Dinnes for the continued operation of the subject wastewater recycle system. Please note, an 80 GPM pump is the largest pump authorized for this permit. This permit shall be effective from the date of issuance until July 31, 1999, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. Dinnes Macon County FOR THE continued operation of a 60,000 GPD wastewater recycle system consisting of a S foot by 80 feet long wooden flume, three 1,000 gallon sediment tanks, an 80 GPM pump for recycling the water, a 1,000 gallon tank for water storage while sediment is being removed, and all associated valves, piping, controls, and appurtenances to serve Big Find Gem Mine (tourist attraction) with no discharge of wastes to the surface waters, pursuant to the application received July 29, 1994, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment, Health and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until July 31, 1999, and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Environmental Management accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of the request will be considered on its merits and may or may not be approved. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those actions that may be required by this Division, such as the construction of additional or replacement treatment or disposal facilities. 1 14. Any duly authorized officer, employee, or representative of the Division of Environmental Management may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the recycle system at any reasonable time for the purpose of determining compliance with this permit, may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. 15. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205 (c)(4)• lb. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c). 17. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be unposed by other government agencies (local, state, and federal) which have jurisdiction. 18. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of this project. 2 The Asheville Regional Office, telephone number 704/ 2`±-6208 shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an in-place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 7. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-215.1 and in a manner approved by the North Carolina Division of Environmental Management. 8. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 9. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 10. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited. 11. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 13. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available to the Division of Environmental Management or other permitting authority, upon request. 14. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of this project. 2 ,> Noncompliance Notification: The Permittee shall report by telephone to the Asheville Regional Office, telephone number 704/ 251-6208 as soon as possible, but in no case more than 24 hours or on the next working day .following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin or tank, the known passage of a slug of hazardous substance through the facility, or any other unusual circumstances; b. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compressors, etc.; c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility; or d. Any time that self-monitoring information indicates that the facility is not in compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 20. Upon classification of the facility by the Certification Commission, the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the Certification Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of Title 15A, Chapter 8A, .0202. 21 The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. Benton, Jr. JW: jr 81517 Consideration of Reinstatement of the Requirements for the Classification of Wastewater Treatment Facilities Seryih _Gem Mining Operations The Chairman presented this item for consideration by the Commission and referred to the narrative pertaining to the subject in the Explanation of Agenda Items. Upon reading the explanation into the record, the Chairman then referred the Commission to the Regulation and the section containing the rating sheet. Mr. Coburn pointed out that the rating sheet automatically placed mining operations in a Class I category. He then read into the record a letter from Mr. Roy Davis of the Asheville Regional Office in which it was pointed out 'that five years before, it had been requested that mining operations be exempted -from the rating scale. The letter continued to read that it was now felt that these facilities merit classification. A copy of this letter and attachments are attached hereto and by reference made a part of these Minutes. (Attachment No. 11.) The Chairman went on to say that this matter was highly controversial and he had discussed the issue with Mr. Benton. He said that Mr. Benton did not discuss the situation extensively; however, he did recommend that if the Commission decided to hold a public hearing to amend the Regulation to require Classification of these facilities that the hearing be held in the gem mining area in order to provide better opportunity for the people involved in the mining operations to attend the hearing. BOX 629 RALEIGH MAR 26 19961 27602 Western Regional Office March 24, 1981 Asheville, North