Dear Permittee:
On July 31, 1995 the Division of Environmental Management issued you
the subject permit. One of the conditions of the subject permit read as
follows:
Upon completion of construction and prior to operation of this permitted
facility, a certification must be received from a professional engineer
certifying that the permitted facility has been installed in accordance
with the requirements of this permit and the approved plans and
specifications. Mail certification to the Permits and Engineering Unit,
P.O. Box 29535, Raleigh, N.6., 27626-0535.
To date, our records show that no certification has been received for the
subject permit. If the permitted facility has been constructed and placed into
operation please submit the required certification immediately. Operation of
the treatment system prior to submission of the required certification is in
violation of your permit and is subject to enforcement action. If. you have any
questions, please contact your consulting engineer for this project, . If the
facility has not been constructed, please contact the Asheville Regional Office
at (704)251-6208, so that they can update their records.

WQ0011261, dated July 31, 1995, to Mr. Michael Jaynes for the construction and operation of the subject
recycle system.
This permit shall be effective from the date of issuance until June 30, 2000, and shall be subject to
the conditions and limitations as specified therein. Please pay particular attention to the monitoring
requirements in this permit. Failure to establish an adequate system for collecting and maintaining the
`required operational information will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of
this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North
Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447,
Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

construction and operation of a 4,800 GPD recycle system consisting of a 50 foot flume line, a 2' x 5' x 2'
settling tank, and a 9'x 20'x 10' recycle tank with pumps, to serve Linville Mountain Gem Shop, with no
discharge of wastes to the surface waters, pursuant to the application received July 3, 1995, and in
conformity with the project plan, specifications, and other supporting data subsequently filed and
approved by the Department of Environment, Health and Natural Resources and considered a part of this
permit.
This permit shall be effective from the date of issuance until June 30, 2000, and shall be subject to
the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in accordance with,
the conditions of this permit, the approved plans and specifications, and other supporting
data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of the request will be considered on its merits and may or may
not be approved.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those
actions that may be required by this Division, such as the construction of additional or
replacement treatment or disposal facilities.
The Asheville Regional Office, telephone number (704) 251-6208, shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an in-place
inspection can be made. Such notification to the regional supervisor shall be made during
the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday,
excluding State Holidays.
7. The residuals generated from these treatment facilities must be disposed in accordance with
General Statute 143-215.1 and in a manner approved by the North Carolina Division of
Environmental Management.
8. The issuance of this permit shall not relieve the Permittee of the responsibility for damages
to surface or groundwaters resulting from the operation of this facility.
9. The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resulting from the operation of this facility.
10. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
11. Any monitoring deemed necessary by the Division of Environmental Management to insure
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.
12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
13. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall maintain an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken by
the Permittee. This log of inspections shall be maintained by the Permittee for a period of
three years from the date of the inspection and shall be made available to the Division of
Environmental Management or other permitting authority, upon request.
14. Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the recycle system at any reasonable time for the purpose
of determining compliance with this�permit, may inspect or copy any records that must be
maintained under the terms and conditions of this permit, and may obtain samples of
groundwater, surface water, or leachate.
15. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205
(c)(4)
16. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c).
17. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.

18. Noncompliance Notification:
The Permittee shall report by telephone to the Asheville Regional Office, telephony
(704) 251-6208,as soon as possible, but in no case more than 24 hours or on Ult, 11LIAL
working day following the occurrence or first knowledge of the occurrence of any of the
following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such as
the dumping of the contents of a basin or tank, the known passage of a slug of
hazardous substance through the facility, or any other unusual circumstances;
b. Any process unit failure, due to known or unknown reasons, that renders the facility
incapable of adequate wastewater treatment, such as mechanical or electrical failures of
pumps, aerators, compressors, etc.;
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass
directly to receiving waters without treatment of all or any portion of the influent to
such station or facility; or
d. Any time that self-monitoring information indicates that the facility is not in compliance
with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.
19. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted, will extend the permit for such period of time
and under such conditions and limitations as it may deem appropriate.

PART IV - EVALUATION AND RECOMMENDATIONS
The wastewater treatment facility is to serve a tourist gem mine. There will be no
discharge of wastewater to surface waters and since the waste material is primarily
dirt, rocks and water and the the wastewater treatment system is a closed loop
there should be no groundwater contamination.
We might like to obtain pump information so that we will have it on file.
It is recommended that a permit be issued.

Per a request made on December 18, 2006, the Division of Water Quality is rescinding the subject recycle
system permit. In accordance with NC State Administrative Code 15A NCAC 02T, effective September,
1, 2006, the recycle system at Linville Mountain Gem Shop meets the requirements of Section .1003(a) .
for systems to be deemed permitted. The recycle system at Linville Mountain Gem Shop is not required
to apply for future permit renewals or modifications provided that the facility continues to comply with
the requirements of 15A NCAC 02T .1000.
Please be advised that NC State Administrative Code 15A NCAC 02T .1003(a)' requires that a Spill
Control Plan be maintained for the Facility. The Spill Control Plan shall at a minimum addresses the
following items.
a. Contact phone numbers for 24-hour response, including weekends and holidays;
b. Contact phone number for the Division of Water,Quality Regional Office;
C. .Contact information for construction crews, contractors and/or engineers;
d. Expected response times;
e. Essential equipment list and spare parts inventory;
f. Location of clean up materials;
g. Site sanitation procedures; and
h. Post -response assessment and reporting.

