HomeMy WebLinkAboutResponse to DEMLR NOV_20190301Regarding Planters Ridge Revised, Phase III 2/24/19 Project Id: Wayne -2018-008 To Whom It May Concern, This letter is in response to the Notice of Violations for the Sedimentation Pollution Control Act that was received by Certified Mail on February 12th, 2019. This letter is our response to the mandatory questions requested in the letter. Corrective action will be completed by 2/27/19. Repairs have been made to the 3 areas that appeared to have issues. Rainfall data and self monitoring records were in place before the letter arrived; however, our inspections and recording were lacking. Please note that our rainfall gauge and self monitoring forms are located by the mailbox kiosk in case they were not located during the inspection. We are working with our inspectors to insure self inspections do not go undone and that all issues are reported to us the same day so that they may be dealt with in a timely manner. We are repairing the wash out behind the retention pond on lot 65. It appeared the silt fence had failed so new rolled jute matting has been placed down the spillway with a slow release behind the overflow. Silt fencing was installed along the damaged area up to the jute matting. Also removed the silt that had washed approximately 20' past the silt fence. The pipe discharge located at the back of lot 69 and 70 has had the rip rap extended approximately 30 additional feet along with rip rapping the side of the ditch where other washing was occurring. We also flattened the rip rap in order to dissipate and spread the water to reduce the water energy as it leaves the pipe. There was also a small area behind lot 70 where there was some light washing going on. We added silt fencing and some rolled jute matting to slow or detain the water. Please not that we have added seeding and mulching in all 3 areas in order to get grass up as soon as possible. The reason why a civil penalty should not be assessed is that we are working hard to correct/repair our mistakes.
