The site is developed with a middle school, parking aras and landscaped areas. The remainder of the site consists of
undeveloped wooded land. The site is located in a residential and mixed use area of Asheboro, Randolph County, North
Carolina.

The purpose of the project is to provide access to a proposed middle school.

The overall project consists of development of the site with a middle school. In order to provide safe access to the site
and the proposed middle school, an access road and two stream and one wetland crossings are necessary. To facilitate
development of the site and construction of the proposed stream/wetland crossing, clearing and grading the site is
necessary. Graders, haulers, excavators and other heavy equipment will be used during site construction.

The applicant received a NWP 39 Verification (SAW -2017-01797, dated 4.20.18) and 401 WQC (20171523, dated
3.27.18) for the proposed impacts:
Crossing #1 - 95 LF permanent fill culvert, 7 LF permanent fill rip -rap fill and 10 LF temp pump around.
Crossing #2 - 47 LF permanent fill culvert, 7LF permanent fill rip -rap, 10LF temp pump around and 1,600 SF of wetland
fill.
The applicant constructed Crossing 1 with an additional 15 LF of permanent impact from keyed in rip -rap and Crossing 2
with an additional 9 LF of permanent impact from keyed in rip -rap.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Due to the development and use of the site as a middle school, several access roads must be constructed to provide safe
access to the site.Several alternatives were evaluated for the road crossing location. The road crossing locations were
selected in areas of the stream that were relative straight and free of meanders. Crossing locations #2 and #3 were selected
to be as far up -gradient as possible to reduce impact to larger areas of wetlands further down -gradient. Initial desgins were
located farther down -gradient then the proposed crossing locations and would have resulted in additional impacts to wetlands.
There are approximately 2.0 acres of wetlands and 1,900 linear feet of intermittent stream located on the site. The remaining
approximate 1.94 acres of wetlands and 1,727 linear feet of intermittent stream channel are being avoided.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The impact and clearing limits will be staked and silt fence or other sediment retention devices will be used. Temporary coffer
dams will be installed up -gradient of the proposed culverts. During construction, water will be pumped around the construction
footprint. Appropriate bank protection will be provided in the channels during construction and all excess excavated material
will be immediately removed from the crossing areas and stockpiled in upland locations. Upon completion of the culvert
installations, the temporary sand bag coffer dams will be removed and flow will be diverted through the culverts. Following
construction, disturbed banks will be restored to similar pre -construction conditions, matted and seeded/live staked.

Pilot consulted the USFWS Randolph County list, dated 9.13.17 to identify protected species that could occur within the
proposed project area. The USFWS list of protected species identifies the Cape Fear shiner (E) and Schweinitiz's
sunflower. Based on our observations, the proposed road crossing locations would not contain suitable habitat for these
species. Therefore, it is our opinion that the proposed project would have no effect to federally protected species.

-NCAC 4B .0129.

North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring
protection of existing natural resources and adjoining properties. If, following the
commencement of this project, the erosion and sedimentation control plan is inadequate to meet
the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General
Statute 113A-51 through 66), this office may require revisions to the plan and implementation of
the revisions to insure compliance with the Act.
Acceptance and approval of this pian is conditioned upon your compliance with Federal and
State water quality laws, regulations, and rules. In addition, local city or county ordinances or
rules may also apply to this land -disturbing activity. This approval does not supersede any other
permit or approval.
Please note that this approval is based in part on the accuracy of the information provided in the
Financial Responsibility Form, which you provided. You are requested to file an amended form
if there is any change in the information included on the form. In addition, it would be helpful if

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in
the review area, and the requestor of this PJD is hereby advised of his or her option
to request and obtain an approved JD (AJD) for that review area based on an
informed decision after having discussed the various types of JDs and their
characteristics and circumstances when they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a
Nationwide General Permit (NWP) or other general permit verification requiring "pre-
construction notification" (PCN), or requests verification for a non-reporting NWP or
other general permit, and the permit applicant has not requested an AJD for the
activity, the permit applicant is hereby made aware that: (1) the permit applicant has
elected to seek a permit authorization based on a PJD, which does not make an
official determination of jurisdictional aquatic resources; (2) the applicant has the
option to request an AJD before accepting the terms and conditions of the permit
authorization, and that basing a permit authorization on an AJD could possibly result
in less compensatory mitigation being required or different special conditions; (3) the
applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can
accept a permit authorization and thereby agree to comply with all the terms and
conditions of that permit, including whatever mitigation requirements the Corps has
determined to be necessary; (5) undertaking any activity in reliance upon the subject
permit authorization without requesting an AJD constitutes the applicant's acceptance
of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps permit
authorization based on a PJD constitutes agreement that all aquatic resources in the
review area affected in any way by that activity will be treated as jurisdictional, and
waives any challenge to such jurisdiction in any administrative or judicial compliance
or enforcement action, or in any administrative appeal or in any Federal court; and (7)
whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms
and conditions contained therein), or individual permit denial can be administratively
appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it
becomes appropriate to make an official determination whether geographic
jurisdiction exists over aquatic resources in the review area, or to provide an official
delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds
that there "may be"waters of the U.S. and/or that there "may be" navigable waters of
the U.S. on the subject review area, and identifies all aquatic features in the review
area that could be affected by the proposed activity, based on the following
information:
