The Wilmington District, Corps of Engineers (Corps) has received an application from
West Landing Development seeking After -the -Fact Department of the Army
authorization for permanent impacts to 0.14 -acre of jurisdictional wetlands, 0.21 -acres of
stream channel (pre -1996 impact) and 564 linear feet of perennial streams; and
temporary impacts to 0.10 -acre of forested wetlands and 100 linear feet of intermittent
streams associated with the construction of West Landing, a residential subdivision in
Sanford, Lee County, North Carolina.
Specific plans and location information are described below and shown on the attached
plans. This Public Notice and all attached plans are also available on the Wilmington

Clean Water Act
Location
West Landing Subdivision is a 127.5 -acre property located off Wicker Street in Sanford,
Lee County, North Carolina. The project site contains five unnamed perennial streams,
one unnamed intermittent stream, and one jurisdictional wetland al of which drain to
Persimmon Creek in the Cape Fear River Basin (8 -Digit Cataloging Unit 03030004).
Latitude and Longitude in Decidegrees of the site is 35.4615 N. and 79.2168 W.
Existing Site Conditions
The property is currently being developed with 217 single-family lots, which are being
constructed in four phases. Roadway paving and home construction are already complete
in Phases I and II. Roadway paving is complete, and home construction is nearly
complete in Phase III. Ground clearing, partial paving and limited home construction
have begun in Phase IV. Sewer and power easements have been constructed on the site.
The project site contains five unnamed perennial streams, one unnamed intermittent
stream, and one jurisdictional wetland all of which drain to Persimmon Creek in the Cape
Fear River Basin. A U.S. Army Corps of Engineers (Corps) jurisdictional determination
has been completed for the site which verifies these aquatic features.
Impacts to the jurisdictional features listed above have occurred for the construction of all
four Phases.
Applicant's Stated Purpose
The project purpose is to complete construction of a residential subdivision to satisfy a
demand for single-family homes.
Project Description
The activity involved the construction of a residential subdivision. This includes all
roadways, utility lines, stormwater features, and amenities. Since impacts to
jurisdictional features have occurred without a Section 401 or 404 permit, a Notice of
Violation was issued by the North Carolina Division of Water Quality on December 13,
2005, and a Notice of Unauthorized Activity/Permit Noncompliance was issued by the
Corps on February 28, 2006. An After -the -Fact Individual DA Permit application was
completed by the applicant to alleviate the violations and satisfy the stipulations of the
Clean Water Act. Listed below is a break -down of the impacts associated with each
Phase of the subdivision. Each of the stream crossings listed below resulted in impact by
means of a culvert for roadway access.
Phase I of the subdivision resulted in 55 linear feet of impact to a perennial stream
needed to access the property. Five separate stream crossings are associated with Phase
II of the subdivision which resulted in 219 linear feet of impact. In addition, two
perennial streams were converted to an open -water pond to manage stormwater for this
phase of the subdivision. Flooding from these ponds resulted in 1,380 linear feet of
stream impact. Phase III incurred three stream crossings for a total length of 140 linear
feet. Additional stream impacts completed by individual lot owners resulted in 250 linear