The facility serves a tourist gem mine. There is no discharge from the
existing facility to surface waters.. The facility is a closed loop with
collection of inert materials in the settling basins. There should be no

WQ0011261, dated July 31, 1995,'to Mr. Michael Jaynes for the construction and operation of the subject
recycle system.
This permit shall be effective from the date of issuance until June 30, 2000, and shall be subject to
the conditions and limitations as specified therein. Please pay particular attention to the monitoring
requirements in this permit. Failure to establish an adequate system for collecting and maintaining the
required operational information will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of
this permit. This request must be in the form of a written petition, conforming to Chapter_150B of North
Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447,

RECYCLE SYSTEM PERMIT
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction and operation of a 4,800 GPD recycle system consisting of a 50 foot flume line, a 2' x 5' x 2'
settling tank, and a 9'x 20'x 10' recycle tank with pumps, to serve Linville Mountain Gem Shop, with no
discharge of wastes to the surface waters, pursuant to the application received July 3, 1995, and in
conformity with the project plan, specifications, and other supporting data subsequently filed and
approved by the Department of Environment, Health and Natural Resources and considered a part of this
permit.
This permit shall be effective from the date of issuance until June 30, 2000, and shall be subject to
the following specified conditions and limitations:
1. This permit shall become voidable' unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other supporting
data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of the request will.be considered on its merits and may or may
not be approved.
5.. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those
actions that may be required by this Division, such as the construction of additional or
replacement treatment or disposal facilities.
6. The Ashevill: i;egional Office, telephone number (70-, -51-6208, shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an in-place
inspection can be made. Such notification to the regional supervisor shall be made during
the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday,
excluding State Holidays.
7. The residuals generated from these treatment facilities must be disposed in accordance with
General Statute 143-215.1 and in a manner approved by the North Carolina Division of
Environmental Management
8. The issuance of this permit shall not relieve. the Permittee of the responsibility for damages
to surface or groundwaters resulting from the operation of this facility.
9. The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resulting from the operation of this facility.
10. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
11. Any monitoring deemed necessary by the Division of Environmental Management to insure
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.
12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
13. The Permittee or his, designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall maintain an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken by
the Permittee. This log of inspections shall be maintained by the Permittee for a period of
three years from the date of the inspection and shall be made available to the Division of
Environmental Management or other permitting authority, upon request
14. Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the recycle system at any reasonable time for the purpose
of determining compliance with this permit, may inspect or copy any records that must be
maintained under the terms and conditions of this permit, and may obtain samples of
groundwater, surface water, or leachate.
15. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205
(c)(4)
16. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c).
17. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.

18. Noncompliance Notification:
The Permittee shall report by telephone to the Asheville Regional Office, tel(
(704) 251-6208, as soon as possible, but in no case more than 24 hours
working day following the occurrence or first knowledge of the occurrence of any of the
following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such as
the dumping of the contents of a basin or tank, the known passage of a slug of
hazardous substance through the facility, or any other unusual circumstances;
b. Any process unit failure, due to known or unknown reasons, that renders the facility
incapable of adequate wastewater treatment, such as mechanical or electrical failures of
pumps, aerators, compressors, etc.;
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass
directly to receiving waters without, treatment of all or any portion of the influent to
such station or facility; or
d. Anytime that self-monitoring information indicates that the facility isnot in compliance
with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.
19.�. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted, will extend the permit for such period of time
and under such conditions and limitations as it may deem appropriate.

Dear Representative Hunter:
Thank you for your interest in addressing the concerns of your constituent, Mr. David
Jaynes of Marion, North Carolina, about the need to obtain a water quality permit for the
rock shop he is opening for his son. Your letter to Henry Lancaster, Director of Public
Affairs for the Department of Environment, Health and Natural Resources, was referred to
me for a response.
Mike Parker of the Asheville Regional Office met with Mr. Jaynes and his son on June
14, 1995, and advised them that there was a permit requirement to operate a flume line and
screening operation. He also advised them that the Division of Environmental Management
(DEM) had determined that sediment from the screening operation was in fact a pollutant
and, therefore, considered wastewater. I have enclosed the section of the state's
administrative code which includes the definitions that apply in this case and are stipulated
in G.S. 143-213 (18). The attached and referenced statute defines "other waste" as
sawdust, shavings, lime, refuse, offal, oil, tar chemicals, dissolved and suspended solids,
sediment, etc.
On June 15, 1995, Mr. Parker returned to Mr. Michael Jaynes' business and delivered
a copy of the rules (15 NCAC 2H .0200 - Waste Not Discharged to Surface Waters) and a
permit application for recycle facilities. Mr. Parker helped Mr. Jaynes complete the
application, which is the only recycle permit application the Division has for all types of
recycle systems, and marked on the application which sections would apply to his
operation.
Both Mr. Michael Jaynes and Mr. David Jaynes indicated that they did not think the
flume water should be considered wastewater, and they did not think a permit was
necessary. Mr. Parker explained the definitions and requirements for the permit and noted
that about 20 operations of this type are already under permit with DEM. On June 20,
1995, Mr. Parker mailed Mr. Michael Jaynes excerpts of the general statutes, including the
definitions, so he could see that sediments and solids are defined as pollutants.

(24) "Petroleum product" means all petroleum products as defined by G.S. '143-215.94A(7) and includes