Carolina MEMORANDUM To: Bill Raney FROM: Jo Anne Sanford RE Monitoring and Reporting Requirements to be Imposed on Western North Carolina Gem Miners Mike Parker of the Asheville Regional office has posed a question concerning a matter which appears likely to result in some administrative hearings and I would like to pass it on for someone in the EPS to handle. A number of stream problems have resulted from the poor operation by certain gem -mine owners of their facilities, prompting the Asheville office to revoke their permits and to attempt to impose a number of monitoring and reporting require merits which the operators contend to be burdensome and objectionable. The Department had previously exempted this industry from monitoring and reporting requirements and they have never been classified. However, the recurring problems with the facilities have caused the Department to take the 'position that they must now monitorforthree parameters as follows: TSS twice monthly; turbidity - weekly, and settleable matter - weekly. If classified, the operations would be Class I facilities and subject to quarterly monitoring requirements for TSS and monthly requirements for turbidity and settleable matter. Finally, 15 NCAC 2B .0508(b)(3) provides authority for imposing, essentially, such additional tests at such points and with such frequency as the Department deems necessary to monitor the discharge and its effects on the stream. According to Mike, the operators appear certain to challenge the Department's authority on this matter and the Asheville office wants a review of their position before proceeding further. Mike spoke to Thomas Hilliard and I both about this so Thomas can be -2 - consulted for OLA's view. It appears to me that if the Department can support the frequency requirements as being reasonable and necessary to protect the stream then they would withstand any challenge to the permit posed in a hearing. There is some need for immediate attention to this matter in that the mining season begins in April. I hereby request that the monitoring frequency, as stipulated in the Permit to Discharge Wastewater Under the NODES Draft, be changed from bi-monthly testing for suspended solids to monthly and from weekly testing for turbidity and settle- able matter to monthly. From all information I have been able to obtain, we do not meet the qualifica- tions for any SIC heading and are not classified, yet are being placed under many Class I specifications (SIC# 1499). According to the 1977 Amendment for SIC# 1400-1499, mines are stated to have a marketable product. This is certainly not the case with tourist gem mining. Vie are dealing with nothin{;more than small amounts of dirt. However, in the same 1977 Amendment, sewage treatment systems with a comparable gallon per day water flow are only required a monthly monitoring frequency and, I assume, there is chemical use involved in their processing procedure. Our previouspermit required monthly monitoring and I feel that this frequency is adequate due to the fact that Environmental Management personnel, who took responsibility for previous monitoring, chose to test our water only -rjo to three times yearly, Monthly testing would be a frequency increase of 100% to 200% over previous years. As the draft requirements now stand there would be an increase of testing by greater than 900`x. Contrary to a seemingly popular opinion, we are small, privately operated busi- nesses, who realize little profit. We are simply an attraction which draws a sizable tourist trade into the mountains of Viestern North Carolina. As you are probably aware, the equipment r..:essary to preform the required tests is quite costly. We have been quoted a cost figure of $25.00 a week, by a man who has the equipment needed, for the preformance of our required tests. Obviously, $25.00 a month would be a more economically feasible figure. The weekly figure would cause hardship with our already overtaxed operating budget. In view of these facts, I feel that it is a reasonable request that the monitor- ing frequency be modified as stated in paragraph one and would greatly appreciate your prompt attention and consideration in this matter. Should your office decide to deny this request, I would appreciate a letter containing your reasons and justification for that decision. Sincerely,. There was no indication of toxicity; many "sensitive" organisms were present below the mines. However, the introduction of sediment bas reduced the amount of available substrate. This will impact both benthos and fish. A more severe reduction might have been observed in November, as some recovery would be expected before we made our collections. A biological survey of Caler Fork Creek was conducted on January 15, 1981. Three stations were established on Caler Fork Creek.. Following normal channels, the mines have two basic options. First, they can re -apply for the permits which have been revoked, either proposing new systems or improv=ed operation of the systems that are in place now. Such application pro- cedures -in effect provide time to work out any problems. The second option would be to put in the non -discharge systems which have been recommended. Since these are environmentally superior, they would insure thebestprotection of the streams, which are also part of the area's tourist attractiveness. I