Today I inspected the animal waste lagoon closure site at the Francis Farm on Owl Ridge Road. All
pipes.leading to the lagoon have been removed, as well as the swine housing facility. The
wastewater once stored in the lagoon has been land -applied via the irrigation system. Only a small
amount of sludge and water remain in the lagoon. Removal of the remaining waste is not necessary
in order to meet the USDA-NRCS Conservation Practice Standard Code 360 (Closure of Waste
Impoundments). The earthen dam may now be breached and fill material placed in the pool area.
Please be aware the intent of the USDA-NRCS standard is to protect water quality and eliminate any
safety hazard. Should the property owner.wish toconvert the lagoon site to residential or commercial
use, he or she may want to remove the remaining organic material (sludge). While the remaining
waste may not pose a water quality hazard, it could impact the engineering properties of the soil at
the site. I suggest you make the property owner aware of the limitations of the closure standard.
Closing the lagoon per the standard will protect water quality, however remnants of the lagoon will
remain in the soil profile.
Once the dam has been fully breached, all disturbed areas at the site shall be vegetated according to
USDA-NRCS Conservation Practice Standard 342 (Critical Area Treatment) before the closure can
be considered complete. Contact me if you have any questions or need additional information.

Bev,
I agree with J.R. At this time, we have no basis to force proper closure, unless the
ponds start causing environmental problems in the future.
As.for the second issue, if they remain below threshold, the facility would remain
"deemed" and would not require yearly inspections. However, you may inspect the
facility if there is some basis to do so (complaint, environmental concerns, etc.).

On November 30, 2005, 1 conducted a routine Compliance Inspection of the animal waste
handling system for Francis Farm Mill. Your facility has not been certified and therefore not permitted.
It is my understanding that the Haywood County Soil & Water Conservation District has
completed your waste plan. Once the waste plan has been certified you may submit the permit
application. I encourage you to submit this application as soon as possible as you are operating without a
permit. In addition, a start/stop pump marker should be installed in the lagoon. -
Even though you are not yet permitted, you are doing a good job with your waste application
records. Please see the attached inspection report for additional comments regarding future record
keeping requirements. As discussed during the inspection the approved reporting forms can be found at

currently documenting: waste applications on the IRR -1 & 2 forms, 120 minute spray irrigation inspections, and weather codes. The
following items will also require documentation when permitted: 1) Weekly freeboard measurements, 2) Rainfall, 3) Waste pond
inspections after a greater than one inch rainfall and monthly, 4) Calibration of waste application equipment, and 5) Sludge survey.
Mr. Francis has repaired the leak from the flush tanks which was discovered during the operations review.

On November 15, 2004, 1 conducted a routine Compliance Inspection of the animal waste
handling system for Francis Farm Mill. Your facility has not been certified and therefore not permitted.
Upon certification of your waste plan, you may apply for a permit. It is recommended that you contact
the Haywood County Soil & Water Conservation District for assistance in this matter. It is my
understanding that the Haywood County SWCD is in the process of revising the waste plan. In addition,
a waste level marker should be installed in the lagoon and liquid levels should be recorded on a weekly
basis. Once your facility has been certified and permitted I will do a follow-up inspection. Please see the
attached report for additional comments.

attached application and all supporting documentation. In accordance with Chapter 626 of 1995 Session Laws
(Regular Session 1996), Section 19(c)(2), any owner or operator who fails to submit an application by the date
specified by the Department SHALL NOT OPERATE the animal waste system after the specified date. Your
application must be returned within sixty (60) days of receipt of this letter. Failure to submit the application as required
may also subject your facility to a civil penalty and other enforcement actions for each day the facility is operated
following the due date of the application.
The attached application has been partially completed using information listed in your Animal Waste
Management Plan Certification Form. If any of the general or operation information listed is incorrect please make
corrections as noted on the application before returning the application package. The signed original application, one
copy of the signed application, two copies of a general location map, and two copies of the Certified Animal Waste

Vegetation on the lagoon embankment needs to be between 5 and 18 inches in height.
Mr. Francis was not on site for the review. 1 talked to Mr. Francis on 6-18-04 and set up the inspection
date and time. A worker on site informed me that Mr. Francis was at a funeral today. The worker also,
informed me that there was approximately 105. sows on site today.

During the 1999 session, the North Carolina General Assembly passed a law directing the North
Carolina Department of Environment of Natural Resources (DENR) to develop an inventory and
ranking of all inactive lagoons and storage ponds in the State. In order to meet this directive, a
representative of DENR has recently evaluated the inactive lagoon(s) and/or storage ponds) on your
property. Inactive lagoons and storage ponds were defined by the Statute as structures which were
previously used to store animal waste but have not received waste for at least one year:
The information collected on your property is contained in the attached field data sheets. Using
this field data, staff ranked your inactive waste structures as high, medium or low according to its
potential risk for polluting surface and/or groundwater. Your waste structure(s) was ranked as

Regardless of their ranking, owners of all waste lagoons and storage ponds have certain
management responsibilities. These include taking appropriate actions to eliminate current
discharges, prevent future discharges and to insure the stability of their structures. Staff of the
Division of Water Quality will be in contact with owners of all inactive structures that have been
determined to pose a serious environmental risk, based on its ranking and/or additional field data
collected by the Department.
All liquids and waste removed from these structures must be land applied at a rate not to exceed
the agronomic needs of the receiving crops. Any major modifications made to the dike walls or
structure must be done in accordance with current standards and under the direction of a technical
specialist designated for structural design. Your local Soil and Water Conservation District is an
excellent source for information and guidance related to proper waste application practices, structure
operation. and maintenance, and other related animal waste management standards and/or
requirements.
Nothing in this letter should be taken as removing from you the responsibility and liability for
any past or future discharges from your lagoon(s) and/or storage pond(s) or for any violations of
surface water or groundwater quality standards.

Dear Mr. Francis:
Division of Water Quality (DWQ) has received your request for reactivation of Facility Number 44-1. 1
received the documentation proving the last time you were running ten percent of your original registered
number of animals on-site. This is sufficient documentation for proving animals on-site within the past four
years. According to our database we have not received an Animal Waste Management Plan Certification for the
facility in the past. In order to continue the reactivation process please have a technical specialist certify this
facility. Please complete the attached request for reactivation form and send it and the completed certification to
DWQ to be reviewed. Please wait for notification of approval from our office before restocking the facility
above 250 animals.
As of January 1, 1997 all owners of animal operations with animal waste management systems had
to designate an Operator in Charge. A training and certification program for operators of animal waste
management systems is available. Please contact your local county extension agent for training dates and
times. As the owner of an animal operation with an animal waste management system, you must designate
an Operator in Charge and must submit the enclosed designation form to the WPCSOCC. If you do not
intend to operate your animal waste management system yourself, you must designate an employee or
engage a contract operator to be the Operator in Charge. The person designated as the Operator in Charge,
whether you or another person, must sign the enclosed application form. This form can be submitted once
you are notified that the facility has been reactivated.
