Box 29535, Raleigh, North Carolina 27626-0535 Telephone 919-733-7015 An Equal Opportunity Affirmative Action Employer NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT, HEALTH, AND NATURAL RESOURCES RALEIGH LEACHATE TREATMENT AND TRANSPORT FACILITIES In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO County of Macon Macon County FOR THE construction and operation of a-6000 GPD landfill leachate collection and disposal system which consists of a 480,000 gallon aerated lagoon, two 7400 gallon utility tanks for settling and remediation, approximately 456 linear feet of 4 -inch diameter force main, pumps, valves, piping, and other appurtenances to serve the Macon County landfill and the discharge of 6000 GPD of collected leachate into the Town of Franklin's existing sewerage system, pursuant to the application received on May 16, 1991, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment, Health, and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until April 30, 1993, and shall be subject to the following specified conditions and limitations: I. PER 1. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications. Mail the Certification to the Permits and Engineering Unit, P.O. Box 29535, Raleigh, NC 27626-0535. 2. The Asheville Regional Office, phone no. 704/251-6208, shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an in-place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 3. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 4. The sludge generated from these treatment facilities must be disposed of in accordance with General Statute 143-215.1 and in a manner approved by the North Carolina Division of Environmental Management. 5. Diversion or bypassing of the wastewater from the treatment facilities is prohibited. 1 6. The facilities must be properly maintained and operated at all times. 7. The wastewater collected by this system shall be treated in the Town of Franklin's Wastewater Treatment Facility prior to being discharged into the receiving s stream. 8. Construction of the facilities shall be scheduled so as not to interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater to the surface waters of the State. 9. The facilities shall be protected from the 100-year flood. 10. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater collection facilities. 11. This permit shall become voidable unless the agreement between the County of Macon and the Town of Franklin for the collection and final treatment of wastewater is in full force and effect. 12. This permit shall become voidable unless the agreement between the County of Macon and the Town of Franklin for the construction and operation of the leachate collection facilities on the Town of Franklin's property is in full force and effect. 13. At least two feet of freeboard shall be maintained in the lagoon at all times. II. OPERATION AND MAINTENANCE REQUIREMENTS 1. The facilities shall be properly maintained and 'operated at all times. 2. Upon classification of the facility by the Certification Commission, the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge of the wastewater treatment facilities. The operator must hold a certificate of the type and grade at least equivalent to the classification assigned to the wastewater treatment facilities by the Certification Commission. Once the facility is classified, the Permittee must submit a letter to the Certification Commission which designates the operator in responsible charge within thirty days after the wastewater treatment facilities are 50% complete. 3. The facilities shall be effectively maintained and operated as a non-discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. III. LVIONITORING AND REPORTING REQUIREMENTS 1. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 2 2. Should there be concentrations in the lagoon which require treatment, or if the lagoon is not in use, (additional) samples shall be taken from the appropriate tank. 3 In addition to the definitions in the Town of Franklin's Sewer Use Ordinance, the following definitions apply: a. A,composite sample, for monitoring requirements, is defined as the collection ofa minimum of one grab sample per hour for each hour of discharge during the entire discharge period on the sampling day. For the purposes of this permit, if the facility is operated in the batch discharge mode, a grab sample from any properly mixed tank shall be considered a composite sample. b. A "daily" monitoring frequency shall mean each working day. c. A "grab" sample, for monitoring requirements, is defined as a single "dip and take" sample collected at a representative point in the discharge stream. 4. d. An "instantaneous" measurement, for monitoring requirements, is defined as a single reading, observation, or measurement. The effluent from the subject facilities shall be monitored by the Permittee at the point prior to discharge to the Town of Franklin for the following parameters. Should monitoring indicate results in excess of the indicated concentrations, the Town and the Division shall be notified immediately. The appropriate action shall be determined on a case by case basis. In no case will concentrations which could be detrimental to the Town of Franklin's wastewater treatment facility be allowed. The discharge shall be evaluated for all volatile fractions, acid fractions, base/neutral fractions, and pesticide fractions listed in Table II of Appendix D of 40 CFR Part 122 and all metals, cyanide, and phenols listed in Table III of Appendix D of 40 CFR Part 122. The permittee shall test the effluent for any pollutants listed in Tables IV and V of Appendix D of 40 CFR Part 122, if a specific to the above testing requirements, other significant levels of synthetic organic chemicals must be identified. For the purpose of implementing this requirement, the largest 10 percent of the GC/MS peaks other than the priority pollutants shall be identified. All tests shall be performed in accordance with the EPA Reference Methods listed in 40 CFR Part 136. 5. Test procedures for the analysis of pollutants shall be performed in accordance with the techniques prescribed in 40 CFR Part 136 and amendments thereto unless specified otherwise in the monitoring conditions of this permit. 