motor oils (new and used).
(25) "pollutant*" means waste as defined in G.S. 143-213(13).
(26) "Private sewer" me= any part of a sewer system which collects wastewater from more than -.one
building, is privately owned and is not directly controlled by a public authority.
(27) "Professional -engincerm, means a person who. is presently registered and licensed as a professional
engmcar by the North Carolina, State Board of Registration For Professional Engine= and Land
Surveyors.
(28) -Public or community sewage sy3tCMx MWM a single system of sewage collection, treatment, or
di4msal owned and operated by a sanitary district, a metropolitan sewage; . district, a water and sewer
authority, a county, a municipality, ar.a, public utility.
(29) 'Public sewer" means a sew" located in a dedicated public street, roadway, or dedicated public
right-of-way or easement which is owned or operated by any municipality, county, water or sewer
district, or any other political subdivision of the state authorized to construct or operate a sewer
system,
(30) "Rapid infiltration system" mean- rotary distributorsystems or other similar systems that dispose of
tertiary treated waste at high surface area loading rates of greater than 1.5 gpdtfe.
(31) "Residuals" means any solid or semisolid waste, other than residues from agricultural products and
processing genctrated from a wastewater ointment facility, water supply treatment facility or air
pollution control facility permitted under r. the authority Of the EUVItOnmental'Management
Commission.,
(32) "Residues: from agricultural products. and pracessingo means solids, semi-solids or liquid residues
from food and beverage processing and handling; silvicultuM agriculture; and aquaculture Operations
permitted under the authority of the Environmental Management Commission that are non-toxic,
non -hazardous and contain no domestic wastewater.
(33) 'Sewage" means the liquid and solid human waste, and liquid . viewtic generated by domestic
water -using fixtures and appliances, from any residence, pinec of business, or place of public
assembly. Sewage does not include wastewater that is totally or partially industrial wastewater, or
any other wastewater not considered to be domestic waste..
(34) "Sewer system" mom pipelines or conduits, pumping stations, specialized mode of conveyance and
appliances apputtanant thereto, used for conducting wastes. to a point of ultimate disposal.

143-212. Definitions.
Unless a different meaning is required by the context, the following definitions apply to this
Article and Articles 21A and 21B of this Chapter:
(1) "Area of the State" means a municipality, a county, a portion of a county or a municipality, or
other substantial geographic area of the State designated by the Commission.
(2) "Commission",means the North Carolina Environmental Management Commission.
(3) "Department" means the Department of Environment, Health, and Natural Resources.
(4) "Person" includes individuals, firms, partnerships, associations, institutions, corporations,
municipalities and other political subdivisions, and governmental agencies.
(5) „Secretary" means the Secretary of Environment, health, and Natural. Resources.
(6) "Waters". means any stream' river, brook, swamp, lake, sound, tidal estuary, bay, creek,
reservoir, waterway, or other body or accumulation of water, .whether surface or underground, public
or private, or natural or artificial, that is contained in, flows through, or borders upon any portion of
this State, including any portion of the Atlantic Ocean over which the State has jurisdiction.

Editor's Note. - Session Laws 1989 (Reg. Sess., 1990), C. 954, effective July 18, 1990, and expiring
July 1, 1991, provides in s. 1: "Except as provided in Section 2 of this act and notwithstanding the
provisions of G.S. 153A-285, G.S. 153A-287, or any other provision of law, no entity whether public
or private, or whether acting separately or jointly may divert any of the waters of this State, as
defined in G.S. 143-212(6), from the basin of any named river to another nor institute any proceeding
in the nature of eminent domain to acquire water, water rights, or lands having water rights attached
thereto for a use that will result in waters of this State being diverted from the basin of one named
river to another."
Sections 2 and 3 of Session Laws 1989. (Reg. Sess., 1990), c. 954 describe those diversions not
affected by the prohibitions in section 1 of the act, and sections 4 to 6 relate to construction of the act.
A former 143-212 was repealed by Session Laws 1973, c. 1262, s:. 23.
Effect of Amendments. - The 1991 (Reg. Sess., 1992) amendment, effective July 24, 1992, deleted
"applicable to Article" at the end of the catchline, and substituted the present introductory paragraph
for the former which read: "The following definitions apply to this Article."
143-213. Definitions.
Unless the context otherwise requires, the following terms as used in this Article and Articles 2 1 A
and 21B of this Chapter are defined as follows:
(1) The term "air cleaning device" means any method, process or equipment which removes,
reduces, or renders less noxious air contaminants discharged into the atmosphere.
(2) The term "air contaminant" means particulate matter, dust, fumes, gas, mist, smoke, or vapor
or any combination thereof.
(3) The term "air- contamination" means the presence in the outdoor atmosphere of one or more
air contaminants which contribute to a condition of air pollution.
(4) The term "air contamination source" means any source at, from, or by reason of which there is
emitted into the atmosphere any air contaminant.
(5) The term "air pollution" shall mean the presence in the outdoor atmosphere of one or more air
contaminants in such quantities and duration as is or tends to be injurious to human health or welfare,
to animal or plant life or to property or that interferes with the enjoyment of life or property.
(6) to (8) Repealed by Session Laws 1987, c. 827, s. 153.
(9) Whenever reference is made in this Article to the "discharge of waste," it shall be interpreted
to include discharge, spillage, leakage, pumping, placement, emptying,.or dumping into waters of the
State, or into any unified sewer system or arrangement -for sewage disposal, which system or
arrangement in turn discharges the waste into the waters of the State.
(10) The term "disposal system" means a system for disposing of waste, and including sewer
systems and treatment works.
(11) Repealed by Session Laws 1987, c. 827, s. 153.
(12) The term "emission" means a release into the outdoor atmosphere of air contaminants_
(13) The term "outlet" means the terminus of a sewer system, or the point of emergence of any
waste or the effluent therefrom, into the waters of the State.
(14) Repealed by Session Laws 1987, c, 827,,s. 153.
(15) The term "sewer system" means pipelines or conduits, pumping stations, and force mains,
and all other construction, devices, and appliances appurtenant thereto, used for conducting wastes to
a point of ultimate disposal.
(16) The term "standard" or "standards" means such measure or measures of the quality of water
and air as are established by the Commission pursuant to G.S. 143-214.1 and G.S. 143-215.
(16a) "Stormwater" means the flow of water which results from precipitation and which occurs
immediately following rainfall or a snowmelt.
(17) The term "treatment works" means any plant, septic tank disposal field, lagoon, pumping
station, constructed drainage ditch or surface water intercepting ditch, incinerator, area devoted to
Sanitary landfill, or other works not specifically mentioned herein, installed for the purpose of
&eating,.equalWng, neutralizing, stabilizing orddlsposing of waste.
(18) "Waste" shall: -tnean and include the�following:
a. "Sewage," which shall mean water -carried human waste discharged, transmitted, and
collected from residences, buildings, industrial establishments, or other places into a unified
sewerage system or an arrangement for sewage disposal ora group of such sewerage arrangements or
systems, together with such ground, surface, storm, or other water as may be present.
b. "Industrial waste" shall mean any liquid, solid, gaseous, or other waste substance or a
combination thereof resulting from any process of industry, manufacture, trade or business, or from
the development of any natural resource.
c. "Other waste" means sawdust, shavings, lime, refuse, offal, oil, tar chemicals, dissolved and
suspended solids, sediment, and all other substances, except industrial waste, sewage, and toxic
chemicals which may be discharged into or placed in such proximity to the water that drainage
therefrom may reach the -water.
d. "Toxic waste" means that waste, or combinations of wastes, including disease -causing
agents, which after discharge and upon exposure, ingestion, inhalation, or assimilation into any
organism, either directly from the environment or indirectly by ingestion through food chains, will'
cause death, disease, behavioral abnormalities, cancer, genetic mutations, physiological malfunctions
(including malfunctions in reproduction) or physical deformities, in such organisms or their
offspring. i
(19) The term "water pollution" means the man-made or man -induced alteration of the chemical,
physical, biological, or radiological integrity of the waters of the State, including, but specifically not
limited to, alterations resulting from the concentration or increase of natural pollutants caused by
man -related activities.
(20) Repealed by Session Laws 1987, c. 827, s. 153.
(21) The term "watershed" means a natural area of drainage, including all tributaries contributing
to the supply of at least one major waterway within the State, the specific limits of each separate
watershed to be designated by the Commission.
(22) The term "complex sources" means any facility which is or may be an air pollution source or
which will induce or tend to induce development or activities which will or may be air pollution
sources, and which shall include, but not be limited to, shopping centers; sports complexes; drive-in
theaters; parking lots and garages; residential, commercial, industrial or institutional developments;
amusement parks and recreation areas; highways; and any other facilities which will result in
increased emissions from motor vehicles or stationary sources.
(23) The term "effluent standards or limitations" means any restrictions established pursuant to
this Article on quantities, rates, characteristics and concentrations of chemical, physical, biological
and other constituents of wastes which are discharged from any pretreatment facility or from any
outlet or point source to the waters of the State.
(24) The term "point source" means any discernible, confined, and discrete conveyance,
including, but specifically not limited to, any pipe, ditch, channel, tunnel, conduit, well, discrete
fissure, container, rolling stock, or concentrated animal -feeding operation from which wastes are or
may be discharged to the waters of the State.
(25) The terns "pretreatment facility" means any treatment works installed, for the purpose of
treating, equalizing, neutralizing or stabilizing waste from any source prior to discharge to any
disposal system subject to effluent standards or limitations.
(26) The term "pretreatment standards" means effluent standards or limitations applicable to
waste discharged from a pretreatment facility.

