SAW -2o18-02188 Dear Mr. Bailey: Per the request for additional information received December 20, 2018 via email, provided below are responses and updated documents: 1. Project plans require additional details: a. Currently wetland areas are not clearly visible on the plan sheets. Add all wetland boundaries to the plans and label them according to the delineation documentation provided by Dewberry on 8/24/2018. I recommend that a different color be used on the plan sheets for wetland lines (such as green?). Show and label the wetland boundaries on the profile drawings as well; Response: Wetland boundaries are shown in color and labeled on updated plans. b. Clearly label all streams on the plan sheets according to the delineation documentation provided by Dewberry on 8/24/2018. I recommend that a different color be used on the plan sheets for stream lines (such as blue?). Show and label the streams on the profile drawings as well; Response: Streams are shown in blue and labeled on the updated plans. c. Currently there is no way to match up itemized impacts listed in the PCN with the plans. As such, add Impact Site labels to the plans, and add corresponding labels to Section D. of the PCN for clarity purposes: Impact Site 1: Wetlands WD and WE Impact Site 2: Stream SH; Impact Site 3: Wetlands WC (2 areas); Impact Site 4: Streams SF and SG, Wetland WB; Impact Site 5: Stream SE; Impact Site 6: Streams SC and SD; Impact Site 7: Streams SA and SB, Wetland WA; Mr. David E. Currently Impact Sites are labeled as: Impact Site 1: Wetland WD Impact Site 2: Stream SH Impact Site 3: Cascade Creek (Stream SF and SB) Impact Site 4: Wetland WB Impact Site 5: Stream SE Impact Site 6: Stream SD Impact Site 7: Stream SC Impact Site 8; Stream SB and SA d. Specify whether the utility corridor would include a permanent maintenance easement where vegetation would be maintained in an herbaceous state. If so, include zoomed -in details of each stream and/or wetland crossing showing the footprint of the permanent maintenance and temporary construction corridors. Such details must also show the extent of temporary impacts (streams and wetlands) and extent of permanent maintenance impacts through wetland areas. Further, for each applicable crossing, quantify the acreage of wetlands proposed to be converted from forested wetlands and permanently maintained in an herbaceous state and add those as separate impacts in Section D of the PCN; Response: The wetlands and streams are within NCDOT right-of-way and maintained by that agency. Any current regular maintenance by NCDOT will be the same going forward. Zoomed in details are shown for each impact for a clearer view. All construction within wetlands and streams will be a temporary impact, with the exception of rip rap stabilization on the stream banks, which will be permanent. The wetlands in their existing state are not forested within the NCDOT right-of-way. 2. Project plans indicate that stream crossings include discharging rip rap. If so, please confirm (including via profile drawings) that any rip rap placed below the ordinary high water mark will be placed such that the top of the rip rap will be no higher than the existing stream bed elevation (see NWP 12 Regional Condition 4.1.11). Note that the "Rip -Rap Placement Detail" on Sheet C22 does not appear to comply with this Regional Condition. Also, since discharged rip rap would not be removed, the lengths of stream subject to rip rap discharge must be added to the PCN as permanent impacts; Response: Referring to Sections 4.1.11 and 3.5.2 of the NWP 12 Regional Condition, riprap will be pushed or keyed into the bank of the waterbody, no higher than existing stream bed elevation. This method is shown on the rip -rap placement detail. Please advise of any outlying concern. y.: Dewberry ..... Mr. David E. Bailey, PWS US Army Corps of Engineers January 25, 2019 Page 3 of 7 3. Given the time past from the date of the USFWS Section 7 self -certification letter, as well as the known occurrences of several aquatic species in Cascade Creek and the Dan River, we have initiated informal consultation with the USFWS. Please note that the Corps cannot verify the use of a NWP until Section 7 consultation is complete; Response: The USFWS letter sent on 12/20/2019 identified species of concern as the Roanoke Logperch, James Spinymussel, Atlantic Pigtoe, and Smooth Coneflower. A Smooth Coneflower survey will be performed in May.A revised Self -Certification package for the project will be re -submitted to USACE as soon as possible. Further information regarding the aquatic species is discussed in the next comment. 