6. Samples and measurements taken as required herein shall be representative of the volume and nature of the monitored discharge. All samples shall be taken at the monitoring points specified in this permit and, unless otherwise specified, before the effluent joins or is diluted by any other wastestream, body of water, or substance. Monitoring points shall not be changed without notification and prior written approval by this Division. 7. If the permittee monitors any pollutant at the location(s) designated herein more frequently than required by this permit, using approved analytical methods as specified above, the results of such monitoring shall be submitted to the Division. The Division may require more frequent monitoring or the monitoring of other pollutants not required in this permit by written notification. 8. Once the permit is modified to incorporate the monitoring wells and the appropriate monitoring and reporting, if groundwater sampling indicates or predicts problems with the compliance with Groundwater Standards, this permit will be modified to include additional and/or more restrictive limitations. 9. Three copies of all monitoring data (as specified in condition III.2 and IIIA) shall be submitted on or before of the last day of the following month to the following address: NC Division of Environmental Management Water Quality Section Facility Assessment Unit PO Box 29535 Raleigh, NC 27626-0535 10. In addition, one copy of the results of all of the monitoring shall be submitted to the Town of Franklin, 70 West Main Street, Franklin, North Carolina 28734. 11. No residuals shall be removed from the facility without the written approval from the Division of Environmental Management under the North Carolina General Statutes and appropriate Administrative Code Sections. 12. A maintenance log shall be maintained at this facility including but not limited to the following items: a. Visual observations of the facility and facility site. b. Record of preventative maintenance. 4 13. Noncompliance Notification: The Permittee shall report by telephone to the Asheville Regional Office, telephone no. 704/251-6208, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester, the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any time that self-monitoring information indicates that the facility has gone out of compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS 1. The Compliance Boundary for the disposal system is specified by regulations in 15 NCAC 2L, Classifications and Water Quality Standards applicable to the groundwater of North Carolina. An exceedance of Groundwater Quality Standards beyond the Compliance Boundary is subject to penalty provisions applicable under General Statute 143-215.6(1)x. The sale of property, by the Permittee, which is within or contiguous to the disposal system site may alter location of the Compliance Boundary. 2. For facilities permitted on or after December 30, 1983, the Compliance Boundary is established at the lesser of 250 feet from the treatment lagoon, or 50 feet within the property boundary. 3. The REVIEW BOUNDARY for the disposal system is specified by regulations in 15 NCAC 2L, Groundwater Classifications and Standards. A REVIEW BOUNDARY is established around disposal systems midway between the Compliance Boundary and the perimeter of the waste disposal area. When the concentration of any substance equals or exceeds the maximum allowable concentration of that substance at the REVIEW BOUNDARY, as determined by monitoring, the permittee shall either (i) demonstrate, through predictive calculations or modeling, that natural site conditions, facility design and operational controls will prevent a violation of standards at the Compliance Boundary; or, (ii) submit a plan { for the alteration of existing site conditions, facility design or operational controls that will prevent a violation of standards at the Compliance Boundary, and implement that plan upon its approval by the Director. 5 4. Any groundwater quality monitoring as deemed necessary by the Division of Environmental Management shall be provided. V . INN.SPE TIONS 1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 2. The Permittee or his designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by, the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division of Environmental Management or other permitting authority. 3. Any duly authorized officer, employee, or representative of the Division of Environmental Management may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site and facility at any. reasonable time for the purpose of determining compliance with this permit; may inspector copy any records that must be kept under the terms and conditions of this permit; or may obtain samples of groundwater, surface water, or leachate. 1 This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans, specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Environmental Management accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6. 5. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 6. Prior to any transfer of this land, a notice shall be given to the new owner that gives full details of the materials applied at this site. 7. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of the project. A 8. The annual administering and compliance fee must be paid by the Permittee within thirty days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). a The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. Within thirty days after issuance of this permit, the County of Macon shall provide three copies of the boring logs (for those borings near the lagoon) to the Division's Asheville Regional Office. Within thirty days after issuance of this permit, the County of Macon shall provide evidence to the Division's Asheville Regional Office that the owner/authority of the connecting sewer line has obtained the appropriate permit(s) from this Division for relocation/construction of these sewers. Within thirty days of issuance of this permit, the County of Macon shall request monitor well construction permits from the Division's Asheville Regional Office. Immediately upon receipt of those monitor well construction permits, the County of Macon shall make a formal request to the Division's Permits and Engineering Unit that this permit (Permit No. WQ0005075) be modified to incorporate the requirements for monitor wells, along with the appropriate requirements for sampling and analysis. The Division feels that you should be able to provide actual characteristic values from operating landfills. