Ross Jr., Secretary North Carolina Department of Environment and Natural Resources October 17, 2006 Mr. Charlie Keeter P.O. Box 1612 Henderson, NC 27536 Subject Property: Cameron & Associates Tract Alan W. Klimek, P.E. Director Division of Water Quality DWQ EXP# 06-1592 Vance County On-Site Determination for Applicability to the Neuse Riparian Area Protection Rules (15A NCAC 2B .0233)-EXPRESS REVIEW PROGRAM On October 17, 2006, at your request, an on-site determination was conducted to review a stream feature located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The feature is labeled as "A" on the attached USGS map, initialed by Lia Myott and Cynthia Van Der Wiele on October 17, 2006. The Division of Water Quality (DWQ) has determined that the feature labeled as "A" on the attached maps is subject to the Neuse Buffer Rule beginning at the culvert of the wet detention pond on the adjacent property. Stream A is intermittent between the culvert and the flag labeled, "A, STR 1NT/PER", and had a stream identification form score of 21. The stream is perennial downstream of flag "A" and had a stream identification form score of 40.5. Macrobenthos found in the perennial stream include caddisfly (Family Phryganeidae), riffle beetle, fish fly larva, and scuds. This on-site determination shall expire five (5) years from the date of this letter. While conducting the .field assessment of the stream feature, it was observed that clearing work had been performed. Erosion control measures were not in place and the stream buffer on both side of the stream had been removed. This work has not been authorized by the Division of Water Quality and will necessitate a Notice of Violation. Landowners or affected parties that dispute a determination made by the DWQ that a surface water exists and that it is subject to the buffer rule may request a determination by the Director. A request for a determination by the Director shall be referred to the Director in writing c/o Cyndi Karoly, DWQ 401 Oversight/Express Review Permitting Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. You must act within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start until the affected party (including downstream and adjacent landowners) is notified of this decision. This determination is final and binding unless you ask for a hearing within 60 days. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor does this letter approve any activity within Waters of the United States or W ters of the State. If you have any questions, please contact Cynthia Van Der Wiele at 919.715.3473. ~~~ (yAlan W.
