Dear Ms. Karoly and Mr. McMillan:
This letter is in response to your Request for More Information letter dated February 8, 2007. The original
questions/requests are copied below as they appear on the February 8, 2007 letter and are then followed by our
response to each.
Additional Information Requested:
1. Your application states that your project is in the Cape Fear River Basin, however, your NCEEP
acceptance letter states that the mitigation is for the Neuse River basin. Please address this discrepancy.
The application package submitted to your office on January 30, 2007 is correct; the 12 Oaks project is in the Cape
Fear River Basin. The original application package submitted in March 2006 (with supplemental information
supplied in April and May 2006) also correctly stated that the project is in .the Cape Fear River Basin, including the
EEP acceptance letter dated March 1, 2006. The letter supplied in the recently submitted modification request was
the EEP "receipt" dated July 2006, which contained a typographical error. Please see the attached revised EEP
receipt which contains a notation explaining the error.
We anticipate that this answers all of the DWQ's questions in order to complete the final review process fora 401
Water Quality Certification. If you have any further questions or any additional explanation is needed, please don't
hesitate to call.

The North Carolina Ecosystem Enhancement Program (NCEEP) has received checks as indicated above as payment for the
compensatory mitigation requirements of the 401 Water Quality Certification/Section 404 Permit issued for the above
referenced project. This receipt serves as notification that the compensatory mitigation requirements for this project have
been satisfied. You must also comply with all other conditions of this certification and any other state, federal or local
government permits or authorization associated with this activity.
The NCEEP, by acceptance of this payment, acknowledges that the NCEEP is responsible for the compensatory mitigation
requirements associated with the project permit and agrees to provide the compensatory mitigation as specified in the permit.
The mitigation will be performed in accordance with the Memorandum of Understanding between the NC Department of
Environment and Natural Resources and the US Army Corps of Engineers dated November 4, 1998, as indicated below.

Please note that a payment made to the Ecosystem Enhancement Program is not reimbursable unless a request for
reimbursement is received within 12 months of the date of the original receipt (July 25, 2006). Any such request must also
be accompanied by letters from the permitting agencies stating that the permit and/or authorization have been rescinded.
*This is a revised receipt to correct one issued dated July 25, 2006. The original receipt contained a typographical
error in the table above indicating an incorrect river basin. Please note that although the original receipt had the
wrong river basin, EEP records indicate the mitigation is indeed being done in We Cape Fear 03030004 hydrologic
