Individual Section 404 and 401 Permit Applications West Landing Development, Sanford, NC November 6, 2006 ECS Project # 14552 1.0 Introduction (Block 18) West Landing Subdivision is a 127.5 acre property located off of Wicker Street in Sanford, North Carolina. An Approximate Vicinity Map is included in Attachment A. The property is being developed with 217 single-family lots, which are being constructed in four phases. Roadway paving and home construction are already complete in Phases I and II. Roadway paving is complete, and home construction nearly so, in Phase III. Ground clearing, partial paving and limited home construction have begun in Phase IV. Sewer and power easements have been previously constructed on the site. On December 13, 2005, West Landing Development received a Notice of Violation from the North Carolina Division of Water Quality (NCDWQ) for failure to secure a 401 Water Quality Certification. On February 28, 2006, West Landing Development received a Notification of Unauthorized Activity/Permit Noncompliance from the U.S. Army Corps of Engineers (USACE). Both documents pertained to fill in stream channels and wetlands, which are jurisdictional under Section 404/401 of the Clean Water Act, without obtaining the required permits. The following information is provided as part of an after - the -fact Individual Permit to satisfy Sections 404 and 401 of the Clean Water Act and to resolve the NCDWQ's and USACE's Notices of Violation. 2.0 Purpose and Need (Block 19) The purpose and need for this project is to build and satisfy a demand for single-family homes in a quickly growing area of Lee County. The roadways and associated stream and wetland crossings are needed in order to access buildable lots within the property. 3.0 Site Description The project site is located within the Piedmont Physiographic Region of North Carolina, characterized by rolling hills with a gentle slope. Elevations on the property range from 340 to 400 feet above mean sea level. The soils on the site are of the Mayodan series, which is well -drained and non -hydric. Seven jurisdictional features (five perennial streams, one intermittent stream, and one wetland), all unnamed tributaries to Persimmon Creek (DWQ Index # 17-40-2, Class C), exist on-site. The streams are located within the Cape Fear Watershed. A jurisdictional determination (JD) site review, verifying the locations of these streams, was conducted by Mr. Todd Tugwell, of the USACE, on February 24, 2006. All jurisdictional features were approved as delineated in the field by ECS. The JD Plat, dated September 28, 2006, is attached to this Individual Permit. An Intermittent/Perennial (I/P) Stream Determination, verifying the quality of steams located within the subdivision, was conducted by Mr. Eric Kulz on March 24, 2006. Mr. Kulz forwarded his conclusions to West Landing Development in a letter dated March 1 Individual Section 404 and 401 Permit Applications West Landing Development, Sanford, NC November 6, 2006 ECS Project # 14552 28, 2006. There will apparently be permanent impacts to 0.14 ac. of wetlands as a result of completing all four phases of the subdivision. Fill placement to provide a road crossing at Wimberley Woods Drive (W1, West Landing Phase IV Site Plans, page C3) will account for all 0.14 ac. of permanent wetland impact. There will apparently be temporary impacts to 0.10 ac. of wetland after completing all four phases of the subdivision. These wetlands were impacted during the initial layout of Phase IV. The initial design called for road crossings at Wiley Street (W2, West Landing Phase IV Site Plans, Page C5, crossing to Lot 386) and Windfall Drive (W3, West Landing Phase IV Site Plans, Page C4, crossing to Lot 340). Redesign of Phase IV has employed the use of cul-de-sacs, eliminating the need for road crossings at these wetlands. Cul-de-sac avoidances of these wetlands are illustrated in West Landing Phase IV Wetland Delineation Plan for Wiley Street on page C5, and for Windfall Drive on page C4. These wetlands are in the process of being restored. The following narrative describes each impact according to the phase of subdivision in which it is located, and how each impact will be permitted and mitigated. Subdivision Phase I A stream impact (S1) resulting from the completion of Phase I is located on Winterlocken Drive, north of the West Landing subdivision. S 1 was installed into an unnamed tributary of Persimmon Creek prior to 1996. West Landing Development does not have a diagram of S1, as it did not build the road crossing. However, S1 allows access to the subdivision, and must be permitted as part of the project. S1 consists of a 72" RCP culvert, and is approximately 55 linear feet (LF) in length. Prior to 1996, the USACE permitted stream impacts as areal (acerage) impacts to Waters of the U.S. Therefore, with a length of 55 LF, and an average stream width before impact of 20 ft., the area impacted at S1 is approximately 0.03 ac. Subdivision Phase II Seven impacts are present in Phase II of the subdivision. Impact S2 (West Landing Phase 2 Site Plans, Page C-2, Culvert #4), consists of two 36" RCP culverts at a road crossing on Wickfield Drive. S2 is approximately 67 LF, with an average stream width before impact of 2 ft. Therefore, S2 has a linear impact of 67 LF, with a Waters of the U.S. impact of 0.003 ac. Impact S3 (West Landing Phase 2 Site Plans, Page C-2, Culvert #3), consists of a 54" RCP culvert at a road crossing on Winterwind Circle. S3 is approximately 72 LF, with an average stream width before impact of 2 ft. Therefore S3 has a linear impact of 72 LF, with a Waters of the U.S. impact of 0.003 ac. Impact S4A (West Landing Phase 2 Site Plans, Page C-1, crossing to Lot 49 and into Existing Lake) was installed into an unnamed tributary to Persimmon Creek prior to 1996. West Landing Development did not build the road crossing. However, S4A allows access to the subdivision, and must be permitted as part of the project. S4A consists