Pay particular attention to the monitoring requirements in, as failure to establish an adequate system for collecting and maintaining the required information will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. McDowell County FOR THE construction and operation of 650 -gallon per day wastewater recycle facilities for a truck wash bay located in a Quonset -type building and consisting of the following minimum components: an 18 -cubic foot grit chamber/grease trap with sanitary tee; four -inch pipe to convey wastewater from the grit chamber/grease trap to a storage tank; a 2,000 -gallon storage tank; 1.5 -inch supply pipe to convey wastewater from the storage tank to a package -type wastewater recycle system; a package -type wastewater recycle system (i.e., Model CLP -5023A manufactured by Landa Water Cleaning Systems, Inc. or equivalent); a pressure washer; and all associated piping, valves, electrical items, instrumentation/controls, and other appurtenances necessary to make complete and operational wastewater recycle facilities . The wastewater recycle facilities are intended to serve JLJ Trucking, Inc., which is located at Route 4 Box 1084 on U.S. Highway 70 Westin Marion, North Carolina, with no discharge of wastes to the surface waters, pursuant to the application received on March 28, 2001 as well as the additional information received on July 31, 2001, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered apart of this permit. This permit shall be effective from the date of issuance until August 31, 2006 and shall be subject to the following specified conditions and limitations: I A leakage test shall be performed on the grit chamber/grease trap and storage tank to ensure that any exfiltration occurs at a rate which does not exceed 20 gallons per 24 hours per 1,000 gallons of tank capacity. The engineer's certification required in Condition No. 2 shall serve as proof of compliance with this condition. 2. Upon completion of construction and prior to operation of the permitted wastewater recycle facilities, a certification shall be received from a North Carolina -licensed professional engineer certifying that the facilities have been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. If the facilities are to be completed in phases and partially certified you shall retain the responsibility to track further construction approved under the same permit and shall provide a final certificate of completion once all of the facilities have been constructed. Mail the Certification to the NCDENR-DWQ, Non -Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. 3. The Asheville Regional Office, telephone number (828) 251-6208, shall be notified at least 48 hours in advance of operation of the installed wastewater recycle facilities so that an in-place inspection can be made. Such notification to the regional water quality supervisor shall be made during normal office hours (i.e., from 8:00 a.m. until 5:00 p.m.) on Monday through Friday, excluding State Holidays. 4. The wastewater recycle facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of the facilities. 5. In the event that the wastewater recycle facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those actions that may be required by this Division, such as the construction of additional or replacement facilities. 6. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface waters or groundwater resulting from the operation of the wastewater recycle facilities. 7. The Permittee shall check the grit chamber/grease trap and storage tank once per week for the accumulation of residuals and pumped these out as needed to ensure the successful operation of the wastewater recycle facilities. All residuals generated by the facilities shall be disposed in accordance with General Statute § 143-215.1 and in a manner approved by the Division. 8. Diversion or bypassing of untreated wastewater from the wastewater recycle facilities shall be prohibited. 9. The wastewater recycle facilities shall be properly maintained and operated at all times. 10. Upon classification of the wastewater recycle facilities by the Water Pollution Control Systems Operators Certification Commission (WPCSOCC), the Permittee shall employ a certified operator to be in responsible charge (ORC) of the facilities. The operator shall hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the facilities by the WPCSOCC. The Permittee shall also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of 15A NCAC 8G .0202. The ORC of the facilities shall visit Class I facilities at least weekly and Class II, III, and IV facilities at least daily, excluding weekends and State Holidays; shall properly manage and document daily operation and maintenance of the facilities; and shall comply with all other conditions of 15A NCAC 8G.0202. 11. Any monitoring deemed necessary by the Division to ensure surface water and groundwater protection shall be established and an acceptable sampling reporting schedule shall be followed. 12. Noncompliance Notification: The Permittee shall report by telephone to the Water Quality Section of the Division's Asheville Regional Office, telephone number (828) 251-6208, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater recycle facilities that results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin or tank, the known passage of a slug of hazardous substance through the facilities, or any other unusual circumstances; b. Any process unit failure, due to known or unknown reasons, that renders the wastewater recycle facilities incapable of adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compressors, etc.; c. Any failure of a pumping station, sewer line, or treatment components resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station, line, or component; or 2 d. Any time that self-monitoring information indicates that the wastewater recycle facilities compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within five days following its first knowledge. This report shall outline the actions taken or proposed to be taken to ensure that the problem does not recur. 13. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to ensure proper operation of the subject facilities. 14. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and deterioration, operator errors, and discharges that may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or summary including, at a minimum, the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available to the Division or other permitting authority upon request. 15. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the wastewater recycle facilities at any reasonable time for the purpose of determining compliance with this permit, may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples- of groundwater, surface water, or leachate. 16. This permit shall become voidable unless the wastewater recycle facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications and other supporting data. 17. This permit shall be effective only with respect to the nature and volume of wastes described in the application and other supporting data. 18. This permit shall not be transferable. In the event there is a desire for the wastewater recycle facilities to change ownership, or there is a name change of the Permittee, a formal permit request shall be submitted to the Division) accompanied by documentation from the parties involved and other supporting materials as may be appropriate. The approval of the request shall be considered on its merits and may or may not be approved. 19. Failure to abide by the conditions and limitations contained in this permit shall subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statutes §143- 215.6A through §143-215.6C. 20. The issuance of this permit shall not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (i.e., local, state, and federal) that have jurisdiction, including, but not limited to applicable river buffer rules in 15A NCAC 2B .0200, soil erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under the Division's General Permit NCGO100000, and any requirements pertaining to wetlands under 15A NCAC 213.0200 and 15A NCAC 2H.0500. 21. A set of the approved plans and specifications shall be retained by the Permittee for the life of the wastewater recycle facilities. 22. The annual administering and compliance fee shall be paid by the Permittee within 30 days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15A NCAC 211.0205 (c)(4). 23. The Permittee, at least six months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Division shall review the adequacy of the wastewater recycle facilities described therein and, if warranted, shall extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. In accordance with NC State Administrative Code 15A NCAC 02T, effective September 1, 2006, the recycle system at J.L.J Trucking Inc. meets the requirements of Section .1003(a) for systems to be deemed permitted. The recycle system at .L.J Trucking Inc. is not required to apply for future permit renewals or modifications provided that the facility continues to comply with the requirements of 15A NCAC 02T .1000. Please be advised that NC State Administrative Code 15A NCAC 02T .,1003(a) requires that a Spill Control Plan be maintained for the Facility. The wastewater recycle facilities are intended to serve JLJ Trucking, Inc., which is located at Route 4 Box 1084 on U.S. Highway 70 West in Marion, North Carolina, with no discharge of wastes to the surface waters, pursuant to the application received on March 28, 2001 as well as the additional information received on July 31, 2001, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until August 31, 2006 and shall be subject to the following specified conditions and limitations: 1 A leakage test shall be performed on the grit chamber/grease trap and storage tank to ensure that any exfiltration occurs at a rate which does not exceed 20 gallons per 24 hours per 1,000 gallons of tank capacity. The engineer's certification required in Condition No. 2 shall serve as proof of compliance with this condition. 2. Upon completion of construction and prior to operation of the permitted wastewater recycle facilities, a certification shall be received from a North Carolina -licensed professional engineer certifying that the facilities have been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. If the facilities are to be completed in phases and partially certified, You shall retain the responsibility to track further construction approved under the same permit, and shall provide a final certificate of completion once all of the facilities have been constructed. The Asheville Regional Office, telephone number (828) 251-6208, shall be notified at least 48 hours in advance of operation of the installed wastewater recycle facilities so that an in-place inspection can be made. ` Such notification to the regional water quality supervisor shall be made during normal office hours (i.e., from 8:00 a.m. until 5:00 p.m.) on Monday through Friday, excluding State Holidays. 4. The wastewater recycle facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of the facilities. 5. In the event that the wastewater recycle facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those actions that may be required by this Division, such as the construction of additional or replacement facilities. 6. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface waters or groundwater resulting from the operation of the wastewater recycle facilities. 