The Groundwater Section has become aware of the subject proposal to upgrade the existing
wastewater treatment plant from 1 MGD to 3 MGD in order to accommodate additional flow
from a new industry. The proposal includes plans to :abandon an existing basin and to utilize an
existing unlined lagoon as an aeration basin.. The existing NPDES permit will expire on
November 30, 1998. When the application for renewal of the NPDES permit is received, the
Groundwater Section wishes to take that opportunity to comment on the renewal, so that
groundwater monitoring may be incorporated into the NPDES permit. In order to assess the
need for monitoring under an NPDES permit at this facility, the Groundwater Section would like
to require groundwater monitoring as part of the Authorization to Construct so that monitoring
data can be collected between now and November of 1998,

In 1985 the Groundwater Section constructed seven (7) monitor wells at the facility as part
of the pollution monitor network. The monitoring data collected from 1985 through 1991 shows
no exceedances of groundwater standards during that time, ,with the exception of periodic
increases in total coliform, iron, and manganese (naturally occurring).
The Groundwater Section wishes to recommend that groundwater monitoring be
stipulated in the Authorization to Construct in the following language:
The three existing monitor wells (upgradient monitor well P79w4 and downgradient monitor
wells P79w2 and P79w5) shall be sampled initially at the start-up or the expanded system and
thereafter every April, August, and December for the following parameters:

The measurement of water levels must be made prior to sampling for the remaining parameters.
The depth to water in each well shall be measured from the surveyed point on the top of the
casing.
If any volatile organic compounds are detected by Method 6230D, then the Asheville Regional
Office groundwater supervisor (telephone number: (704)251-6208) must be contacted immediately
for further instructions regarding any additional follow-up analyses required. The results of all
initial and follow-up analyses must be submitted simultaneously.
The results of the sampling and analysis must be received on Form GW 59 (Groundwater
Quality Monitoring: Compliance Report Form) by the Groundwater Section, Permits and
Compliance Unit, P.O. Box 29578 Raleigh, N.C. 27626-0578 on or before the last working
day of the month following the sampling month.

As part of the Authorization to Construct for the subject
facility, groundwater monitoring is required at the start-up of
the expanded system. I have requested the ORC, Paul Rhodes, to
sample 3 of the monitor wells as soon as possible (prior to
start-up), so that the groundwater monitoring data can be
reviewed prior to coordinating our comments for renewal of the
NPDES permit.
Paul Rhodes indicated that the monitor wells will be sampled in
early December. That data will be reviewed and comments sent to
you as soon as possible.

A letter of request for an Authorization to Construct was received September 5, 1997 by the
Division and final plans and specifications for the proposed wastewater treatment plant upgrade from 1.0
MGD to 3.0 MGD has been reviewed and found to be satisfactory. _Authorization is hereby for the
construction of the following units:'
• Mechanically cleaned bar screen and conveyor system,
• Aerated grit and grease removal system,
• 1.3 MGD influent flow equalization basin with three existing relocated 1*5 FIP floating surface
aerators,
• Equalization basin splitter box,
• 2.7 MGD aeration basin with five existing relocated 15 HP floating surface aerators and five
25 HP floating surface aerators,
• 2.3 MGD aeration basin with four existing relocated 15 HP floating surface aerators and five
25 HP floating surface aerators,
• Clarifier splitter box,
• Dual 75 foot circular clarifiers,
• 441,000 gallon sludge digester with three 25 l-lP floating surface aerators,
• Chlorination / dechlorituition system including V-notch chlorinators and chlorine/sulfur
detection and warning devices,
Chemical feed building, and
• All necessary controls, piping and appurtenances
with final discharge of treated wastewater into Cleghorn Creek where it joins Stonecutter Creek which is
classified C waters in the Broad River Basin.
The following special conditions apply to the issuance of this authorization to construct:
• A sludge management plan must be prepared and reviewed prior to operation of the
proposed treatment works.

