On February 5 , 2019, the Division of Water Resources (Division) received your After the Fact Application dated February 5, 2019, requesting a 401 Water Quality Certification from the Division for the subject property. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until the following information is received: 1. The Division has concerns with the current dimensions of the stream channel. In addition to what the Corps has requested (see email below), please provide the Division with proper dimension, pattern, and profile data that supports the existing design. This needs to be based on a reference reach or a stable reach near the site. [15A NCAC 02H .0506(b)(3)&(4)] 2. The Division also has concerns with the lack of vegetation in the daylighted reach. Please provide a planting plan incorporating native woody vegetation that will provide sufficient shade to the stream to avoid contravening the water quality standard for temperature. [15A NCAC 02B .0211(18)] Pursuant to Title 15A NCAC 02H .0502 (c), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received within 30 calendar days, of receipt of this email, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee.
