In accordance with your request for permit renewal received March 28, 2000, and additional
information received April 11, 2001, we are forwarding herewith Permit No. WQ0003799, dated March
27, 2002, to Mr. Curtis G. Rhoades for the continued operation of the subject wastewater recycle system.
This permit shall be effective from the date of issuance until February 28, 2007, shall void Permit
No. WQ0003799 issued October 30, 1995, and shall be subject to the conditions and limitations as
specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to
establish an adequate system for collecting and maintaining the required operational information will
result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the.
right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of
this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North
Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center
Raleigh, NC 27699-6714. Unless such demands are made this permit shall be final and binding.

continued operation of a 10,000 GPD wastewater recycle system consisting of a 15,000 gallon capacity
primary basin, a 1 -Hp recycle pump, approximately 80 linear feet of 2 -inch force main, approximately 80
feet of sleuth, and all associated piping, valves, controls, and appurtenances to serve the Gold City Gem
Mine with no discharge of wastes to the surface waters, pursuant to the renewal request received March
28, 2000, and in conformity with the project plan, specifications, and other supporting data subsequently
filed and approved by the Department of Environment and Natural Resources and considered a part of
this permit.
This permit shall be effective from the date of issuance until February 28, 2007, shall void Permit
No. WQ0003799 issued October 30, 1995, and shall be subject to the following specified conditions and
limitations
1. This permit shall become voidable unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change ownership,
or there is a name change of the Permittee, a formal permit request must be submitted to the
Division of Water Quality (Division) accompanied by an application fee, documentation from the
parties involved, and other supporting materials as may be appropriate. The approval of the
request will be considered on its merits and may or may not be approved.

-0. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those actions that may
be required by this Division, such as the construction of additional or replacement treatment or
disposal facilities.
6. The residuals generated from these treatment facilities must be disposed in accordance with
General Statute 143-215.1 and in a manner approved by the Division.
7. The, issuance of this permit shall not relieve the Permittee of the responsibility for damages to
surface or groundwaters resulting from the operation of this facility.
8. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the
discharge of any wastewater resulting from the operation of this facility.
9. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
10. Freeboard in the primary basin shall not be less than two feet at any time.
11. Any monitoring deemed necessary by the Division to insure surface and ground water protection
will be established and an acceptable sampling reporting schedule shall be followed.
12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure
proper operation of the subject facilities.
13. The Permittee ' or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to the
release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall
maintain an inspection log or summary including at least the date and time of inspection,
observations made, and any maintenance, repairs, or, corrective actions taken by the Permittee.
This log of inspections shall be maintained by the Permittee for a period of three years from the
date of the inspection and shall be made available to the Division or other permitting authority,
upon request.
14. Any duly authorized officer, employee, or representative of the Division may, upon presentation of
credentials, enter and inspect any property, premises or place on or related to the recycle system
at any reasonable time for the purpose of determining compliance with this permit, may inspect or
copy any records that must be maintained under the terms and conditions of this permit, and may
obtain samples of groundwater, surface water, or leachate.
15. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days
after being billed by the Division. Failure to pay the fee accordingly may cause the Division to
initiate action to revoke this permit as specified by 15A NCAC 2H .0205 (c)(4).
16. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee
to an enforcement action by the Division in accordance with North Carolina General Statute 143-
215.6A to 143-215.6C.
17. The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be imposed by other government agencies
(local, state, and federal) which have jurisdiction.
18. A set of approved plans and specifications for the subject project must be retained by the Permittee
for the life of this project.

