The Division of Water Quality has learned that Mr. Greg Ferguson has
recently removed all dairy cattle from the property which he leases from
you on Jonathon Creek Road (Highway 276), in Haywood County. This letter
is to advise you that if anyone else might be interested in leasing the
property in the future for a dairy or other animal operation, they will be
required to first obtain the necessary permits and certifications.
Before you lease the property to anyone else, or allow more animals
to be held on the property, it is advised- that you make sure that the
Haywood County Soil and Water office. and this Office are contacted,
regarding the need for any permits.
If you have any questions, please do not hesitate to contact Mr.
Keith Haynes or me at 251-6208. Thank you for your attention to this

Dear Mr. Ferguson:
The routine on-site inspection of your animal waste handling
system for your dairy farm was conducted on September 17, 1997
by Mr. Keith Haynes of this Office. The investigation -revealed
one area of concern that needs to be addressed in order to assure
compliance with 15A NCAC 2H .0200 Regulations administered by
this Division. (A copy of Mr. Haynes inspection report -is
attached for your records.)
Specifically, wash -down water from the milk room is being
discharged directly into a small creek on your property. This
type of discharge constitutes a violation of North Carolina
General Statute (NCGS) 143-215.1, which is enforceable under
provisions of NCGS 143-215.6A.
It is our understanding that you are awaiting assistance
from the Haywood County Soil and Water Office for an Animal
Waste Management Plan which will address this area of concern.
While you are awaiting assistance, please make every effort to
assure that this discharge is not allowed to reach surface waters
of the State.

31 Milkroom wash down water enters a small creek which runs through the feed lot. Any run-off from the lot also enters the same
lot is scraped and hauled daily. The animals are kept on the lot only at feeding time. They are pastured all other times.
Facility will need a certifiable plan.

Dear Mr. Westall:
This letter is in reference to facility number 44-55, Greg Ferguson. I would like to let
you know what has already been done, what is being planned and to give you a timetable
signed by Mr. Ferguson to complete the work. We have also included in this a request
for additional time to complete this plan.
Because of the workload our engineers had for the area, Mr. Ferguson was the last
operation in Haywood County to receive his plan. Therefore he has not had as long as
some of the other operations to do the work. Mr. Ferguson has completed two stock
trails, two surface water diversions to keep the surface water from flowing into the
holding area, and some critical area seeding. He has also installed a culvert that carries
the surface water away from the barn and the temporary manure storage facility so the
surface water will not be contaminated. This culvert also keeps the wastewater from the
milk room and parlor from going directly into the creek like it did previously.
Mr. Ferguson has also done some grading in preparation for constructing his dry stack.
Since Mr. Ferguson already uses the town of Maggie Valley's water system for his water
supply, we have asked the town to let Mr. Ferguson hook on to the sewer line with the
wastewater from the barn and parlor. We have a meeting with the town of Maggie Sewer
Department, the District, Jeff Young — DENR Engineer and the property owner for the
week of March 27, 2000. If Mr. Ferguson receives permission to connect to the sewer
line that would take care of the wastewater problem and we already have plans in place to
take care of the solid waste generated by the dairy.
Also included in this letter as a separate document is a timetable for completion and a
request for additional time signed by Mr. Ferguson.

With the wok necessary to keep the farm operating and with milk prices being where they
are now, I feel this is a realistic time frame for completion of my Waste Management
Plan. During construction I will make every effort to be sure that waste is not allowed to
reach the stream. Therefore, I respectfully request a special agreement from the Division
of Water Quality to allow me to finish the plan I have started.

This letter is in response to a letter I received dated June 30, 2000 from your office.
Pursuant to stipulation of Paragraph 4 of the Special Agreement I am notifying your office in
writing that the failure to comply was not intentional and was due to events and circumstances
beyond my control. Attached is a copy of a letter dated March 24, 2000 of this year from the
Haywood Soil and Water Conservation District asking for an extension of time, i have
accomplished a portion of the work 1 was required to do prior to this and have submitted
documentation for reimbursement which is at this time in the controllers office.
Please accept this as notice that I am coordinating and working with the local office
with Leslie Smathers to rectify this situation. Forthcoming will be documentation from his
office and others to verify that I am in the process of complying. I would request the
violation be stayed and in the meantime I will continue to negotiate with Mr. Smather's to
flnM what i, needed to be in compliance.

