Mr. Holloway,
In order to issue a modification, I am going to need the as -built dimensions for the impacts. I have attached an example
of what I am looking for. You have provided the length of the wall and rip rap, but I need the depth or footprint (see
example bottom figure). Please do this for above and below full pool impacts. If the depth varies, you can give me an
average. I'll put the application on hold until I receive this.
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. If all of the requested information is not received within 30 days, the Division
will be unable to approve the application and it will be returned.

Mr. Holloway,
As you may be aware, I conducted a site inspection of the subject property on December 4, 2018. Sorry for the long
delay. I have been out of town. Please reference additional condition #2 of the 401 approval letter (attached). If your
project changes, you must notify the Division and you may be required to submit a new application package with the
appropriate fee. It appeared that the seawall was longer than what you had indicated in the plans and extended into
the lake and onto Duke Energy property approximately 6-10 feet. In addition, your contractor indicated that rip rap was
to be placed along the shoreline (to the left of the seawall if you are facing the wall). This was not part of the
approval. Please provide me with an updated application detailing exactly what work has been completed and include
any additional rip rap or fill along the shoreline. Please include the dimensions of the fill material so that I can
incorporate that into the modification. Also, you will need to meet all Duke Energy guidelines. If you have any questions
please contact me.

After discussion with Kevin Holland, attached are revised site and side view plans for the wall. The dry stack boulder wall
following the contour of the shoreline gives us the best chance of saving the shoreline trees and meeting Duke
requirements. I have cc'd Kevin Holland with the plans to confirm that this plan meets with their approval.
Kevin, could you please confirm to Robert that this is acceptable. If not, let me know what revision is necessary

On August 8, 2018, the Division of Water Resources (Division) received your application dated August 5, 2018,
requesting a 401 Water Quality Certification from the Division for shoreline stabilization on your property. The Division
has reviewed the additional information and has determined the application is incomplete and cannot be processed. The
application will be placed on hold until the following items are addressed:
1. According to your application and subsequent email on August 16, 2018, the proposed retaining wall will
encroach onto Duke Energy property 4-5 feet. Please provide documentation from Duke Energy that the
proposed retaining wall/fill encroachment is authorized. [15A NCAC 02H .0502(f)]
In addition, you will want to reach out to Kevin Holloway with Duke to make sure your proposed wall meets their
specifications.
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