feet of impact. Phase IV has five stream crossings, four of which are for a total length of
285 linear feet. The fifth crossing is being redesigned for cul-de-sac use, with stream
restoration in progress for the 100 linear feet of original stream impact. An additional
0.14 -acre of permanent wetland impact has occurred in association with one of the stream
crossings. Temporary impacts to 0.10 -acre of wetland occurred during the initial layout
of Phase IV and are currently being restored.
Several of the impacts listed above occurred prior to 1996 including the construction of
the pond and four roadway crossings. Prior to 1996, stream impacts were assessed on an
acreage basis rather than per linear foot. When taking this into account, along with
reducing the total impacts due to redesign/restoration (100 linear feet) and impacts from
private lot owners (250 linear feet), the total permanent impacts to streams for this
application result in 0.21 -acres (pre 1996) and 564 linear feet (post 1996).
To mitigate for impacts to jurisdictional features, the applicant has proposed payment
into the North Carolina Ecosystem Enhancement Program (NCEEP).
Other Required Authorizations
This notice and all applicable application materials are being forwarded to the appropriate
State agencies for review. The Corps will generally not snake a final permit decision until
the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State
certification required by Section 401 of the Clean Water Act (PL 92-500). The receipt of
the application and this public notice combined with appropriate application fee at the
North Carolina Division of Water Quality central office in Raleigh will constitute initial
receipt of an application for a 401 Water Quality Certification. A waiver will be deemed
to occur if the NCDWQ fails to act on this request for certification within sixty days of
the date of the receipt of this notice in the NCDWQ Central Office. Additional
information regarding the Clean Water Act certification may be reviewed at the NCDWQ
Central Office, 401 Oversight and Express Permits Unit, 2321 Crabtree Boulevard,
Raleigh, North Carolina 27604-2260. All persons desiring to make comments regarding
the application for certification under Section 401 of the Clean Water Act should do so in
writing delivered to the North Carolina Division of Water Quality (NCDWQ), 1650 Mail
Service Center, Raleigh, North Carolina 27699-1650 Attention: Ms Cyndi Karoly by
January 3, 2007.
Essential Fish Habitat
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the
Magnuson -Stevens Fishery Conservation and Management Act. The Corps' initial
determination is that the proposed project will not adversely impact EFH or associated
fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils
or the National Marine Fisheries Service.

Cultural Resources
The Corps has consulted the latest published version of the National Register of Historic
Places and is not aware that any registered properties, or properties listed as being
eligible for inclusion therein are located within the project area or will be affected by the
proposed work. Presently, unknown archeological, scientific, prehistoric, or historical
data may be located within the project area and/or could be affected by the proposed
work.
Endangered Species
The Corps has reviewed the project area, examined all information provided by the
applicant and consulted the latest North Carolina Natural Heritage Database. Based on
available information, the Corps has determined pursuant to the Endangered Species Act
of 1973, that the proposed project will have no effect on federally listed endangered or
threatened species or their formally designated critical habitat.
Evaluation
The decision whether to issue a permit will be based on an evaluation of the probable
impacts, including cumulative impacts, of the proposed activity on the public interest.
That decision will reflect the national concern for both protection and utilization of
important resources. The benefit which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. All factors
which may be relevant to the proposal will be considered including the cumulative effects
thereof; among those are conservation, economics, aesthetics, general environmental
concerns, wetlands, historic properties, fish and wildlife values, flood hazards, flood plain
values (in accordance with Executive Order 1 1988), land use, navigation, shoreline
erosion and accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of property
ownership, and, in general, the needs and welfare of the people. For activities involving
the discharge of dredged or fill materials in waters of the United States, the evaluation of
the impact of the activity on the public interest will include application of the
Environmental Protection Agency's 404(b)(1) guidelines.
Commenting Information
The Corps of Engineers is soliciting comments from the public; Federal, State and local
agencies and officials, including any consolidate State Viewpoint or written position of
the Governor; Indian Tribes and other interested parties in order to consider and evaluate
the impacts of this proposed activity. Any corrnnents received will be considered by the
Corps of Engineers to determine whether to issue, modify, condition or deny a permit for

this proposal. To make this decision, comments are used to assess impacts on endangered
species, historic properties, water quality, general environmental effects and the other
public interest factors listed above. Comments are used in the preparation of an
Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS)
pursuant to the National Environmental Policy Act (NEPA). Comments are also used to
determine the need for a public hearing and to determine the overall public interest of the
proposed activity.
Any person may request, in writing, within the comment period specified in this notice,
that a public hearing be held to consider the application. Requests for public hearings
shall state, with particularity, the reasons for holding a public hearing. Requests for a
public hearing shall be granted, unless the District Engineer determines that the issues
raised are insubstantial or there is otherwise no valid interest to be served by a hearing.
Written comments pertinent to the proposed work, as outlined above, will be received
by the Corps of Engineers, Wilmington District, until 5pm, January 12, 2007. Comments