have been informed that a biological study of Cowee Creek is already underway in the Asheville Regional office. I am sure they will be happy to discuss the findings with local interest groups. The Division of Environmental Management has expressed a sincere commitment to have this worked out, both for the benefit of the tourist mining operations and for the enhancement of the environment in Macon County. Clean streams are also tourist attractions, and we have found that when ;the cost is reasonable, good wastewater management practices are always to be preferred. If there are any difficulties in getting this worked out, the mines should contact me to work out an acceptable course of action. Following normal channels, the mines have two basic options. First, they can re -apply for the permits which have been revoked, either proposing new systems or improved operation of the systems that are in place now. Such application pro- cedures in effect provide time to work out any problems. The second option would be to put in the non -discharge -systems which have been recommended. Since these are environmentally superior, they would insure the best protection of the streams, which are also part of the area's tourist attractiveness. I have been informed that a biological study of Cowee 'Creek isalready underway in the Asheville Regional Office. I am sure they will be happy to discuss the findings with local interest groups. The Division of Environmental Management has expressed a sincere commitment tohavethis worked out, both for the benefit of the tourist mining operations and for the enhancement of the environment in Macon County. Clean streams are also tourist attractions, and we have found that when the cost is reasonable, good wastewater: management practices are always to be preferred. The mines have been featured in numerous magazine articles and on several national television programs, bringing favorable publicity, not only to Franklin and Macon County, but to the whole State of North Carolina. We have met at some length with environmental engineers from the agency office in Asheville, and with the mine owners themselves. As the Chamber of Commerce for an area which is rich in natural beauty, we are strongly committed to protecting our unspoiled environment. For this reason, we have carefully weighed the facts presented by.the Division of.Environmental Management. For the past four years, the mines have been operating under permits to discharge wastewater. These permits were issued by the Division of Environmental Management. Recently, the permits were revoked because of the agency's contention that the mines have never consistently met the standards for suspended solids and turbidity set forth in the permits. Before the mines can re --open, they are being required to install closed systems, in which the wash water is circulated rather than being discharged into the receiving streams. ..Lie Honorable James B. Although a circulating system can be installed fairly inexpensively in some instances, in other cases the expense is prohibitive. Several facts have come to light during our investigation of this matter. One is that the mines have been monitored only one to three times a year, in a manner that the mine owners feel has been haphazard. Second, the guidelines being applied are based on "best engineering judgement", as there are no established regulations for tourist gem mines. Third, no background study or biological study of Cowee Creek has been done. There is some evidence that game fish and other aquatic life have not been disturbed by the operation of the mines. Fourth, there is no contention on the part of the Division of Environmental Management that the Little Tennessee Raver, into which Cowee Creek flows, is at all affected by the mines. Our recent meeting with the mine owners has convinced us of their good intentions. We feed that they, too, are concerned for the quality of the water, and wish to do all in their power to protect it. We were favorably impressed with the spirit of cooperation shown by the mine owners, who have recently formed an association under the aegis of the Chamber of Commerce. Our request is not that environmental standards be overthrown, but that the mine owners _be ,,granted an extension of time to prove that the present system of settling ponds can adequately handle the wastes discharged from their operations. (This waste is not chemical in nature, of course, but consists of dirt washed from the flumes where tourists search for gems.) We respectfully propose that this extension be granted for one year, during which time the mine owners, through their newly formed minelassociation, will themselves provide for regular, standardized monitoring (to be done under contract). We also suggest that a biological study of the stream be done during this time to assess the effect, if any, of the mines on aquatic life in Cowee Creek. This proposal will, we feel, provide a much more meaningful data base for future decisions than is now available. We are convincedl-that the mine owners are committed to making their present discharging systems work, and we would like to see them have the chance to do so. Unless the Cowee Valley mines are able to operate next summer, we fear that the Franklin area will face a bleak tourist season, and the effect will be felt in