In accordance with your application received on March 28, 2001 as well as the additional information
received on July 31, 2001, we are forwarding herewith Permit No. WQ0019846, dated September 19, 2001, to JLJ
Trucking, Inc. for the construction and operation of the subject wastewater recycle facilities.
_ This permit shall be effective from the date of issuance until August 31, 2006 and shall be subject to the
conditions and limitations as specified therein. Please take time to review this permit carefully. Pay particular
attention to the monitoring requirements in, as failure to establish an adequate system for collecting and
maintaining the required information will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request
must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Unless such
demands are made, this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and
other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
JLJ Trucking, Inc.
McDowell County
FOR THE
construction and operation of 650 -gallon per day wastewater recycle facilities for a truck wash bay located in a
Quonset -type building and consisting of the following minimum components: an 18 -cubic foot grit chamber/grease
trap with sanitary tee; four -inch pipe to convey wastewater from the grit chamber/grease trap to a storage tank; a
2,000 -gallon storage tank; 1.5 -inch supply pipe to convey wastewater from the storage tank to a package -type
wastewater recycle system; a package -type wastewater recycle system (i.e., Model CLP -5023A manufactured by
Landa Water Cleaning Systems, Inc. or equivalent); a pressure washer; and all associated piping, valves, electrical
items, instrumentation/controls, and other appurtenances necessary to make complete and operational wastewater
recycle facilities . The wastewater recycle facilities are intended to serve JLJ Trucking, Inc., which is located at
Route 4 Box 1084 on U.S. Highway 70 Westin Marion, North Carolina, with no discharge of wastes to the surface
waters, pursuant to the application received on March 28, 2001 as well as the additional information received on
July 31, 2001, and in conformity with the project plan, specifications, and other supporting data subsequently filed
and approved by the Department of Environment and Natural Resources and considered apart of this permit.
This permit shall be effective from the date of issuance until August 31, 2006 and shall be subject to the
following specified conditions and limitations:
I A leakage test shall be performed on the grit chamber/grease trap and storage tank to ensure that any
exfiltration occurs at a rate which does not exceed 20 gallons per 24 hours per 1,000 gallons of tank
capacity. The engineer's certification required in Condition No. 2 shall serve as proof of compliance
with this condition.
2. Upon completion of construction and prior to operation of the permitted wastewater recycle facilities, a
certification shall be received from a North Carolina -licensed professional engineer certifying that the
facilities have been installed in accordance with this permit, the approved plans and specifications, and
other supporting materials. If the facilities are to be completed in phases and partially certified you
shall retain the responsibility to track further construction approved under the same permit and shall
provide a final certificate of completion once all of the facilities have been constructed. Mail the
Certification to the NCDENR-DWQ, Non -Discharge Permitting Unit, 1617 Mail Service Center,
Raleigh, NC 27699-1617.
3. The Asheville Regional Office, telephone number (828) 251-6208, shall be notified at least 48 hours in
advance of operation of the installed wastewater recycle facilities so that an in-place inspection can be
made. Such notification to the regional water quality supervisor shall be made during normal office
hours (i.e., from 8:00 a.m. until 5:00 p.m.) on Monday through Friday, excluding State Holidays.
4. The wastewater recycle facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater resulting from the operation of the facilities.
5. In the event that the wastewater recycle facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those actions that
may be required by this Division, such as the construction of additional or replacement facilities.
6. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface
waters or groundwater resulting from the operation of the wastewater recycle facilities.
7. The Permittee shall check the grit chamber/grease trap and storage tank once per week for the
accumulation of residuals and pumped these out as needed to ensure the successful operation of the
wastewater recycle facilities. All residuals generated by the facilities shall be disposed in accordance
with General Statute § 143-215.1 and in a manner approved by the Division.
8. Diversion or bypassing of untreated wastewater from the wastewater recycle facilities shall be
prohibited.
9. The wastewater recycle facilities shall be properly maintained and operated at all times.
10. Upon classification of the wastewater recycle facilities by the Water Pollution Control Systems
Operators Certification Commission (WPCSOCC), the Permittee shall employ a certified operator to be
in responsible charge (ORC) of the facilities. The operator shall hold a certificate of the type and grade
at least equivalent to or greater than the classification assigned to the facilities by the WPCSOCC. The
Permittee shall also employ a certified back-up operator of the appropriate type and grade to comply
with the conditions of 15A NCAC 8G .0202. The ORC of the facilities shall visit Class I facilities at
least weekly and Class II, III, and IV facilities at least daily, excluding weekends and State Holidays;
shall properly manage and document daily operation and maintenance of the facilities; and shall
comply with all other conditions of 15A NCAC 8G.0202.
11. Any monitoring deemed necessary by the Division to ensure surface water and groundwater protection
shall be established and an acceptable sampling reporting schedule shall be followed.
12. Noncompliance Notification:
The Permittee shall report by telephone to the Water Quality Section of the Division's Asheville
Regional Office, telephone number (828) 251-6208, as soon as possible, but in no case more than 24
hours or on the next working day following the occurrence or first knowledge of the occurrence of any
of the following:
a. Any occurrence at the wastewater recycle facilities that results in the treatment of significant
amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the
contents of a basin or tank, the known passage of a slug of hazardous substance through the
facilities, or any other unusual circumstances;
b. Any process unit failure, due to known or unknown reasons, that renders the wastewater recycle
facilities incapable of adequate wastewater treatment, such as mechanical or electrical failures of
pumps, aerators, compressors, etc.;
c. Any failure of a pumping station, sewer line, or treatment components resulting in a by-pass
directly to receiving waters without treatment of all or any portion of the influent to such station,
line, or component; or

