Please see attached PDF response to your comments dated January 15,2019. Also included is a complete sheet set to
make sure there is no confusion on which sheets had updates. Sheets 6, 18 and 19 of 19 highlight most of the changes
and additional information.
As described in the letter and depicted on the updated drawings, we've made several changes to the project to address
your comments that will hopefully alleviate any division objections to the project.
Please contact Steve or myself to discuss if needed. Let me know if you would like a hard copied mailed.

Dear Curt,
We are in receipt of your 1/15/19 comments to DCM regarding the current CAMA permit
application for the Waters at Lea Island project located in Hampstead, NC. We are
addressing the list of minimization and avoidance measures suggested.
Minimization and Avoidance Measures
Due to the cumulative impacts expected from this project, the division objects to the
permit application as proposed unless additional minimization and avoidance measures
are taken. The division offers the following suggestions to achieve this.
• Remove the proposed dredging along the open shoreline (lots 41-49).
The current proposed dredging along the open shoreline (lots 41-49) is to -6' mlw
within the same footprint as formerly permitted and dredged to a depth of -4'
mlw. The existing channel serves a total of 15 boat docks now located along this
shorefront. The applicant wishes to maintain this channel for boating access for
the future project's lot owners. As a form of minimization, the applicant is now
reducing the requested depth here to -4' mlw as formerly permitted/dredged and is
considered maintenance dredging in all dimensions. Most of the area within this
dredging footprint is currently between -3' and -4' mlw, which reduces the net
dredge cut to around 1' on average. This minimizes the potential for impacts
adjacent to the dredging area and matches the earlier authorized dredging
dimensions. Considering the proposed channel dimensions have been reduced
here to the historically maintained width and depth, no effects to SAV or shellfish
resources are expected. The enclosed North Channel Detail (sheet 19 of 19) is
overlaid on the most recent available 2016 NC Onemap aerial photo. This aerial
and others we have examined show no evidence of a shellfish or SAV resource

immediately adjacent to the dredge cut.
• Reduce proposed shoreline hardening by using non -vertical stabilization along
the open southeast shoreline. Natural methods, such as planted vegetation or reef
construction, are considered to have the least adverse impact, while vertical
structures are generally considered to have the greatest impact (DCM 2006). In a
scoping meeting held on July 27, 2018, both the United States Army Corps of
Engineers (USA CE) and at that time the DCM Fisheries Resource Specialist
stated that they would prefer to see the incorporation of living shorelines to
minimize the impacts of the project and the USACE even mentioned the possibility
of its use for mitigating wetland impacts associated with this project. The.final
application doesn't mention any attempt to incorporate the use of living
shorelines or alternatives to vertical bulkheads in the narrative. The DMF would
strongly encourage the investigation and addition of alternative shoreline
stabilization methods other than the proposed 2,800 linear feet of new sheet pile
bulkhead. This could offset impacts from habitat loss and water quality
degradation
The proposed bulkhead and wing wall on lots 49 and 50 is approximately 265'
along the shoreline. The applicant has agreed to remove this bulkhead and instead
construct a low 2' high riprap slope on upland above the joint coastal/404 wetland
line. Please see enclosed sheet 6 of 19. No wetlands will be impacted and the
riprap will be above the normal tidal range removing concerns related to wave
refraction and scour. The remaining new sheet pile bulkheading within the project
is associated with the construction of the inland basin marina and entrance
channel.
• Restrict docks along the open shoreline (lots 41-49) to observation platforms and
eliminate dredging along the shoreline. The DMF recommends a deed restriction
be placed on lots 41- 49 which would prevent the permitting of any water -
dependent structures (observation platforms only) to minimize future impacts to
the project area. Restricting boat dockage along this shoreline will not only
remove the need to dredge but will aid in preventing further impacts to the nearby
,fisheries resources. Dredging, boat traffic, shading impacts, storm water runoff,
and upland development in this area all have the potential to negatively impact
the habitat function. This deed restriction will aid in minimizing overall impacts
and avoiding additional impacts in this area specifically. This area provides high
quality nursery and foraging habitat because of the combination of shallow soft
bottom, fringing coastal marsh and oysters as well as SAV and subtidal shell
habitat. While the proposed project would reduce the existing number of water
dependent structures along the proposed lots #41-49 from the current 15 to a
proposed 9, it should be noted that the creation of an access channel would create
an additional 7 lots which have the potential to add docking facilities where there
are currently only 2. Furthermore, the need to maintain these docks in addition to
the 75 slips proposed in the marina basin, does not demonstrate any

minimization. The division also supports any additional deed restrictions
suggested by DMF's Shellfish Sanitation Section to prevent a closure of waters
currently open to the harvest of shellfish.

• In lieu of #3, restrict docks along the open shoreline (lots 41-49) to faxed
platforms only. Additionally, condition stops at 18 " above the substrate for any
boatlifts. This would eliminate the need for dredging and also prevent any bottom
impacts from floating structures.
As mentioned, the number of docks along the open shoreline (lots 41-49) will be
reduced from the 15 existing to 9 (one per lot here). Any future private docking
structures whether floating or fixed could extend to the edge of the dredging area
to avoid the "channel" area or to the 1/4 waterbody distance, whichever is most
restrictive under DCM rules. This would place any wet slips or lift slips in water
close to -4' m1w. As a result, any floating docks would not impact the bottom at
low tide and no lift slip stops are necessary. It should be noted that any limitations
on floating docks and the need for lift slip stops 18" above the substrate are
related to shallower waters that are classified as Primary Nursery Area (PNA) and
this area is not classified as PNA.
In addition, through discussions with the Shellfish Sanitation Office, the applicant
agreed to reduce (through deed restrictions) the number of lots along the marina
entrance canal that could have future boat slips and limit the remaining lots here
as well as the Medlin and Lea properties on the entrance channel to only one slip
apiece.
• To compensate for the loss of docking along the shoreline, the applicant could
include a boat ramp within the upland basin.
A boat ramp and necessary vehicle/trailer parking would add an additional area of
impervious surface to the land plan and needlessly eliminate beneficial vegetative
cover. There would also be an increased level of vehicular traffic within the
subdivision. Aesthetically, trailered boats parked on individual lots throughout the
neighborhood would be detrimental to the character of the development. In
addition, the inherent value of waterfront lots with the ability to access the
owner's boat without a launch and retrieval process is beneficial.
• Condition the permit so that future maintenance dredging be conducted during
the October- March dredging window unless turbidity curtains are used.
The applicant agrees to use turbidity curtains if maintenance dredging takes place outside

the October through March dredging window.