1.0 Introduction (Block 18)
West Landing Subdivision is a 127.5 acre property located off of Wicker Street in
Sanford, North Carolina. An Approximate Vicinity Map is included in Attachment A.
The property is being developed with 217 single-family lots, which are being constructed
in four phases. Roadway paving and home construction are already complete in Phases I
and II. Roadway paving is complete, and home construction nearly so, in Phase III.
Ground clearing, partial paving and limited home constriction have begun in Phase IV.
Sewer and power easements have been previously constructed on the site.
On December 13, 2005, West Landing Development received a Notice of Violation from
the North Carolina Division of Water Quality (NCDWQ) for failure to secure a 401
Water Quality Certification. On February 28, 2006, West Landing Development received
a Notification of Unauthorized Activity/Permit Noncompliance from the U.S. Army
Corps of Engineers (USACE). Both documents pertained to fill in stream channels and
wetlands, which are jurisdictional under Section 404/401 of the Clean Water Act, without
obtaining the required permits. The following information is provided as part of an after -
the -fact Individual Permit to satisfy Sections 404 and 401 of the Clean Water Act and to
resolve the NCDWQ's and USACE's Notices of Violation.
2.0 Purpose and Need (Block 19)
The purpose and need for this project is to build and satisfy a demand for single-family
homes in a quickly growing area of Lee County. The roadways and associated stream and
wetland crossings are needed in order to access buildable lots within the property.
3.0 Site Description
The project site is located within the Piedmont Physiographic Region of North Carolina,
characterized by rolling hills with a gentle slope. Elevations on the property range from
340 to 400 feet above mean sea level. The soils on the site are of the Mayodan series,
which is well -drained and non -hydric.
Seven jurisdictional features (five perennial streams, one intermittent stream, and one
wetland), all unnamed tributaries to Persimmon Creek (DWQ Index # 17-40-2, Class C),
exist on-site. The streams are located within the Cape Fear Watershed. A jurisdictional
determination (JD) site review, verifying the locations of these streams, was conducted
by Mr. Todd Tugwell, of the USACE, on February 24, 2006. All jurisdictional features
were approved as delineated in the field by ECS. The JD Plat, dated September 28, 2006,
is attached to this Individual Permit.
An Intermittent/Perennial (UP) Stream Determination, verifying the quality of steams
located within the subdivision, was conducted by Mr. Eric Kulz on March 24, 2006. Mr.
Kulz forwarded his conclusions to West Landing Development in a letter dated March

28, 2006. Mr. Kulz determined that five perennial streams and one intermittent stream
are located within the subdivision.

There will apparently be permanent impacts to 0.14 ac. of wetlands as a result of
completing all four phases of the subdivision. Fill placement to provide a road
crossing at Wimberley Woods Drive (W1, West Landing Phase IV Site Plans,
page C3) will account for all 0.14 ac. of permanent wetland impact.
There will apparently be temporary impacts to 0.10 ac. of wetland after
completing all four phases of the subdivision. These wetlands were impacted
during the initial layout of Phase IV. The initial design called for road crossings
at Wiley Street (W2, West Landing Phase IV Site Plans, Page C5, crossing to Lot
386) and Windfall Drive (W3, West Landing Phase IV Site Plans, Page C4,
crossing to Lot 340). Redesign of Phase7IV has employed the use of cul-de-sacs,
eliminating the need for road crossings at these wetlands. Cul-de-sac avoidances
of these wetlands are illustrated in West Landing Phase IV Wetland Delineation
Plan for Wiley Street on page C5, and for Windfall Drive on page C4. These
wetlands are in the process of being restored.