I received.from Mr. David Jaynes, a good friend and
constituent from Marion, North Carolina.
David has written concerning a problem he is having in
starting up a new business. The main question appears to be
whether or not there is a legal requirement for a permit from
your department for this type operation and if so, why.
Based on David's letter, I do not understand why one would be
required. I would appreciate your reviewing his letter and
seeing if you can be of assistance.

Dear Mr. Hunter:
I am in the process of opening a rock shop for my son Michael. This shop
is located approximately 1/4 mile south of Linville Caverns, on Highway 221.
Michael will be cutting natural gemstones and mounting them in rings,
pendants, earrings etc. In order to draw additional customers, we have
built a flume line. This consists of water flowing down a wooden trough,
providing customers a means to wash dirt away form "potential" gemstones.
This is done by putting dirt into a 4"x12"x12' open topped, screened bottom
box and dipping it into the flowing -water.
Having said all of the above, I will tell you my problem.
A gentleman from the North Carolina Department of Environment, Health
and Natural Resources stopped by (having seen the flume line while traveling
up 221) and said we would need a permit from his department in order to
open the shop. He left us a permit application. Directions in the application
as well as in the pamplet explaining the application do not apply to this type
of facility. The application is for waste recycling.
There is no waste involved in this process. Water is pumped from our well into
a large tank-gothing goes into any stream or onto the ground. Everything is
self-contained. It is very similar to a swimming pool slide. The dirt is also
reused. (See drawing)
Bob, I can see no relavance to the operation of a recreational, self-contained
flume line of this type and any kind of adverse environmental situation..
Nothing is taken from the ground or streams and nothing is allowed to go into
the ground or into a stream. I welcome anyone to check the shop for any problems
that could possibly be considered as environmentaly unsound.
The application and regulations that we received were prepared for sewer
systems, disposal of farm animal waste etc. This is a recreational, non -industrial,.
non-comerical, non -waste water, non-domestic, non -applicable activity.
The application requires that we sign a statement of truth to the best of
our ability etc. However, the state Environmental Representative took the
liberty of inserting information into some of the fill in spaces which would
lead the reader to believe something that is not applicable.(See copy of application,
Bob, I don't want you to spend a lot of time on this but I feel we
are being inaccurately included in their regulation.as it now exists.
Nothing applies. I would like to have a copy of a relevant regulation.
(See the attached copy from the pamplet we received) indicating activities
requiring permits. I cannot help but feel that this man is -trying to
justify his employment.

