During this PAR period (,Ian. 1 2018 -- Dec. 31 2018,) the following
summarizes the status of each Industrial User, and any changes that have
occurred.
IUP #0007 ProAmpac :
Bonita changed their naive to ProAmpac in. February. ProAmpac was under
a consent order for .BOD, Ammonia, and Zinc until June 1 2018. In July
ProAmpac was switched to Lbs. to help with compliance issues. Their
permit was modified to change detection levels for Cadmium and Selenium.
They had one violation for TSS during 2018 and was fined $200.00.
IUP #0008 American Zinc Products:
AZP permit was modified to change detection limits for Cadmium, Silver,
and Selenium. AZP had several violations for ammonia and failure to
sample. They were fined a total of $12,200.00 and surcharged $49.02. They
entered into a consent order in January 2019 to find and alleviate the
ammonia issue. AZP is currently not running their zinc recovery process,
they are supposed to start up around June 2019.
Riverstone WWTP :
Riverstone had no violations during 2018. When AZP starts up we are
concerned they will affect the efficiency of the plant with there zinc
discharge.

Pursuant to provisions of the Sewer User Ordinance of the Town of Forest City, this Consent
Order is made effective the 1st day of June, 2017, between Bonita Pioneer Packaging Products
(hereinafter the "User+') and the Town of Forest City (hereinafter the "Town")

permit limitations to cover additional cost actually
incurred of the Town's wastewater treatment plant do
to the increased pollutant load

(iv) Unless and until compliance is achieved with the
permit, the user will undertake activities necessary to
bring the User into compliance with permit.
b_ User shall perform each of the activities set forth in subparagraph (a) on or before the
dates established thereby unless such dates are extended by agreement of User and the
Town may request such extensions for good cause, and the Town will not unreasonably
withhold its consent to such extensions.
c_ If there is any construction to replace or upgrade the pretreatment unit, then the user shall
submit a construction report stating in detail the work performed during the month and the
percentage of completion of the project. The report shall be in narrative form and must
be submitted with the monthly report cited in 4a.
All reports required by the Consent Order shall be submitted to the Town by Certified Mail,
Return Receipt Requested, addressed to:

d. The User has come forward before any determination by the Town of SNC (significant
non-compliance) of the permit. Any such determination made by the Town of the
Consent Order as a result of violations of the consent order BOD, Ammonia, and Zinc
pass-thru shall carry penalties as suggested by the Town's Enforcement Response Plan
e. Any violation of the terms of this Consent Order shall subject the User to the enforcement
authority outlined in the Ordinance. Such action may include, but is not limited to such
fines, penalties and assessments as may be set forth in the Code of Ordinance of the
Town of Forest City, as amended from time to time.
If any violations or discharges adversely affect the Town of Forest City Riverstone
WWTP's operations, causes violations of WWTP's permit or causes pass-thru, the
Enforcement Response Plan and Sewer Use Ordnance guidelines and penalties will be
followed.
In lieu of other penalties, the following stipulated penalties shall apply for violations of the
User's limits or failure to meet a milestone date under this Consent Order, or failure to
achieve full compliance with Consent Order_

termination of this Order, the User shall be subject to all terms of the permit.

procedures, rules, regulations, ordinances, and statutes of the Town, State, and federal
governments as they may apply to User, Nothing contained herein shall be construed as a