• It is the Divisions understanding that the proposed interlocking sheet piles between the
equalization basin and aeration basin number 2 and between aeration basin number 1
and aeration basin number 2 will no longer be installed due to budget constraints. The
Division has approved the plans and specifications with the understandingthat floating-
curtains will be installed in place of the interlocking sheet piles. This authorization to
construct is being issued with the understanding that as -built plans, for the installation
of floating curtains, will be submitted for Division review upon completion.
The subject facility must perform groundwater monitoring in reference to the
requirements stated below.
The three existing monitoring wells (upgradient monitoring well P79w4 and
downgradient monitoring wells P79w2 and P79w5) shall be sampled initially, at the
start-up of the expanded system and thereafter every April, August, and December for
the following parameters:

conditions, the Permittee shall take immediate corrective action, including those as may be required by this

The Asheville Regional Office, telephone number (704) 251-6208, shall be notified at least forty-
eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
iiade. Such notification to the regional supervisor shall be made during, the normal office hours from 800
a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.
Upon completion of construction and prior to operation of this permitted facility, a certification
roust be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, this Authorization to Construct and the approved plans and
specifications. Mail the Certification to the NPDES Unit, P.O. Box 29535, Raleigh, NC 27626-0535.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the
life of the facility.
The Operational Agreement between the Permittee and the Environmental Management
Commission is incorporated herein by reference and is a condition of this Permit. Noncompliance with the
resins of the Operational Agreement shall subject the Permittee to all sanctions provided by G. S. 143-
2 15.6 for violation of or failure to act in accordance with the terms and conditions of this Permit.
Failure to abide by the requirements contained in this Authorization to Construct inay subject the
t'crmittee to an enforcement action by the Division of Water Quality in accordance with North Carolina
lieneral Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from complying
th any and all statutes, rules, regulations, or ordinances which may be imposed by other government
r gencies (local, stage, and federal) which have jurisdiction.

In accordance with the application for a discharge permit received on October 8, 1996, the Division is
forwarding herewith the subject NPDES permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable
to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150E of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer
27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and
binding.
Please take notice this permit is not transferable. Part It, EA. addresses the requirements to be followed
in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management
Act or any other Federal or Local governmental permit that may be required.

and IV hereof.
The permit shall become effective May 1,1997.

is hereby authorized to:
1. Continue to operate a 1.0 MGD wastewater treatment plant consisting of a bar rack, grit
chamber, two aerated lagoons in series, and chlorine disinfection located at Rutherfordton
Wastewater Treatment Plant, off US Highway 221, south of Rutherfordton, Rutherford
County (See Part III of this permit), and
2. Discharge from said treatment works at the location specified on the attached map into
Cleghorn Creek which is classified Class C waters in the Broad River Basin, and
3. After receiving an Authorization to Construct from the Division of Water Quality, expand the
existing wastewater treatment plant to 3.0 MGD and relocate the discharge point several
hundred feet downstream on Cleghorn Creek where it joins Stonecutter Creek.

A letter of request for an Authorization to Construct was received September 5, 1997 by the
Division and final plans and specifications for the proposed wastewater treatment plant upgrade from 1.0
MGD to 3.0 MGD has been reviewed and found to be satisfactory. Authorization is hereby for the
construction of the following units:
• Mechanically cleaned bar screen and conveyor system,
• Aerated grit and grease removal system,
• 1.3 MGD influent flow equalization basin with three existing relocated 15 HP floating surface
aerators,
• Equalization basin splitter.box,
• 2.7 MGD aeration basin with five existing relocated 15 HP floating surface aerators and five
25 HP floating surface aerators,
• 2.3 MGD aeration basin with four existing relocated 15 HP floating surface aerators and five
25 HP floating surface aerators,
• Clarifier splitter box,
• Dual 75 foot circular clarifiers,
• 441,000 gallon sludge digester with three 25 HP floating surface aerators,
• Chlorination / dechlorination system including V-notch chlorinators and chlorine/sulfur
detection and warning devices,
• Chemical feed building, and
• All necessary controls, piping and appurtenances
with final discharge of treated wastewater into Cleghorn Creek where it joins Stonecutter Creek which is
classified C waters in the Broad River Basin.
The following special conditions apply to the issuance of this authorization to construct:
• A sludge management plan must be prepared and reviewed prior to operation of the
proposed treatment works.