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications. Mail the Certification to the Permits and Engineering Unit, P.O. Box 29535, Raleigh, NC 27626-0535. 2. The Asheville Regional Office, phone no. 704/251-6208, shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an in-place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 3. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 4. The sludge generated from these treatment facilities must be disposed of in accordance with General Statute 143-215.1 and in a manner approved by the North Carolina Division of Environmental Management. 5. Diversion or bypassing of the wastewater from the treatment facilities is prohibited. 13. Noncompliance Notification: The Permittee shall report by telephone to the Asheville Regional Office, telephone no. 704/251-6208, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any time that self-monitoring information indicates that the facility has gone out of compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS 1. The Compliance Boundary for the disposal system is specified by regulations in 15 NCAC 2L, Classifications and Water Quality Standards applicable to the groundwater of North Carolina. An exceedance of Groundwater Quality Standards beyond the Compliance Boundary is subject to penalty provisions applicable under General Statute 143-215.6(1)a. The sale of property, by the Permittee, which is within or contiguous to the disposal system site may alter location of the Compliance Boundary. 2. For facilities permitted on or after. December 30, 1983, the Compliance Boundary is established at the lesser of 250 feet from the treatment lagoon, or 50 feet within the property boundary. 3. The REVIEW BOUNDARY for the disposal system is specified by regulations in 15 NCAC 2L, Groundwater Classifications and Standards. A REVIEW BOUNDARY is established around disposal systems midway between the Compliance Boundary and the perimeter of the waste disposal area. When the concentration of any substance equals or exceeds the maximum allowable concentration of that substance at the REVIEW BOUNDARY, as determined by monitoring, the permittee shall either (i) demonstrate, through predictive calculations or modeling, that natural site conditions, facility design and operational controls will prevent a violation of standards at the Compliance Boundary; or, (ii) submit a plan for the alteration of existing site conditions, facility design or operational controls that will prevent a violation of standards at the Compliance Boundary, and implement that plan upon its approval by the Director. 5 4. Any groundwater quality monitoring as deemed necessary by the Division of Environmental Management shall be provided. V. INSPECTIONS 1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 2. The Permittee or his designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division of Environmental Management or other permitting authority. 3. Any duly authorized officer, employee, or representative of the Division of Environmental Management may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site and facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be kept under the terms and conditions of this permit; or may obtain samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS 1. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans, specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Environmental Management accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 4. Failure to abide by the conditions and limitations contained in this pernut may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6. 5. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 6. Prior to any transfer of this land, a notice shall be given to the new owner that gives full details of the materials applied at this site. 7. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of the project. 6 8. The annual administering and compliance fee must be paid by the Pennittee within thirty days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 9. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. 10. Within thirty days after issuance of this permit, the County of Macon shall provide three copies of the boring logs (for those borings near the lagoon) to the Division's Asheville Regional Office. 11. Within thirty days after issuance of this permit, the County of Macon shall provide evidence to the Division's Asheville Regional Office that the owner/authority of the connecting sewer line has obtained the appropriate permit(s) from this Division for relocation/construction of these sewers. 12. Within thirty days of issuance of this permit, the County of Macon shall request monitor well construction permits from the Division's Asheville Regional Office. Immediately upon receipt of those monitor well construction permits, the County of Macon shall make a formal request to the Division's Permits and Engineering Unit that this permit (Permit No. WQ0005075) be modified to incorporate the requirements for monitor wells, along with the appropriate requirements for sampling and analysis. The following are thought to be advantages of this site: 1. There is very little off-site drainage on to the property. 2. There are existing vegetated buffers along Lake Emory. "Wetlands" type vegetation growth should be encouraged. 3. There appears to be only one small stream with one tributary on the property. The existing ponds which appear to be in this stream are part of a non -discharging agricultural wastewater treatment system, the stream by-passes the ponds. ` These ponds could be used for sedimentation control or other purposes; however the Division of Environmental Management should be consulted prior to allowing a dis- charge to occur from the ponds. 