Ross Jr., Secretary SEP 0 5 2007 Today I inspected the animal waste lagoon closure site at the Francis Farm on Owl Ridge Road. All pipes.leading to the lagoon have been removed, as well as the swine housing facility. The wastewater once stored in the lagoon has been land -applied via the irrigation system. Only a small amount of sludge and water remain in the lagoon. Removal of the remaining waste is not necessary in order to meet the USDA-NRCS Conservation Practice Standard Code 360 (Closure of Waste Impoundments). The earthen dam may now be breached and fill material placed in the pool area. Please be aware the intent of the USDA-NRCS standard is to protect water quality and eliminate any safety hazard. Should the property owner.wish toconvert the lagoon site to residential or commercial use, he or she may want to remove the remaining organic material (sludge). While the remaining waste may not pose a water quality hazard, it could impact the engineering properties of the soil at the site. I suggest you make the property owner aware of the limitations of the closure standard. Closing the lagoon per the standard will protect water quality, however remnants of the lagoon will remain in the soil profile. Once the dam has been fully breached, all disturbed areas at the site shall be vegetated according to USDA-NRCS Conservation Practice Standard 342 (Critical Area Treatment) before the closure can be considered complete. At this time, we have no basis to force proper closure, unless the ponds start causing environmental problems in the future. As.for the second issue, if they remain below threshold, the facility would remain "deemed" and would not require yearly inspections. However, you may inspect the facility if there is some basis to do so (complaint, environmental concerns, etc.). Todd J. R. BTW - this farm also has a lagoon and the owners are trying to sell the property, possibly to another hog operation (would operate below threshold). Your facility has not been certified and therefore not permitted. It is my understanding that the Haywood County Soil & Water Conservation District has completed your waste plan. Once the waste plan has been certified you may submit the permit application. I encourage you to submit this application as soon as possible as you are operating without a permit. In addition, a start/stop pump marker should be installed in the lagoon. - Even though you are not yet permitted, you are doing a good job with your waste application records. Your facility has not been certified and therefore not permitted. Upon certification of your waste plan, you may apply for a permit. It is recommended that you contact the Haywood County Soil & Water Conservation District for assistance in this matter. It is my understanding that the Haywood County SWCD is in the process of revising the waste plan. In addition, a waste level marker should be installed in the lagoon and liquid levels should be recorded on a weekly basis. Once your facility has been certified and permitted I will do a follow-up inspection. Please see the attached report for additional comments. This is sufficient documentation for proving animals on-site within the past four years. According to our database we have not received an Animal Waste Management Plan Certification for the facility in the past. In order to continue the reacdv4on process please have a technical specialist certify this facility. PIease complete the attached request for reactivation form and send it and the completed certification to DWQ to be reviewed. Please wait for notification of approval from our office before mstocking the facility above 250 animals, As of January 1, 1997 all owners of animal operations with animal waste management systems bad to designate an Operator in Charge, A training and certification program for operators of animal waste management systems is available. Please contact your local county extension agent for training dates and . times. As the owner of an, animal operation with an animal waste management system, you must designate an Operator in Charge and must submit the enclosed designation form to the WPCSOCC, If you do not intend to operate your animal waste management system yourself, you must designate an employee or engage a contract operator to be the Operator in Charge. The person designated as the Operator in Charge, whether you or another person, must sip the enclosed application form. This form can be submitted once you are notified that the facility has been reactivated.
