The site is currently developed and contains numerous warehouse and storage buildings and associated infrastructure. The project applicant is proposing to redevelop the site into a
mixed-use development with modern facilities and improvements to the infrastructure, including adding another point of ingress and egress. land use in the vicinity is primarily
commercial and industrial.

The existing warehouse development has had only one access point across railroad tracks at the northeast corner of the property to Ellis Road. We are redeveloping the site with new
buildings and have purchased the narrow property where a new and safer entry drive will be constructed in order to provide better access in and out of the development. The site plan
has approved by City of Durham.

A new access road is being proposed for the redeveloped warehouse site to provide a safer point of ingress and egress. The current access crosses railroad tracks adjacent to Ellis
Road. A perennial stream will be crossed with the new access road. Typical construction equipment will be utilized including graders, excavators, back hoes, dump trucks, etc.

The stream crossing cannot be completely avoided and still provide a necessary ingress and egress point for the project. The road crossing has been
designed to minimize the amount of impact as much as practicable while still meeting NCDOT and local engineering standards for road crossings. No
other jurisdictional impacts occur as a result of this project.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
The road crossing is utiliang tail walls and wing walls to minimize stream impacts. The culvert will be buries a minimum of 12 inches below the stream
bed to promote movement of aquatic life. Rip -rap is being placed upstream and downstream of the culvert to prevent scour and erosion at the
crossing location.

ESI obtained a report on February 19, 2019 from the NC Natural Heritage Program indicating that there are no known occurrences of federal
threatened or endangered species in the study area. There is a Historic occurrence of smooth coneflower (Echinacea laevigata) within one mile of the
study area but this was last observed in 1954. The existing infrastructure on the site and the disturbed surrounding landscape make the site's habitat
unsuitable for other federal protected species.

be a stream. Features that are checked "Subject" possess characteristics that qualify it to be a
stream. There may be other streams located on your property that do not show up on the maps
referenced but, still may be considered jurisdictional according to the US Army Corps of
Engineers (USACE) and the Division of Water Resources (DWR), or both.
Wetlands are evaluated by the City of Durham Planning Department. If a wetland is
suspected to exist within or in close proximity to the project area, contact Dennis Doty
(Dennis.Doty@durhamnc.gov or 919-560-4137 ext. 28252) to determine wetland setbacks.
This on-site determination shall expire five (5) years from the date of determination in this
letter. Landowners or affected parties that dispute a determination made by the City of
Durham may request a determination by DWR. An appeal request must be made within
sixty (60) calendar days of the date of this letter or from the date the affected party
(including downstream and/or adjacent owners) is notified of this letter. A request for a
determination by DWR shall be referred to them in writing c/o Karen Higgins, 401 and
Buffer Permitting Section, 1617 Mail Service Center, Raleigh, NC 27699-1617.
DWR's determination can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH). A petition form may be obtained from the OAH at
http://www.ncoah.com/ or by calling the OAH Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A
petition is considered filed when the original and one (1) copy along with any applicable OAH
filing fee is received in the OAH during normal office hours (Monday through Friday between
8:OOam and S:OOpm, excluding official state holidays).
The petition may be faxed to the OAH at (919) 431-3100, provided the original and one copy of
the petition along with any applicable OAH filing fee is received by the OAH within five (5)
business days following the faxed transmission.