d. Any time that self-monitoring information indicates that the wastewater recycle facilities
compliance with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter form within
five days following its first knowledge. This report shall outline the actions taken or proposed to be
taken to ensure that the problem does not recur.
13. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to ensure proper
operation of the subject facilities.
14. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions
and deterioration, operator errors, and discharges that may cause or lead to the release of wastes to the
environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or
summary including, at a minimum, the date and time of inspection, observations made, and any
maintenance, repairs, or corrective actions taken. This log of inspections shall be maintained by the
Permittee for a period of three years from the date of the inspection and shall be made available to the
Division or other permitting authority upon request.
15. Any duly authorized officer, employee, or representative of the Division may, upon presentation of
credentials, enter and inspect any property, premises or place on or related to the wastewater recycle
facilities at any reasonable time for the purpose of determining compliance with this permit, may
inspect or copy any records that must be maintained under the terms and conditions of this permit, and
may obtain samples- of groundwater, surface water, or leachate.
16. This permit shall become voidable unless the wastewater recycle facilities are constructed in
accordance with the conditions of this permit, the approved plans and specifications and other
supporting data.
17. This permit shall be effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
18. This permit shall not be transferable. In the event there is a desire for the wastewater recycle facilities
to change ownership, or there is a name change of the Permittee, a formal permit request shall be
submitted to the Division) accompanied by documentation from the parties involved and other
supporting materials as may be appropriate. The approval of the request shall be considered on its
merits and may or may not be approved.
19. Failure to abide by the conditions and limitations contained in this permit shall subject the Permittee to
an enforcement action by the Division in accordance with North Carolina General Statutes §143-
215.6A through §143-215.6C.
20. The issuance of this permit shall not preclude the Permittee from complying with any and all statutes,
rules, regulations, or ordinances which may be imposed by other government agencies (i.e., local, state,
and federal) that have jurisdiction, including, but not limited to applicable river buffer rules in 15A
NCAC 2B .0200, soil erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under
the Division's General Permit NCGO100000, and any requirements pertaining to wetlands under 15A
NCAC 213.0200 and 15A NCAC 2H.0500.
21. A set of the approved plans and specifications shall be retained by the Permittee for the life of the
wastewater recycle facilities.
22. The annual administering and compliance fee shall be paid by the Permittee within 30 days after being
billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to
revoke this permit as specified by 15A NCAC 211.0205 (c)(4).
23. The Permittee, at least six months prior to the expiration of this permit, shall request its extension.
Upon receipt of the request, the Division shall review the adequacy of the wastewater recycle facilities
described therein and, if warranted, shall extend the permit for such period of time and under such
conditions and limitations as it may deem appropriate.

Approximately 7 miles east of Old Fort, located on the right.
Comments:
Spoke with Mr. Johnson (owner) of JLJ Trucking. Mr. Johnson indicated
that trucks are not washed outside the covered bay area. There was no
evidence of trucks being washed outside of covered bay area. JLJ had a
Wastewater Recycle permit through DWQ. The permit was rescinded
12/1/2006 as it fell under the new 2T Rules for recycle systems.

