This is to acknowledge receipt of your request that your facility no longer be registered as an animal waste
management system per the terms of 15A NCAC 2H .0217. The information you provided us indicated that your
operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not
require registration for a certified animal waste management plan.
Under 15A NCAC 2H.0217, your facility is deemed permitted if waste is properly managed and does not
reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be
required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to
the surface waters of the state will subject you to a civil penalty up to $10,000 per day.
Should you decide to increase the number of animals housed at your facility beyond the threshold limits
listed below, you will be required to receive approval from the Division of Water Quality prior to stocking animals
to that level. Threshold numbers of animals are as follows:

Dear Mr. Haner:
1 have received your correspondence' 'of October 1, 1998, regarding the above -
referenced matter. „ Please be advised that the Buncombe County Board of Education
took full possession of the referenced J.C. Nesbitt farm on September 1 1998, for the
intent purpose of constructing a new 800 student middle school. ;The contracts for this' `
construction was approved and signed by'the Board of Education on August_ 19, 1998.
On September 1, 1998, when full possession of the property was taken, the animal
waste lagoon was void of any animal waste, which had been removed by, Mr. Nesbitt
prior to this date. This waste lagoon is in the process of being graded at this writing.

We were recently notified of your purchase of the J. C. Nesbitt Dairy whit
John Nesbitt in Buncombe County. The Division of Water Quality (DWQ
number 11-25'which you will find on the attached sheets. Please reference this facility number on all
correspondence with DWQ that is in reference to this farm. Please complete the attached Notification of
Change of Ownership form naming you as the owner to the best of your ability so that we may update our
records. If this farm is no longer being operated for swine, please complete the attached form and attach a
note that the farm is no longer operated and that you would like the farm to be removed from our Active
Animal Operations Registration List.
You are also required to designate a Certified Operator in Charge for this facility. Please use the enclosed
form to designate the Operator in Charge for this facility. All facilities were required to designate an Operator
in Charge by January 1, 1997. To obtain certification, you will be required to complete ten hours of training
and pass an examination by December 31, 1997. A training and certification program for operators of
animal waste management systems is available. Please contact your local county agency for training dates and
times. As the owner of an animal operation with an animal waste management system, you must designate an
Operator in Charge and must submit the enclosed designation form to the WPCSOCC. If you do not intend
to operate your animal waste management system yourself, you must designate an employee or engage a
contract operator to be the Operator in Charge. The person designated as the Operator in Charge, whether
you or another person, must complete the enclosed application form.
DWQ would like to take this opportunity to remind you that per the terms of the Environmental Management
Commission 15A NCAC 2H .0200 Rules, all registered animal operations must obtain and implement a
certified waste management plan by December 31, 1997. For technical assistance in obtaining a certified
waste management plan, pleasecontact Buncombe County Soil & Water Conservation District.
