In accordance with your application received September 2, 1993, we are forwarding herewith
Permit No. WQ0003699 dated October 14, 1993, to Aspect Minerals, Incorporated for the continued
operation of the subject wastewater recycle system. The J.M. Huber Corporation has sold it's facility
known as the Spruce Pine Mica Plant to Aspect Minerals, Inc. which now refers to the subject facilities as
the Bear Creek Plant. This permit modification is to change the name of the permittee to Aspect Minerals,
Incorporated.
This permit shall be effective from the date of issuance until June 30, 1995, and shall be subject to
the conditions and limitations as specified therein. Please pay particular attention to the monitoring
requirements in this permit. Failure to establish an adequate system for collecting and maintaining the
required operational information will result in future compliance problems. Issuance of this permit hereby
voids Permit No. WQ0003699 issued July 27, 1990.
If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have
the right to request an adjudicatory hearing upon written request within 30 days following receipt of this
permit. This request must be in the form of a written petition, conforming to Chapter 150B of North
Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447,

RECYCLE SYSTEM PERMIT
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina
as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
Aspect Minerals, Incorporated

FOR THE
continued operation of a 18,000 GPD wastewater recycle system consisting of a disk filter, three inorganic
solids settling pond in parallel, a large fine settling basin, a 200 GPM recycle pump, a 5,000 gallon
pressurized storage tank, an chemical feed system, and all associated piping, valves, controls, and
appurtenances to serve Aspect Minerals, Incorporated's Bear Creek Plant (formerly J.M. Huber Corp.
Spruce Pine Mica Plant) with no discharge of wastes to the surface waters, pursuant to the application
received September 2, 1993, and in conformity with the project plan, specifications, and other supporting
data subsequently filed and approved by the Department of Environment, Health and Natural Resources
and considered a part of this permit.
This permit shall be effective from the date of issuance until June 30, 1995, and shall be subject to
the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans, specifications, and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of the request will be considered on its merits and may or may
not be approved.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as
may be required by this Division, such as the construction of additional or replacement
wastewater treatment or disposal facilities.

6. The sludge generated from these treatment facilities must be disposed of in accordance with
General Statute 143-215.1 and in a manner approved by the North Carolina Division of
Environmental Management.
7. The issuance of this permit shall not relieve the Permittee,of the responsibility for damages
to surface or groundwaters resulting from the operation -of this facility.
8. The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resulting from the operation of this facility.
9. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
10. Freeboard in the settling basins shall not be less than two feet at any time.
11. Any monitoring deemed necessary by the Division of Environmental Management to insure
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.
12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
13. The. Permittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall keep an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken
by the Permittee. This log of inspections shall be maintained by the Permittee for a period
of three years from the date of the inspection and shall be made available upon request to
the Division of Environmental Management or other permitting authority.
14. Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the recycle system at any reasonable time for the purpose
of determining compliance with this permit; may inspect or copy any records that must be
kept under the terms and conditions of this permit; or may obtain samples of groundwater,
surface water, or leachate.
15. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205
(c)(4).
16. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
17. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
18. A set of approved plans and specifications for the subject project must be retained by the
Permittee for the life of this project.

19. Noncompliance Notification:
The Permittee shall report by telephone to the Asheville Regional Office, telephone number
704/ 251-6208 as soon as possible, but in no case more than 24 hours or on the next
working day following the occurrence or first knowledge of the occurrence of any of the
following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such
as the dumping of the contents of a basin or tank; the known passage of a slug of
hazardous substance through the facility; or any other unusual circumstances.
b. Any process unit failure, due to known or unknown reasons, that render the facility
incapable of adequate wastewater treatment such as mechanical or electrical failures
of ppmps, aerators, compressors, etc.
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-
pass directly to receiving waters without treatment of all or any portion of the
influent to such station or facility.
d. Any time that self-monitoring information indicates that the facility is not in
compliance with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following fust knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.
20. Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of
the wastewater treatment facilities. The operator must hold a certificate of the type and
grade at least equivalent to or greater than the classification assigned to the wastewater
treatment facilities by the Certification Commission. The Permittee must also employ a
certified back-up operator of the appropriate type and grade to comply with the conditions
of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at
least weekly and each Class II, III, and IV facility at least daily, excluding weekends and
holidays, and must properly manage and document daily operation and maintenance of the
facility and must comply with all other conditions of Title 15A, Chapter 8A,.0202.
21. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted, will extend the permit for such period of time
and under such conditions and limitations as it may deem appropriate.
22. Issuance of this permit hereby voids Permit No. WQ0003699 issued July 27, 1990.

acid feed system and piping and appurtenances for a recycle
system.