19. Noncompliance Notification:
The Permittee shall report by telephone to the Asheville Regional Office, telephone number (828)
251-6208, as soon as possible, but in no case more than 24 hours or on the next.working day
following the occurrence or first knowledge of the occurrence of any of the following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of significant
amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the
contents of a basin or tank, the known passage of a slug of hazardous substance through the
facility, or any other unusual circumstances;
b. Any process unit failure, due to known or unknown reasons, that renders the facility incapable
of adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators,
compressors, etc.;
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to
receiving waters without treatment of all or any portion of the influent to such station or facility;
or
d. Any time that self-monitoring information indicates that the facility isnot in compliance with its
permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in Tetter form within
five (5) days following first knowledge of the occurrence. This report must outline the actions taken
or proposed to be taken to ensure that the problem does not recur.
20. Upon classification of the facility by the Water Pollution Control Systems Operators Certification
Commission (WPCSOCC), the Permittee shall employ a certified wastewater treatment plant
operator to be in responsible charge (ORC) of the wastewater treatment facilities. The operator
must hold a certificate of the type and grade at least equivalent to or greater than the classification
assigned to the wastewater treatment facilities by the WPCSOCC. The Permittee must also
employ a certified back-up operator of the appropriate type and grade to comply with the conditions
of 15A NCAC 8G .0202. The ORC of the facility must visit each Class I facility at least weekly and
each Class ll, III, and IV facility at least daily, excluding weekends and holidays, and must properly
manage and document daily operation and maintenance of the facility and must comply with all
other conditions of 15A NCAC 8G .0202.
21. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy .of the facilities
described therein, and if warranted, will extend the permit for such period of time and under such
conditions and limitations as it may deem appropriate.

5. In event the facilities fail to perform satisfactorily including the, creation
of nuisance conditions, the Permittee shall take such immediate corrective
action as may be required by this Division including the construction of
additional or replacement wastewater treatment or disposal facilities.

6. Solids, sludges, or other pollutants removed or resulting from the wastewater
treatment process shall be contained and disposed of in such a manner as to
prevent any contamination of the surface or groundwaters of the State.
7. Diversion or bypassing of the wastewater from the recycle system is prohibited.
8. Adequate facilities shall be provided to prevent surface runoff from carrying
any disposed or stored material into the receiving stream.
9. The issuance of this permit shall not relieve Gold City Properties, Inc. of
the responsibility for damages to surface or groundwaters resulting from the
operation of this facility.
10. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater into the surface waters of
the State.
11. A suitable vegetative cover or equivalent alternative shall be maintained on
graded slopes to prevent erosion.
12. Freeboard in the settling basins shall not be less than two (2) feet.
13. The Permittee, at least six (6) months prior to the expiration of this permit,
shall request its extension. Upon receipt of the request, the Commission
will review the adequacy of the facilities described therein, and if indicated,
will extend the permit for such period of time and under such conditions and
limitations as it may deem appropriate.

Per a request made by on December 12, 2006, the Division of Water Quality is rescinding the subject
recycle system permit. In accordance with NC State Administrative Code 15A NCAC 02T, effective
September 1; 2006, the recycle system at Gold City Gem Mine meets the requirements of Section
.1003(a) for systems to be deemed permitted. The recycle system at Gold City Gem Mine is not required
to apply for future permit renewals or modifications provided that the facility continues to comply with
the requirements of 15A NCAC 02T .1000.
Please be advised that NC State Administrative Code 15A NCAC 02T .1003(a) requires that a Spill
Control Plan be maintained for the Facility. The Spill Control Plan shall at a minimum addresses the
following items:
a. Contact phone numbers for 24-hour response, including weekends and holidays;
b. Contact phone number for the Division of Water Quality Regional Office;
C. Contact information for construction crews, contractors and/or engineers;
d. Expected response times;
e. Essential equipment list and spare parts inventory;
f. Location of clean up materials;
g. Site sanitation procedures; and
h.. Post -response assessment and reporting.

(REQUEST TO RESCIND PERMIT FOR WASTEWATER RECYCLE SYSTEMS)

This form is for the request to rescind Division of Water Quality wastewater recycle permits for systems deemed
permitted under Administrative Code Section 15A NCAC 02T enacted September 1, 2006,
15A NCAC 02T.1003 PERMITTING BY REGULATION
(a) The following systems are deemed permitted pursuant to Rule .0113 of this Subchapter provided the system
meets the criteria in Rule .0113 of this Subchapter and all criteria required for the specific system in this Rule:
(1) Return of wastewater contained and under roof within an industrial or commercial process where there is no
anticipated release of wastewater provided the facility develops and maintains a spill control plan in the
event of a release and no earthen basins are used.
(2) Recycling of rinse water at concrete mixing facilities for concrete mix removal from equipment provided
the wastewater is contained within concrete structures, there is sufficient storage capacity to contain the
runoff from a 24-hour, 25 -year storm event plus one foot freeboard and the facility develops and maintains
a spill control plan in the event of a wastewater release. The facility must notify the appropriate Division
regional office in writing noting the owner, location, and that the design complies with the above criteria.
(3) Recycling of wash and rinse water at vehicle wash facilities provided the wastewater is contained within
concrete, steel or synthetic structures (i.e. not including earthen basins), all vehicle washing is conducted
under roof and there are no precipitation inputs (direct or indirect), and the facility develops and maintains a
spill control plan in the event of a wastewater release.
(4) The reuse or return of wastewater within the treatment works of a permitted wastewater treatment system.
(b) The Director may determine that a system should not be deemed permitted in accordance with this Rule and Rule
.0113 of this Subchapter. This determination shall be made in accordance with Rule .0113(e) of this Subchapter.
Note: Any invoiced annual fee dated prior to Division receipt of this application is still due.

