Dear Mr. Tennant:
The Division has reviewed your application for the subject permit. To enable us to complete our
review in accordance with N.C.G.S. 143-215.1 and 15A NCAC 2H.0105,please provide additional
or revised information to address the following comments:
The Benthic Macroinvertebrate Survey received in June 26, 2015 in response to permit
requirements was conducted by uncertified biological laboratory for benthic assessments.
Moreover,the samples collected from Goshen Swamp were outside the swamp sampling window
(February 1-March 15) and did not follow the swamp collection methods. The permit special
condition A (5) part C, Benthic Sampling Requirement, clearly specifies that "All benthic
sampling shall be performed by a laboratory certified for benthic assessments, using
approved sampling methods". Therefore, Bay Valley Foods, LLC needs to re-do the benthic
sampling survey using NC DWR certified biological laboratory for benthic assessments.

The new survey has to be conducted following the DWR standard operating procedure.If you have
any questions regarding the DWR standard operating procedure, please feel free to contact DWR
Biological Assessment Unit at 919-743-8400. The report should include both taxonomic data and
bioclassifications.
It is the State recommendations that you should peruse re-doing the Benthic Survey as soon as
possible with the time frame listed above. Please contact us if you would like to discuss this matter
in further details. If no response is received by April 21, 2019 [per 15A NCAC 2H.0107(b)], the