4. There has been a hog feeding operation on this site for years. A landfill here could, in fact, provide some improvement regarding odors. 7. This site is near the old landfill, but hauling distance will be somewhat shorter. In conclusion, this site appears to be the most acceptable location which has been evaluated thus far. The five sites that were evaluated were as follows: (1) Shope property in Coweeta, (2) Hannah property in Patton Valley, (3) Bradley property in Oak Grove, (4) Ledford property in Franklin, (5) Deal property in Corbin Knob. The five properties were evaluated against each other as to how well they met the criteria previously established,by the Task Force and approved by this Board. Each criteria had been weighted by the Task Force as to what we felt was their relative importance. Each site was then given a weighted value on each criteria as to how it met that particular criteria and how it compared to the other sites. USEABLE ACRES - Value = 8 The Task Force had established that 100 useable acres was desired but not mandatory. A. Hannah Property - 80 total points The Hannah property contains 245 acres that is useable for either trenches or fill material and rated highest for this criteria. Score = 10 B. Ledford Property - 72 total points The Ledford property contains 125 acres that is useable for trenches or fill. Areas of useable land is continuous and most could be used for trenches. Score = 9 C. Shope Property - 48 total points The Shope property contains 100 acres that is useable for trenches or fill. Areas of useable land is segmented which would lessen the amount that could be used for trenches. Score = 6 D. Bradley Property - 32 total points The Bradley property contains 90 useable acres that is useable for trenches or fill. Score = 4 E. Deal Property = 24 total points The Deal property also contained 90 useable acres. Useable land is segmented. POLLUTION POTENTIAL -Value = 8 The Task Force is concerned for the potential for pollution, especially surface or ground water. A. Ledford Property - 80 total points The Ledford property contains only one stream which runs ---into Lake Emory. There is also city water available to residences in the area which would minimize any problems shoud groundwater become polluted. The soil contained on the property would also make the potential for pollution very low. Score = 10 B. Hannah Property - 24 total points The Hannah Propety has Blaine Branch running through the property along with several spring heads. Although only 10 residences are down stream from the property and the soil has a low potentional for pollution, the Task Force felt that any pollution could be a problem. Score = 3 C. Bradley Property - 24 total points The Bradley property has Caler Creek running through the property with 44 residences down stream. Although the soil has a low probability of pollution, the Task Force felt the impact would be equal to that of the Hannah tract. Score = 3 D. Deal Property - 16 total points The Deal property has Cat Creek running through the property with 20 residences down stream. The soil contained on the property would indicate a high potential for pollution. Score = 2 E. Shope Property - 8 total points The Shope property has the North Fork of Coweeta Creek running through the property with 200 resi- dences down stream. The soil also indicates a high potential for pollution. Shope Property The Shope property is a long time family farm having been purchased -by the Shope family in 1845. The property is also valued as a wildlife habitat as sell as containing many wild plant and flowers that are currently listed as endan- gered species. There have also been finds of significant historical artifacts during archeological exploration. There are four residences located on the property which include a new house currently under construction by Mr. Shope. B. Hannah Property The Hannah property is located in Patton Valley. This area has a high potential for growth and the county would possibly stand a loss of revenue due to the relatively high land value. The property has also been owned by the Hannah family for many years and contains the residences for seven family members plus the Hannah homeplace. There is also a potential for a large number of people to be affected by noise, smell, etc. C. Bradley Property The Bradley property is a working farm that has-been in the Bradley family for 50 years. There are two churches in the immediate area that could be adveresly affected due to the fact that the property would be difficult to screen from view. The Oak Grove area also has potential for growth. The Bradley homeplace is on property. D. Ledford Property The Ledford property now contains a hog farm. There is a potential for a large number of people to be affected by noise, smell, etc. There is also a question concerning the possibility of the property being annexed into the Franklin City limits. E. Deal Property The Deal property is also a working family farm. There is probably no such thing as a "perfect" site for a landfill. The purpose of this evaluation was to identify the best balanced choice. The Task Force feels that we have accomplished this goal. I have summarized below my comments on the three sites inspected by us: Site 4 (Third Choice) - The site is isolated from homes but has two streams running through the middle of the site. It is not bounded on the downgradient side by a major stream or river so groundwater contamination could probably be expected off site. There would be some areas along the streams on site where the water -table would be less than four feet below the land surface. There are not a lot of rock outcrops on the site and adequate cover material would probably be available. Site 5 (Second Choice) - This site is generally similar to site 4 except that the stream on site does not restrict the site to the extent the two streams do on site 4. The ranking of this site as the second choice