Project Information and Prior Project History, 3. Project Description, 3e.: Approximately 880 linear feet of culvert was removed from S36 (Figure 3.0) during upland grading and earthwork activities on a portion of the High Hampton golf course. Once the culvert was exposed, the contractor determined that the pipe was undersized and in poor condition. The contractor's original intent was to replace the exact length of culvert removed from the stream. However, no notification was provided to the USACE or NCDWR and an unauthorized, online sediment basin was installed within the stream channel. As a result, the stream channel was impacted by unauthorized sediment and requires stabilization. A sediment removal plan was approved by NCDWR on January 15, 2019 and unauthorized sediment resulting from daylighting the culverted stream has since been removed from the tributary via the use of shovels and buckets. The banks of the stream channel have also been stabilized with matting and sod (Photo 1 and Photo 2). An additional project component would be to stabilize the remainder of the online -sediment basin, via the use of boulders to create a step feature (Figure 3.1 and Figure 3.2). Typical construction and earth -moving equipment would be utilized during stabilization of the basin and installation of two boulder steps. A pump around system/apparatus would be installed prior to construction activities in order to redirect the stream flow for work -in -the -dry conditions (Figure 3.2). Project History, 5b.: Several permits have been requested and obtained in the past by High Hampton and are summarized in Table 1 below. An individual permit (IP) application was also submitted to the USACE and NCDWR on May 29, 2018 for impacts associated with the redevelopment of the High Hampton. Country Club. During a site inspection on December 18, 2018, representatives from the USACE and NCDWR observed unauthorized impacts to waters of the U.S. on the portion of the site/golf course located south of NC Highway 107. As a result, the USACE issued a Notification of Unauthorized Activity on January 8, 2018 (Attachment C) and the IP application was administratively withdrawn. CEC is working with High Hampton and Daniel Communities to address remedial actions requested by the USACE/NCDWR and will prepare a revised IP application for submittal. Additionally, NCDWR issued a Notice of Violation (NOV) on January 7, 2019, for the site as a result of unauthorized impacts (Section F. Supplementary Information, 2. Violations). The NOV requested that High Hampton contact the USACE to determine the appropriate after -the -fact permit pertaining to impacts from culvert removal and stream stabilization on 536. This nationwide permit application is aimed at fulfilling NCDWR's request and resolving any unauthorized impacts or deficiencies in daylighting the stream. 2 Table I. The NOV cited unauthorized sediment impacts to an unnamed tributary to Fowler Creek (536, Figure 3A). A remediation plan was submitted by CEC and approved by NCDWR. CEC revisited the site on January 28, 2019 to evaluate sediment removal efforts. It is the opinion of CEC that sediment removal activities are complete, and a final site walk with NCDWR has been scheduled for February 6, 2019. F. Supplementary Information, 5. Endangered Species and Designated Critical Habitat (Corps Requirement), 5d.: CEC conducted a threatened and endangered species survey during the stream and wetland delineation from August -- September 2017 and again on May 3-4, 2018 to determine the presence or absence of Federally listed species. No Federally threatened or endangered species were identified on-site. CEC also consulted the FWS's "Northern Long -Eared Bat Consultation Areas" map for Jackson County. The proposed project site is not in a Hydrologic Unit Code (HUC) identified as having known occurrences of hibernation or maternity sites. Cavers/bat biologists from Skybax Ecological Services, LLC conducted a bat survey of the High Hampton project area from July 23 - PO 25, 2018. Although the presence of small boulder crawl-ins/crawl-throughs and rock shelters were Present within the study area, none provided suitable conditions for overwintering habitat for gray, Indiana, and/or Northern long-eared bat. F. Supplementary Information, 7. Historic or Prehistoric Cultural Resources (Corps Requirement), 7b.: A desktop review of the National Register of Historic Places (NRNP) records maintained by the NC State Historic Preservation Office (SHPO) and available on SHPO's HPOWEB GIS Service indicates five historic properties located within an approximate 1 -mile radius of the High Hampton project site: High Hampton Inn Historic District (JK0006), Church of the Good Shepherd (JK0008), George M. Cole House (JK0269), Evan Pell Store (JK0270), and the Mordecai Zachary House (JK0024). High Hampton is coordinating with SHPO regarding proposed redevelopment activities within other parts of the site. The Corps has confirmed the golf course redesign activities are within the proposed project area for the redevelopment project. It is noted the application for the redevelopment project and the proposed associated impacts to WoUS was under review and evaluation by the Corps during the time of the impacts to jurisdictional features were undertaken. No authorization had been issued by the DA to impact WoUS for the redevelopment project or for any other activities at the High Hamptou'property(s). It is noted the application for the redevelopment project and the proposed associated impacts to waters of the U.S. (WOUS) is currently under review and evaluation by the Corps. The DA has not issued a decision for the proposed impacts to WoUS at this time. With this letter the Corps is informing you the conductance of activities in areas outside of the Corps jurisdiction associated with the proposed redevelopment project does not imply that this office will necessarily approve the proposed impacts to WoUS cutrently under review or any future proposal to impact WoUS on this property. The conductance of clearing, grading, and construction activities will not affect the Corps current review or any future proposed impacts to WoUS. The occurrence of these activities within the redevelopment project area will not be an adequate justification for authorization of the proposed impacts currently under review or authorization of future impacts. The Corps will examine the proposed impacts to WoUS for the proposed redevelopment project and any future proposal to impact WoUS to ensure you have avoided, minimized, and/or mitigated for unavoidable impacts. At this time, the proposed impacts to WoUS outlined in your application is being evaluated by the Corps to determine if measures you have proposed to avoid, minimize, and mitigate for unavoidable impacts to WoUS are applicable and appropriate. No authorization has been issued by the DA to impact WoUS for the redevelopment project or for any other activities at this property. Any impacts to WoUS within the Corps jurisdiction will be a violation of federal law under the Clean Water Act, Section 301 (33 USC 1311), and may be consider a knowing violation of federal law. This can result in issuance of a notification of unauthorized activity and cause the current application requesting DA authorization to be administratively withdrawn. Also, it has been reported that a historic schoolhouse within the redevelopment project area has been removed and transported off the property. The removal of the building is associated with the golf course redesign, which is a part of the redevelopment project. The schoolhouse was built around 1891 by General Wade Hampton, a person of historic significant. The building could be eligible for inclusion in the National Register of Historic Places. The Corps strongly advises you to contact Renee Gledhill -Early (919-807-6579, renee.gledhill-early a@ncdcr.gov) of the N.C. State Historic Preservation Office (SHPO) in order to determine requirements this agency has for the removal the schoolhouse.