Enclosed is Huber's resubmittal for renewal of the
non -discharging wastewater permit at the Spruce Pine Mica Plant
in Mitchell County. This is in response to Project Return
(WQ0002518) dated March 5, 1990. This document was never
received by my office. I was alerted to it by Mr. Mike Parker in
the Asheville Regional Office. Mr. Parker sent me a fax copy of
Mr. Safrit's cover letter only. The original application dated
October 4, 1989, is still missing.
This is the second time that I have not received a mailing
from your office. The other time was when Mr. Cleary requested
additional information on November 13, 1989. This letter had the
wrong mailing address, and I was not alerted to it until February
of 1990. I responded on February 13, 1990.
Enclosed is another $100.00 processing fee; however, in light
of the above circumstances, Huber requests that this additional
fee be waived and the check returned.

permit for the subject facility.
In a letter dated November 13, 1989, you were advised to provide additional technical
information within sixty (60) days to make the application package complete or your application
package would be returned as incomplete. Since thins sixty (60) day requirement elapsed on January
12, 1990, the Division of Environmental Management must return your application and support
documents as incomplete, in accordance with North Carolina General Statute, 143-215.1.
When you have obtained the requested information which is needed to make your
application complete, you may submit a new application package and permit processing fee. Please
be advised that the operation of the subject wastewater treatment and disposal facilities without a
valid permit is a violation of North Carolina General Statute 143-215.1 and may subject you to

I apologize for the delay in responding to you. Apparently your
request of November 13, 1989 was mislaid here, as I do not recall
seeing it.
Attached is a map of the Spruce Pine plant site showing the
settling basins and property boundaries. The basins are unlined.
The wastewater going to them consists of waste mica and mica
slimes (primarily clay). Sulfuric acid and small amounts of
acrylic polymer are added to the ponds to facilitate settling.
Water is recycled back to the plant. There is no point discharge
from these ponds.
Thank you for your assistance with bur permit renewal.

t1txiration date. We have net received a request for renewal from
you as of this date.
A renewal request shall consist of a letter requesting renewal. A processing fee
must be submitted with the request. Please find attached a copy of the 15 NCAC 211
.0205(c) regulations. The processing fee .for your facility is based on the design or
permitted flow, whichever is appropriate, listed in the first four categories of
facilities. Sludge renewals are based on total. acres of land permitted. Also the
Environmental Management Commission adopted rules on August 1, 1988, requiring the
payment of an annual fee for most permitted facilities (See Attached). You will be

This matter should be given prompt attention in that continued operation after
the permit's expiration, without the filing of a complete and timely request for

J. M. Huber Corporation has requested renewal of Permit Number
6281R4 changed to WQ0002518, for the continued operation of their
recycling inorgainc solids wastewater treatment facility consisting
of three 12 -foot diameter clarifiers, three settling basins, a 5000
gallon pressurized water storage tank, a 200 gpm return water pump,
chemical feed units for lime and polymers and sludge press for
dewatering solids. The sludge is disposed of in a landfill at Deneen
Mica Company.
Recent inspections have found that the third settling pond was being
constructed and has now been placed into operation. The facility is
operating properly with no discharge to surface waters. The nearest
residence to the facility is 300 feet to the south.
After complying with Groundwater Section requirements, it is
recommended that the permit be issued.

discharging wastewater treatment facility will expire on August 31, 1985. Applications
for renewal must be filed 180 days prior to the expiration date. As of this date an
application for permit renewal has not been received. If there is no change proposed
for your wastewater treatment facility, the application for permit renewal need only to
consist of a letter requesting that the permit be renewed. Proposed changes at the
facility require the submission of a new application form and other supporting data.
Please give this matter prompt attention in that continued use of the facility
without submitting a complete and timely application for renewal constitutes a
violation of N. C. General Statute 143-215.1(a). Application for renewal and renewal

At the request of our Division Environmental and Safety Coordinator,
Mr. Jay Hutto, I have had prepared d revised drawing of our waste water treat-
ment system at the Spruce Pine plant. This drawing represents the "as '.wilt''
facility and differs from the original sketch submitted.only by the inclusion
of an inlet basin (approximately 200 square feet x 4 feet deep).
As previously discussed in Carl Kollmar's letter to you dated May 25,
1983, the Spruce Pine plant is presently operating as a pilot -plant type faci-
lity. Process development work is now in progress to optimize the equipment,
the process and the wastewater treatment system. Additional permit applica-
tions for changes in our wastewater treatment system will most likely be forth-
coming as we establish more exact needs. Either Jay Hutto or myself will
be in contact with your office as these needs become apparent.
We certainly appreciate the effort on your part in attaining the necessary
permit approvals and changes we have requested. If you have any questions