There are 2429 linear feet of stream impacts as a result of completing all four
phases of the subdivision. The following narrative describes each impact
according to the phase of subdivision in which it is located, and how each impact
will be permitted and mitigated.
Subdivision Phase I
A stream impact (Sl) resulting from the completion of Phase I is located on
Winterlocken Drive, north of the West Landing subdivision. S 1 was installed into
an unnamed tributary of Persimmon Creek prior to 1996. West Landing
Development does not have a diagram of S 1, as it did not build the road crossing.
However, S1 allows access to the subdivision, and must be permitted as part of
the project. S 1 consists of a 72" RCP.culvert, and is approximately 55 linear feet
(LF) in length. Prior to 1996, the USACE permitted stream impacts as areal
(acerage) impacts to Waters of the U.S. Therefore, with a length of 55 LF, and an
average stream width before impact of 20 ft., the area impacted at S1 is
approximately 0.03 ac.
Subdivision Phase II
Seven impacts are present in Phase II of the subdivision. Impact S2 (West
Landing Phase 2 Site Plans, Page C-2, Culvert #4), consists of two 36" RCP
culverts at a road crossing on Wickfield Drive. S2 is approximately 67 LF, with
an average stream width before impact of 2 ft. Therefore, S2 has a linear impact
of 67 LF, with a Waters of the U.S. impact of 0.003 ac.
Impact S3 (West Landing Phase 2 Site Plans, Page C-2, Culvert #3), consists of a
54" RCP culvert at a road crossing on Winterwind Circle. S3 is approximately 72
LF, with an average stream width before impact of 2 ft. Therefore S3 has a linear
impact of 72 LF, with a Waters of the U.S. impact of 0.003 ac.
Impact S4A (West Landing Phase 2 Site Plans, Page C-1, crossing to Lot 49 and
into Existing Lake) was installed into an unnamed tributary to Persimmon Creek
prior to 1996. West Landing Development did not build the road crossing.
However, S4A allows access to the subdivision, and must be permitted as part of
the project. S4A consists of approximately 10 LF of rip rap placed in the stream
at a 72" RCP culvert inlet. Prior to 1996, the USACE permitted stream impacts

as impacts to Waters of the U.S. Therefore, with a length of IOLF, and an
average stream width before impact of 5 ft., the area impacted at S4A is
approximately 0.001 ac.
Impact S413 (West Landing Phase 2 Site Plans, Page C-1, crossing to Lot 49 and
into Existing Lake) was installed into an unnamed tributary to Persimmon Creek
prior to 1996. West Landing Development did not build the road crossing.
However, S4A allows access to the subdivision, and must be permitted as part of
the project. S413 consists of a 72" RCP culvert, and is approximately 50 LF in
length. Prior to 1996, the USACE permitted stream impacts as impacts to Waters
of the U.S. Therefore, with a length of 50 LF, and an average stream width before
impact of 5 ft., the area impacted at S4B is approximately 0.006 ac.
Impact S4C (West Landing Phase 2 Site Plans, Page C-1, crossing to Lot 49 and
into Existing Lake) was installed into an unnamed tributary to Persimmon Creek
prior to 1996. West Landing Development did not build the road crossing.
However, S4C allows access to the subdivision, and must be permitted as part of
the project. S4C consists of approximately 20 LF of rip rap placed at a 72" RCP
culvert outlet. Prior to 1996, the USACE permitted stream impacts as impacts to
Waters of the U.S. Therefore, with a length of 20 LF, and an average stream
width before impact of 5 ft., the area impacted at S4A is approximately 0.002 ac.
Impact S5 (no diagram) is an unnamed tributary to Persimmon Creek flooding
impact due to the creation of a pond in the subdivision prior to 1996. West
Landing Development does not have a diagram of S5, as it did not create the
pond. However, S5 enhances and, to a lesser degree, controls stormwater for the
subdivision, and must be permitted as part of the project. S5 consists of
approximately 300 LF of stream impact due to the creation of the pond. A
multiplier of 1.2 to account for stream meander brings the impact to 360 LF.
Prior to 1996, the USACE permitted stream impacts as impacts to Waters of the
U.S. Therefore, with a length of 360 LF, and an average stream width before
impact of 2 ft., the area impacted at S5 is approximately 0.02 ac.
Impact S6 (no diagram) is an unnamed tributary to Persimmon Creek flooding
impact due to the creation of a pond in the subdivision prior to 1996. West
Landing Development does not have a diagram of S6, as it did not create the
pond. However, S6 enhances and, to a lesser degree, controls stormwater for the
subdivision, and must be permitted as part of the project. S6 consists of
approximately 850 LF of stream impact due to the creation of the pond. A
multiplier of 1.2 to account for stream meander brings the impact to 1020 LF.
Prior to 1996, the USACE permitted stream impacts as impacts to Waters of the
U.S. Therefore, with a length of 1020 LF, and an average stream width before
impact of 5 ft., the area impacted at S6. is approximately 0. 12 ac.