(36) "Soil remediation at minimum rates" means the treatment of soils containing petroleum products by
land application methods, at an evenly distributed application thickness not to exceed an average of
one inch.
(37) "Soil scientist" means as individual who is a Certified Professional in Soils through the NCRCPS
(N.C. Registry of Certified Professionals in Soils) or a Certified Professional Soil Scientist or Soil
Specialist by ARCPACS (American Registry of Certified Professionals in Agronomy, Crops and
Soils) or a Registered Professional Soil Scientist by NSCSS (the National Society of Consulting Soil
Scientist) or can provide documentation that he/she meets the minimum education and experience
requirements for certification or registration by one or more of the organizations named in this
Subparagraph or upon approval by the Director, an individual with a demonstrated knowledge of Soil
Science.
(38) "Staff" means the staff of the Division of Environmental Management, Department of Environment,
Health, and Natural Resources.
(39) "Subsurface ground absorption sewage disposal system" means a waste disposal method which
distributes waste beneath the ground surface and relies primarily on the soil for leaching and removal
of dissolved and suspended organic or mineral wastes. Included are systems for public or community
sewage systems and systems which are designed for the disposal of industrial wastes. Land
application systems utilizing subsurface residual injection are not included.
(40) "Surface waters" means all waters of the state as defined in G.S. 143-212 except underground
waters.
(41) "Toxicity test" means a test for toxicity conducted using the procedures contained in 40 CFR 261,
Appendix II which is hereby incorporated by reference including any subsequent amendment's and
editions. Copies of this publication are available from the Government Institutes, Inc., 4 Research
Place, Suite 200, Rockville, MD 20850-1714 for a cost of thirty-six dollars ($36.00) each plus four
dollars ($4.00) shipping and handling. Copies are also available for review at the Division of

(42) "Treatment works or 'disposal system which does not discharge to surface waters" means any
treatment works, facility or disposal system which is designed to:
(a) operate as closed system with no discharge to waters of the state, or
(b) dispose/utilize of wastes, including residuals, residues, contaminated soils and animal waste, to the
surface of the land, or
(c) dispose of wastes through a subsurface absorption system. '
(43) "Waste oil" means any used nonhazardous petroleum product other than crankcase oil. Crankcase
oil mixed with other used nonhazardous petroleum products will be considered as waste oil.

—T-kvo- sets of detailed plans and specifications signed and sealed by a North Carolina
Professional Engineer. The plans must include a general location map, a site map which
indicates where any borings or hand auger samples were taken, along with buffers,
structures, and property lines. Each sheet of the plans and the first page of the specifications
must be signed and sealed.
d. For industrial wastewater, a complete chemical analysis of the typical. wastewater
must be provided. The analysis may include, but shall not be limited to, Total Organic
Carbon, BOD, COD, Chlorides, Phosphorus, Nitrates, Phenol, Total Trihalomethanes,
TCLP analysis, Total Halogenated Compounds, Total Coliforms, and Total Dissolved
Solids.
e. If lagoons are a part of the facilities and the recycle water is industrial, provide a
hydrogeologic description of the subsurface to a depth of 20 feet or bedrock, whichever is
less. The number of borings shall be sufficient to define the following for the area
underlying each major soil type at the site: significant changes in lithology, the vertical
permeability of the unsaturated zone, the hydraulic conductivity of the saturated zone, and
the depth of the mean seasonal high water table.
f. Five copies of all reports, evaluations, agreements, supporting calculations, etc., must be
submitted as a part of the specifications which are signed and sealed by a North Carolina
Professional Engineer. Although certain portions of this required submittal must be
developed by other professionals, inclusion of these materials under the signature and seal
of a North Carolina Professional Engineer signifies that he has reviewed this material -and
has judged it to be consistent with his proposed design.

In order to determine whether provisions for dual or standby power may be required for the
subject facility, the classification of the closest downslope surface waters (the surface waters that
any overflow from the facility would flow toward) must be determined. You are required to
submit this form, with items 1 through 10 completed, to die appropriate Division of Environmental
Management Regional Water Quality Supervisor (see attached listing). At a minimum, you must
include an 8.5" by 11" copy of the portion of a 7.5 minute USGS Topographic Map which shows
the subject surface waters. You must identify the location of the facility and the closest downslope
surface waters (waters for which you are requesting the classification) on the subriutted map copy.

I met with Mr. David Jaynes and his son Michael on June 14,
1995, and advised them that there was a permit requirement to
operate a flume line and screening operation. I also advised
them that the Division had determined that this sediment from the
screening operation was in fact a pollutant and considered
wastewater. Refer to the attached definitions from 15 NCAC 2H
.0200 page 3 (25) "pollutant" means waste as defined in G. S.
143-213(18). Refer to G. S. 143-213 (18) c. "Other waste" means
sawdust, shavings, lime, refuse, offal, oil, tar chemicals,
dissolved and suspended solids, sediment,..... etc.
On June 15, 1995, I returned to Mr. Michael Jaynes business
and delivered a copy of 15 NCAC 2H .0200 -Waste Not Discharged to
Surface Waters and a copy of permit application Form:RFAC 4/91
for recycle facilities. I helped Mr. Jaynes complete the
application (this is the only recycle permit application the
Division has and is used for all types of recycle systems) and
marked on the application which sections would apply to his
operation.
Both Mr. David Jaynes and Mr. Michael Jaynes indicated that
they did not think that the flume water should be considered
wastewater and they did not think that a permit was necessary.
I tried to explain the definitions and requirements for the

permit but they insisted that this was not wastewater. I further
explained that the Division has approximately 20 operations of
this type already under permit.
On June 20, 1995, I mailed to Mr. Michael Jaynes excerpts of
G. S. 143-213 and G. S. 143-215 including the definitions so that
he could see that sediment and solids were defined as pollutants.
Further, I have discussed this type of operation with Ms.
Coleen Sullins, Supervisor of the Permits and Engineering Unit
and Ms. Carolyn McCaskill, Supervisor of the State Engineering
Review Group and they both agree that this type of operation
requires a recycle non -discharge permit.
For your information on May 8, 1989, Paul Wilms, Director
of the Division of Environmental Management, assessed Mr. Ron
Muse d/b/a Maggie Gem Mine a civil penalty in the amount of
$542.78 for constructing and operating a treatment works without
a permit. Water Quality File No. WQ 88-48.
Also, the Division received a permit application for the non
discharge recycle facility from Mr. Michael Jaynes on July 3,
1995.
I will be happy to assist Mr. Jaynes in any way possible to
obtain a permit or answer any of his questions. He has my

characteristics or concentrations of typical petroleum product constituents in sufficient quantities as
to be detectable by compatible laboratory analytical procedures.
(24)
"Petroleum product" means all petroleum products as defined by G.S. 143-215.94A(7) and includes
motor gasoline,. aviation gasoline, gasohol, jet fuels, kerosene, diesel fuel, fuel oils (##1-##6), and
motor oils (new and used).

