HomeMy WebLinkAboutNCS000240_Charlotte PCSO Mod Response_20190225 February 25, 2019 Mr. Marc Recktenwald Surface Water Quality and Environmental Permitting Program Manager City of Charlotte – Stormwater Services 600 East 4th Street Charlotte, NC 28202 Re: Intent to Modify Post Construction Stormwater Ordinance City of Charlotte NPDES MS4 Permit NCS000240 Mecklenburg County Dear Mr. Recktenwald: The Division is in receipt of your February 20, 2019 letter regarding the city’s intent to modify its current post- construction stormwater ordinance (PCSO) to comply with N.C. Session Law 2018-145 (Senate Bill 469), effective 12/27/2018, which revised N.C.G.S. 143-214.7(b3) to apply to all local governments. In order for the city to address the specific sections and requirements of the PCSO that have been rendered unlawful by SL 2018-14, DEMLR concurs with the stated conclusions and path forward to (1) modify the applicable provisions of the city’s PCSO through the necessary procedural processes, and (2) suspend enforcement of the applicable provisions effective 12/27/2018. Furthermore, these actions to comply with S.L. 2018-145 shall not constitute a violation of the city’s municipal separate storm sewer system permit number NCS000240.