Subdivision Phase III
Four impacts are present in Phase III of the subdivision. S7A (Preliminary Plat
West Landing Phases III & IV, Page C2, crossing to Lot 303), consists of a 36"
RCP culvert at a road crossing on Winterlocken Drive. S7A is approximately 43
LF, with an average stream width before impact of 2 ft. Therefore, S7A has a
linear impact of 43 LF, with a Waters of the U.S. impact of 0.002 ac.
Impact S7B (Preliminary Plat West Landing Phases III & IV, Page C2, crossing
to Lot 303) consists of approximately 16 LF of rip rap placed at a 36" RCP
culvert outlet, with an average stream width before impact of 2 ft. Therefore, S713
has a linear impact of 16 LF, with a Waters of the U.S. impact of 0.001 ac.
Impact S8 (Preliminary Plat West Landing Phases III & IV, Page C2, crossing to
Lot 328), consists of a 36" RCP culvert at a road crossing on Wimberley Woods
Drive. S8 is approximately 81 LF, with an average stream width before impact of
2 ft. Therefore, S8 has a linear impact of 81 LF, with a Waters of the U.S. impact
of 0.004 ac.
Impact S9 (Culvert on Lots 328 and 329 in Phase III, no diagram), consists of a
36" RCP culvert along the front yards of Lots 329 and 329 on Winterlocken
Drive. S9 is approximately 250 LF, with an average stream width before impact
of 2 ft. Therefore, S9 has a linear impact of 250 LF, with a Waters of the U.S.
impact of 0.01 ac. This impact will not be the responsibility of West Landing
Development, as it was installed by private builders on private property.
Subdivision Phase IV
Five impacts are present in Phase IV of the subdivision. S IOA (West Landing
Phase IV Site Plans, Page C4, crossing to Lot 315) consists of a 42" RCP culvert
at a road crossing on Wimberley Woods Drive. S IOA is approximately 86 LF,
with an average stream width before impact of 3 ft. Therefore, S 10A has a linear
impact of 86 LF, with a Waters of the U.S. impact of 0.006 ac.
Impact S 10B (West Landing Phase IV Site Plans, Page C4, crossing to Lot 315)
consists of approximately 29 LF of rip rap placed at a 42" RCP culvert outlet,
with an average stream width before impact of 3 ft. Therefore, S l OB has a linear
impact of 29 LF, with a Waters of the U.S. impact of 0.002 ac.
Impact SIIA (West Landing Phase IV Site Plans, Page C4, crossing to Lot 345)
consists of a 66" RCP culvert at a road crossing on Wimberley Woods Drive.
S I I A is approximately 140 LF, with an average stream width before impact of 3
ft. Therefore, S 11 A has a linear impact of 140 LF, with a Waters of the U.S.
impact of 0.008 ac.