"Pollutant" means waste as defined in G.S. 143-213(18).
(26)
"Private sewer" means any part of a sewer system which collects wastewater from more than one
building, is privately owned and is not directly controlled by a public authority.
(27)
"Professional - engineer"_ means a person who . is presently registered and licensed as a professional
engineer by the North Carolina State Board of Registration For Professional Engineers and Land
Surveyors. -
(28)
"Public or community sewage system" means a single system of sewage collection, treatment, or
disposal owned and operated by a sanitary district, a metropolitan sewage district; a water and sewer
authority, a county, a municipality, or a public utility.
(29)
"Public sewer" means a sewer located in a dedicated public street, roadway, or dedicated public
right-of-way or easement which is owned.or operated by any municipality, county, water or sewer
district, or any other political subdivision of the state authorized to construct or operate a sewer
system.
(30)
"Rapid infiltration system" means rotary distributor systems or other similar systems that dispose of
tertiary treated waste at high surface area loading rates of greater than ;1.5 gpolft2. _-
(31)
"Residuals" means any solid or semisolid waste, other than residues from agricultural products and
processing generated from a wastewater treatment facility, water supply treatment facility or air
pollution control facility permitted under the authority of the Environmental Management
Commission. -
(32)
"Residues from agricultural products and processing" means solids, semi-solids or liquid, residues
'
from food and beverage processing and handling; silviculture; agriculture; and aquaculture operations
permitted under the authority of the Environmental Management Commission that are. non-toxic,
non -hazardous and contain no domestic wastewater.
(33) _
"Sewage" means the liquid and solid human waste, and liquid waste 'generated by domestic
water -using fixtures and appliances, from any residence, place of business, or place. of public
assembly. Sewage does not include wastewater that is totally or partially industrial wastewater, or
any other wastewater not considered to be domestic waste.. ..

."Sewer system" means pipelines or conduits, pumping stations, specialized mode of conveyance and - .
appliances appurtenant thereto, used for conducting wastes. to a point of ultimate disposal.
(35)
"Soil remediation at conventional rates" means the utilization of soils containing petroleum products

(13) The term"outlet" means the terminus of a sewer system, or the point of emergence of any
waste or the effluent therefrom, into the waters of the State.

(15) The term "sewer system" means pipelines or conduits, pumping stations, and force mains,
and all other construction, devices, and appliances appurtenant thereto, used for conducting wastes to
a point of ultimate disposal.
(16) The term "standard" or "standards" means such measure or measures of the quality of water
and air as are established by the Commission pursuant to G.S. 143-214.1 and G.S. 143-215.
(16a) "Stormwater" means the flow of water which results from precipitation and which occurs
a. "Sewage," which shall mean water -carried human waste discharged, transmitted, and
collected from residences, buildings, industrial establishments, or other places into a unified
sewerage system or an arrangement for sewage disposal or a group of such sewerage arrangements or
systems, together with such ground, surface, storm, or other water as may be present.
b. "Industrial waste" shall mean any liquid, solid, gaseous, or other waste substance or a
combination thereof resulting from any process of industry, manufacture, trade or business, or from
the development of anv natural resource.
. " otic waste" means that waste, or combinations of wastes, including disease -causing
agents, which after discharge and upon exposure, ingestion, inhalation, or assimilation into any
organism, either directly from the environment or indirectly by ingestion through food chains, will
cause death, disease, behavioral abnormalities, cancer, genetic mutations, physiological malfunctions
(including malfunctions in reproduction) or physical deformities, in such organisms or their
offspring.
(19) The term "water pollution" means the man-made or man -induced alteration of the chemical,
physical, biological, or radiological integrity of the waters of the State, including, but specifically not
limited to, alterations resulting from the concentration or increase of natural pollutants caused by
man -related activities.
(20) Repealed by Session Laws 1987, c. 827, s. 153.
(21) The term "watershed" means a natural area of drainage, including all tributaries contributing
to the supply of at least one major waterway within the State, the specific limits of each separate
watershed to be designated by the Commission.
(22) The term "complex sources" means any facility which is or may be an air pollution source or
which will induce -or tend to induce development or activities which will or may be air pollution
sources, and which shall include, but not be limited to, shopping centers; sports complexes; drive-in
theaters; parking lots and garages; residential, commercial, industrial or institutional developments;
amusement parks and recreation areas; highways; and any other facilities which will result in
increased emissions from motor vehicles or stationary sources.
(23) The term "effluent standards or limitations" means any restrictions established pursuant to
this Article on quantities, rates, characteristics and concentrations of chemical, physical, biological
and other constituents of wastes which are discharged from any pretreatment facility or from any
outlet or point source to the waters of the State.
(24) The term "point source" means any discernible, confined, and discrete conveyance,
including, but specifically not limited to, any pipe, ditch, channel, tunnel, conduit, well, discrete
fissure, container, rolling stock, or concentrated animal -feeding operation from which wastes are or
may be discharged to the waters of the State.
(25) The term "pretreatment facility" means any treatment works installed for the purpose of
treating, equalizing, neutralizing or stabilizing waste from any source prior to discharge to any
disposal system subject to effluent standards or limitations.
. (26) The term "pretreatment standards" means effluent standards or limitations applicable to
waste discharged from a pretreatment facility.
143-212. Definitions.
Unless a different meaning is required by the context, the following_ definitions apply to this
Article and Articles 21A and 21B of this Chapter:
(1) "Area of the State" means a municipality, a county, a portion of a county or a municipality, or
other substantial geographic area of the State designated by the Commission.
(2) "Commission",means the North Carolina Environmental Management Commission.
(3) "Department" means the Department of Environment, Health, and Natural Resources.
(4) "Person" includes individuals, firms, partnerships, associations, institutions, corporations,
municipalities and other political subdivisions, and governmental agencies.
(5) "Secretary" means the Secretary of Environment, Health, and Natural Resources.
(6) "Waters"• means any stream; river, brook, swamp, lake, sound, tidal estuary, bay, creek,
reservoir, waterway, or other body or accumulation of water, "whether surface or underground, public
or private, or natural or artificial, that is contained in, flows through, or borders upon any portion of
this State, including any portion of the Atlantic Ocean over which the State has. jurisdiction.