Dear Mr. Johnson:
Per a request made by J.L.J Trucking on November 22, 2006, the Division of Water Quality is rescinding
the subject recycle system permit. In accordance with NC State Administrative Code 15A NCAC 02T,
effective September 1, 2006, the recycle system at J.L.J Trucking Inc. meets the requirements of Section
.1003(a) for systems to be deemed permitted. The recycle system at .L.J Trucking Inc. is not required to
apply for future permit renewals or modifications provided that the facility continues to comply with the
requirements of 15A NCAC 02T .1000.
Please be advised that NC State Administrative Code 15A NCAC 02T .,1003(a) requires that a Spill
Control Plan be maintained for the Facility. The Spill Control Plan shall at a minimum addresses the
following items:
a. Contact phone numbers for 24-hour response, including weekends and holidays;
b. Contact phone number for the Division of Water Quality Regional Office;
C. Contact information for construction crews, contractors and/or engineers;
d. Expected response times;
e. Essential equipment list and spare parts inventory;
f. Location of clean up materials;
g. Site sanitation procedures; and
h. Post -response assessment and reporting.

This form is for renewal without modification for all wastewater non -discharge systems. Wastewater non -discharge
systems include: High Rate Infiltration Systems; Infiltration/Evaporation Lagoons; Reclaimed Water Utilization
Systems; Wastewater Recycle Systems Single Family Surface Irrigation Systems; and Surface irrigation Systems.
This application may not be used for renewal of Land Application of Residuals Permits.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and
other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
JLJ Trucking, Inc.

FOR THE
construction and operation of 650 -gallon per day wastewater recycle facilities for a truck wash bay located in a
Quonset -type building and consisting of the following minimum components: an 18 -cubic foot grit chamber/grease
trap with sanitary tee; four -inch pipe to convey wastewater from the grit chamber/grease trap to a storage tank; a
2,000 -gallon storage tank; 1.5 -inch supply pipe to convey wastewater from the storage tank to a package -type
wastewater recycle system; a package -type wastewater recycle system (i.e., Model CLP -5023A manufactured by
Landa Water Cleaning Systems, Inc. or equivalent); a pressure washer; and all associated piping, valves, electrical
items, instrumentation/controls, and other appurtenances necessary to make complete and operational wastewater
recycle facilities . The wastewater recycle facilities are intended to serve JLJ Trucking, Inc., which is located at
Route 4 Box 1084 on U.S. Highway 70 West in Marion, North Carolina, with no discharge of wastes to the surface
waters, pursuant to the application received on March 28, 2001 as well as the additional information received on
July 31, 2001, and in conformity with the project plan, specifications, and other supporting data subsequently filed
and approved by the Department of Environment and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until August 31, 2006 and shall be subject to the
following specified conditions and limitations:
1 A leakage test shall be performed on the grit chamber/grease trap and storage tank to ensure that any
exfiltration occurs at a rate which does not exceed 20 gallons per 24 hours per 1,000 gallons of tank
capacity. The engineer's certification required in Condition No. 2 shall serve as proof of compliance
with this condition.
2. Upon completion of construction and prior to operation of the permitted wastewater recycle facilities, a
certification shall be received from a North Carolina -licensed professional engineer certifying that the
facilities have been installed in accordance with this permit, the approved plans and specifications, and
other supporting materials. If the facilities are to be completed in phases and partially certified, You
shall retain the responsibility to track further construction approved under the same permit, and shall
provide a final certificate of completion once all of the facilities have been constructed. Mail the
Certification to the NCDENR-DWQ, Non -Discharge Permitting Unit, 1617 Mail Service Center,
Raleigh, NC 27699-1617.
The Asheville Regional Office, telephone number (828) 251-6208, shall be notified at least 48 hours in
advance of operation of the installed wastewater recycle facilities so that an in-place inspection can be
made. ` Such notification to the regional water quality supervisor shall be made during normal office
hours (i.e., from 8:00 a.m. until 5:00 p.m.) on Monday through Friday, excluding State Holidays.
4. The wastewater recycle facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater resulting from the operation of the facilities.
5. In the event that the wastewater recycle facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those actions that
may be required by this Division, such as the construction of additional or replacement facilities.
6. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface
waters or groundwater resulting from the operation of the wastewater recycle facilities.
7. The Permittee shall check the grit chamber/grease trap and storage tank once per week for the
accumulation of residuals and pumped these out as needed to ensure the successful operation of the
wastewater recycle facilities. All residuals generated by the facilities shall be disposed in accordance
with General Statute § 143-215.1 and in a manner approved by the Division.
8. Diversion or bypassing of untreated wastewater from the wastewater recycle facilities shall be
prohibited.
9. The wastewater recycle facilities shall be properly maintained and operated at all times.
10. Upon classification of the wastewater recycle facilities by the Water Pollution Control Systems
Operators Certification Commission (WPCSOCC), the Permittee shall employ a certified operator to be
in responsible charge (ORC) of the facilities. The operator shall hold a certificate of the type and grade
at least equivalent to or greater than the classification assigned to the facilities by the WPCSOCC. The
Permittee shall also employ a certified back-up operator of the appropriate type and grade to comply
with the conditions of 15A NCAC 8G .0202. The ORC of the facilities shall visit Class I facilities at
least weekly and Class II, III, and IV facilities at least daily, excluding weekends and State Holidays;
shall properly manage and document daily operation and maintenance of the facilities; and shall
comply with all other conditions of 15A NCAC 8G.0202.
11. Any monitoring deemed necessary by the Division to ensure surface water and groundwater protection
shall be established and an acceptable sampling reporting schedule shall be followed.
12. Noncompliance Notification:
The Permittee shall report by telephone to the Water Quality Section of the Division's Asheville
Regional Office, telephone number (828) 251-6208, as soon as possible, but in no case more than 24
hours or on the next working day following the occurrence or first knowledge of the occurrence of any
of the following:
a. Any occurrence at the wastewater recycle facilities that results in the treatment of significant
amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the
contents of a basin or tank, the known passage of a slug of hazardous substance through the
facilities, or any other unusual circumstances;
b. Any process unit failure, due to known or unknown reasons, that renders the wastewater recycle
facilities incapable of adequate wastewater treatment, such as mechanical or electrical failures of
pumps, aerators, compressors, etc.;
c. Any failure of a pumping station, sewer line, or treatment components resulting in a by-pass
directly to receiving waters without treatment of all or any portion of the influent to such station,
line, or component; or