Impact S11B (West Landing Phase IV Site Plans, Page C4, crossing to Lot 345)
consists of approximately 30 LF of rip rap placed at a 66" RCP culvert outlet,
with an average stream width before impact of 3 ft. Therefore, S11B has a linear
impact of 30 LF, with a Waters of the U.S. impact of 0.002 ac.
Impact S12 (West Landing Phase IV Site Plans, Page C4, crossing to Lot 340)
consists of a temporary stream impact at Windfall Drive. S12 was impacted
during the initial layout of Phase IV. The initial design called for road crossing at
Windfall Drive. Redesign of Phase IV has employed the use of cul-de-sacs,
eliminating the need for road crossing at this stream. Cul-de-sac avoidances of
this stream are illustrated in West Landing Phase IV Wetland Delineation Plan for
Windfall Drive on page C4. The stream is in the process of being restored.

There are 0.24 ac. of total wetland impacts as a result of completing all four
phases of the West Landing subdivision. Of these impacts, 0.10 ac. are temporary
wetland impacts (W2, W3). These temporary wetland impacts are currently in the
process of being restored. Once restoration has been completed, total permanent
wetland impacts at West Landing as a result of completing all four phases of the
subdivision are 0.14 ac. (i.e., 0.24 ac. — 0.10 ac. = 0.14 ac.).

There are 2429 total linear feet of stream impacts as a result of completing all four
phases of the West Landing subdivision. Of these impacts, 135 LF of stream
impacts (S 1, S4A, S4B, S4C) to perennial streams are road crossings constructed
prior to 1996. Prior to 1996, the USACE permitted stream impacts as impacts to
Waters of the U.S. Therefore, permits for these impacts will be for 0.039 ac. to

Waters of the U.S. rather than 135 LF of stream impacts. Another 1380 LF are
flooding impacts (S5, S6) due to the creation of a pond. This pond was created
prior to 1996. Prior to 1996, the USACE permitted stream impacts as impacts to
Waters of the U.S. Therefore, permits for these impacts will be for 0.14 ac. to
Waters of the U.S., rather than 1380 LF of stream. Another 250 LF of impacts
(S9) to a perennial stream were created by private builders, and are not the
responsibility of West Landing Development. Finally, 100 LF of stream impacts
are temporary impacts (S12) to an intermittent stream. Redesign of Phase IV has
employed the use of cul-de-sacs as minimization measures, eliminating the need
for road crossing at this stream. This stream is in the process of being restored.
Total stream impacts to be permitted at West Landing as a result of completing all
four phases of the subdivision are 564 LF. Total Waters of the U.S. impacts to be
permitted at West Landing as a result of completing all four phases of the
subdivision are 0.21 ac.

An existing pond is located at the West Landing subdivision. It is not a
proposed pond. The pond was created by damming perennial streams. Permit
requirements for these streams are discussed above in the stream impact
section.

4.3 Cultural Resources
ECS personnel reviewed the databases at both the North Carolina State Historic
Preservation Office, and the North Carolina Office of State Archeology for the
USGS 7.5 Minute Sanford Quadrangle in order to identify any cultural resources
that may be located within the subdivision area. No cultural resources were
identified within any of the four phases of the West Landing Subdivision.
ECS personnel also reviewed the status of surrounding natural resources in order
to determine if any Wild and Scenic Rivers might be impacted by the project.
The West Landing subdivision will not impact any designated Wild and Scenic
Rivers.
4.4 Threatened and Endangered Species
ECS personnel reviewed the database at the Natural Heritage Foundation for the
USGS 7.5 Minute Sanford Quadrangle in order to determine if any threatened or
endangered species were present within the location of the planned development
area. No Federally endangered, threatened, proposed endangered or proposed
threatened species were identified within any of the four phases of the West
Landing Subdivision.
5.0 Completed Work (Block 23)
Phases I and II have completed roadway paving and home construction. Phase III has
completed roadway paving and home construction is nearly complete. In Phase IV,
ground clearing, partial paving and limited home construction has begun. Cul-de-sacs,
rather than through streets, are in the process of being constructed. The construction of