(Reg. Sess., 1992), c. 1028, s. 1.)
Editors Note. - Session Laws 1989 (Reg. Sess., 1990), c. 954, effective July 18, 1990, and expiring
July 1, 1991, provides in s. 1: "Except as provided in Section 2 of this act and notwithstanding the
provisions of G.S. 153A-285, G.S. 153A-287, or any other provision of law, no entity whether public
or private, or whether acting separately or jointly may divert any of the waters of this State, as
defined in G.S. 143-212(6), from the basin of any named river to another nor institute any proceeding
in the nature of eminent domain to acquire water, water rights, or lands having water rights attached
thereto for a use that will result in waters of this State being diverted from the basin of one named
river to another."
Sections 2 and 3 of Session Laws 1989 (Reg. Sess., 1990), c. 954 describe those diversions not
affected by the prohibitions in section 1 of the act, and sections 4 to 6 relate to construction of the act.
A former 143-212 was repealed by Session Laws 1973, c. 1262, s:. 23.
Effect of Amendments. - The 1991 (Reg. Sess., 1992) amendment, effective July 24, 1992, deleted
"applicable to Article" at the end of the catchline, and substituted the present introductory paragraph
for the former which read: "The following definitions apply to this Article."
143-213. Definitions.
Unless the context otherwise requires, the following terms as used in this Article and Articles 21A
and 21B of this Chapter are defined as follows:
(1) The term "air cleaning device" means any method, process or equipment which removes,
reduces, or renders less noxious air contaminants discharged into the atmosphere.
(2) The term "air contaminant" means particulate matter, dust, fumes, gas, mist, smoke, or vapor
or any combination thereof.
(3) The term "air contamination" means the presence in the outdoor atmosphere of one or more
air contaminants which contribute to a condition of air pollution.
(4) The term "air contamination source" means any source at, from, or by reason of which there is
emitted into the atmosphere any air contaminant.
(5) The term "air pollution" shall mean the presence in the outdoor atmosphere of one or more air
contaminants in such quantities and duration as is or tends to be injurious to human health or welfare,
to animal or plant life or to property or that interferes with the enjoyment of life or property.
(6) to (8) Repealed by Session Laws 1987, c. 827, s. 153.
(9) Whenever reference is made in this Article to the "discharge of waste," it shall be interpreted
to include discharge, spillage, leakage, pumping, placement, emptying, or dumping into waters of the
State, or into any unified sewer system or arrangement for sewage disposal, which system or
arrangement in turn discharges the waste into the waters of the State.
(10) The term "disposal system" means a system for disposing of waste, and including sewer
systems and treatment works.
(11) Repealed by Session Laws 1987, c. 827, s. 153.
(12) The term "emission" means a release into the outdoor atmosphere of air contaminants.

The appropriate permit processing fee, in accordance with 15A NCAC 2H .0205(c)(5).
—Fives sets of detailed plans and specifications signed and sealed by a North Carolina
Professional Engineer. The plans must include a general location map, a site map which
indicates where any borings or hand auger samples were taken, along with buffers,
structures, and property lines. Each sheet of the plans and the first page of the specifications
must be signed and sealed.
;d. For industrial wastewater, a complete chemical analysis of the typical wastewater
f must be provided. The analysis may include, but shall not be limited to, Total Organic
Carbon, BOD, COD, Chlorides, Phosphorus, Nitrates, Phenol, Total Trihalomethanes,
TCLP analysis, Total Halogenated Compounds, Total Coliforms, and Total Dissolved
Solids.
e. If lagoons are a part of the facilities and the recycle water is industrial, provide a
hydrogeologic description of the subsurface to a depth of 20 feet or bedrock, whichever is
less. The number of borings shall be sufficient to define the following for the area
underlying each major soil type at the site: significant changes in lithology, the vertical
permeability of the unsaturated zone, the hydraulic conductivity of the saturated zone, and
the depth of the mean seasonal high water table.
f. Five copies of all reports, evaluations, agreements, supporting calculations, etc., must be
submitted as a part of the specifications which are signed and sealed by a North Carolina
Professional Engineer. Although certain portions of this required submittal must be
developed by other professionals, inclusion of these materials under the signature and seal
of a North Carolina Professional Engineer signifies that he has reviewed this material and
has judged it to be consistent with his proposed design.

WQ0011261, dated January 7, 2000, to Mr. Michael Jaynes for`the continued operation of'the subject wastewater
recycle system.
This permit shall be effective from the date of issuance until December 31., 2004, shall void Permit No.
WQ0011261 issued July 31, 1995,, and shall'be subject to the conditions and limitations as specified therein. Please
pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for
collecting and maintaining the required. operational information will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This
request mus' -be in the form of a written'petition, conforming to Chapter -1:50B of North Carolina General Statutes,
and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Unless
such demands are made this permit shall be final and binding.