of approximately 10 LF of rip rap placed in the stream at a 72" RCP culvert inlet. Impact S4B (West Landing Phase 2 Site Plans, Page C-1, crossing to Lot 49 and into Existing Lake) was installed into an unnamed tributary to Persimmon Creek prior to 1996. West Landing Development did not build the road crossing. However, S4A allows access to the subdivision, and must be permitted as part of the project. S413 consists of a 72" RCP culvert, and is approximately 50 LF in length. Prior to 1996, the USACE permitted stream impacts as impacts to Waters of the U.S. Therefore, with a length of 50 LF, and an average stream width before impact of 5 ft., the area impacted at S4B is approximately 0.006 ac. Impact S4C (West Landing Phase 2 Site Plans, Page C-1, crossing to Lot 49 and into Existing Lake) was installed into an unnamed tributary to Persimmon Creek prior to 1996. West Landing Development did not build the road crossing. However, S4C allows access to the subdivision, and must be permitted as part of the project. S4C consists of approximately 20 LF of rip rap placed at a 72" RCP culvert outlet. Prior to 1996, the USACE permitted stream impacts as impacts to Waters of the U.S. Therefore, with a length of 20 LF, and an average stream width before impact of 5 ft., the area impacted at S4A is approximately 0.002 ac. Impact S5 (no diagram) is an unnamed tributary to Persimmon Creek flooding impact due to the creation of a pond in the subdivision prior to 1996. West Landing Development does not have a diagram of S5, as it did not create the pond. However, S5 enhances and, to a lesser degree, controls stormwater for the subdivision, and must be permitted as part of the project. S5 consists of approximately 300 LF of stream impact due to the creation of the pond. A multiplier of 1.2 to account for stream meander brings the impact to 360 LF. Prior to 1996, the USACE permitted stream impacts as impacts to Waters of the U.S. Therefore, with a length of 360 LF, and an average stream width before impact of 2 ft., the area impacted at S5 is approximately 0.02 ac. Impact S6 (no diagram) is an unnamed tributary to Persimmon Creek flooding impact due to the creation of a pond in the subdivision prior to 1996. West Landing Development does not have a diagram of S6, as it did not create the pond. However, S6 enhances and, to a lesser degree, controls stormwater for the subdivision, and must be permitted as part of the project. S6 consists of approximately 850 LF of stream impact due to the creation of the pond. A multiplier of 1.2 to account for stream meander brings the impact to 1020 LF. Prior to 1996, the USACE permitted stream impacts as impacts to Waters of the U.S. Therefore, with a length of 1020 LF, and an average stream width before impact of 5 ft., the area impacted at S6 is approximately 0. 12 ac. Z Individual Section 404 and 401 Permit Applications West Landing Development, Sanford, NC November 6, 2006 ECS Project # 14552 Subdivision Phase III Four impacts are present in Phase III of the subdivision. S7A (Preliminary Plat West Landing Phases III & IV, Page C2, crossing to Lot 303), consists of a 36" RCP culvert at a road crossing on Winterlocken Drive. S7A is approximately 43 LF, with an average stream width before impact of 2 ft. Therefore, S7A has a linear impact of 43 LF, with a Waters of the U.S. impact of 0.002 ac. Impact S713 (Preliminary Plat West Landing Phases III & IV, Page C2, crossing to Lot 303) consists of approximately 16 LF of rip rap placed at a 36" RCP culvert outlet, with an average stream width before impact of 2 ft. Therefore, S713 has a linear impact of 16 LF, with a Waters of the U.S. impact of 0.001 ac. Impact S8 (Preliminary Plat West Landing Phases III & IV, Page C2, crossing to Lot 328), consists of a 36" RCP culvert at a road crossing on Wimberley Woods Drive. S8 is approximately 81 LF, with an average stream width before impact of 2 ft. Therefore, S8 has a linear impact of 81 LF, with a Waters of the U.S. impact of 0.004 ac. Impact S9 (Culvert on Lots 328 and 329 in Phase III, no diagram), consists of a 36" RCP culvert along the front yards of Lots 329 and 329 on Winterlocken Drive. S9 is approximately 250 LF, with an average stream width before impact of 2 ft. Therefore, S9 has a linear impact of 250 LF, with a Waters of the U.S. impact of 0.01 ac. This impact will not be the responsibility of West Landing Development, as it was installed by private builders on private property. Subdivision Phase IV Five impacts are present in Phase IV of the subdivision. S l0A (West Landing Phase IV Site Plans, Page C4, crossing to Lot 315) consists of a 42" RCP culvert at a road crossing on Wimberley Woods Drive. The initial design called for road crossing at Windfall Drive. Redesign of Phase IV has employed the use of cul-de-sacs, eliminating the need for road crossing at this stream. No cultural resources were identified within any of the four phases of the West Landing Subdivision. ECS personnel also reviewed the status of surrounding natural resources in order to determine if any Wild and Scenic Rivers might be impacted by the project. The West Landing subdivision will not impact any designated Wild and Scenic Rivers. 4.4 Threatened and Endangered Species ECS personnel reviewed the database at the Natural Heritage Foundation for the USGS 7.5 Minute Sanford Quadrangle in order to determine if any threatened or endangered species were present within the location of the planned development area. No Federally endangered, threatened, proposed endangered or proposed threatened species were identified within any of the four phases of the West Landing Subdivision. 5.0 Completed Work (Block 23) Phases I and II have completed roadway paving and home construction. Phase III has completed roadway paving and home construction is nearly complete. In Phase IV, ground clearing, partial paving and limited home construction has begun. Cul-de-sacs, rather than through streets, are in the process of being constructed.