4. Given that occurrences of Roanoke logperch are known in Cascade Creek, and occurrences of James spinymussel are known just downstream in the Dan River, avoidance of impacts to Cascade Creek via HDD or jack and bore methods seem reasonable. However, the plans note an alternative trenching method through Cascade Creek and the PCN accounts for temporary impacts to Cascade Creek due to trenching. Please clear up this discrepancy in the plans and PCN, such that the project would be compliant with NWP 12 Regional Condition 4.1.1. If the Cascade Creek crossing would be installed via HDD, remove this impact from Section D of the PCN and add a note on this page clearly indicating that the impact would be avoided in this manner; Response: The impacts in the PCN consider that Cascade Creek is open cut (trench installation) — thus indicating maximum impact possible. The contract documents allow for the contractor to choose either directional bore or open cut methods. However, we do not want to strictly limit the crossing to only directional drilling or jack and bore methods due the following concerns: Directional Drill — Though directional drilling is becoming very conventional for smaller utilities, directional drilling and installation of a large 20" waterline is highly specialized, will require greater depth into consolidated material/rock (due to relatively shallow saturated overlying soil conditions), and require a bore of approximately l000 LF due to setup conditions at this site. Based on our experience, approximately two years ago in installing a 16" sewer forcemain on the opposite side of the road to cross Cascade Creek, contractors bidding this work were only able to get one price from a subcontractor that had the capability to directional bore the large 16" forcemain. Price for this work was more than three times the cost of open cut; consequently we had to delay the project and obtain approval to open cut and install the sewer forcemain via open cut. It is an unreasonable expectation of the City of Eden taxpayers to take on this ".g.-:1,Dewberry�a Mr. David E. Bailey, PWS US Army Corps of Engineers January 25, 2019 Page 4 of 7 additional cost and risk to the project when reasonable mitigation measures appear to be available to adequately safeguard the environment. Jack and Bore — In order to dig the bore pits deep enough to execute the bore of Cascade Creek, an extensive amount of shoring will be required to retain the road embankment. The groundwater table is also very high in this area, which will also require specialized dewatering methods in the bore pit area, in addition to the shoring. These are sophisticated and higher -risk construction methods, which also pose a safety risk to workers. We do not recommend jack and bore for installation under Cascade Creek. If open cut is utilized, to minimize potential impacts to listed threatened or endangered aquatic species, we propose to restrict work so that work will only occur outside the spawning season of each of the listed species. Construction details, related mitigation methods, as well as restoration indicated on sheet C- 22 will be strictly adhered to. Full time inspection will be provided to insure compliance with mitigation measures. Final restoration of grade to original, and restoration of vegetation per planting schedules on C-22 will be performed. 5. Provide a plan including any pertinent detail sections for typical wetland impacts via trenching. Such plans should include dewatering methods, lengths of time that trenches will be open in wetlands, and confirmation that the top 6 to 12 inches of the trench will be backfilled with topsoil from the trench. Per NWP 12 Regional Condition 4.1.9, provide a specific wetland restoration plan including how grade and contour will be re-established, anti -compaction measures in soils subject to construction traffic and matting, stabilization methods, and seeding/planting lists and specifications. Be sure to specify wetland restoration differences in temporary and permanent easement areas. Such details should be provided as an addendum that can be referenced in permit Special Conditions; Response: C22 serves as the Wetland and Stream Impacts detail sheet and includes temporary and permanent seeding mixtures. 6. Plan sheet -specific comments: a. Sheet C5: Wetland lines do not appear on the plan sheet (should be Wetlands WD and WE, per comment 1)a above. The footprint of wetland areas proposed for impact (permanent maintenance as well as temporary construction corridors) should be clearly shown on a zoom -in of the crossing (should be labeled "Impact Site 1" per comment 1)c. above. The sheet references "Provide Stream Restoration per Details"; however, this area includes wetlands rather than streams, and the plan sheet should reference a Wetland Restoration plan (see comment 5 above); Response: Wetland lines and labels added, zoom -in view of impact added, and temporary construction corridor is shown. The permanent maintenance easement is the NCDOT right-of-way. Refer to the profile y.: Dewberry ..... Mr. David E. This does not impact the wetland, and the note simply refers to the detail by which the rip rap shall be installed. b. Sheet C6: Clearly show and label Stream SH per comment 1)b above. The footprint of the stream proposed for impact should be clearly shown on a zoom -in of the crossing (should be labeled "Impact Site 2" per comment 1)c. above); Response: Stream label added, and zoom -in view of impact added. c. Sheet C7: Wetland lines do not appear on the plan sheet (should be Wetland WC [2 segments], per comment 1)a above). The footprint of wetland areas proposed for impact (permanent maintenance as well as temporary construction corridors) should be clearly shown on a zoom -in of the crossing (should be labeled "Impact Site 3" per comment 1)c. above). The sheet should also reference a Wetland Restoration plan (see comment 5 above); Response: Wetlands are located outside the NCDOT right-of-way and construction is limited to within the right-of-way. Thus, no impact to the wetlands. Wetland lines have been illustrated on the plan sheet. d. Sheet C8: Clearly show and label Streams SF and SG per comment 1)b above. If applicable, the footprint of