Dear Mr. Jackson:
The North Carolina Division of Water Resources is in receipt of your self-reported bypass of partially treated
wastewater that occurred at the Mount Holly WWTP on February 22, 2019. This self-reported bypass occurred in the
influent screen area of the facility. The volume of the bypass was reported to be 25,750 gallons, all of which reached
Catawba River. This correspondence is being issued as a Notice of Violation.
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division received notification of the bypass within 24 hours as required by NPDES Permit No. NCO021156
[Part II, Section C, (4)(b)(2)].
You are requested to respond to this Notice, in writing,regarding the above noted violations,within fifteen(15)
days of receipt. The response should include all remedial actions including the specific activities to prevent the
recurrence of these violations as well as detailing all information regarding the cause of the violation. Failure to respond
and/or failure to resolve the violations could subject you to further action by the Division of Water Resources. Please be
advised that pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars($25,000.00)per
day, per violation and may be assessed against any person who violates or fails to act in accordance with the terms,
conditions, or requirements of any permit issued pursuant to G.S. 143-215.1.
