NCS000546 on November 21, 2018. The Division has reviewed and approved your request. This modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This modification includes the following changes from your current permit: Modifications to the permit in Part II on pages 6-7 of 16, to include stormwater outfall SWO15 in monitoring requirements. Revisions to the permit cover page to reflect the latest amendment date. Please replace these pages in the current permit with the revised pages and discard the older pages. If any parts, measurement frequencies, or sampling requirements contained in this modification are unacceptable to you, then you have the right to file a petition for a contested case with the Office of Administrative Hearings within thirty (30) days following receipt of this letter. This petition must conform to the requirements of Chapter 150B of the North Carolina General Statutes. Petitions must be timely filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604. This permit shall become effective May 15, 2015. This permit and the authorization to discharge shall expire at midnight on April 30, 2020. Amended August 14, 2015, June 20, 2016, December 29, 2016, and March 7, 2019, signed this 71h day of March 2019. Division of Energy, Mineral and Land Resources By the Authority of the Environmental Management Commission Permit No. NCS000546 SECTION B: ANALYTICAL MONITORING REQUIREMENTS Analytical monitoring of stormwater discharges shall be performed as specified in Tables 1-5. All analytical monitoring shall be performed during a measureable storm event at the specified-stormwater discharge outfalls (SDOs) that discharge stormwater associated with industrial activity (See Definitions). A measurable storm event is a storm event that results in an actual discharge from the permitted site outfall. The previous measurable storm event must have been at least 72 hours prior. The 72-hour storm interval does not apply if the permittee is able to document that a shorter interval is representative for local storm events during the sampling period, and the permittee obtains approval from the local DEMLR Regional Engineer. See Definitions. The parameters in Table 1 shall be monitored during a measurable storm event from Outfalls SW001 and SW001A (Drainage Area 1), Outfall SWO02 (Drainage Area 2), Outfall SWO03 (Drainage Area 3), Outfall SWO05 (Drainage Area 5), Outfall SWO07 (Drainage Area 7), Outfall SWO08 (Drainage Area 8), Outfall SWO09 (Drainage Area 9), and Outfall SW010 (Drainage Area 10), Outfall group SWO13 (Drainage Area 13 includes nine, SWO13-7 through SW013-15, 10" stormwater discharge outfalls along the rail line), Outfall SWO15 (Drainage Area 15), Outfall SWO16 (Drainage Area 16), Outfall SWO20 (Drainage Area 20) discharging to the Catawba River. • Outfalls SW001 and SW001A (Drainage Area 1) includes approximately 2,000 linear feet of rail lines and undeveloped wooded areas upland of the rail lines. • Outfall SWO02 (Drainage Area 2) includes approximately 1,000 linear feet of paved road and a 2.5 acre laydown area. • Outfall SWO03 (Drainage Area 3) includes approximately 1,500 linear feet of rail lines. • Outfall SWO05 (Drainage Area 5) is comprised of a gravel laydown yard and vegetated slopes located west and upland of the limestone unloading area. The gravel laydown yard comprises approximately 3 acres. The drainage area also includes approximately 500 linear feet of paved roadway. • Outfall SWO07 (Drainage Area 7) includes approximately 1,500 linear feet of rail lines, and 400 linear feet of gravel roadway and 400 linear feet of limestone conveyor. • Outfall SWO08 (Drainage Area 8) includes approximately 2,400 linear feet of rail lines, and 1000 linear feet of paved road and 400 linear feet of limestone conveyor. • Outfall SWO09 (Drainage Area 9) includes approximately 940 linear feet of rail lines. • Outfall SWO10 (Drainage Area 10) includes approximately 1,280 linear feet of rail lines. • Outfall Group SWO13 (Drainage Area 13) includes nine 10" stormwater discharge outfalls along approximately 1700 linear feet of rail lines and gravel road. • Outfall SWO15 (Drainage Area 15) includes a large soil borrow area, two ash structure fill areas, and approximately a one -mile gravel and dirt road. • Outfall SWO16 (Drainage Area 16) includes approximately 1,700 linear feet of paved access road, 1,000 linear feet of a paved ash haul road, 700 linear feet of paved road south of the access road, 1,000 linear feet of dirt roads and a gravel laydown and equipment parking area north of the access road. If the facility is monitoring monthly because of Tier Two or Three response actions under the previous permit, the facility shall continue a monthly monitoring and reporting schedule in Tier Two or Tier Three status until relieved by the provisions of this permit or the Division. 2 Grab samples shall be collected within the first 30 minutes of discharge. When physical separation between outfalls prevents collecting all samples within the first 30 minutes, sampling shall begin within the first 30 minutes, and shall continue until completed. 3 Sample Location: Samples shall be collected at each stormwater discharge outfall (SDO) specified above unless representative outfall status (ROS) has been granted. The permittee may petition the Director for ROS using DEMLR's ROS Request Form. DEMLR may grant ROS if stormwater discharges from a single outfall are representative of discharges from multiple outfalls. Approved ROS will reduce the number of outfalls where the analytical sampling requirements apply and will be documented in a letter to the permittee. A copy of the Division's letter granting ROS shall be kept on site. 4 For each sampled measureable storm event, the total precipitation must be recorded. An on -site rain gauge is required. Where isolated sites are unmanned for extended periods of time, a local rain gauge reading may be substituted for an on -site reading. 1 Outfall Group 13 (Drainage Area 13) includes nine 10" stormwater discharge outfalls along the rail line.