PERMISSION IS HEREBY GRANTED TO

FOR THE
continued operation of a 4,800 GPD wastewater recycle system consisting of a 50 foot flume line, a 2' x 5' x 2'
settling tank, and a 9' x 20' x 10' recycle tank with pumps to serve the Linville Mountain Gem Shop, with no
discharge of wastes to the surface waters, pursuant to the renewal request received October 5, 1999, and in
conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the
Department of Environment and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until December 31, 2004, shall void Permit No.
WQ0011261 issued July 31, 1995, and shall be subject to the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes described in the application and
other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is
a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality
(Division) accompanied by an application fee, documentation from the parties involved, and other supporting
materials as may be appropriate. The approval of the request will be considered on its merits and may or may
not be approved.
5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall take immediate corrective action, including those actions that may be required by this
Division, such as the construction of additional or replacement treatment or disposal facilities.
6. The residuals generated from these treatment facilities must be disposed in accordance with General Statute
143-215.1 and in a manner approved by the Division.

7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages
groundwaters resulting from the operation of this facility.
The facilities shall be effectively mair..tained and operated as anon -discharge system to prevent �.., u.�......b.
of any wastewater resulting from the operation of this facility.
Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
10. Any monitoring deemed necessary by the Division to insure surface and ground water protection will be
established and an acceptable sampling reporting schedule shall be followed.
11. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation
of the subject facilities.
12. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and
deterioration, operator errors and discharges which may cause or lead to the release of wastes to the
environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or
summary including at least the date and time of inspection, observations made, and any maintenance, repairs,
or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for
a period of three years from the date of the inspection and shall be made available to the Division or other
permitting authority, upon request.
13. Any duly authorized officer, employee, or representative of the Division may, upon presentation of
credentials, enter and inspect any property, premises or place on or related to the recycle system at any
reasonable time for the purpose of determining compliance with this permit, may inspect or copy any records
that must be maintained under the terms and conditions of this permit, and may obtain samples of
groundwater, surface water, or leachate.
14. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after
being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to
revoke this permit as specified by 15A NCAC 2H .0205 (c)(4).
15. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an
enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.
16. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal)
which have jurisdiction.
17. A set of approved plans and specifications for the subject project must be retained by the Permittee for the
life of this project.
18. Noncompliance Notification:
The Permittee shall report by telephone to the Asheville Regional Office, telephone number (828) 251-6208,
as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or
first knowledge of the occurrence of any of the following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts
of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin
or tank, the known passage of a slug of hazardous substance through the facility, or any other unusual
circumstances;

Any process unit failure, due to known or unknown reasons, that renders the facility incapable of
adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compressors,
etc.;
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to
receiving waters without -treatment of all or -any portion of the influent to such station or facility; or
d. Any time that self-monitoring information indicates that the facility is not in compliance with its permit
limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5)
days following first knowledge of the occurrence. This report must outline the actions taken or proposed to
be taken to ensure that the problem does not recur.
19. The.Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon
receipt of the request, the Commission will review the adequacy of the facilities described therein, and if
warranted, will extend the permit for such period of time and under such conditions and limitations as it may
,deem appropriate.

David has written concerning a problem he is having in
starting up a new business. The main question appears to be

I am in the process of opening a rock shop for my son Michael. This shop
is located approximately 114 mile south of Linville Caverns, on Highway 221.
Michael will be cutting natural gemstones and mounting them in rings,
pendants, earrings etc. Iu order to draw additional customers, we have
built a flume line. This consists of water flowing down a wooden trough,
providing customers a means to wash dirt away .form "potential" gemstones.
This is done by putting dirt into a 4"x12"x12' open topped, screened bottom
box and dipping it into the flowing water.
Raving said all of the above, I will tell you my problem.
A gentleman from the North Carolina Department of Environment, Health
and Natural Resources stopped by (having seen the flume line while traveling
up 221) and. said We would need a permit from his department in order to
open the shop. lie left us a permit application. Directions in the application
as well as in the pamplet explaining the application do not apply to this type
of facility. The application is for waste recycling.
There is no waste involved in this process. Water is pumped from our well into
a large tank•gothing goes into any stream or onto the ground. Everything is
self ---contained. It is very similar to a swimming pool slide. The dirt is also
reused. (See drawing)
Bob, I can see no relavance to the operation of a recreational, self-contained
flume line of this type and any kind of adverse environmental situation.
Nothing is taken from the ground or streams and nothing is allowed to go into
the ground or into a stream. I welcome anyone to check the shop for any problems
that could possibly be considered as environmentaly unsound.
The application and regulations that we received were prepared for sewer
systems, disposal of farm animal waste etc. This is a recreational, non -industrial,
non-comerical, non -waste water, non-domestic, non -applicable activity.
The application requires that we sign a statement of truth to the best of
our ability etc. However, the state Environmental Representative took the
liberty of inserting information into some of the fill in spaces which would
lead the reader to believe something that is not applicable.(See copy of application)

Bvb, I don't want you to spend a lot of time on this but I feel we
are being inaccurately included in their regulation as it now exists.
Nothing applies. I would like to have a copy of a relevant regulation.
(See the attached copy from the pampiat we received) indicating activities
requiring permits. I cannot help but feel that this mau is trying to
justify his employment.

Dear Mr. Jaynes:
Mr. Michael Parker of this Division's Water Quality Section
has been -discussing with you the need for a non -discharge recycle
permit. For your use I am enclosing a copy of excerpts of
General Statutes 143-213 and 143-215 in which I have highlighted
certain areas that may be pertinent to your operation. Based on
these statutes we have determined that a nondischarge recycle
permit is required for you to operate the flume line and gem
mining operation. The water used to wash the silt, soil and sand.
from the gemstones and rocks becomes wastewater and the two
settling tanks and pump constitutes a wastewater treatment
system.
For your information we have approximately 20 permitted gem
mines within the 19 county area served by the Asheville Regional
Office. We look forward to receiving your permit application.