Dear Ms Woody:
I have obtained the document, "Gravity Sewer Minimum Design Criteria" adopted
by the Division of Water Quality on February 12, 1996. Within this document, all
specifications for proposed sewer lines are listed. After reviewing it, I am not
qualified to furnish engineering plans, calculations and other supporting
documentation for Mr. Ferguson's fast-track application for gravity sewer.
I sent you engineering drawings on November 3, 2000 that included a site plan and
cross-section of the proposed pipeline. These plans were prepared as part of the
animal waste management system which meets all USDA-NRCS -and SWCC
standards. However, I did not anticipate the pipeline would evolve into a municipal
gravity sewer having to meet state design criteria.
The state specifications require the installation of 48" diameter manholes and the
pipeline must be rerouted because the pipe shall have only straight alignment
between manholes. This requirement means another survey of a new pipeline
route must be completed and new drawings prepared.
If I attempt to develop plans for a municipal sewer, I will violate Chapter 89C of
North Carolina General Statutes also known as "The North Carolina Engineering.
and Land Survey Act." I recommend you or Mr. Ferguson retain the services of an
engineer or consulting firm experienced in public works projects: I will gladly furnish
any information or data I have regarding the animal waste management system to
them.

In accordance with your application received February 15, 2001, please find attached
Permit No=1NQ0019629--for the 'construction -and operation of the subject:wastewater collection
system extension. This Permit shall be effective from the date of issuance until rescinded and
shall be subject to the conditions and limitations as specified therein. This cover letter shall be
considered a part of this permit and is therefore incorporated therein by reference.
Please pay particular attention to condition three (3) of the permit which requires that
the wastewater collection facilities be properly operated and maintained, in accordance with
15A NCAC 2H .0227 or any individual system -wide collection system permit issued to the
Permittee.
Permitting of this project. does not constitute acceptance of any part of the project that. does
not meet 15A NCAC_2H .0200; the Division of Water Quality's (Division) Gravity Sewer Minimum

Maggie. Valley Wastewater Treatment facility (NPDES Permit No. NC0056561) prior to being
discharged into the receiving stream
If any parts, requirements, or limitations contained in this permit are unacceptable,.you have
the right to request an adjudicatory hearing upon written request within 30 days following receipt
of this permit. This request must be in the form of a written petition, conforming to Chapter 1506
of North Carolina General Statutes, .and filed with the Office of Administrative Hearings; 6714 Mail

WASTEWATER COLLECTION SYSTEM EXTENSION PERMIT
This permit shall be effective from the date of issuance until rescinded and shall be subject
to the following specified conditions and limitations:
1. This permit shall become voidable unless the wastewater collection facilities are constructed
in accordance with the conditions of this permit: 15A NCAC 2H moo; the Division of Water
Quality's (Division) Gravity Sewer,Minimum Design Criteria adopted February -12, 1996 as
applicable, the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump
Stations and Force Mains adopted June. 1, 2000- as applicable; and other supporting
materials unless specifically mentioned herein.
-2: This permit shall be effective only with respect to the nature and volume of wastes described -
in the application and other, supporting data.
3. The wastewater collection facilities shall be properly maintained and operated at all times. .
The Permittee shall maintain compliance with an individual system -wide collection system,
permitfor the operation and maintenance of these -facilities as required by 15A NCAC 2H
.0227. If an individual -permit is not required, the following performance criteria shall be met
as provided .in 15A NCAC 2H .0227-
a. The sewer system shall be effectively maintained and operated at all times to prevent
discharge to surface waters, and any contravention of the groundwater standards in
15A NCAC 2L .0200 or the surface water standards in 15A NCAC 2B .0200.
b. A map of the sewer system shall be developed prior to January 1, 2004 and shall
be actively maintained'..
C. An operation and maintenance -plan shall,be developed and implemented.
d. Pump stations that arenot connected to a telemetry system shall be. inspected daily,
as defined in 15A NCAC 2B .0503(5), until July 1, 2001; and thereafter, pump
stations shall be inspected every day. Pump stations that are connected to a
telemetry system shall be inspected at least once per week.
e.. High-priority sewer lines shall be inspected at least once per every six-month period.

