Dear Ms. Dailey and Ms. Higgins:
On behalf of our client, the Inter Church Council Housing Corporation (ICCHC), Kimley-Horn is
submitting the attached application for authorization under Nationwide Permit (NWP) 13 for the above
referenced project. The ICCHC proposes to stabilize a failing length of streambank within Pritchard
Branch (NCDWR: UT to Morgan Creek) to protect an adjacent drive into the Chase Park Apartment
complex in a way that is durable, cost effective, and meets regulatory and environmental
requirements. The purpose of this project is to protect and repair the existing infrastructure located
along Pritchard Branch (UT to Morgan Creek). These goals will be achieved by installing vegetated
soil lifts above a boulder toe along the right bank, rock toe protection along both banks, and a
constructed riffle and log sill within the channel. When possible, construction materials will come from
the project area or a localized, native source.
Jurisdictional features occurring within the project area were delineated by Kimley-Horn staff on
December 12, 2018. One stream (Pritchard Branch) was identified within the project area. Pritchard
Branch is a perennial tributary to Morgan Creek. Pritchard Branch is not classified by NCDWR.
Pritchard Branch appears on the most recent USGS Topographic Quad Map and on the NRCS Soil
Survey of Orange County and for this reason, it has been assumed subject to the Jordan Lake
Watershed Riparian Buffer rules.
Permanent impacts will occur to Pritchard Branch and Buffer Zones 1 and 2 as a result of the bank
stabilization. A stream diversion operation with pump around is proposed within Pritchard Branch to
allow for work in the dry and to reduce downstream sedimentation. Temporary impacts will result to
Buffer Zones 1 and 2 as a result of the necessary construction access to the site. Equipment and
material staging, and construction access will be limited to the existing driveway and disturbed area
where possible. The proposed project has been designed and will be constructed to avoid impacts to
both Pritchard Branch and the regulated riparian buffers where possible. Necessary impacts will only

occur when targeted bank stabilization activities are underway. All temporarily impacted riparian
buffer areas will be restored to pre-existing condition upon completion of the project.

The proposed stream bank repair project is located along Pritchard Branch (UT to Morgan Creek). The project area is bounded by a driveway to the north and west, an apartment
complex to the east, and US 64 to the south. The project vicinity is comprised primarily of residential development interspersed by commercial centers and undeveloped riparian
corridors.

The purpose of the proposed project is to protect and repair existing infrastructure by stabilizing an eroding stream bank.

The project proposes to stabilize the right bank of Pritchard Brank (UT to Morgan Creek) and repair the existing driveway to the Chase Park Apartment complex Erosive flows within
Pritchard Branch have caused scour and sloughing adjacent to the apartment complex driveway which has led to buckling and cracking in the pavement. The project will stabilize the
erosive bank by installing vegetated soil lifts above a boulder toe on the right bank, rock toe protection along both banks, and a constructed riffle and log sill within the channel.
Excavators, pavers, graders, and other equipment typical of paving and bank stabilization projects Will be used.

to avoid impacts to riparian buffers to the extent practical. A temporary pump -around has been proposed in the design to avoid sedimentation
downstream.

The proposed project will be constructed to stabilize an eroding bank within Pritchard Branch (Ur to Morgan Creek). Silt fences will be placed along
the limits of disturbance to confine equipment to the designated staging and access areas. Where feasible, construction materials and equipment will
be stored and staged in upland areas. A temporary pump -around will be implemented during construction to allowfor work in the dry and to reduce
downstream sedimentation.

The USFWS lists five federally protected species as known to occurr within Orange County: bald eagle, Cape Fear shiner, dwarf wedgemussel,
Michau)ts sumac, and smooth coneflower. A review of the NC Natural Heritage Program (NCNHP) element occurrence database (updated January
2019) indicates no known occurrences of any federally protected species within 1.0 mile of the project area.
Suitable habitat for bald eagle is not present within the study area due to the lack of large, dominant trees within 1.0 mile of open water. Due to the
lack of suitable foraging or nesting sites within the project area, it is anticipated that the proposed project will not affect this species.
Suitable habitat for Cape Fear shiner may be present within the study area; however, the proposed project will have no adverse affects to potential
habitat and will only better the habitat within Pritchard Branch (UT to Morgan Creek).
Suitable habitat for dwarf wedgemussel is not present within the study area due to the lack of well oxygenated, fast Flowing streams with stable root -
lined banks.
Suitable habitat for Michawes sumac and smooth coneflower is not present within the study area due to the frequent maintenance schedule of the
driveway corridor.
Based on the lack of known occurrences, the lack of suitable habitat, and the minimal adverse impacts anticipated with the proposed project, it is has
been determined that the proposed project will have no effect on Cape Fear shiner, dwarf wedgemussel, Michames sumac, and smooth coneflower.

identified within 0.25 mile of the project area. However, the historic district is separated from the project area by the existing apartment complex
Additionally, the proposed project will have only minimal and temporary impacts to the surrounding viewshed. Due to the existing development
separating the project from the historic district and the temporary and minimal impact anticipated as part of the proposed project, it has been
determined that the project will have no affect on any historic or cultural resources.
