Bottomland Hardwood Forest wetlands cover a significant portion of the eastern and central areas of the property, and an Overhead Wire runs along the western boundary and Powhatan Road. General land use in the vicinity of the project consists of residential and agricultural land. 4b. Previously, they were one large parcel at appropmatley 92 acres. It was determined in that meeting by Ross Sullivan that the two developments each had Independent Utility and therefore could be considered two "single & complete" projects. D. Through project review and avoidance & minimization, these impacts have been modified to only include one wetland impact for a sanitary sewer connection. Impact Area #1 is a proposed permanent, no permanent loss wetland impact through the narrowest section of the onsite wetland. The proposed impacts total 0.053 acres. The impact is considered "permanent, no permanent loss" because the sanitary sewer will be open -cut, the wetland will be brought back to original contours and allowed to revegetate with an adjacent wetland seed source however wetland species of trees will not be allowed to growwithin the 25' sanitary sewer easement. Additionally, the proposed trails have been redesigned to be one boardwalk section and constructed via pile driven piers with no mechanized equipment within the wetland area. All other development will be within uplands. 1b. We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The Mill Creek Subdivsion project is a residential development. Additionally, the project is located within Johnston County jurisdiction, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area in addition to "diffuse flood' requirements at a minimum and could require Best Management Practices that control nitrogen if diffuse flowcannot be achieved; and 2) the Water Supply, Watershed Protection Program which limits development densities as well as requires protective riparian buffers.
