Unless the former lessee/permit holder says he wants the permit out of his name, then we probably should have them do it. If the lessee has removed all animals and is off of the site, then responsibility for the WSP goes back on the landowner. So if we do a change of ownership, we can re -issue the permit in the owner's name. Any other questions let me know. If the WSP is closed, the permit can be rescinded. At this point, the beef rattle operation could start up and wou not need to be permitted, assummR it was a pasture operation. The point of closure is that the WSP can't be used anymore for storage of animal waste, so I don't think they can have the WSP closed to NRCS standards and still be available for use as a WSP later. In order for it to be considered closed it either has to be breached or converted to a farm pond. Most WSPs are too small for conversion to a farm pond to helps. If the waste holding pond is "closed" can it be kept in tact for future use as a waste holding pond as opposed to a farm pond? Sorry for the confusion. Once it is closed, we can rescind the permit. I think there is a NRCS farm pond standard that it would need to meet. For the new lessee, just because the cattle are on pasture doesn't mean that they would not need a permit. They would still need to deal with milking parlor wash water, etc. It is possible that they would not need a permit though. Let me know if you have any other questions. They just have to modify the plan and it has to be applied at the agronomic rates, cropping windows, etc. The fescue crop does have to be utilized, if cows are out on the pasture it shouldn't be an issue, otherwise it could be cut for hay. Waste samples are required within 60 days of each waste application, both for the dry stack (slurry) manure; and the liquid pond waste (liquid). Also, I will get you a clearer map of your application fields, and we will work on getting the field numbers to match on your records. The map you currently have is difficult to read. I noted in the review that the liquid holding pond needs to be pumped down as soon as possible since it is over the maximum fill level. Again, thanks for meeting with me on Monday. I also reviewed the waste utilization plan prepared for the facility. The assumption made for plant available nitrogen (PAN) for the liquid waste is valid and is supported by USDA-NRCS Conservation Practice Standard Code 633 (Waste Utilization). From the USDA-NRCS Agricultural Waste Management Field Handbook Part 651, the following characteristics of dairy waste are given: Weight — 80lbs/d/1000# Nitrogen — 0.45lbs/d/1000# 'All values are for lactating cows, manure as excreted, Table 4-5 (125cows)(1400#/cow)(80lbs/d/1000#)(365d/yr)(lton/2000#) = 2555 tons/yr MANURE (125cows)(1400#/cow)(0.45lbsN/d/1000#)(365d/yr) = 28744 lbs N/yr TOTAL NITROGEN Since the dairy cattle are confined 100% of the time, nearly all the manure will be scraped and stored in the manure dry -stacking facility. USDA-NRCS Conservation Practice Standard Code 633 states that feedlot scraped manure contains 101bs/ton of total nitrogen. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers. Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to be kept on the appropriate recordkeeping forms (i.e. 1RR1, IRR2, DRY1, DRY2, DRY3, SLUR1, SLUR2, SLD I, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ) compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an appropriate enforcement action. The certification, however, was conditional pending the purchase and installation of an irrigation system. The conditional certification stipulated the irrigation equipment must be in place by March 1, 1999. 1 visited the dairy farm yesterday to verify delivery and installation of an irrigation system. Mr. Teague has purchased and installed the necessary irrigation equipment for application of animal waste on crops specified in his waste utilization plan. The equipment is capable of applying waste at rates that do not exceed those specified in the CAWMP. Your facility was conditionally certified on 10/15/98 pending purchase and installation of waste application and handling equipment. Please verify that such conditions have been fulfilled. 2. Your waste utilization plan shows plant available nitrogen rate based on `experience with other liquid storage ponds". Current guidelines suggest either using book values (NRCS standards 633) or to submit a minimum of three years of records of both nutrient concentrations and annual liquid volume to determine the farm averages. For dairies with storage ponds, a minimum of two samples must be collected annually for such analysis. (d) "OWNER" has secured assistance from a certified technical specialist to develop an animal waste management system which, once certified, will meet or exceed all applicable guidelines and standards and will be able to comply with all aspects of the Commissions animal waste general permit. (e) During the term of this Agreement there will be no increase in Steady State Live Weight (SSLW) at the facility. Any new construction will be designed to accommodate only the SSLW for which the facility was registered in accordance with 15A NCAC 2H.0217(a)(1)(D). (e) Since this Special Agreement is by Consent,.neither party will file a petition for a contested case or for judicial review concerning its terms. (f). Nothing in this Special Agreement shall be taken as absolving or relieving "OWNER" from any responsibility or liability for discharges of animal waste to surface waters of the State of North Carolina. 2. "OWNER" agrees that unless excused under paragraph four (4), "OWNER" will pay the Director of DWQ, by check payable to the North Carolina Department of Environment and Natural Resources, 'stipulated penalties according to the following schedule for failure to meet the deadline set out in paragraph 2(a) above. An extraordinary event beyond the "OWNER'S" control. Contractor delays or failure to obtain funding will not be considered as events beyond the "OWNER's control; or e. Any combination of the above causes. Failure within thirty (30) days of receipt of written demand to pay the penalties, or challenge them by a contested case petition pursuant to G.S. 150B-23, will be grounds for a collection action, which the Attorney General is hereby authorized to initiate. The only issue in such an action will be whether the thirty (30) days has elapsed. 