d. Anytime that self-monitoring information indicates that the. wastewater recycle facilities are not in
compliance with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter form within
five days following its first knowledge. This report shall outline the actions taken or proposed to be
taken to ensure that the problem does not recur.
13. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to ensure proper
operation of the subject facilities.
14. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions
and deterioration, operator errors, and discharges that may cause or lead to the release of wastes to the
environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or
summary including, at a minimum, the date and time of inspection, observations made, and any
maintenance, repairs, or corrective actions taken. This log of inspections shall be maintained by the
Permittee for a period of three years from the date of the inspection and shall be made available to the
Division or other permitting authority upon request.
15. Any duly authorized officer, employee, or representative of the Division may, upon presentation of
credentials, enter and inspect any property, premises or place on or related to the wastewater recycle
facilities at any reasonable time for the purpose of determining compliance with this permit, may
inspect or copy any records that must be maintained under the terms and conditions of this permit, and
may obtain samples of groundwater, surface water, or leachate.
16. This permit shall become voidable unless the wastewater recycle facilities are constructed in
accordance with the conditions of this permit, the approved plans and specifications and other
supporting data.
17. This permit shall be effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
18. This permit shall not be transferable. In the event there is a desire for the wastewater recycle facilities
to change ownership, or there is a name change of the Permittee, a formal permit request shall be
submitted to the Division) accompanied by documentation from the parties involved and other
supporting materials as may be appropriate. The approval of the request shall be considered on its
merits and may or may not be approved.
19. Failure to abide by the conditions and limitations contained in this permit shall subject the Permittee to
an enforcement action by the Division in accordance with North Carolina General Statutes §143-
215.6A through § 143-215.6C.
20. The issuance of this permit shall not preclude the Permittee from complying with any and all statutes,
rules, regulations, or ordinances which may be imposed by other government agencies (i.e., local, state,
and federal) that have jurisdiction, including, but not limited to applicable river buffer rules in 15A
NCAC 2B .0200, soil erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under
the Division's General Permit NCGO100000, and any requirements pertaining to wetlands under 15A
NCAC 2B .0200 and 15A NCAC 2H.0500.
21. A set of the approved plans and specifications shall be retained by the Permittee for the life of the
wastewater recycle facilities.
22. The annual administering and compliance fee shall be paid by the Permittee within 30 days after being
billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to
revoke this permit as specified by 15A NCAC 214.0205 (c)(4).
Z3. The Permittee; at least six months prior to the expiration of this permit, shall request its extension.
Upon receipt of the request, the Division shall review the adequacy of the wastewater recycle facilities
described therein and, if warranted, shall extend the permit for such period of time and under such
conditions and limitations as it may deem appropriate.