all other areas of Western North Carolina. As you can see, each letter is based upon the results of an inspection conducted of these facili. ties on August 7, 1980s in rich significant permit violations were documented, The specific violation(s) and permit conditions are detailed in each letter as either effluent Total Suspended Solids and/or Turbidity violations although direct bypassing of a wastewater treatment system.was observed for one mine. You should also note that each letter outlined that right of the discharger to contest this revocation.. Since no action of this nature was taken, revocation was effective fbr each permit during the week ending November 7, 1983. The Cowee Valley Ruby Mines are concentrated in an area subject to severe accumulation of stream pollutants. In order to minimize this condition and thereby enhance the quality of these waters,; these discharging wastewater treatment facilities serving the mines Faust he properly operated at all times, A review of sampling data and previous inspection reports on file in this office shows permit violations for each discharge in addition to 'those mea- cured during the August 7, 1983 inspection.. WATER MANAGEMENT WATER QUALITY GROUND WATER WATERWAYS & SEASHORE PLANNING I I recently had the opportunity to meet with many of the owners of tourist gem minesin the Macon County area, to discuss North Carolina's water pollution abatement laws and how they apply to ,the tourist gem mining industry. I am writing this letter to those of you with whom I met plus other mine owners of whom I am aware to confirm the main points discussed in our meeting.- General Statute 143-215 is North Carolina's principal water pollution control legislation. It requires that wastewater discharges to this State's surface waters, such as those coming from a mine, hold a Permit from this Office. In order to obtain a Permit from this Office, plans and specifications for,a wastewater treatment facility must be submitted to this Office for review and approval. Approval ' in the form of a Permit is granted only after,it has been determined that the proposed wastewater treatment facility will protect the receiving stream in accordance with this State's Water Quality Standards. Those portions of the Water Quality Standards which would apply to your gem mine are that the discharge to the receiving stream must have not more than 0.10 milliliters per`°liter settleable solids in thirty minutes and that the wastewater after complete mixing with the receiving stream must not increase the turbidity in that stream by an amount greater than 10 Jackson Turbidity Units. A simple settling pond of approximately 24 -hours detention time can meet the settleable solids limits. Meeting the turbidity standards depends on the size of the receiving stream available.._A mine discharging into a small stream the size of Coweeta Creek for example would probably have difficulty in meeting the turbidity limit with just a simple settling basin. For those mines whose wastewater is discharged to a small stream the most economical approach for providing adequate wastewater treatment facilities might be a losed system. In such a system the water .from. thew �-_ ash troughdischarged to a pond where the settleable solids drop out and the settled water returned by pump to the head of the wash trough. In this system no discharge to a stream takes place and therefore Water a Quality Standards6-rt-Q In addition to needing a,Permit from the North Carolina Office -'of Water and Air Resources to discharge treated wastewater it has been determined that the tourist gem mines require a Permit under the 1899 Refuse Act which is being administered by the Federal Environmental Protection Agency and the Army Corps of Engineers. Such a Permit will not be.issued until it has been determined that,,the mine is treating r its wastewater in accordance with North Carolina's water pollution control laws. General Statute 143-215 is North Carolina's principal water pollution control legislation. It requires that wastewater discharges to this State's surface waters, such as those coming from a mine, hold a Permit from this Office: In order to obtain a Permit from this Office, plans and specifications for a wastewater treatment facility must be submitted to this Office for review and approval. Approval in the form of a Permit is granted only after it has been determined that the proposed wastewater treatment facility will protect the receiving stream in accordance with this State's Water Quality Standards. Those portions of the Water Quality Standards which would apply to your gem mine are that the discharge to the receiving stream most have not more than 0.10 milli liters per'liter settleable solids in thirty minutes and that the wastewater after complete mixing with the receiving stream must not increase the turbidity in that stream by an amount. greater than 10 Jackson Turbidity Units. I hope my sketch will be adequate for plans. I recommend that a Permit be issued for the continued operation of this system with the following conditions among others: (1) Effluent 30 -minute Settleable Solids concentration will be less than 0.1 ml/l. (2) Discharge will not increase receiving stream turbidity by an amount greater than 10 Jackson Turbidity Units. (3) If at any time it is determined that the system will not protect.