f._ A general observation of the entire sewer.system shall be conducted at least once
per year..
g. Inspection and maintenance records shall be maintained for a period of at leas
years.
h. Overflows and bypasses shall be reported to the appropriate- Division Regional Office
in accordance with 15A NCAC 2B .0506(a), and public notice shall be provided as
required by North Carolina General Statute 143-215.1 C.
4. This permit shall not be transferable. In the event there is a desire for the wastewater
facilities to change ownership, or there is a name .change of the Permittee, a formal permit
request shall be submitted to the Division accompanied by documentation from the parties
involved, and other supporting materials as may be appropriate. The approval of this
request shall be considered on its merits andmay or may not be approved.
5. Construction of the gravity sewers shall be scheduled so as not to interrupt service by the
existing utilities nor result in an overflow or bypass discharge of wastewater to the surface
waters of the State.
6. Upon completion of construction and prior to operation of these permitted facilities, a
certification, a copy of the construction record drawings, as well as supporting design
calculations for any pump stations permitted as part of this project shall be received from a
North Carolina -licensed Professional Engineer certifying that the facilities .have been
installed in accordance with this permit; 15A NCAC 2H .0200; the Division's Gravity Sewer
Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design
Criteria for the Fast -Track Permitting of Pump Station and Force Main adopted June 1, 2000
as. applicable; and other supporting materials. If this project is to be completed in phases
and partially certified, you shall retain the responsibility to track further construction approved
under the same permit, and shall provide a final certificate of completion once the entire
project has been. completed. A copy of the construction record drawings, indicating the
facilities constructed in the phase being certified, shall be submitted with each partial
certification. Mail- the Engineer's Certification, one copy of the "Construction Record
Drawings", and one copy of the supporting design calculations to the Non -Discharge
Permitting Unit, 1617 Mail Service Center,, Raleigh, NC 27699-1617.
7. A copy of the construction record drawings shall be maintained on file by the Permittee for
the life of the wastewater collection facilities.
8. Failure to abide by the conditions and limitationscontained in this permit; 15A NCAC 2H
.0200; the Division's Gravity Sewer Design Criteria adopted February 12, 1996 as
applicable,; the Division's Minimum Design Criteria for the Fast -Track .Permitting of Pump
Station and Force Mains adopted June 1, 2000 as applicable; and other supporting materials
may.subject the Permittee to an enforcement action by the.Division, in accordance with
North Carolina General Statutes. 143-215.6A through 143-215.6C.
9. In the event that the wastewater collection facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as -the construction of additional
or replacement facilities.
10. The issuance of this permit shall not exempt the Permittee from complying with any and all
statutes, rules, regulations, or ordinances that may be imposed by other government
agencies (local, state and federal) which have jurisdiction, including but not limited to
applicable river buffer rules in 15A NCAC 2B .0200, erosion and sedimentation control
PprequireZments in 15A NCAC, Ch. 4 -and under the Division's General Permit NCG0100000,
anequirements pertaining to wetlands under -.15A NCAC 2B .0200 and 15A. NCAC 2H
.0500.
11. Non-compliance Notification:
The Permittee, shall report by telephone to the Asheville Regional Office, telephone number
828/251-6208 as soon as possible, but in no case more than 24 hours or on the next working
day, following the occurrence or first knowledge of the occurrence of either of the.following:
a. Any process unit failure, due to known or unknown reasons, that renders the facility
incapable of adequate wastewater transport, such as mechanical or electrical failures of
pumps, line blockage or breakage, etc.; or.
b. Any failure -of a pumping station or sewer line resulting in a by-pass directly to receiving
waters without treatment of all or any portion of the influent to such station or facility..
Persons, reporting such occurrences. bytelephone shall also file a written report in letter form
within five days following first knowledge. of the occurrence. This report must outline .the
actions taken or proposed to be taken to ensure that the problem does hot recur.

owned public utility, submit two copies of the Certificate of Public Convenience and Necessity, which demonstrates
that the public utility is authorized to hold the utility franchise for the area to be served by the sewer extension. If a
Certificate of Public Convenience and Necessity has not been issued, provide two copies of a letter from the NC
Utilities Commission's Public Staff that states that an application for a franchise has been received, that the service area
is contiguous to an existing franchised area, and/or that franchise approval is expected.
E. Operational Agreements — Submit one original and two copies of a properly executed operational agreement if the
sewer extension will be serving residential or commercial lots (e.g., houses, condominiums, townhomes, outparcels,
etc.) that will be owned by a homeowners' association or developer. If the applicant is a homeowners' association, use
Form HOA 10/99. If the applicant is a developer, use Form DEV 10/99.
V/ F. Flow Acceptance Letters — If the owner of the downstream sewers and/or WWTF is different from the applicant,
submit two copies of a flow acceptance letter from the owner of the downstream sewers and WWTF. Flow acceptance
letters must contain the following minimum information: applicant and project name, amount of flow accepted, and
name and permit number of the receiving sewers/WWTF. The flow acceptance must not expire prior to permit
issuance and must be dated less than a year prior to the application date. Intergovernmental agreements or other
contracts will not be accepted in lieu of a project -specific flow acceptance letter.

