Kaylie,
On May 15, 2018, the Division of Water Resources (Division) received your application dated March 8, 2018, requesting
a 401 Water Quality Certification from the Division for the subject project. Additional information supporting the
application was received June 1, 2018. The Division has determined that your application is incomplete and cannot be
processed. The application is on hold until the following item is addressed:
1. A complete review of the project cannot be conducted until the U.S. Army Corps of Engineers has verified all stream
and wetland locations for the Mud Creek Sewer Line. Please notify me once all stream and wetlands within the project
boundary have been confirmed by the U.S. Army Corps of Engineers. [15A NCAC 02H .0502(a)(7)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. If all of the requested information is not received, the Division will be unable to
approve the application and it will be returned.

Please see the responses below:
1) The re -submitted PCN wetland impacts table does not note the permanent impacts to forested and shrub -shrub
wetlands by conversion to herbaceous wetlands within the permanently maintained corridor along the utility right of
way. Please revise and resubmit this table noting in the comment section that approximately 0.5 acres of wetlands will
be permanently impacted due to conversion for the establishment of a 10 -ft wide permanent maintenance corridor.
Please see the attached/revised impacts table for the project. I apologize for prior confusion regarding this information.
2) The applicant is proposing broad impacts to WoUS for this project. Provide an analysis of alternatives to the proposed
sewer line alignment. This analysis should also include the feasibility of using alternative construction methods and
sewer line operation techniques in order to minimize impact to jurisdictional aquatic resources.
WGLA Engineering has prepared a memo addressing alternatives, which is attached for review.
3) The submitted documents do not note construction access points/corridors to the project area. Please submit
plans/maps locating these corridors and noting if impacts to WoUS will occur for these access features.
Please reference the figure included with the attached WGLA memo.
An updated impact map is also attached. Wetland Impacts #17 (W18), #18 (W19), and #19 (W21) were located in prior
converted cropland and have been removed from the impact map and impact table.

The Corps has received and reviewed your comments and documents per the Corps' request for additional information
dated March 26, 2018, for the Mud Creek Interceptor Sewer Line project in Hendersonville, Henderson County, NC. After
review and evaluation of the submitted documents, the Corps is requesting the following additional information.
1) The re -submitted PCN wetland impacts table does not note the permanent impacts to forested and shrub -shrub
wetlands by conversion to herbaceous wetlands within the permanently maintained corridor along the utility right of

At this time, the request to utilize NWP 12 for authorization of impacts to WoUS is on hold until the above additional
information has been received. Once the Corps receives the information noted above we will be able to continue to