buffers, structures, and property lines. Each sheet of the plans.and the fust page of the. specifications must be signed and sealed.
For industrial wastewater, a complete chemical analysis of the typical wpstewater must he provided. The analysis may include
but shall not be limited to. Total Oreanic Carbon, BOD, COD, Chlorides, Phosphorus, Nitrates, Phenol, Total Trihalontethanes
TCLP analvsis, Total Halogenated Compounds. Total Coliforms, and Total Dissolved Solids.
If lagoons are a part of ilio facilities and the recycle water is industrial, provide a hydrogeologic description of the subsurface to :
depth of 20 feet or bedrock, whichever is less. The number of borings shall be sufficient to define the following for the are;
underlying each major sail type at tic site: significant changes in lithology,_die vertical permeability of the unsaturated zone, tht

This permit shall be effective from the date of issuance until September 30, 2000, shall void Permit
No. WQ0003799 issued July 29, 1994, and shall be subject to the conditions and limitations as specified

The issuance of this permit shall not relieve the Permittee of the responsibility for damages
to surface or groundwaters resulting from the operation of this facility.
The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resulting from the operation of this facility.
Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
Freeboard in the primary basin shall not be less than two feet at any time.
Any monitoring deemed necessary by the Division of Environmental Management to insure
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.
Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
The Permittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall maintain an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken by
the Permittee. This log of inspections shall be maintained by the Permittee for a period of
three years from the date of the inspection and shall be made available to the Division of
Environmental Management or other permitting authority, upon request.
Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the recycle system at any reasonable time for the purpose
of determining compliance with this permit, may inspect or copy any records that must be
maintained under the terms and conditions of this permit, and may obtain samples of
groundwater, surface water, or leachate.
The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205
(c)(4)•
16. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c).
17. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
18. A set of approved plans and specifications for the subject project must be retained by the
Permittee for the life of this project.

d. For industrial wastewater, a complete chemical analysis of the typical wastewater must be provided. The analysis may include,
but shall not be limited to. Total Organic Carbon, BOD. COD, Chlorides. Phosphorus, Nivates, Phenol, Total TrihalomcdIalIcs.
TCLP analysis, Total Halogenated Compounds. Total Coliforms; and Total Dissolved Solids.
If lagoons are a pan of the facilities and the recycle water is industrial, provide a hydrogeologic description of the subsurface to a
depth of 20 feet or bedrock, whichever is less. The number of borings shall be sufficient to define the following loo the area
underlying each major soil type at the site: significant changes in lithology, the vertical permeability of the unsaturated zone, the
hydraulic conductivity of the saturated zone, and the depth of the mean seasonal high water table.
f. Five copies of all reports, evaluations; agreements, supporting calculations. etc., most be submitted as a part of the specifications
which are signed and sealed by a North Carolina Professional Engineer. Although certain portions of this required submittal must
be developed by other professionals, inclusion of these materials under the signature and seal of a North Carolina Professional

INSTRUCTIONS TO NC PROFESSIONAL ENGINEER:
The classification of the downslope surface waters (the surface waters that any overflow from the facility would flow toward)
in which the recycle facility will be constructed must be determined by the appropriate DEM regional office. Therefore, you
are required, prior to submittal of the application package, to submit this form, with items 1 through 7 completed,
to the appropriate Division of Environmental Management Regional Water Quality Supervisor (see page 6 of 6). At a
minimum, you must include an 8.5" by I I" copy of the portion of a 7.5 minute USGS Topographic Map which shows the
location of the recycle facility and the downslope surface waters in which they will be located.- Identify the closest downslope
surface waters on the attached map copy. Once the regional office has completed the classification,
reincorporate this completed page and the topographic map into the complete application form and
submit the application package.

the subject recycle system permit from Gold City Properties, Inc. to Mr. Curtis G. Rhoades and Mrs.