E. Operational Agreements — Submit one original and two copies of a properly executed operational agreement if the
sewer extension will be serving residential or commercial lots (e.g.. houses, condominiums, townhoincs, outparcels,
etc.) that will be owned by a homeowners' association or developer. If the applicant is a homeowners' association, use

V/ F. Flow Acceptance Letters — It' the owner of the downstream sewers and/or WWTF is different from the applicant,.
submit two copies of a flow acceptance letter from the owner of the downstream sewers and WWTF. Flow acceptance
letters must contain the following minimum information: applicant and project name, amount of flow accepted, and
name and permit number of the receiving sewcrs/WWTF. The flow acceptance must not expire prior to permit
issuance and must be dated less than a year prior to the application date. Intergovernmental agreements or other
contracts will not be accepted in lieu of project -specific flow acceptance letter.

the. Division of Water Quality has inspected and approved of the facilities. In.order to change the name of
The permit holder, the DEVELOPER must request that the permit be reissued.to the Association. The '
request must include a copy of -the :Association Bylaws and Declaration.
3. The DEVELOPER shall not transfer, convey, assign or otherwise relinquish or release its responsibility
for the operation and maintenance of its Disposal System until a permit has been .reissued to the
DEVELOPEI. successor.
4. The DEVELOPER shall provide in the Declaration and Association Bylaws that the Disposal System and
appurtenances thereto are part of the comi.non elements and shall thereafter be properly maintained and
operated in conformity zvitn law and the provisions of the permit for construction, operation; repair, and .

11POlCDEVELOPER shall provide in the Declaration and .Association Bylaws that the Disposal systemwill
be maintaine.d out of the; common ex'pcnscs..In order to assure that there shall be funds readily available to
repair, maintain or construct.the Disposal System, beyond the routine operation and maintenance
expenses, the Declaration and .association Bylaws shall provide that a fund be created out of the common
expenses. Such fund shall be separate from the routine maintenance funds allocated for the facility and
shall be part of the yearly budget.
In the evert the common expense allocation and separate fund are not adequate 111.r the construction,
repair., and maintenance of the Disposal System, the Declaration and Association .13ylawws shall provide for
special assesstilents to cover such necessary costs. Tbere shall be no limit on the amount or such
assessment& and the Declaration and Bylaws shall provide that such special assessments can be made as
• necessary at any time.
7. If a wastewater collection system and wastewater treatment and/or disposal facility provided by any city,
town, village, cotuity, water -and sewer authorities; or other unit of goveznnaertt shall hereinafter become
available to serve the: Development, thc.DEVELOPF-R shall take such action as is necessary to cause the
existing and future wastewater of the Development to be accepted and discharged into said'governniental
system .. and shall convey or transfer as touch of the Disposal System and such necessary easements as the
govern n.ental unit may require as condition of accepting the .Development's wastewater.
8. Recognizing that it would be contrary to the public interest and to the public health, safety and welfare for
the Association to enter into voluntary dissolution without having made adequate provision for the
continucd proper maintenancc, repair and operatic a of its Disposal System, the DEVELOPER shall
provide in the ,association Bylaws that the Association shall not enter into voluntary dissolution without
first having transferred its said system and facilities to some person, corporation or other entity acceptable
to and approved by the COI OMISSION by the issuance of a permit.
9. 1'he agreements set forth in numbered paragraphs 1, 2, 3, 4, 5, 6, 7, and 8 above shall be conditions of any
permit issued by the COMMISSION to the DEVELOPER for the construction, maintenance, repair and
operation of the Disposal System.

