SUBJECT: Pre-Construction Notiiication Pursuant to Nationwide Permit #14
Replacement of Bridge 459 on SR 2160 (Smith Ave) in Davidson County
WBS Number: 17BP.9. R.33
Dear Mr. Roden-Reynolds:
We are requesting Section 404 Nationwide Permit (NWP) #14 far the replacement of Bridge no. 459
with a 9'X6' double barrel box culvert buried 1' below the stream bed. Low flow will be isolated to a
single barrel, with a rock lined floodplain bench at the inlet and outlet of the culvert. The low flow barrel
will have a 1' sill with a center baffle and the high flow will have a 1.5' sill. The low flow barrel will be
backfilled with a mix of rip rap and native material. The high flow barrel will be backiilled with rip rap
and/or native material. The new culvert will result in 90' of permanent stream impact due to placement
of iill from the culvert and the relocating the channel into the culvert. Mitigation is being provided by
the Division of Mitigation Services for the 90' of impacts at a 2:1 ratio. A Mitigation Acceptance Letter
is included in the permit package.
There will be an onsite detour built to allow trafiic to be maintained for the residents living on Smith
Ave. Smith Avenue is a dead end street, and access must be maintained during construction. We will
install a temporary access road with a stream crossing consisting of 2 pipes which will result in 26' of
temporary stream impacts. Upon completion of the new double barrel box culvert, the temporary pipes
will be removed. The channel will be restored to preconstruction contours, with stream bank slopes that
are 2:1 or flatter, lined with coir fiber matting, and vegetated with a native riparian seed mix.
The USFWS county list for endangered and threatened species was reviewed to determine
threatened and endangered species for Davidson County (updated June 26, 2018). USFWS lists
Schweinitz's sunflower (Helianthus schweinitzii) as endangered in Davidson County. The
project area is regularly mowed and does not provide habitat for the sunflower. In addition, the
North Carolina Natural Heritage Program Natural Heritage Element Occurrence data was
reviewed on February 18, 2019, and no known populations were found. Therefore, it was
determined that the project would have `No Effect' on Schweinitz's sunflower.

The USFWS lists the Northern long-eared bat (NLEB-Myotis septentrionalis) as threatened in
Davidson County. The project has marginal habitat for the NLEB in the form sparse woody

vegetation greater than 3" dbh. The North Carolina Natural Heritage Program Natural Heritage
Element Occurrence data was accessed on February 18, 2019, and there were no known
hibernacula within 1 mile of the project study. The bridge was surveyed for the presence of bats
and no bats were found on the structure. The existing bridge is a low timber bridge which is not
an ideal roosting location for the bats. The requirements of the SLOPES for the NLEB have been
completed.
The Bald and Golden Eagle Protection Act is the primary rule protecting eagles. Davidson
County has known populations of the bald eagle. The North Carolina Natural Heritage Program
Natural Heritage Element Occurrence data was accessed on February 18, 2019 to review for
presence of the eagle within 1 mile of the project area. There are no known bald eagle
populations within 1 mile of the project area or no water bodies large enough to support eagles
within 1 mile. No field surveys were completed for the bald eagle.
NCDOT Cultural Resource staff have reviewed the project area for Archeological and Historic
Architectural resources. They determined that the no surveys were required, and there were no resources
present. Copies of there reports are included in the pernut application.
By copy of this letter, we also request 401 review and approval from the NC Division of Water
Resources with one copy of the application package provided to Amy Chapman, Transportation
Pernutting Unit Supervisor, and Dave Wanucha, DOT Project Coordinator. If you have any questions,
