sheets 1-4 and 7 to remove the proposed fill impacts from Wetland W2; c. Note that NWP 29 cannot authorize impacts to wetlands for stormwater management facilities, including sediment basins; 3) If impacts to Wetland W2 are proposed, provide avoidance and minimization information specific to this area, and update the compensatory mitigation plan as well as the NCDMS acceptance letter; 4) On Plan Sheets 3, 4, and 7 for all wetland areas proposed for impact, show the proposed wetland impact extents using unique shading or hatching, rather than removing those impacted wetland areas from the plan sheets.