This permit shall be effective from the date of issuance until April 30, 1996, and shall be subject to
the conditions and limitations as specified therein.. Please pay particular attention to the monitoring
requirements in this permit. Failure to establish an adequate system for collecting and maintaining the

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

continued operation of a 10,000 GPD wastewater recycle system consisting of a 15,000 gallon primary
basin, a 1 Hp pump, approximately 80 feet of 2 inch force main, approximately 80 feet of sleuth, and all
associated piping, valves, controls, and appurtenances to serve Gold City Tourist Gem Mine with no
discharge of wastes to the surface waters, pursuant to the name change request received May 4, 1994, and
in conformity with the project plan, specifications, and other supporting data subsequently filed and
approved by the Department of Environment, Health and Natural Resources and considered a part of this
permit.
This permit shall be effective from the date of issuance until April 30, 1996, and shall be subject to
the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other supporting
data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3 The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of the request will be considered on its merits and may or may
not be approved.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those
actions that may be required by this Division, such as the construction of additional or
replacement treatment or disposal facilities.

6. The Asheville Re "nal Office, telephone number 704/ 25208 shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an in-place
inspection can be made. Such notification to the regional supervisor shall be made during
the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday,
excluding State Holidays.
7. The residuals generated from these treatment facilities must be disposed in accordance with
General Statute 143-215.1 and in a manner approved by the North Carolina Division of
Environmental Management
8. The issuance of this permit shall not relieve the Permittee of the responsibility for damages
to surface or groundwaters resulting from the operation of this facility.
9. The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resulting from the operation of this facility.
10. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
11. Freeboard in the primary basin shall not be less than two feet at any time.
12. Any monitoring deemed necessary by the Division of Environmental Management to insure
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.

Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
The Permittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall maintain an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken by
the Permittee. This log of inspections shall be maintained by the Permittee for a period of
three years from the date of the inspection and shall be made available to the Division of
Environmental Management or other permitting authority, upon request.
Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the recycle system at any reasonable time for the purpose
of determining compliance with this permit, may inspect or copy any records that must be
maintained under the terms and conditions of this permit, and may obtain samples of
groundwater, surface water, or leachate.
The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205
(c)(4)•
17. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c).
18. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
19. A set of approved plans and specifications for the subject project must be retained by the
Permittee for the life of this project, if available upon issuanceof this permit.

20. Noncompliance Notification:
The Permittee shall reportby telephone to the Asheville Regional Office, telephone number
704/ 251-6208 as soon as possible, but in no case more than 24 hours or on the next
working day following the occurrence or first knowledge of the occurrence of any of the
following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such as
the dumping of the contents of a basin or tank, the known passage of a slug of
hazardous substance through the facility, or any other unusual circumstances;
b. Any process unit failure, due to known or unknown reasons, that renders the facility
incapable of adequate wastewater treatment, such as mechanical or electrical failures of
pumps, aerators, compressors, etc.;
c. Any failure of,a pumping station, sewer line, or treatment facility resulting in a by-pass
directly to receiving waters without treatment of all or any portion of the influent to
such station or facility; or
d. Any time that self-monitoring information indicates that the facility is not in compliance
with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.
21. Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of
the wastewater treatment facilities. The operator must hold a certificate of the type and
grade at least equivalent to or greater than the classification assigned to the wastewater
treatment facilities by the Certification Commission. The Permittee must also employ a
certified back-up operator of the appropriate type and grade to comply with the conditions
of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at
least weekly and each Class IL III, and IV facility at least daily, excluding weekends and
holidays, and must properly manage and document daily operation and maintenance of the
facility and must comply with all other conditions of Title 15A, Chapter 8A, .0202.
22. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted, will extend the permit for such period of time
and under such conditions and limitations as it may deem appropriate.
23. Issuance of this permit hereby voids Permit No. WQ0003799 issued May 15,1991.

Our files indicate that the subject permit issued on 7/29/94 expires on
4/30/96. We have not received a. request for renewal from you as of this date.
A renewal request shall consist of a letter requesting renewal and completion of
the enclosed application, submitted in triplicate. A processing fee must be submitted
with the request. Please find attached a copy of the 15 NCAC 2H .0205(c) regulations.
The processing fee for your facility is based on the design or permitted flow,
whichever is appropriate, listed in the first four categories of facilities. Sludge
renewals are based on total acres of land permitted. If the facility covered by this
permit contains some type of treatment works, a narrative descriptor of the sludge
management plan that is in effect at the facility must be submitted with the
application for renewal.
The Environmental Management Commission adopted revised rules on October 1, 1990
(attached), requiring the payment of an annual fee for most permitted facilities. You
will be billed separately for that fee (if applicable), after your permit is approved.
Please be advised that this permit must not be allowed to expire. If the renewal
•request is not received within 180 days prior to the permit's expiration date as
required by 15 NCAC 2H .0211, you will be assessed an automatic civil penalty. This
civil penalty by North Carolina General Statute may be as much as $10,000 per day. If
a permit renewal request is not received 180 days before permit expiration, a civil
penalty of at least $250 will be assessed. Larger penalties may be assessed depending

The Division of Environmental Management issued the subject permit on 3/02/84
and according to our records, the permit expired on 3/01/88.
North Carolina General Statute 143-215.1(a)(2) requires that a permit be obtained
for the construction or operation of any sewer system, treatment works, or disposal
system within the State. The Division will. inspect this facility in the near future
to determine its compliance status with regard to this regulatory requirement. If
operation of a wastewater treatment system -is occurring or is subject to occur from
this facility, the Division will prepare an enforcement action for violations of North
Carolina General Statute 143-215.1 et. seq. North Carolina General Statute
143-215.6(a)(1) states that a civil penalty of up to ten thousand dollars ($10,000)
may be assessed by the Environmental Management Commission against any person who
violates General Statute 143.215.1.
If you are operating this facility or plan to operate at some future date, you
should submit a reissuance request within fifteen (1.5) days of receipt of this
letter. The letter requesting reissuance, along with a completed Non -Discharge Permit
application and appropriate standard fee, should be sent to:

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

operation of a 10,000 GPD recycle wastewater treatment system consisting of a 15,000 gallon
primary basin, a 1 Hp pump, approximately 80 -feet of 2 -inch force main, approximately 80 feet
of sleuth, and associated piping, valves and appurtenances to serve Gold City Tourist Gem Mine
with no discharge of wastes to the surface waters, pursuant to the application received July 2,
1990 and in conformity with the project plan, specifications, and other supporting data
subsequently filed and approved by the Department of Environment, Health and Natural
Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until April 30, 1996, and shall be
subject to the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans, specifications, and other supporting
data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management accompanied by an' application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of the request will be considered on its merits and may or may
not be approved.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as
may be required by this Division, such as the construction of additional or replacement
wastewater treatment or disposal facilities.

6. The sludge generated from these treatment facilities must be disposed of in accordance with
General Statute 143-215.1 and in a manner approved by the North Carolina Division of
Environmental Management.
7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages
to surface or groundwaters resulting from the operation of this facility.
8. The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resulting from the operation of this facility.
9. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
10. Freeboard in the primary basin shall not be less than two feet at any time.
11. Any monitoring deemed necessary by the Division of Environmental Management to insure
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.
12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
13. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall keep an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken
by the Permittee. This log of inspections shall be maintained by the Permittee for a period
of three years from the date of the inspection and shall be made available upon request to
the Division of Environmental Management or other permitting authority.
14. Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the recycle system at any reasonable time for the
purpose of determining compliance with this permit; may inspect or copy any records that
must be kept under the terms and conditions of this permit; or may obtain samples of
groundwater, surface water, or leachate.
15. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205
(c)(4)•
16. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6.
17. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
18. A set of approved plans and specifications for the subject project must be retained by the
Permittee for the life of this project.

The Permittee shall report by telephone to the Asheville Regional Office,
telephone no. 704/ 251-6208, as soon as possible, but in no case more than 24 hours or on
the next working day following the occurrence or first knowledge of the occurrence of any
of the following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such
as the dumping of the contents of a basin or tank; the known passage of a slug of
hazardous substance through the facility; or any other unusual circumstances.
b. Any process unit failure, due to known or unknown reasons, that render the facility
incapable of adequate wastewater treatment such as mechanical or electrical failures
of pumps, aerators, compressors, etc.
C. Any failure of a pumping station, sewer line, or treatment facility resulting in a
by-pass directly to receiving waters without treatment of all or any portion of the
influent to such station or facility.
d. Any time that self-monitoring information indicates that the facility is not in
compliance with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.
20. The Permittee, at least six (6) months prior to the expiration of this pen -nit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted; will extend the permit for such period of time
and under such conditions and limitations as it may deem appropriate.
21. Issuance of this permit hereby voids Permit No. 4928R issued March 2, 1984.

Dear Mr. Morgan:
This office received a call from Ms Margaret Malloy stating that
Gold City plans to open its tourist mining operation the latter part
of this month.
Enclosed please find a copy of the permit issued by this Department
for dealing with the wastewater from the Gold City mining operation.
Please nate that the permit does not allow a discharge of wastewater to
the surface waters of the State. Recirculation of thewaterfrom the
washing trough, after allowing the solids to settle out, is the usual
procedure for handling the wastewater from a mining operation like Gold
City's. However, Gold City did not have to recirculate its mine wash -
water last year. The settling ponds behind the sluice are in porous
enough soil so that the volume of washwater which was used did not fill
the ponds.
Before starting the mining operation this year, the settling pond
wall which has caved in needs to be repaired. Also, if the amount of
mine water which is used this year is of great enough volume to fill
the settling ponds, pumps will have to be installed to return water
from the second settling basin to the head of the flume.

The present temporary sewage disposal system for gold Mountain
consists of four (4) 11000 gal. septic tanks. One of these-7—an-Es
is hooked directly to the Restaurant and the two nitrification lines
are a total of 300 feet in length and 30 inches in width,
Another tank is hooked to the public rest rooms and it consists of
the same facilities with an extra 100 feet nitrification line.
A third tank is hooked in with the Canteen or Snack Bar and it
consists of 150 feet of 30 inch nitrification line.
The other tank serves the other gift shops, photo shops$ and etc.
It consists of 150 feet of 30 inch nitrification line.
This is allowed because the owners wanted to see whether or not the
place would be a success before establishing a more elaborate central
sewage system.
I feel that this system is adequate for the present time and will not
endanger any water supplies.

3. The water and sewer systems were apparently designed and approved
by Mr. Harold Collins, Sanitarian, iMacon County Health Department.

to the top of Gold Nounta,in due 'to steep, muddy, narrow roads. herefore;;
I have not, seen tie sewerage facilities. Mr. Moses advised me, however,
that they had put in septic tanns.
It appears that there is no unified collection system and that the
facilities installed are under the jurisdiction of the local health de-
partment
l did contact Mr. Collins wife who said that she would have him
write me' coicerning the sewerage facilities he approved.. 1 will advise
you as soon as I have heard from him.

uary 22, 1965, at which time we inspected a proposers `site for seuer5a e
facilities to serve Cold. To-a;atai:n Accrea bona, :area.
The First step involved in providing adequate sewerage facilities
is the selection and approval of a zui.table site upon which to locate
a sewage treatment plant. such a site was inspected on January 22 and
appeared to the writer to meet this Department's requirements. Prior
to submitting a plant site inspection report to the .=tate Stream jani"
tation Committee, it was agreed that you would furnish me with the follow-
i.ng additional information
1.. A map showing the location of all proposed buildi n7s with refer-
ence to the sewage tr°ca.tamrnt plant zdte,.
2. Estimated sewage .flows based :),pon he nivalier° of permanent
employees, the number of restroom facilities, and the maticipated
raaaximum number of visitors during the peak Ason.
Upon receipt of the above inf'or ation, l will prepare m plant site
inspection report for presentation to and approval by the State Stream
Sanitation ConNittee. Once the site has been a proved the nExt step
will be to. nave detailed plass and specifieaQ s of the sewage treat-
ment plant and sewage collection system prepared by s registered con-
sulting engineer. These plans and spe e fieations, accompanied by an
application for a Permit, must be subamitted 1'.n duplicate to the 3tate
Stream Sanitation Committee for review and approval. Construction of
the sewerage facilities cannot be started imtil.a Permit has been issued.
