Please reference the comments below in response to your request for additional information.
1) The submitted documents do not meet NWP 12 Regional Condition 4.2.9. Please submit a wetland restoration and re -
vegetation plan.
Please reference the attached Figure 3.8. After installation, impacted wetlands would be returned to original contours
and appropriate seed would be applied (Ernst-ERNMX-305). A 10 -foot -wide corridor will be maintained for maintenance
activities. Native tree seedlings would be planted within impacted areas outside of the 10 -foot -wide maintenance
corridor as well.
2) The PCN's wetland impacts table does not note the permanent impacts to forested wetlands by conversion to
herbaceous wetlands within the permanently maintained corridor along the utility right of way. Please revise and
resubmit this table.
Permanent impacts to forested wetlands are included on the attached table.
3) The applicant's proposed compensatory mitigation is insufficient and not appropriate in offsetting the environmental
losses resulting from unavoidable impacts to waters of the U.S. (WoUS) authorized by the Department of Army permit.
The proposed discharge of fill material into WoUS will convert forested or scrub -shrub wetlands to herbaceous wetlands
in the permanently maintained utility line right-of-way resulting in losses of wetland functions and services. Therefore,
these wetlands will be permanently adversely affected by the regulated activity. The Corps has determined for this
project mitigation will be required to reduce the adverse environmental effects of the permitted activity. Also, the
proposed mitigation does not meet NWP 12 Regional Condition 4.2.10. Please submit a compensatory mitigation
proposal or plan for the proposed permanent impacts to forested and shrub -shrub wetlands which will be converted to
herbaceous wetlands due to the permanently maintained corridor along the utility right-of-way.
The applicant will purchase mitigation credits via DMS at a proposed 1.5:1 ratio for permanent impacts to forested and
shrub -scrub wetlands.
4) Conduct North Carolina Wetland Assessment Methodology (NCWAM) in the forested wetlands which are to be
converted to herbaceous wetlands and submit the NCWAM data sheets for review by the agencies (i.e., Corps. DWR,
WRC, FWS).
NCWAM forms are attached for review.
CEC conducted a threatened and endangered species survey with USFWS and WRC on April 27, 2018. No Federally listed
species were observed during the survey. Results from the survey are also attached.

The Corps has received and reviewed your recently submitted PCN application with supporting documents and
Jurisdictional Determination (JD) Request for the Mud Creek Interceptor Sewer Line project in Hendersonville,
Henderson County, NC. The submitted information requested this project be verified under NWP 12. After review and
evaluation of the submitted documents, the Corps is requesting the following additional information in order for us to
consider the application and JD request to be complete.
1) The submitted documents do not meet NWP 12 Regional Condition 4.2.9. Please submit a wetland restoration and re -
vegetation plan.
2) The PCN's wetland impacts table does not note the permanent impacts to forested wetlands by conversion to
herbaceous wetlands within the permanently maintained corridor along the utility right of way. Please revise and

The submitted documents also included a request for a pre -JD of the utility right-of-way and associated construction
corridor. No copy of the documents noting the County's right-of-ways, easement agreements, ownership, or landowner
permission of entry were submitted with this request. The policy position of the Corps Regulatory Program is that Corps
Regulators should not enter private property unless they have the property owner's permission or an administrative
warrant. While the Agent Authorization submitted with documentation noting pending right-of-way which could allow
access and/or right of entry have been utilized in the past this right of entry document pre -dates the District's current
approach to dealing with this issue. Therefore, please provide copies of the County's right-of-ways, easement
agreements, ownership, and/or landowner permission of entry for the project corridor. The Corps will review these
documents to determine if the documents will meet current policy position of the Corps Regulatory Program for our
staff's right of entry to conduct the requested pre -JD field activities.
At this time, the request to utilize NWP 12 for authorization of impacts to WoUS and the request for JD are on hold until
the above additional information has been received. Once the Corps receives the information noted above we will be

1.0 INTRODUCTION
The following is an addendum to the January 12, 2018 Habitat Assessment, Threatened and
Endangered Species Survey (T&E) for the Mud Creek Sewer Line project, located in
Henderson County, North Carolina. This second survey was completed on April 27, 2018 and
follows the recommendation of the initial T&E which states the site should be revisited in the
growing season to assess the possibility of the presence of any threatened or endangered
species.
2.0 METHODOLOGY
A pedestrian survey was conducted by Mr. Clement Riddle, Ms. Kaylie Yankura and Ms.
Chelsea Blakely of C1earWater Environmental Consultants (CEC), along with Byron
Hamstead and Rebecca Reid of the U.S. Fish and Wildlife Service, and Andrea Leslie of the
N.C. Wildlife Resource Commission.
The herbaceous, forested, and shrub/scrub wetlands within the property boundary were
investigated for the presence of any of the following threatened or endangered plant species:
bunched arrowhead (Sagittaria fasciculata), mountain sweet pitcher plant (Sarracenia rubra
ssp. jonesii), and swamp pink (Helonias bullata).
3.0 FINDINGS
Three wetland types, herbaceous, forested and shrub/scrub, were investigated. Habitat
descriptions with associated plant species for each wetland type are listed below.
3.1 Herbaceous Wetland
This wetland type is dominated by herbaceous species. There is no canopy
cover and few shrubs may be present. Species found in this habitat include
reed canary grass (Phalaris arundinacea), Japanese honey suckle
(Lonicera japonica), goldenrod (Solidago sp.), dock (Rumex sp.), jewel
weed (Impatiens capensis), green arrow arum (Peltandra virginica),
raspberry (Rubus sp.), rose (Rosa sp.) and few saplings such as willow
(Salix sp.) and box elder (Acer negundo).
3.2 Shrub/Scrub Wetland
This wetland has no tree canopy and is dominated by young trees and shrubs
less than 4 meters tall. Species found in this habitat include reed canary grass,
common bluegrass (Poa annua), Japanese honey suckle, wild grape (Vitis
sp.), goldenrod, jewel weed, apple tree (Malus sp.), button bush
(Cephalanthus occidentalis), willow, silky dogwood (Cornus amomum),
and green ash (Fraxinus pennsylvanica).
3.3 Forested Wetland
This wetland is dominated by trees with a partially closed canopy above
shrubs and low-lying herbaceous species. Species found in this habitat include
box elder, water oak (Quercus nigra), white pine (Pinus strobus), silky
dogwood, viburnum (Viburnum sp.), elderberry (Sambucus canadensis),
green ash, willow, tag alder (Alnus serrulata), red maple (Acer rubrum),
cleavers (Galium aparine), sensitive fern (Onoclea sensibilis), jewel weed,
golden ragwort (Packera aurea), moss (Sphagnum sp.), goldenrod, Japanese
honeysuckle, pickerel weed (Pontederia cordata), and raspberry.
4.0 CONCLUSIONS AND RECCOMENDATIONS
While potentially suitable habitats for these endangered species were on site, no
threatened or endangered species were observed. It is the opinion of CEC that the
project is not likely to adversely affect these species.