5. This Special Agreement and any terms and conditions contained herein, hereby supersedes 15A NCAC 2H .0217(a)(1)(E). 6. The issuance of this COC does not excuse the Permittee from the obligation to comply with all applicable laws, rules, standards, and ordinances (local, state, and federal), nor does issuance of a COC to operate under this permit convey any property rights in either real or personal property. The plant nutrients in the animal waste should be used to reduce the amount of commercial fertilizer required for the crops in the fields where the waste is to be applied. This waste utilization plan uses nitrogen as the limiting nutrient. You must have the animal waste analyzed to determine nutrient content as close to the time of application as practical and at least within 60 days of the date of application before each application cycle. Soil nutrients in all fields where waste will be applied must be analyzed at least annually so that all plant nutrients can be balanced for realistic yields of the crop to be grown. Soil test and waste analysis records shall be kept for five (5) years. Poultry dry waste application records shall be maintained for three (3) years. Waste application records for all other waste shall be maintained for five (5) years. Several factors are important in implementing your waste utilization plan in order to maximize the fertilizer value of the waste and to ensure that it is applied in an environmentally safe manner: 1. Always apply waste based on the needs of the crop to be grown and the nutrient content of the waste. Do not apply more nitrogen than the crop can utilize. Soil types are important as they have different infiltration rates, leaching potentials, cation exchange capacities, and available water holding capacities. 3. Normally waste shall not be applied to land eroding at greater than 5 tons per acre per year. With special precautions, (see Required Specification No. 4) waste may be applied to land eroding at up to 10 tons per acre per year. 4. Do not apply waste on saturated soils, when it is raining, or when the surface is frozen. Either of these conditions may result in runoff to surface waters which is a violation of the North Carolina Division of Water Quality (NCDWQ) .0200 regulations. 5. Wind conditions at the time of field application of waste should also be considered to avoid drift and downwind odor problems. 6. To maximize the value of nutrients for crop production and to reduce the potential for pollution, the waste should be applied to a growing crop. Otherwise apply waste no earlier than 30 days prior to planting a crop or prior to forages breaking dormancy. Injecting or otherwise incorporating the waste below the soil surface will conserve nutrients and reduce odor problems. 7. Zinc and copper levels in the soils in all fields where waste is applied shall be monitored and alternative application fields shall be used when these metals approach excess levels. This plan is based on waste application by irrigation and broadcasting with a spreader. If you choose to alter the method(s) of application in the future, you need to revise this plan. Nutrient levels for various waste application methods are not the same. The estimated acres needed to apply the animal waste is based on typical nutrient content for dairy systems in North Carolina. Actual acreage requirements shall be based on waste analysis reports from storage structures in your waste management system. Your liquid waste storage pond (storage structure) is designed for 180 days of temporary storage and the temporary storage must be removed on the average of once every 6 MONTHS. In no instance should the volume of waste being stored in your structure be higher than the maximum storage marker except in the event of a 25 year, 24 hour storm. This level is marked by a 4'inch by 4 inch pressure treated post. Your dry stack is designed for 120 days of storage. Manure must be removed from the structure before it can discharge from the ramp end. Call your technical specialist after you receive the waste analysis report for assistance in determining the amount per acre to apply and the proper application rate prior to applying the waste. You should plan time and have appropriate equipment to apply the waste in a timely manner. Values used above are based on analysis of waste from similar livestock operations in North Carolina (source: USDA-NRCS FOTG Practice Standard 633 -Waste Utilization). Actual nutrient content of the waste from this system may vary from these values. Waste analysis should be made of the actual waste as soon as possible after significant waste accumulates in the storage structure(s). The applicator is cautioned that P and K may be over applied while meeting the N requirements. In the future, regulations may require farmers in some parts of North Carolina to have a nutrient management plan that addresses all nutrients. This plan only addressesnitrogen. F WASTE APPLICATION TABLES The crop fields shown in the Waste Application Tables that follow are available for waste application. It will not be necessary and may not be desirable to apply waste to each of these fields in any given year. The Lbs. of Nitrogen Per Acre shown in the tables are estimated annual nitrogen (N) requirements of the crop to be grown based on the potential productivity of the soil and assuming no double cropping. The Recommended Lbs. of N to be Applied per acre indicates the Nitrogen that can be reasonably applied to the crop and used by the crop in a timely manner using animal waste alone. It will not be practical to meet all the nutrient needs of some crops with animal waste. Supplemental applications of commercial fertilizer may be required during the growing season in order to meet all crop nutrient needs. It is assumed that for certain row crops only a fraction of the total annual nitrogen requirement can be applied using animal waste. The landowner shall record the actual waste application volume made on each field on the Department of Water Quality Waste Application Record Form.