With regard to your letter dated December 6, 2000 stating the Notice of Violation, I
would like to take a minute of your time to enlighten you on the situation we are in as far as
getting in compliance.
As you will see attached is an order of events ranging for several months with
documentation available upon your request if you choose, attempting to get in compliance with
this issue. It seems that the logical thing to do is'to go under the main'road with the Town of
Maggie Valley sewer which has been approved. We were at the.meeting on November 8, 2000
with Leslie Smathers and Mike Mehaffey, it was our understanding that the permit we filled out
and paid the money for at that time (which was never submitted to Raleigh) would just be
completed by Jeff Young and submitted and then we would be able to, get bids with the assistance
of Leslie and the Town of Maggie. We did not know until we received the letter from Jeff on
12/23/00 (which was one and 1/2 months after original papers and check had been sent to; him) and
after we had asked Leslie Smathers in a faxed letter on November 29, 2000 that he was; unable
to do the plans for the project since it is a public works project. We had inquired routinely about
the process and how was it going with no avail. When we learned of this of course most offices
are closed for holidays, but Leslie stated he had contacted contacted an public engineering firm
HSSM who deals with this all of the time. Mike Mehaffey from the Town of Maggie is going to
get with Dan McPherson next week from HSSM also. With weather permitting, they should
hopefully be here the first week of January to do an estimate, etc. and let us know what is going
on with this project.
It is not intentional that we are not in compliance. I have buried a holding tank, there is no
discharge at this time, is pumped daily and the solid manure is hauled to the fields on a daily basis.
So at this time we are contained and there is no discharge: I could not build a dry stack, etc. until
the sewer lines are in place due to the location where it needs to be built.

The dairy is my only source of livelihood for myself and my family and I do not have any
other way of making a living and I do not wish to close, but as you can see from the schedule of
events, every way I turn I get lost somewhere else. Hopefully with the help of HSSM, we
possibly can get this in. The Town of Maggie advised that it may be possible for them to
engineer, draw plans, permit and have paperwork in order for them by the first of February.
As you are probably aviare the cost of running a dairy is much greater than ever before
and the milk prices were much better in the 80's than they are now. Trying to keep above water is
hard without any additional problems, this is why I want to keep a family operating dairy for a
long time hopefully to carry over for my children. This is why I would to get complied and fixed
one time and for all and according to Maggie Valley, the sewer is the most logical way to go.
What I am asking from you is to hear from you regarding your thoughts on this matter. I
apologize for taking so much of your time, however I do not feel that you have been fully
informed of the situation and the problems arising. Please direct any correspondence you have to

the proper permits to get sewer in place. At this time, Gayna Woody and Greg
Ferguson filled out their portion of the Nondischarge permit and enclosed a
check for $400.00 and was told to send to Jeff Young to do final work on it.

Gayna Woody received letter dated 12/23/2000 from Jeff Young advising that
he could not do plans for public work projects and that myself or Greg needed
to hire a private engineering firm.
December 27, 2000
Gayna Woody tried to call the Raliegh office to find that it was closed until the first
week of January in the Permit Section but did talk to JR Joshi who advises that
we could have an extension till 1/31/2001 until someone in permitting could get
a handle on this. Leslie said we should just wait and tell them that we were out of
time and couldn't get finished.
The bottom line is we have been trying to get permitted for quite sometime and haven't received
any help from Raleigh other than Teresa Nantea with Leslie which we appreciated, however I
don't feel we should be held in violation for not being able to get in compliance since we have
been diligently trying.
Also Theresa advised we had to do General Permit for solid waste and it was filled out what
Greg could and sent to Leslie to complete in November.

This letter is with an attachment of a letter dated July 28, 20174 from Leslie Smathers
showing further improvements I have made to contain the water run off. I am attaching a time
table of events that I wish to attempt compliance by and would request your consideration with
these dates. It is my understanding that we may possibly be able to get certified prior to the
installation of the roof over the feed lot. We are awaiting a response from engineering
regarding this at this time.
Please accept this as notice that I am coordinating and working with the local office
with Leslie Smathers to rectify this situation. Forthcoming will be documentation from his
office and others to verify that I am in the process of complying.
Any assistance you can give me with this matter will be greatly appreciated. If you

During the inspection it was evident that work toward

according to your special agreement. It is'our
understanding that you have started some construction, but
have not requested additional time to complete the work.
Please be advised that your special agreement required that
your dairy be certified by December 31, 1999 and includes
stipulations for the assessment of civil penalties for
failing to be certified by the aforementioned date.
If.you have not already done so, it is imperative that
you contact the Divisicin of Water Quality with a request,
for additional time for completing work toward
certification. Included in this request should be an
estimated time for completion of the work. While you are
awaiting construction, please make every effort to assure
that waste is not allowed to reach surface waters of the
State.