On September 19, 2001 J.L.J. Trucking, Inc. was issued Permit No. WQ0019846 for the
construction and operation of truck wash wastewater -recycling facility. The purpose of the facility
was to prevent the discharge of the truck wash water from your operation to the surface of your
property. I was informed today that your truck wash facility remains to be completed. The
purpose of this letter is to confirm my conversation with you today. In that phone conversation,
we discussed the need for the facility to be completed. Furthermore, you informed me that the
facility would be completed in accordance with the approved plans and specification, on or before
August 31, 2003. I have attached a copy of your permit for your records. Plans and
specifications should be obtained from Mr. Charles H. Davis, your engineer.
Finally, I recommend you read your permit carefully, doing so will minimize your exposure
to enforcement actions. Please note that item number 3 requires that you notify this office at
least 48 hours before the facility is put into operation. Should you have any questions regarding

a. One original and three copies of the completed and appropriately executed application form.
b. The appropriate permit processing fee, in accordance with 15A NCAC "?H .0205(c)(5),
c, Five (5) sets of detailed plans and specifications signed and sealed by a North Carolina Professional Engineer. The plans must
include a general location map, a site map which indicates where any borings or hand auger samples were taken, along with
buffers, structures, and property lines. Each sheet of the plans and the fust page of the specifications must be signed and sealed.
d. For industrial wastewater, a complete chemical analysis of the typical wastewater must be provided. The analysis may include,
but shall not be limited to, Total Organic Carbon, BOD, COD, Chlorides, Phosphorus, Nitrates, Phenol, Total Trihalomethanes,
TCLP analysis, "Dotal Halogenated Compounds, Total Coliforms, and Total Dissolved Solids.
e. If lagoons are a part of the facilities and the recycle water is industrial. provide a hydrogeologic description of the subsurface to a
depth of' 20 feet or bedrock, whichever is less. The number of borings shall be sufficient to define the following for the area
underlying each major soil type at the site: significant changes in lithology, the vertical permeability of the unsaturated zone, Lhc
hydraulic conductivity of the saturated zone, and the depth of the mean seasonal high water table.
f. Five copies of all reports, evaluations, agreements, supporting calculations, etc., must be submitted as a part of the specifications
which are signed and sealed by a North Carolina Professional Engineer. Although certain portions of this required submittal most
be developed by other professionals, inclusion of these materials under the signature and seal of a North Carolina Professional
Engineer signifies that he has reviewed this material and has judged it to be consistent with his proposed design.
g. Five (5) copies of the existing permit if a renewal or a modification.

INSTRUCTIONS TO NC PROFESSIONAL ENGINEER:
The classification of the downslope surface waters (tie surface waters that any overflow from the facility would flow toward)
in which the recycle facility will be constructed must be determined by the appropriate DEM regional office. Therefore, you
are required, prior to submittal of the application package, to submit Chis form, Nvitit items 1 through 7 completed,
to the appropriate Division of Environmental Manaoetnent Regional Water Quality Supervisor (see page 6 of 6). At a
minimum, you must include an 8.5" by 11" copy of the portion of a 7.5 minute USGS Topographic Map which shows the
location of the recycle facility and the downslope surface waters in which they will be located. Identify the closest downslope
surface waters on tlhe attached map copy.. Once the regional office has completed the classification,
reincorporate this completed page and the topographic map into the complete application form and
submit the application package.

I am writing you in reference to the status of the septic system permit application for the
truck washing facility at your business JLJ Trucking on Highway 70 West between Old Fort and
Marion.
The wastewater- from the truck washing is considered to be industrial process wastewater
(IPWW) because it does not have the same characteristics as domestic wastewater or sewage.
Because of this, the N.C. Groundwater Section is also required to review your plans. Upon doing
so, they have asked for monitoring wells. Their proposed monitoring well locations are in the
proposed septic system drainfield site. This would cause immediate violation of discharge limits
plus a very good chance of groundwater contamination through a monitoring well shaft.
Based upon this information, I am sorry to say that we have no choice other than to deny
your application for a septic system permit.
Three other options come to mind:
1.) You can seek a stream discharge permit through the N.C. Division of Water
Quality - Larry Frost (828) 251-6208
2.) You can seek additional property for another septic system site.
3.) You can explore the possibility of a complete recycling system. I think the
Division of Water Quality would be responsible for permitting this. We may
have some manufacturers information however. Metal Industries near you on
Highway 70 West has one of these type systems.

The classification of the downslope surface waters (the surface waters that any overflow from the facility would flow toward)
in which the recycle facility will be constructed must be determined by the appropriate DEM regional office. Therefore, you
are required, prior to submittal of the application package, to submit this form, with items I through 7 completed,
to the appropriate Division of EnvironmentaFManagement Regional Water Quality Supervisor (see page 6 of 6). At a
minimum, you must include an 8.5" by 11 copy of the portion of a 7.5 minute USGS Topographic Map which shows the
location of the recycle facility and the downslope surface waters in which they will be located. Identify the closest downslope
surface waters on the attached map copy. Once_ the regional office has completed the classification,
reincorporate this completed page and the topographic map into the complete application form and
submit the application package.
