This permit shall be effective from the date of issuance until May 31, 1999, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. This permit shall be effective from the date of issuance until May 31, 1999, and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Environmental Management accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of the request will be considered on its merits and may or may not be approved. 5. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit,. the approved plans and specifications, and other supporting materials. Mail the Certification to the Water Quality Permits and Engineering Unit,P.O. Box 29535, Raleigh, NC 27626-0535. 1 6. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those actions that may be required by this Division, such as the construction of additional or replacement treatment or disposal facilities. 7. The Mooresville Regional Office, telephone number (704) 663-.1699, shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an in- place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 8. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-215.1 and in a manner approved by the North Carolina Division of Environmental Management. 9. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 10. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 11. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited 12. Freeboard in the "upslope pond shall not be less than two feet at any time. 13. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 14. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 15. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and deterioration, operator errors and discharges' which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available to the Division of Environmental Management or other permitting authority, upon request. 16. Any duly authorized officer, employee, or representative of the Division of Environmental Management may, upon presentation of credentials; enter and inspect any property, premises or place on or related to the recycle system at any reasonable time for the purpose of determining compliance with this permit, may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. 17. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205 (c)(4) 18. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c). 2 19. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, ruleg, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 20. A set of approved plans and specifications for, the subject project must be retained by the Permittee for the life of this project. 21. Noncompliance Notification: The Permittee shall report by telephone to the Mooresville Regional Office, telephone number (704) 663-1699, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin or tank, the known passage of a slug of hazardous substance through the facility, or any other unusual circumstances; b. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compressors, etc.; c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility; or d . Any time that self-monitoring information indicates that the facility is not in compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 22. Any groundwater quality monitoring, as deemed necessary by the Division, shall be provided. 23. The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in 15A NCAC 2L, Groundwater Classifications and Standards. The Compliance Boundary is for the disposal system constructed after December 31, 1983 is established at either (1) 250 feet from the waste disposal area, or (2) 50 feet within the property boundary, whichever is closest to the waste disposal area. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to immediate remediation action in addition to the penalty provisions applicable under General Statute 143-215.6A(a)(1). In accordance with 15A NCAC 2L, a REVIEW BOUNDARY is established around the disposal systems midway between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance of standards at the Review Boundary shall require remediation action on the part of the Permittee. 3 24. Upon classification of the facility by the Certification Commission, the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the Certification Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of Title 15A, Chapter 8A, .0202. 25. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. It should be noted that our additional information request was not sent to the applicant until after the ninety (90) day permitting deadline had expired. The package was first received by SERG on February 2, 1994. The Groundwater Section received the package for review on March 1, 1994 and a request for additional information was sent to SERG on March 8, 1994. The additional information letter to the applicant from SERG is dated May 24, 1994. On May 24, 1994, I received a phone call from Pat Shillington of Engineering & Environmental Science Company, the consulting firm for the applicant, and we discussed the request. At that time he informed me that Aspect Mineral was rather upset at the late additional information request as they were under pressure to start operations. These comments are presented due to a cooperative Regional Groundwater staff who rearranged their schedule in order to expedite these comments. After an on-site visit by the Regional Office, it was discovered that the nearby residence's water supply (a natural spring) is located in a different drainage divide and the recycle lagoon should not influence that supply. This fact plus the amount of land owned by the applicant, in all other directions, negate the need for monitoring wells. We recommend issuance of the permit with the following conditions: 1. Any groundwater quality monitoring, as deemed necessary by the Division, shall be provided. The spring serving the private residence on the adjacent property east of the Aspect Minerals plant is located in a different drainage divide. therefore it would be unlikely to receive any impact from activities occurring at Aspect Minerals. 