the stream proposed for impact should be clearly shown on a zoom -in of the crossing. The plan sheet shows both an HDD plan and an "Alternative Open -Cut Cascade" option. Please clear up this discrepancy (per comment 4 above). This is your General Stormwater Permit for Construction Activities, developed to meet federal National Pollutant Discharge Elimination System (NPDES) requirements. It is separate and in addition to your Erosion and Sedimentation Control (E&SC) Plan. Federal regulations adopted by the U.S. Environmental Protection Agency (EPA) and N.C. Environmental Management Commission require an NPDES storm -water permit for your project. In North Carolina, the EPA has delegated authority to administer the NPDES program to the Department of Environment and Natural Resources. The E&SC plan approved by the Division of Energy, Mineral and Land (DEMUR), or a delegated local pro- gram, contains the core erosion control requirements for your project. The NPDES Stormwater General Permit contains additional requirements related to a broader range of water quality issues. These permits are related, but separate. Both contain conditions your project site must meet. Are there new requirements in this permit? This General Permit reflects changes made in the federal regulations effective Feb. 1, 2010, that regulate discharges from construction sites. The federal regulations resulted from litigation decisions that mandated construction activities over a certain size must contain additional measures to reduce the amount of wastes and sediment loading that reach the nation's waters. The Department of Environment and Natural Re- sources established the Construction General Permit Technical Advisory Group to guide the development of this NPDES permit. A drag permit was available for public review in May 2011, and the final permit be- came effective on Aug.3,2011. The most notable change in the new permit is a requirement that ground stabilization, such as wheat straw application, be applied within 14 days from the last land -disturbing activity. For steep slopes, that area must be stabilized within 7 days. Please see page 2 of this technical bulletin for more details. Do I need to submit a Noticeof Intent to have coverage under this permit? No. Your project is covered by this permit upon approval of an adequate erosion and Sedimentation control plan that meets requirements for surface dewatering of basins and ground stabilization timeframes. What tloes this permit require me to do? You should read and become familiar with the provisions of this permit. Below is a list of the major requirements, with indications where those differ from the previous Construction Stormwater General Permit. Erosion and Sediment Control Plan You must implement the E&SC Plan approved for your project by DEMLR or by a delegated local program. Adherence to that E&SC Plan is an enforceable component of this General Permit. Your E&SC plan will identify areas where the more stringent 7- and 14- day ground stabilization requirements apply. See "Ground Stabilization Requirements" on page 2 of this bulletin. Monitoring and Inspections • You must keep a rain gauge on the project site. • Dedicated demolition and other waste areas and earthen material stockpiles must be located at least 50' from stoml drains or streams unless no alternative is feasible (new requirement). • You must inspect all E&SC measures at least once a week and within 24 hours after any storm event greater than a half-inch (during a 24-hour period). You must take immediate corrective action for any device failure. • You must inspect all outlets where stormwater runoff leaves the site and evaluate the effect on near -by streams or wetlands. • Corrective action must be taken if sediment is deposited off -she or into a stream or wetland, or causes a visible increase in turbidity (cloudiness) of any waterbody. r (• You must keep records of these inspections and any corrective actions taken. This means you must take corrective action if erosion and sediment control measures are not operating properly. Operation and maintenance includes, but is not limited to: • Regularly cleaning out sedimentation basins. • Stabilizing eroded banks, channels or spillway structures. • Repairing/clearing out inlets and outlets. • Repairing and maintaining storm drainage inlet and outlet protection. • Repairing piping, seepage and mechanical damage. • Repairing silt fence damage. Reporting The self -inspections required by this permit are an opportunity to identify impacts to nearby waters. If you observe sediment that has deposited in a stream or wetland, you must notify the DEMLR regional office within 24 hours and provide written notice within five days (see item #3 on page six of the General Permit). Non-compliance and Fines Projects that violate Stormwater Permit conditions and/or have un -authorized water quality impacts are subject to fines. Civil penalties of up to $25,000 per day for each violation may be assessed. Inspections Staff from DEMUR and local pro -grams with delegated authority will perform random inspections of your project site to ensure compliance with state and federal regulation governing construction activities. That means that your project, if found to be in violation, could potentially be subject to enforcement action by both DEMUR and the local program. The inspections may be routine in nature or the result of a citizen complaint.
