[SEGi Project #: OS-212.011 RE: Town of Carolina Beach -Ditching Plan 1131, 1223, 1227 & 1231 Saint Joseph Street Carolina Beach, New Hanover County, NC Nation Wide Permit 18 Dear Mr. McMillan: Our firm has been retained by the Town of Carolina Beach to pursue a Nation Wide Permit to impact 0.086 acre of jurisdictional wetlands. The site is located off Saint Joseph Street, in Carolina Beach, New Hanover County, North Carolina. The applicant is proposing to convert jurisdictional wetlands to Waters of the United States for the purpose of creating and maintaining at 30' drainage easement. There is an existing ditch found in the area, which that transects three properties: Mr. Freeman's (1131 Saint Joseph Street); Mr. Lanier's (1223 & 1227 Saint Joseph Street); and Mr. McDowell's (1231 Saint Joseph Street). The existing ditch does not have the capacity to convey the increased volume of water associated with the increased impervious surface areas found in this area of rapid development. The applicant is proposing to fill in the existing ditch, and take the measures listed below to create a new conveyance of water in this area: • The Town of Carolina Beach is proposing to excavate a new 3' deep ditch, to be used as stormwater outfall. • The new ditch will be a grassed Swale, lined with excelsior mat and seeded, with 3:1 side- slopes. • Only 15' of the allotted 30' easement will be impacted due to excavation and future maintenance the newly proposed ditch. • Excavation will be accomplished using heavy machinery, such as an backhoe. • The majority of spoil from the excavation will be utilized as fill material for the existing ditch. S~G~ • Any remaining spoil will be stored on highground within the Hidden Hills Subdivision. To off-set the conversion of jurisdictional wetlands to Waters of the United States, mitigation is offered through payment to the North Carolina Ecosystem Enhancement Program (NC EEP) at a 2.91:1 ratio (proposed impact = 0.086 acre, requested mitigation = 0.25 acre). The land found to the north-east of the subject parcel (the McDowell property) has a single family residential dwelling located toward the southern property boundary The land surrounding the proposed drainage easement is unimproved and the general land use in the vicinity of the project site is residential 10. Describe the overall project in detail, including the type of equipment to be used: The applicant is proposing to convert jurisdictional wetlands to Waters of the United States for the purpose of creating a 30' wide drainage easement The applicant is proposing to utilize a 15' portion of the aforementioned easement for the purpose of excavating and maintaining a new drainage ditch The existing ditch, found along the property boundary of the three parcels discussed herein, does not provide sufficient drainage for this rapidly developing area In order to allow for better flow and flood control in this area the applicant is ~ osing to excavate a new ditch through wetlands found on the parcels and use the spoil material to fill the existing ditch The proposed ditch will be dug to a depth of 3 feet with side slopes of 3:1 (grassed swalesl The remaining spoil from the freshly excavated ditch will be placed on highground within the Hidden Hills Subdivision (found off Saint Joseph Street in Carolina Beachl Applicant-has received permission from adjacent property owners to utilize a small portion of their lands in order to accommodate the proposed ditch By means of excavation, the ditch will be du through the adjacent properties, using heavy machinery such as excavators and backhoes Page 3 of 9 11. Explain the purpose of the proposed work: The intent of the project is to convert jurisdictional waters to Waters of the United States, for the purpose of creating and maintaining a 30' drainage easement The existing ditch found in this area does not provide sufficient flow of water in the area The excavation of a new ditch will allow for a better stormwater outfall. The Town of Carolina Beach will be responsible for the drainage easement and maintenance of the ditch. The newly proposed ditch will match the original grade and contour of the existing ditch, so it may tie into the existing inverts and allow for positive drainage IV. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of Page 6 of 9 aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USAGE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at httn://h2o.enr.state.nc.us/ncwetlands/strm~ide html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts.