2). The pond is located upgradient from the plant. Aspect Minerals owns and controls all of the property between the pond and the South Toe River. 3). It is questionable as to the existence of a water table above bedrock on this site. Groundwater monitoring of the bedrock aquifer may not be representative for assessing activities occurring on site, depending on the source of the recharge for the water bearing fracture. I recommend that the permit_ be issued with the standard clause that any ; groundwater monitoring, as deemed necessary by the Department, shall be provided. This report contains a discussion of the system, waste water characteristics, subsurface conditions and other pertinent information. Submitted with this report are the "Plans and Specifications". Following is brief discussion of the project. GENERAL DISCUSSION A recirculation system is proposed at the South Toe River Facility. This facility is located in Yancy County immediately north of Hwy 19 (see Figure No. 1 in Attachment A). This facility will process ore mined for mica and sand. This facility was formally known as Deneen Mica Company and the existing structures will be used for the processing of mica and sand. When the facility was operated by Deneen Mica Company, processing was conducted under a NPDES Permit. Water was pumped from the South Toe River to a pond upslope of the facility. The water then would drain by gravity to the mica processing facility. The washwater would be pumped to a series of ponds that are located on the opposite side of the South Toe River. As much a 1 MGD of water could be discharged back to the river (see Figure No. 1 in Attachment A). Instead of operation of the plant with the existing NPDES permit, a non -discharge (Recirculation Permit) is desired. This water will be recirculated back to the upslope pond. However, the wash water will be cleaned of fine colloidal clay prior to discharge back into the pond. An Enviroclear thickener and _vacuum drum filter are proposed to remove the colloidal clay sediments from the water. Since some water will coat the mica and sand or be trapped in the clay sediments, makeup water will be derived by pumping from the South Toe River. Page 2 Non -Discharge Permit (Recirculation System) South Toe River Plant Yancey County, North Carolina All of the existing plant facility equipment, including the various process water lines and _pumps will be used with the proposed recirculation system. However, some modifications of the facility will be required and will include: 1. Plugging the overflow pipe at the upslope pond. The overflow pipe presently discharges to the South Toe River. 2. Construction of ditches around the upslope pond to prevent upslope surface water runoff into the pond. Upslope stormwater runoff into the pond could cause overtopping of the pond embankment 3. Placement of Class A Erosion Control Stone at the water inlet to the pond 4. Verification, _through falling head permeability tests on undisturbed soil samples, that at least 1 ft. of the pond's surficial soils have a coefficient of permeability of at least 1X10-7 cm/sec. 5. Installation of a pump and pipe line to the clay thickening devices. The clay thickening devices will consist of and Enviroclear Thickener and a vacuum drum filter. 6. Construction of a containment pad for temporary deposition of the clay. The containment pad will also have a soil liner 1 ft. thick having a coefficient of permeability of at least 1X10-7 cm/sec. 7. Construction of a storm drain that leads from the containment pad to the upslope pond. The clay thickening devices also will be connected to the storm drain for discharge of the water from these devices to the pond. RECIRCULATION SYSTEM MATERIAL BALANCE It is estimated, based on past experience with areas excavated nearby, that approximately 40 percent of the material will consist of clay. At maximum production 600 lbs. of ore can be processed per min. and 240 lbs. of clay will be contained in the water. For continuous process with three (3) shifts, 432 tons of ore can be processed with 172.8 tons of clay (dry) produced. The clay washwater (clay at 4 to 5 percent solids) will be pumped through a 6 -inch approximately 420 ft. long Schedule 80 pipeline to an Enviroclear Thickener. Prior to entering the thickener, 62S Page 3 Non-Discharge Permit (Recirculation System) South Toe River Plant Yancey County, North Carolina Nalco 8873 Flocculant will be added at a rate of 0.3 pounds per ton of clay or at approximately 0.12 lbs. of flocculant per minute or 51.84 lbs. of flocculant per day (3 shifts). The clay is brought to approximately 20 percent solid and then pumped to a vacuum drum filter where the clay is increased to 60 percent