This is in response to our recent telephone conversation and your
letter of May 3, 1983, concerning J.M. Huber's plans to increase the
size of the current process wastewater impoundment. As I stated in
my letter of April 26, 1983, after many months of installing and modi-
fying the equipment we are ready to begin operating as a pilot -plant
type facility for the next few months. This process development is
necessary to optimize the equipment, the process, and the wastewater
treatment system.
I, again, remind you the attached permit application will most
likely be temporary until we develop our final process. At that time
we will submit a final application for the wastewater treatment system.
The following should answer the questions you raised in your
letter:
o process description:
The Spruce Pine facility is designed' -to produce a -wet ground -SNL.
mica product. Mica concentrate purchased on the open market will
be used as feedstock. The process will require the use of sodium
hexametaphosphate (Calgon) to disperse any clay slimes present in
the mica concentrate. The sodium hexametaphosphate will be purchased
in 50 lb. bags and stored inside the building. We anticipate using
3-6 pounds of the dispersant per ton of feedstock. The water and
slimes produced at various steps in the process will be pumped to
the clarifiers and treated to settle the slimes so we can reuse the
water.

C, general_ description of impoundment expansion:
The current impoundment has approximately 4200 square feet
of surface area and an average depth of one foot. We plan to
dredge the pond to a depth of six feet. This should allow us
a final- capacity of 113,000 gallons. The removed material will
either be deposited along the existing duce wall and regraded,
or hauled away as landfill. A very low static head (less than
2 feet) is expected on the dike wall. Its primary purpose will
be to prevent rainwater runoff from entering the impoundment.

Since our purchase of this facility we have installed three
12 foot: diameter x 5 foot depth clarifiers. These clarifiers
will handle dilute volumes (approximately 50 gal./min.) of clay
slimes or minus 80 mesh mica.
o clarification process:
Clarification will be enhanced by the addition of approximately
200 ppm of lime slurry (CaCO3) to a pH of 10-10.5. If further
treatment is necessary to facilitate settling, we plan to use less
than 10 ppm of an anionic polymer. The clarified water is then
sent to the impoundment where sulfuric acid will be added on an
"as needed" basis to maintain a pH of 6-9. The acid will be
stored in one gallon bottles within the plant.
o pumping and piping information:
Except for periodic replenishment with fresh water to replace
water lost through evaporation, or in the drying step, all plant
process water will be pumped from the impoundment using a centri-
fugal pump. The pump is designed to deliver 200 gal./min. of water
at 60 psi pressure. At the anticipated water usage rate, the pump
will cycle approximately five times per hour into a 5000 gallon
pressurized surge tank. The water line to the plant and the
clarifier return line are 4 -inch diameter PVC pipe buried underground.

and recycle system consisting of three 12 -foot diameter by 5 -foot deep clarifiers,
and approximately 113,000 gallon settling pond, a 200 GPM return water pump, a
_,000 gallon pressurized storage tank, gravity pipe line, force main, valves,
'fittings, pumps, appurtenances and with additions of lime, sulfuric acid., and
coagulant aids to serve the J. M. Huber Corporation Spruce Pine facility with
no discharge to the surface waters of the State,
'pursuant to the your letter of request for reissuance received February 18, 1985,
and in conformity with the project plans, specifications, and other supporting
data, subsequently filed and approved by the Department of Natural Resources and
Community Development and considered a part of this permit.
This Permit shall be effective from the date of issuance until March 31, 1990,
shall void Permit No. 628183 issued July 28, 1985, and.a shall be subject to the
conditions and limitations.
1. This permit shall become voidable unless the existing facilities were constructed
in accordance with the approved plans, specifications, and other supporting
data and new modifitations and installations are in accordance with plans,
specifications, and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable.
5. This permit shall become voidable in the event of failure of the soil to
adequately absorb the wastes, and may be rescinded unless the facilities are,
installed, maintained and operated in a manner which will protect the assigned
water quality standards of the surface waters and ground waters.

6. In event the facilities fail to perform satisfactorily including the creation
of nuisance conditions, the Permittee shall take such immediate corrective
action as may be required by this Division, including the construction of
additional or replacement wastewater treatment or disposal facilities.

accordance with General Statutes 143-215.1 and in a manner approvable by the

any disposed or stored material into the receiving stream.

or spillage of hazardous or toxic substances either stored or being used in
the pretreatment facilities on project site.
12.Freeboard in the holding pond shall not be less than two (2) feet at any time.

13. The issuance of this permit shall not relieve S. M. Huber Corporation of the
responsibility for damages to surface or ground waters resulting from the
operation of this facility.
14. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater into the surface waters
