(owner) please find attached a complete application and supplemental information requesting written concurrence from the US Army Corps of Engineers (USAGE) and North Carolina Division of Water Resources (NCDWR) that the activities associated with the development of a residential subdivision that are described herein may proceed under Nationwide Permit (NWP) 29 and the associated General Certification (GC) 4139. Project Summary and Purpose The overall project is a single-family residential subdivision with residential streets and utilities that will connect to existing adjacent roads and utilities in the area. The 21.74 -acre project is located immediately north of Morrisville Carpenter Road and south of Town Hall Drive in Morrisville, NC. The corresponding Wake County PINs for the property are 0745-93-8919 and 0745-94-4609. and the approximate center of the property is Latitude: 35.822220° N; Longitude.- 78.832016' ongitude:78.832016° W. The purpose of the proposed project is to construct a residential subdivision and associated utilities to meet the demand for housing in this part of Wake County. Protect Detail The overall project is a single-family residential subdivision that consists of 66 -detached residential lots. Utilities for the proposed project will connect to existing utility lines in the area. Waste water from the site will tie into existing town of Morrisville sewer lines that extend across the northern portion of the project area. A single sewer line crossing will result in a stream and riparian buffer impact. Two town -maintained roads will be constructed on the project site which will connect Town Hall Drive with Morrisville Carpenter Road. A road crossing will result in impacts to a stream and the adjacent riparian buffers. The location that subdivision roads tie into the existing roads is dictated by required distances of existing intersections on Morrisville Carpenter Road and by an existing stub and roundabout (currently under construction) on Town Hall Drive. Three stormwater BMPs will be placed on the property to treat runoff. Stormwater BMP discharge will result in two locations of riparian buffer impact. The Town of Morrisville has a regional stormwater BMP planned for a portion of the Property that exists between the UT to Crabtree Creek and Town Hall Drive (no wetlands present within the on-site footprint) which will expand an existing smaller stormwater BMP. The stormwater BMP location as well as the existing stub and roundabout (currently under construction) on Town Hall Drive further dictate the placement of the proposed road crossing of the UT to Crabtree Creek. Heavy equipment typically used for similar construction projects (e.g. back hoes, bull -dozers, etc) will be utilized. No federally threatened or endangered species are listed to occur within 1 mile of the site according. to- the NC Natural Heritage Program (NHP) Database. No bridges or structures will be removed from the site. No wind turbines will be constructed as part of the project. No recorded historic properties are located on the project site according to the State Historic Preservation Office (SHPO) HPO Web Online as of February 2019. The Morrisville Historic District is located approximately 500 feet due east of the northeastern property corner. Project History The project site was originally evaluated in 2017. A site meeting was held with Ms. Tasha Alexander of the USACE on May 24, 201 (Action ID #2017-00733) and the results of the determination are shown on the attached site plans. A site meeting was not held with the NCDWR because the existence of streams as depicted on the soil survey were not being disputed. A preapplication meeting was held with Ms. Tasha Alexander on January 9, 2019 at which time the overall justification for the road crossing location was discussed as well as the use of the Town of Morrisville's Morrisville Community Park Stream and Riparian Buffer Restoration Site for mitigation purposes. The use of an open -bottomed culvert was also discussed during this meeting and additional maps and information were sent shortly there after for general concept approval. The same information was sent to Ms. Stephanie Goss of the NCDWR and a summary of the USACE preapplication meeting was provided during a phone call. Avoidance and Minimization Buffer impacts associated with the stormwater discharge locations were minimized by using easements that enter the buffers at perpendicular angles. Stream and riparian buffer impacts were minimized with the sewer crossing by using a narrower corridor and crossing at a perpendicular angle. Stream impacts were minimized at the road crossing location by utilizing an open bottomed culvert within a portion of the town -maintained road crossing. The Town of Stadelmaier Property Page 2 of 3 Morrisville has agreed that an aluminum culvert with footings can be used. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt fencing will be installed to provide additional protection from runoff. Project Impacts Proposed riparian buffer impacts will result from two stormwater BMP discharge locations (Impacts 1 and 2) that will result in zone 1 impacts of 403 ft2 and 409 ft2 and zone 2 impacts of 617 ft2 and 638 ft2 respectively. A perpendicular sewer crossing will result in a temporary stream impact of 18 liner feet (LF); zone 1 impacts of 1,100 ft2 and zone 2 impact of 2,036 ft2. The proposed road crossing will result in impacts of 295 LF of stream; 16,749 ft2 of zone 1; and 6,591 ft2 of Zone 2. Mitigation Only the proposed road crossing results in impacts that will require mitigation. A 2:1 stream mitigation rate is proposed to offset the 295 LF of permanent fill impacts resulting from the road construction. Likewise, buffer mitigation of 60,134 credits is proposed as mitigation for the road crossing. The project is located in HUC 03020201. As discussed with Ms. Tasha Alexander during the January 9, 2019 preapplication meeting, stream mitigation will be satisfied by using available credits from the Town of Morrisville's Morrisville Community Park restoration project (see attached Statement of Availability letters). The Morrisville Community Park site will also be used to provide 43,756 riparian buffer credits. The remaining riparian buffer credits totaling 16,378 credits will be purchased from the Falling Creek Nutrient Offset and Buffer Mitigation Bank (see attached letter from Wildlands Holdings).