solids. The clay is then temporarily stored in a containment.area inwhich direct contact with precipitation drains to a surface drain. The surface drain connects to the pond by a 1 ft. diameter concrete pipe. The clay will be appropriately disposed in accordance with DEM and Solid Waste Management Regulations. Recirculation water will be lost due to water coating the mica and sand particles and also from the water left in the clay. Based on water balance calculations (see Attachment B) approximately 24.5 gallons/mina or 35,280 gallons per day (3 shifts) will need to be made up by pumping from the river. WASHWATER CHARACTERISTICS In addition to utilizing Nalco 8873 Flocculant, Nalco 8852 Coagulant and Nalco 3D4147. A mine Flotation Aid will be used during the watersortingof the mica, sand and clay (see Attachment C for Material Safety Data Sheets). Based on past operation of this facility, and other nearby facilities, the. water will have BOD, COD and TOC of less than 10 mg/1 due to the small quantities of material used. The Total Solids in the water after treatment and discharge into the pond will be no more than100mg/1. The Nalco produces will general adhere to the clay particles and will be removed with the clay. SUBSURFACE CONDITIONS Figure No. 3 in Attachment D shows the generalbedrockmaterials in the vicinity of the facility. Bedrock materials generally consist of layers and bands of Hornblene gneiss and schist and mica gneiss and schist. A dike runs through the site in a northeast to southwest direction (see Figure 3 in Attachment D). To further evaluate the subsurface conditions, on January 20, 1994, the subsurface conditions were observed by a-Geotechnical Engineer. Since 20 ft. to 40 ft. steep cuts were observed east of the pond and below the pond, no soil boring were conducted. South Toe River Plant Yancey County, North Carolina In general, the exposed soils predominantly consisted of a micaceous silty sandy CLAY (CL). However, at a few locations as noted on Figure No. 4 in Attachment D, micaceous silty SAND (SM) zones and hard rock were exposed. Where the rock was exposed, moisture seepage was noted. Seepage was not observed at other locations: Based on the site observations, it appears that ground water will be at least 4 ft. below the existing pond and the containment pad. Any water infiltrating these areas would travel in a South -Western direction and eventually daylight where the rock is exposed at lower ground levels. It is estimated that the CLAY has a coefficient of permeability near 1 x 10-6 cm./sec. The SAND zones are estimated to have a coefficient of permeability ranging from 1 x 10-4 cm. /sec. to 1 x 10-.5 cm. /sec SURFACE WATER RUNOFF Surface water runoff from the plant area will eventually drain.to the South Toe River. However, direct precipitation on the pond and containment area will be contained within the recirculation system. Based on ,review of information at the Yancey County Government offices, the plant is outside of the 100 -year flood plain limits. SYSTEM EVALUATION The evaluation of the system includes those areas of the existing plant that require modifications. More than likely there will be other plant modifications, since this plant has not been in operation for nearly two (2) years and several existing plant components may not be `repaired. As these modifications become apparent, as -built drawings and designevaluations will be provided. Following is a brief discussion of these evaluations with any needed design calculation provided in the Attachments. Pond The pond will serve as a constant supply of water to the plant. On January 20, 1994, the spot evaluations of the pond were taken with a level, and distances were conducted with a tape. Based on these measurements, the pond has an average depth of 7.5 ft. and a volume of approximately 472,060 gallons. Minor pond modifications will include stabilization of the water inlet area of the pond and plugging the overflow pipe that discharges directly to South Toe 62 Page 5 Non -Discharge Permit (Recirculation System) South Toe River Plant Yancey County, North Carolina River. If the pond does not have adequate low permeable soils, a new soil clay liner system also will need to be constructed for the pond. In-place testing can be conducted to verify soil permeability adequacy. At least 1 ft. of the pond's surf icial soil should have a coefficient of permeability of the 1 x 10-7 CM. /Sec. or slower. Approximately five (5) acres of upslope land presently drain to the pond.To ensure a non -discharge recirculation system, perimeter ditches will be constructed to pass at least the 50 -year rain event around the pond. The west ditch will be a grassed trapezoidal channel while the east ditch will be v -shaped -and lined with Class A Erosion Control Stone. Attachment E contains the ditch design calculations. Recirculation Pump and Pipe Line A new pump and approximately 420 lineal feet of new pipe line will be required to take the process water from the plant to the clay thickener, system. The pipe will consist of a 6 -inch diameter Schedule 80 PVC. At a flow rate of 700 gpm and an elevation head of 85 ft., the total dynamic system head will be 99.0 ft. Attachment F contains the system head calculations. Clay Thickener System The clay thickener system will consist of an Enviroclear Thickener and a vacuum drum filter. In