the cul-de-sacs is a minimization measure to decrease stream and wetland impacts at the
site. Sewer and power easements have been previously constructed on the site.
West Landing Development 1-A is dated May 30, 1995. This portion of the subdivision
contains 22 lots, and road paving and home construction are complete. The completion
date of this portion of the subdivision is not known.
West Landing Development 1-13 is dated January 8, 1996. This portion of the
subdivision contains 65 lots, and road paving and home construction are complete. The
completion date of this portion of the subdivision is not known.
West Landing Phase 2 is dated March 14, 2001. This portion of the subdivision contains
27 lots, and road paving and home construction are complete. The completion date of
this portion of the subdivision is not known.
Preliminary Plat West Landing Subdivision Phase III and Phase IV is dated October 28,
2002. This portion of the subdivision contains 103 lots. Road paving is complete and
home construction nearly so in Phase III. Ground clearing, partial paving and limited
home construction have begun in Phase IV.
West Landing Phase IV Site Plan is dated March 3, 2005. This site plan is no longer
valid for the site.
West Landing Phase IV Wetland Delineation Plan is dated March 17, 2006. This portion
of the subdivision contains 69 lots, and ground clearing, partial paving and limited home

West Landing Development is purchasing all compensatory mitigation via the North
Carolina Ecosystem Enhancement Program's In -lieu Fee Process. The acceptance letter
can be found in Attachment C.
A total of 0.24 ac. of wetlands were impacted due to the construction of West Landing
Subdivision. However, 0.10 ac. of these wetland impacts (W2, W3) are temporary.
Redesign of Phase IV has employed the use of cul-de-sacs as minimization measures,
eliminating the need for road crossing at these wetlands. These wetlands are in the
process of being restored. Therefore, the total area for wetland compensatory mitigation
to be purchased is 0.14 ac.
A total of 2429 LF of streams were impacted due to the construction of West Landing
Subdivision. However, 135 LF of these stream impacts (SI, S4A, S4B, S4C) are road
crossing impacts constructed prior to 1996. Prior to 1996, the USACE permitted stream
impacts as impacts to Waters of the U.S. Therefore, permits for these impacts will be for

0.039 ac. to Waters of the U.S. rather than 135 LF of stream impacts. Another 1380 LF
of these stream impacts (S5, S6) are pond creation impacts constructed prior to 1996.
Prior to 1996, the USACE permitted stream impacts as impacts to Waters of the U.S.
Therefore, permits for these impacts will be for 0.14 ac. to Waters of the U.S., rather than
1380 LF of stream. Another 250 LF of impacts (S9) to a perennial stream were created
by private builders, and are not the responsibility of West Landing Development.
Finally, 100 LF of stream impacts are temporary impacts (S 12) to an intermittent stream.
Redesign of Phase IV has employed the use of cul-de-sacs as minimization measures,
eliminating the need for road crossing at this stream. This stream is in the process of
being restored. Therefore, the total length for stream compensatory mitigation to be
purchased is 564 LF (see Section 4.2 for details).

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NC EEP) is willing to
accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that
the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the
applicant to contact these agencies to determine if payment to the NC EEP will be approved.
This acceptance is valid for six months from the date of this letter. If we have not received a copy of the issued 404
Permit/401 Certification within this time frame, this acceptance will expire. It is the applicant's responsibility to send
copies of the 404/401/CAMA permits to NC EEP. Once NC EEP receives a copy of the 404 Permit and/or the 401
Certification an invoice will be issued and payment must be made.

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation for the permitted impacts
up to a 2:1 ratio, (buffers, Zone 1 at a 3:1 ratio and Zone 2 at a 1.5:1 ratio). The type and amount of the compensatory
mitigation will be as specified in the Section 404 Permit and/or 401 Water Quality Certification, and/or CAMA Permit. The
mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of
Environment and Natural Resources and the U. S. Army Corps of Engineers dated November 4, 1998.