7. The Permittee shall check the grit chamber/grease trap and storage tank once per week for the accumulation of residuals and pumped these out as needed to ensure the successful operation of the wastewater recycle facilities. All residuals generated by the facilities shall be disposed in accordance with General Statute § 143-215.1 and in a manner approved by the Division. 8. Diversion or bypassing of untreated wastewater from the wastewater recycle facilities shall be prohibited. 9. The wastewater recycle facilities shall be properly maintained and operated at all times. 10. Upon classification of the wastewater recycle facilities by the Water Pollution Control Systems Operators Certification Commission (WPCSOCC), the Permittee shall employ a certified operator to be in responsible charge (ORC) of the facilities. The operator shall hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the facilities by the WPCSOCC. The Permittee shall also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of 15A NCAC 8G .0202. The ORC of the facilities shall visit Class I facilities at least weekly and Class II, III, and IV facilities at least daily, excluding weekends and State Holidays; shall properly manage and document daily operation and maintenance of the facilities; and shall comply with all other conditions of 15A NCAC 8G.0202. 11. Any monitoring deemed necessary by the Division to ensure surface water and groundwater protection shall be established and an acceptable sampling reporting schedule shall be followed. 12. Noncompliance Notification: The Permittee shall report by telephone to the Water Quality Section of the Division's Asheville Regional Office, telephone number (828) 251-6208, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater recycle facilities that results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin or tank, the known passage of a slug of hazardous substance through the facilities, or any other unusual circumstances; b. Any process unit failure, due to known or unknown reasons, that renders the wastewater recycle facilities incapable of adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compressors, etc.; c. Any failure of a pumping station, sewer line, or treatment components resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station, line, or component; or 2 d. Anytime that self-monitoring information indicates that the. wastewater recycle facilities are not in compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within five days following its first knowledge. This report shall outline the actions taken or proposed to be taken to ensure that the problem does not recur. 13. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to ensure proper operation of the subject facilities. 14. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and deterioration, operator errors, and discharges that may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or summary including, at a minimum, the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available to the Division or other permitting authority upon request. 15. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the wastewater recycle facilities at any reasonable time for the purpose of determining compliance with this permit, may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. 16. This permit shall become voidable unless the wastewater recycle facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications and other supporting data. 17. This permit shall be effective only with respect to the nature and volume of wastes described in the application and other supporting data. 18. This permit shall not be transferable. In the event there is a desire for the wastewater recycle facilities to change ownership, or there is a name change of the Permittee, a formal permit request shall be submitted to the Division) accompanied by documentation from the parties involved and other supporting materials as may be appropriate. The approval of the request shall be considered on its merits and may or may not be approved. 19. Failure to abide by the conditions and limitations contained in this permit shall subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statutes §143- 215.6A through § 143-215.6C. 20. The issuance of this permit shall not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (i.e., local, state, and federal) that have jurisdiction, including, but not limited to applicable river buffer rules in 15A NCAC 2B .0200, soil erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under the Division's General Permit NCGO100000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 15A NCAC 2H.0500. 21. The wastewater- from the truck washing is considered to be industrial process wastewater (IPWW) because it does not have the same characteristics as domestic wastewater or sewage. Because of this, the N.C. Groundwater Section is also required to review your plans. Upon doing so, they have asked for monitoring wells. Their proposed monitoring well locations are in the proposed septic system drainfield site. This would cause immediate violation of discharge limits plus a very good chance of groundwater contamination through a monitoring well shaft. Based upon this information, I am sorry to say that we have no choice other than to deny your application for a septic system permit. Three other options come to mind: 1.) You can seek a stream discharge permit through the N.C. Division of Water Quality - Larry Frost (828) 251-6208 2.) You can seek additional property for another septic system site. 3.) You can explore the possibility of a complete recycling system. I think the Division of Water Quality would be responsible for permitting this. We may have some manufacturers information however.