evaluation of the effectiveness of this system, the laboratory report prepared by Mr. Gary L. Nelson and dated February 24, 1987 was used. The area used for these evaluations will be the same source as at the South Toe River Plant. The laboratory tests indicated scale -up rates of 2.5 to 3.5 gpm/ft.2 for the Enviroclear thickener. At a flow rate of 700 gpm, the diameter of the thickener will need to be at least 20 ft. Addition of 0.3 lbs. of floculant per one (1) ton of dry clay soil will be required. The vacuum drum filter was based on the Buchner funnel test performed by Mr. Nelson. At a vacuum of 20 to 25 inches of mercury, submergence of 30%, and a clay load rate of 240 lbs./min., the surface area of the drum will need to be at least 1,100 ft.2. It' is estimated that the clay solid will be 60% after treatment. The calculations are contained in Attachment G. Attachment G also contains a general schematic of the Enviroclear system. 62s Page 6 Non -Discharge Permit (Recirculation System) South Toe River Plant Yancey County, North Carolina Containment Area The clay thickener system and temporary storage of the clay will be within`a 50 ft. by 100 ft. pad having a 1 ft. soil liner with a coefficient of permeability of at least 1 x 10-7 cm./sec. Perimeter berms will be constructed around the containment system to divert upslope runoff around the system, and to collect direct precipitation that will drain through a collection system back to the pond. The primary equipment required for the ,process will include a high capacity thickener and a filter for solids concentration. It was necessary for the clay thickening and filtration processes be evaluated in the pilot plant for equipment and proc- ess verification, optimization, and scale -up. A 3.5 inch diam- eter Enviroclear high capacity thickener wasprovidedby Mr. Archie Brumfield of.M. S. French Company,' Inc., Palmetto, Flo- rida, to evaluate the thickening process. A laboratory Buchner funnel was used to evaluate the filtration process'. Summary: Utilizing a 3.5 inch diameter Enviroclear high capacity thickener and Nalco 8873 polymer to set le a representative clay slurry, scale -up rates of 2.5`-3.5 gpm/ft were achieved. Using the assumed plant production rates, a`high capacity thickener di- ameter of -35 feet would be required with a polymer dosage re- quirement of 0.3 pounds per ton. The project allows for a 60 foot diameter thickener and a polymer dosage requirement of 0.33 pounds per ton. A filtration rate of 58.9 lb/hr/ft2 was calculated from data using a 12.5 CM diameter Buchner funnel and 1.0;cfm,,filter cloth. Based 2on the assumed plant production rates, approxi- mately 564 ft of filt?tion area would be required. The project allows for over 600_ft of area. Procedure and Results: Two 55 -gallon drums ofclay were received from North Caro- lina --one from KMG Minerals located in King's Mountain and one from Deneen Mica Company located near Micaville. The Deneen-Mica: sample contained slurry produced from the tolling of ore from J. M. Huber`s King's Mountain, reserves and represented clay; benefi- ciated from shallow, excavations (less than ,40 feet of depth). The KMG Minerals sample contained slurry produced from theirown ore mined from depths probably exceeding 40 feet. The 3.5 inch diameter Enviroclear high capacity thickener was set-up, demonstrated, and then left with the pilot plant for a two week period by Mr. Brumfield to allow for extensive trials. A schematic of the Enviroclear unit is shown in Figure I. Peris- taltic pumps were used for motoring all streams. Nalco 8873 po- lymer was used in solutions of 0.05-0.1%.as a flocculant settling aid. A series of trials were performed using each clay slurry. Each trial` consisted of selecting a desired slurry feed .rate, op- timizing the polymer dosage rate to achieve a stable floc, and achieving a consistent bed level in the thickener by pumping the underflow at a steady; rate. Once this was accomplished, all per- tinent flow rates were recorded and samples taken to determine solids content. Results from the various trail are shown in Ta- ble I. The value pertinent to scale -up, gp5/ft was computed based on the correlation that one gpm/ft is equal .to each 250 ml/min of feed rate. The results indicated a throughput range of gpm/ft2could be used for scale -up. From this value, based on projected `clay `production, a required thickener size of 35 feet is diameter was calculated. The polymer dosage requirements was calculated at 0.3 pounds per ton of clay based on average data from the trials'. Calculations to support these results are shown in Appendix I. Filtration requirements for the project were determined by filtering clay underflow from the thickener thru a 12.5 CM'diam- eter Buchner funnel using 10 cfm filter cloth. Several trials were conducted on both clay slurries adjusting process; variables to ;optimize the rate. The results from the trials are shown in Table II. Trials 1--8 were .used to determine the optimum feed slurry batch quantity of 200 ml. Trials 9-14 were ,used to deter- mine the ,optimum filtration time of 120 seconds. Trials 15-20 were used to determine the average; cake solids for each clay. The fina results were used to calculate a`filtration rate of q5 lb/hr/ft requiring a' filtration area of approximately 563.6 ft The calculations are shown in Appendix II.' Gary L.
