Dear Mr. O'Briant:
In accordance with your permit major modification request received November 15, 2018, and
subsequent additional information received January 29, 2019, we are forwarding herewith modified
Attachments A and B certified March 8, 2019, to the NC Department of Public Safety for the subject
residuals management program.
Modifications to the subject Attachments are as follows:
• Attachment A: The residuals have increased from 7.5 to 9 dry tons/year from the Odom
Correctional Facility.
Attachment B: The acreage of Field A is decreased by 3.81 acres because of the
construction of an access road. Also, all of Field A and a portion of Field C are within the
100-year flood plain and notes have been added to this effect.
The modified Attachments A and B shall be effective from the date of certification until April 30,
2020 (i.e., expiration date of the current permit), shall void Attachments A and B of Permit No. WQ0011413
issued January 12, 2015, and shall be subject to the conditions and limitations as specified therein, as well
as those specified in the above -referenced permit. Please replace Attachments A and B of Permit No.
WQ0011413 that was issued January 12, 2015, with the modified Attachments A and B. Please note that
the Permittee shall submit a renewal application no later than November 2, 2019.
If any parts, requirements or limitations contained in this certification are unacceptable, the
Permittee has the right to request an adjudicatory hearing upon written request within 30 days following
receipt of this permit. This request shall be in the form of a written petition, conforming to Chapter 150B
of the North Carolina General Statutes, and filed with the Office of Administrative Hearings at 6714 Mail
Service Center, Raleigh, NC 27699-6714. Otherwise, this certification shall be final and binding.
