The project is a 4.8 mile, six-lane divided facility on new location extending from north of SR 2176 (Bryan Boulevard) to SR 2303 (Lawndale Drive) in Greensboro, Guilford County, North Cazolina. Section C of this project begins immediately north of SR 2176 (Bryan Boulevazd) and terminates immediately east of US220 (Battleground Avenue) and Section D begins immediaYely east of Battleground Avenue and ends at SR 2303 (Lawndale Drive). The site contains a portion of Horsepen Creek, fifreen (15) unnamed tributaries to Horsepen Creek, a portion of Richland Creek, five (5) unnamed tributaries to Richland Creek, and fifreen (15) adjacent wetland areas in the Cape Fear River Basin (8-Digit Cataloging Unit 03030002). The above referenced ]etter contained a typographical error on the second page, related to the permit expiration date, which was incorrectly listed as llecember 31, 2023. Rather, as referenced in the DA permit issued on August 1, 2013, as well as the five previous permit modification letters dated March 25, 2014, June 6, 2014, June 19, 2015, October 7, 2015, and July 15, 2016, the accurate permit expiration date was December 31, 2018. As sucb, the DA permit for this project has expired and the stream impacts authorized by the permit modification dated February 25, 2019 are hereby rescinded. Please be advised that no work in waters of the US, including streams and wetlands, is currently authorized for this project. On February 26, 2019, NCDOT Division 7 provided an email synopsis including the status of U-2524 Sections C and D. This email indicated that, witY the exception of work proposed for the permit modification request dated January 11, 2019 (U- 2524D site 4), a11 critical work on activities that required DA authorization are complete, and remaining work would be limited to non-waters of the US, or would conducted in such a way DEPARTMENT OF THE ARMY WILMINGTON DISTRICT, CORPS OF ENGINEERS 69 DARLINGTON AVENUE WILMINGTON, NORTH CAROLINA 28403-1343 March O1, 2019 -2- that does not require DA authorization. We strongly recommend that you confirm with all relevant NCDOT and contractor personnel that the above statement is correct to avoid any unauthorized activities in waters of the US. If you deternvne that additional dischazges of dredged or fill material in waters of the US aze necessary to complete U-2524CD, you must submit an Individual (i.e. Standard) Permit applicarion for Corps evaluation.
