I am going to keep the project on hold until I receive the following information from you. 1. The vegetative conveyance appears to extend into Zone 2 of the Catawba Buffer. This is not allowable. 2. 1 have concerns regarding the fill slope for the trail adjacent to the vegetative conveyance. The fill slope extends into the buffer and I do not think diffuse flow will be attainable at the 50 foot buffer. Diffuse flow is a requirement of the Catawba Buffer Rule. 3. 1 know that you are working on providing a complete count of all trees greater than 5" being proposed for removal from Zone 1 of the Buffer. The SEC plan should indicate that all trees greater than 5" removed from Zone 1 of the Buffer need to be replanted with at least 2 species of native hardwood trees (not vegetation) with at least a 3" caliper. 4. Please confirm that no grading will be occurring within Zone 1 of the buffer to install the end bents for the bridge. This work will be done from a barge, correct? Only minimal disturbance is allowed in Zone 1. All BMP's will be followed such as the installation of orange safety fence to protect the environmentally sensitive areas, installation and maintenance of silt fence, temporary seeding, mulching, and matting during construction of the bridge and trail to protect the buffer zone around Lake James. On October 12, 2018, the Division of Water Resources (Division) received your application dated October 12, 2018, requesting a 401 Water Quality Certification from the Division for the subject project. The required fee was received on October 24, 2018. The Division has determined that your application is incomplete and cannot be processed. The application is on hold until all of the following items are addressed: 1. Please update the erosion control plan to include stabilization measures to protect the Catawba Buffer and Lake James for the construction of the scour hole and vegetated swale. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide a response by December 21, 2018. The EC plan is preliminary, and from looking at it near the lake area, needs some revisions, such as additional silt fence, coir fiber matting for immediate stabilization following construction, and orange safety fence along the 50 -foot buffer contour, as well as, disturbance limits paralleling the area associated with end bent construction.