• It is the Divisions understanding that the proposed interlocking sheet piles between the
equalization basin and aeration basin number 2 and between aeration basin number 1
and aeration basin number 2 will no longer be installed due to budget constraints. The
Division has approved the plans and specifications with the understanding that floating
curtains will be installed in place of the interlocking sheet piles. This authorization to
construct is being issued with the understanding that as -built plans, for the installation
of floating curtains, will be submitted for Division review upon completion.
• The subject facility must perform groundwater monitoring in reference to the
requirements stated below.
The three existing monitoring wells (upgradient monitoring well P79w4 and
downgradient monitoring wells P79w2 and P79w5) shall be sampled initially at the
start-up of the expanded system and thereafter every April, August, and December for
the following parameters:
- Chlorides
- pH
Water Level
- VOCs (December only) by method 6230D
Method 6230D (Capillary Column), "Standard Methods for the Examination
of Water and Wastewater," 17th edition, 1989
- Ammonia Nitrogen
- Total Coliforms
- Fecal Coliforms
The measurement of water levels. must be made prior to sampling for the remaining
parameters. The depth to water in each well shall be measured from the surveyed point
on the top of the casing.
If any volatile organic compounds are detected by Method 6230D, then the Asheville
Regional Office groundwater supervisor (telephone number 704-251-6208) must be
contacted immediately for further instructions 'regarding any additional follow-up
analyses required. The results of all initial and follow-up analyses must be submitted
simultaneously.
The results of the sampling and analyses must be received on Form GW-59
(Groundwater Quality Monitoring: Compliance Report Form) by the Groundwater
Section, Permits and Compliance Unit, Post Office Box 29578, Raleigh, North
Carolina 27626-0578 on or before the last working day of the month following the
sampling month.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of NPDES
Permit No. NCO025909 issued March 31, 1997, and shall be subject to revocation unless the wastewater
treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No.
NC0025909.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.

The Asheville Regional Office, telephone number (704) 251-6208, shall be notified at least forty-
eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00
a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.
Upon completion of construction and prior to operation of this permitted facility, a certification
nniust be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, this Authorization to Construct and the approved plans and
specifications. Mail the Certification to the NPDES Unit, P.O. Box 29535, Raleigh, NC 27626-0535.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the
life of the facility.
The Operational Agreement between the Permittee and the Environmental Management
Commission is incorporated herein by reference and is a condition of this Permit. Noncompliance with the
m.zrms of the Operational Agreement shall subject the Permittee to all sanctions provided by G. S. 143-
215.6 for violation of or failure to act in accordance with the terms and conditions of this Permit.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
I ermittee to an enforcement action by the Division of Water Quality in accordance with North Carolina
General Statute 143-215.6A to 143-215..6C.
The issuance of this Authorization to Construct does not preclude the Permittee from complying
s ith any and all statutes, rules, regulations, or ordinances which may be imposed by other government
,, encies (local, state, and federal) which have jurisdiction.

Rutherford County
The Town of Rutherfordton has proposed to upgrade their existing
wastewater treatment plant from 1 MGD to 3 MGD. The expansion is
to accommodate additional flow from a new industry. The proposal
includes plans to abandon an existing basin and one existing
unlined lagoon is proposed to be utilized as an aeration basin.
I have been requested to expedite review of this project so that
the authorization to construct may be issued as timely as
possible. The review engineer in the Permits and Engineering
Unit is Jeff Myhra at (919)733-5083 ext. 597. Please forward
comments to him as quickly as possible.
The NPDES permit will expire on November 30, 1998. It is
requested that the Groundwater Section have opportunity to review
and comment on the NPDES renewal, so that groundwater monitoring
may be incorporated in the NPDES permit.
In 1985, the Groundwater Section constructed 7 monitor wells as a
part of the pollution monitor network at this facility.
Monitoring data collected by our office from 1985 through 1991
shows no exceedances of groundwater standards with the exception
of periodic increases in total coliform, and iron and manganese
(naturally occuring)
The Asheville Regional Office recommends that groundwater
monitoring be stipulated in the Authorization to Construct. Our
comments are as follows:
