Reference is made to your request for rescission of the subject Distribution of Residual Solids
Permit. Staff from the Asheville Regional Office has confirmed that this Permit is no longer
required. Therefore, in accordance with your request, Distribution of Residual Solids Permit No.
WQ0018592 is rescinded, effective immediately.
If in the future, you wish again to operate a non -discharge system, you must first apply for and
receive a new Distribution of Residual Solids Permit. Operating a non -discharge system without
a valid Distribution of Residual Solids Permit will subject the responsible party to a civil penalty
of up to $25,000 per day.

One of the requirements of your non-discharge permit is the submittal of an annual report to the
Division of Water Quality by March 1st of each year. Our records indicate that the 2003 annual
report has not been submitted for the subject facility. If you have records indicating the report
was submitted, that land application did not occur in 2003, or if you have other relevant
information regarding the facilities operation during 2003, please send such information to the
following address by no later than ten (10) days following receipt of this letter

A review of Mountain Organic Materials' records for March 2004 showed the following
violations:
Compliance Issue
Failure to submit an annual Residuals Analysis Summary (RAS) for 2003.
Remedial actions should be taken to correct this problem. The Division of Water Quality may pursue
enforcement action for this and any additional violations of State law.
To prevent further action, carefully review these violations and deficiencies and respond in writing to
this office within 10 working days of receipt of this letter. You should address the causes of non-
compliance and all actions taken to prevent the recurrence of similar situations. If you should have

A review of Mountain Organic Materials' Records indicate the following violations:
Compliance Issue
Failure to submit Residual Analysis Summary (RAS) for 2002 on or before March 1, 2003.
Remedial actions should be taken to correct this problem. The Division of Water Quality
may pursue enforcement action for this and any additional violations of State law.
To prevent further action, carefully review these violations and deficiencies and respond in
writing to this office within 30 days of receipt of this letter. You should address the causes of
non-compliance and all actions taken to prevent the recurrence of similar situations. If you

The Groundwater Section is in receipt of the subject application to permit the distribution of
animal residual solids (see Figures 1 and 2). The facility intends to compost an estimated 7,200 dry
tons of dairy cattle manure per year and mix it with approximately 3,600 dry tons of sawdust to
create a compost -based soil blend for bulk applications to residential lawns, gardens, and other
applications. It is the understanding of the Groundwater Section that this permit will be new and that
a demonstration project was permitted at this facility by the Division of Waste Management on
September 22, 1998 to operate for approximately one year and that the permit was later extended to
allow operation through October of 2000.
The operation will consist of pumping dairy manure out of a collection pond and through a
separator to separate out the solids. The separated manure will be stockpiled on an asphalt pad until
enough is produced to mix with wood waste (sawdust). The mixture will be staged in piles for
approximately 28 days to allow composting to occur. All of the leachate from the raw product
storage and the composting area will be drained into the primary lagoon, which has concrete sides
and a concrete bottom. The second and third lagoons are reportedly lined with a native compacted
clay material, which is believed to have a very low permeability. It is the understanding of the
Groundwater Section that the compost material is stored on concrete and asphalt pads at all times
and is not stored on (or otherwise allowed to contact) the unprotected surface of the ground.
Staff of the Groundwater Section from the Asheville Regional Office recently visited the
facility. The facility is operated by the Crowell Dairy Farm under an Animal Waste Management
Plan, which is certified by the Division of Soil and Water Conservation. There is a non -potable water
supply well at the facility (see Figure 2.) that should be labeled as non -potable, and the nearest
potable water supply well is reportedly about 600 feet away from the operation at an upgradient
location. The nearest perennial surface water is Hominy Creek, which is approximately 700 feet
downgradient of the operation. The product storage area has an asphalt floor, and the runoff and/or

leachate from this area will drain onto the surface of the ground at the edge of the pavement.
/ Although the quality of this runoff water is questionable, the subsurface material consists of a dense,
sandy clay material and the seasonal high water table beneath this area is believed to exist at a depth
of approximately twenty feet below ground surface. In view of these conditions, it is unlikely that
groundwater quality will be impacted by the runoff water.
The Groundwater Section has reviewed the subject permit application and recommends issuance of
the permit with the following conditions:
* 1. Within sixty (60) days of permit issuance, the on-site non -potable water supply well shall be
clearly labeled as a non -potable supply well which contains water that is not fit for drinking.
2. The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in 15A
NCAC 2L, Groundwater Classifications and Standards. The Compliance Boundary for a disposal
system individually permitted after December 31, 1983 is established at either (1) 250 feet from
the waste disposal area, or (2) 50 feet within the property boundary, whichever is closest to the
waste disposal area. An exceedance of Groundwater Quality Standards at or beyond the
Compliance Boundary is subject to immediate remediation action in addition to the penalty
provisions applicable under General Statute 143-215.6A(a)(1).
In accordance with 15A NCAC 2L, a REVIEW BOUNDARY is established around the disposal
systems midway between the Compliance Boundary and the perimeter of the waste disposal area.
Any exceedance of standards at the Review Boundary shall require remediation action on the part
of the permittee.
3. Any groundwater quality monitoring, as deemed necessary by the Division, shall be provided.

I have reviewed the subject permit application and visited the location.
The current application is for distribution of animal residual solids. The composting operation
itself does not add any significant risk to the groundwater; the limited runoff associated with the
composting will drain back to the existing lagoon. The existing animal waste pit and lagoons are
operated by Crowell Dairy Farm, and they are operated under the animal waste management plan,
which is certified by the Division of Soil and Water Conservation.
The only additional risk to the groundwater associated with composting operation is at the
product storage area (silo in the application), which has an asphalt floor and is located on the west side
of the hill (see attached topo map). The runoff and/or leachate from this storage area will be
discharged onto the ground at the edge of the pavement. We may require some sampling to ensure the
groundwater will not be impacted.
The potential receptors: (1) No -potable water supply well is at a side gradient direction about
50 feet away from the composting bins; (2) Potable water supply well is at the up -gradient direction
about 600 feet away from the operation; (3) Hominy Creek is about 700 feet away in the down -gradient
direction.

A permit has been obtained from Solid Waste for a demonstration project through
October 2000. Because our future growth will most likely be focused on manure
management and since most dairies already have permits through DWQ, then we felt
that DWQ would be most familiar with the existing dairy operations and would be
better prepared to grant and administer our permit.

,;,rdance with 15A NCAC 2H .0200, pathogen reduction can be achieved using either 40CFl
art 257 or 40 CFR Part 503. Either Part a, or Part b and one of the options in Part c must be
completed (please submit all lab analysis, test results and calculations). Please check which test of
the following applies to the subject residual: See Exhibit D
a. A Fecal coliform density less than 1000 Most Probable Number per gram of total
dry solids, or
b. A Salmonella sp. Density less than 3 Most Probable Number per gram of total dry
solids, or
C. In addition to Part a, or Part b being met, one of the following alternatives must also
be completed. Please specify which of the following alternatives below will be met:
1. Alkaline treatment — the pH of the residuals is raised too greater than 12 for at
least 72 hours. During this time, the temperature of the residuals should be
Ike"° greater than 52° C for at least 12 hours. In addition, after the 72-hour period,
the residuals shall be air-dried to greater than 50% total solids.
2. Composting - using either the within-vessel or static aerated pile composting
methods, the temperature of the residuals are raised to 559C or higher for
three days Using the windrow composting method the residuals are raised
to S5 °Cor higher for fifteen days. During the high temperature period
there will be a minimum of five turnings of the windrow.
3. Heat Dr irk— Residuals are dried by direct of indirect contact with hot gases
to reduce the moisture content of the residuals to 10% or lower. Either the
temperature of the gas in contact with the residuals exceeds 80° C or the wet
bulb temperature of the gas in contact with the residuals, when the residuals
leave the dryer exceeds 80° C.
4. Heat Treatment — liquid residuals are heated to a temperature of 180°C or
higher for thirty minutes.
5. Pasteurization — the temperature of the residuals is maintained at 70°C or
higher for at least thirty minutes.
IV. GENERAL INFORMATION:
1. Please provide a brief narrative concerning materials handling, including the following:
(For new treatment facilities to be located in North Carolina)
a How will the waste product be handled and transported from where they are produced
to where they will be treated? Dairy Manure will be pumped through a separator
with the liquid returning to the collection pond and the solids collected for
composting. Moving the solids from separator to mixer will be accomplished with
front-end loader. Mixed materials will be stocked --pile on the asphalt pad for as
Tong as possible before re -mixed and moved into the bin& Wood waste will be
hauled via dump truck to the dairy and stockpiled there until mixed Storage
capacity of the asphalt pad will limit the amount of sawdust stockpiled there,
probably less than 100 yards at any one point

stockpiled onF asphalt pad immediately adjacent t separator until enou�
produced to maintain a minimum of 4 hours of continuos mixing with wood was.
This will amount to no more than 100 yards or one day's production of separated
manure.
C. What will be the duration of treatment of the animal waste product? The mixed and
staged compost mixture will be in initial storage for as long as possible before re-
mixing and filling of the bins. This will allow temperatures to begin to increase at
the exterior of the piles and will also facilitate some drainage of moisture during the
first few days of storage. This initial storage will not exceed 15 days and maybe as
short as 2 days: Once the mixture is placed in the bins and the air is turned on, it
will take approximately 48 hours to reach 1457 consistently throughout the bin.
This will mark the start of temperature controlled composting of the material and
will typically last 28 days at which time the temperature of the compost can no
longer be maintained above 1457, even with continuous airflow through the pile
d. Where will the final product be stored? Initially, the finished compost will be stored
at MOM's mulch yard on Smokey Park Hwy, approximately 6 miles from the farm
Once the desired inventory level at the yard is reached, approximately 200 yards,
then the additional finished -compost inventory will be stored at the dairy in an
empty ground silage silo. The silo has clay walls and either a concrete or asphalt
floor. These silos are capable of storing 4,000 cubic yards of material or about 5
months of finished compost The storage capacity is critical to the maturity of the
,finished compost and shall be maintained at the dairy in one of three silos currently
being used to store silage.
e. How will leachate collection from the raw product storage, treatment facility, and
finish -product storage be handled? All leachate from raw product storage and the
composting area will be naturally drained into the primary lagoon. The amount of
leachate, both from the raw product storage and from the composting operation is
very small in relation to the amount of collection pond overflow that goes into the
first lagoon. Final storage will not be covered since leachate should be minimal
f. How long will the final product be stored before being distributed? A minimum of 30
days after final processing is completed The target is 3 to 6 months
g. If new facilities are to be constructed in the State of North Carolina, please submit
three (3) sets of plans and specifications with the application for approval by the
Division: See Exhibit 9 F

h. How will the final product be distributed (packaging)? Initially, the finished and
cured compost will be blended with several soil amendments to produce a premium
potting soil blend This material will be sold in bulk from our mulch yard Bagging
has been discussed but no plans exist to bag the material in the immediate future

2All the material from the Crowell Farms Inc. composting operation will be sold to
contractors, nurseries, landscapers and homeowners in the Western North Carolina area.
Approximately 10, 000 cubic yards of compost will be produced annually, then mixed with a
variety of soil amendments to produce approximately 12, 000 cubic yards of soil Currently,
the largest consumer of the potting soil blends has not been targeted and that is the nursery
producer. This market will consume approximately 75% of the blended soil material
3. Please provide either a label, which shall be affixed to the bagged processed residual or an
information sheet, which will be provided to the person who receives the processed residual.
The label or information sheet shall contain, at a minimum, the following information: See
Exhibit F
a. The name and address of the person who prepared the residual that is sold or given
away in a bag or other container for application to the land.
b. A statement that application of the residual to the land is prohibited except in
accordance with the instructions on the label or information sheet.
C. A statement that the residuals shall not be applied to any site that is flooded, frozen or
snow covered.
d. A statement that adequate procedures shall be provided to prevent surface runoff from
carrying any disposed or stored residuals into any surface waters.
e. A statement which identifies that this material shall be prevented from entering any
public or private water supply source (including wells) and any stream, lake, or river.

The Division of Waste Management, Solid Waste Section, has reviewed
your request for approval of a Solid Waste Pilot Composting Project. Approval of
this activity is in accordance with the N.C. Solid Waste Management Rules, 15A
NCAC 13B .1409 and subject to the following conditions:
(1) The approval period is from receipt of this letter to October 31, 1999. If an
extension is needed it must be requested by October 1, 1999 with a
justification for the extension.
(2) Composting at this site shall be limited to the materials specified in the
application.
(3) The site shall be prepared to control run-off and run-on. Best management
practices shall be utilized for this purpose. All runoff from the site and any
leachate generated shall be directed through the existing leachate
management system for the dairy farm.
(4) Within 30 days of completion of the pilot project, or by December 1, 1999,
which ever occurs first, submit two copies of the final report to the Solid
Waste Section. The report shall include the information specified in the
approved application.
(5) This approval is subject to immediate revocation if activities on site result in
a director potential threat to the public health or environment, or significant
odor problems are created. The Division of Waste Management reserves the
right to apply any other requirements of 15A NCAC 13B Section .1400 as
the Division deems necessary during the above approval period.

�b) / Operation of the facility and compost monitoring activities will be in accordance with the
approved application and Section .1406 of the Solid Waste Management Rules. Records of
temperatures shall be maintained and shall be available to representatives of the Section
upon request.
(7) Compost testing, frequency of testing, and reporting of test results shall be in accordance
with the approved application and Section .1408 of the Solid Waste Management Rules.
All compost shall be tested and approved by the Solid Waste Section Prior to
distribution.
(8) The construction of each bin shall be approved by the Solid Waste Section prior to placing
materials in the bin for composting. Bin walls shall be of adequate structural integrity to
prevent leachate from seeping through the walls and to be sure that aeration is directed
upward through the entire bin. An adequately sized fan and air distribution system shall be
properly installed and in working order prior to adding materials to the bin.
(9) Classification and distribution of compost shall be in accordance with Section .1407 of the
Solid Waste Management Rules.
(10) This approval is not transferable.
(11) Prior to commencement of composting activities a pre-operation inspection shall be
conduction by Solid Waste Section staff. You should contact Ted Lyon at (919) 733-0692,
ext. 253 to schedule the inspection. Mr. Al Hetzell, Regional Waste Management
Specialist, will be responsible for oversight and inspection of the facility and activities.

Dear Mr. Warren:
The Division of Waste Management has received your request for approval of
Mountain Organic Materials' Compost product for distribution. The compost was produced
at the Mountain Organic Materials Compost Demonstration Site in Buncombe County.
The results of the NCDA waste analysis and the test for man-made inerts meet the
minimum requirements for unrestricted distribution. Three of the four samples that were
tested for pathogens met the minimum requirements, however, the fourth sample was over
the 1000 mpn fecal coliform limit.
Based on the information you have submitted your compost final product has been
given conditional approval for distribution. This approval is contingent on samples from the
next batch of compost produced being sampled to assure that the one bad sample was the
anomaly.
I suggest that you carefully review your pathogen sampling procedure and how the
sample is handled after it is taken. There is a good possibility that the one bad sample is
the result of poor sampling technique.

The Division of Waste Management, Solid Waste Section, has reviewed the as -
built drawings you submitted for the Mountain Organic Materials compost demonstration
project. The information you submitted is adequate for the most recently constructed bins.
Should you choose to apply for apermit to operate the facility, the application will
need to contain as built drawings for all four existing bins as well as all new bins.

Please keep in mind that your demonstration approval expires October 1, 2.000.
You will not be able to compost after that time unless you have obtained a permit.