would be dependent upon obtaining property downgradient from the site to the Little Tennessee River. Memorandum Page 2 March 31, 1987 Nanthala Power & Light Site (First Choice) - This site is bounded on its downgradient side by the Little Tennessee River and only one home is below the site and the river. This home is currently being rented by NP & L and could be abandoned. There are two very small streams on the property on the southeastern and southwestern boundaries, but they could easily be avoided due to their limited drainage area. This is by far the best site in regard to limited potential for off site groundwater contamination. The Nantahala Powsr and Light Company property, centered about Latitude 35 161 3011N and Longitude 830 261 5011W. Of the three sites reviewed, this site is by far the most preferable because it is near the Little Tennessee River which is Class "C" at this point. The river volume should be adequate to minimize any effects on the surface waters that might be caused by the landfill. The necessary setbacks to avoid the 100 year flood plain should result in a minimum of 1000 foot buffer between the landfill and the river. 2. Site number five - Queen Branch drainage area. The forest service has refused to lease additional land to Highlands for the proposed landfill because the proposed landfill does not meet current environmental regulations and it will pollute the underground water supply of nearby residents. The County now proposes to circumvent these laws by acquiring land from Duke Power and swapping it with the forest service for the existing landfill site plus an additional seventy acres. We question whether a tactic like this is compatible with national and state land exchange and environmental policy.- 43 olicy. 43 USC 51716, regarding exchanges of National Forest Service lands for state or municipal lands, requires that the Secretary of Agriculture give full consideration to whether the objectives of the National Forest Service are best served by the proposed exchange. 36 CFR §254.3 requires that the forest service give full consideration to whether the exchange will result in a decrease in public values or the inability to meet National Forest Service management objectives. A new, full service landfill is currently being developed in Franklin, North Carolina, merely fourteen miles away. Not only will the proposed landfill in Highlands be duplicative of the Franklin landfill, but it will have a limited life span, will also significantly increase the ground water and surface water contamination of the area, it will add substantial truck exhaust emissions and other air pollution, and will negatively impact the remaining forest service lands and the full time residents living nearby. We oppose this senseless proposal and ask that you forward on any information you may obtain regarding the status of this matter, new regulations which will effect it, or any other thoughts you may have on the proposal. Representatives of the Task Force (Don Link, DEM -Ground Water; Bill Anderson, DEM -Water Quality, M.L. Babuin, SHWMB) met on Wednesday March 25, in Franklin, N.C. to evaluate several potential landfill sites. The following comments concern the referenced sites on the enclosed diagram in order of preference: 1) q;tp nwnt—a by NP T. (84 acres) -This site appears to meet many of the ' optimum siting criterea standards. It islocatedadjacent to a major discharge which has.virtually no surface water intakes for many miles downstream. Additionally, no surface springs or tributaries exist within the site which would require buffering and/or engineering modifications. Additionally, it is recommended that the county attempt to acquire the parcel of land indicated in red (on the enclosed map) immediately west of the site, to further 'expand the operating area, if at all possible. 2) Site number 5 (North of N.C. 28) may have potential for a prospective site if the following conditions/ alterations are met. First, the property between the river and the boundary of the site (as drawn) would have to be acquired. Extensive roads would have to be constructed to overcome the steep topography (which may render the prospect of this site from an economic point of view, infeasible), 3) All other sites are limited by one of the following: springs/seeps, tributaries, small size, potential ground water problems, access or other miscellaneous siting obstacles. As of this writting,-it is uncertain whether or not the utility company (NP&L) will sell or lease their property. Therefore, the sites which we evaluated which are owned by NP$L may be unavailable for use. Recommendations 1) The 'county should ascertain the availability of said properties. 2) If these lands are unavailable or not accessible, additional effort in locating other sites (which the Task Force has not previously evaluated) should be expanded, and the Task Force is to be notified accordingly. 3) If the first property described in this report is attainable, the county should proceed with the logistics of submitting a site plan to the State through a consulting engineering firm and/or geotechnical engineering firm, per NCAC 10G, Section .0202(a)(3). Paul Wilms SUBJECT: Proposed Macon County Sanitary Landfill Expansion The Division staff has reviewed the conceptual plan and geologic report for the proposed expansion. While having no objections to the facility per se, we are concerned as to what effect the existing landfill may already have had on areal groundwater quality. This concern is based on (1) the fact that a portion of the flow of any leachate from the existing landfill would be in the direction of the proposed site, (2) that it is our understanding that there are no wells monitoring groundwater quality at the existing landfill, and (3) there has been no determination of existing groundwater quality. To address this issue, we would highly recommend that one (1) upgradient and three (3) downgradient monitor wells should be installed and sampled to establish existing groundwater quality prior to initiation of any construction or operational activities. We would request that the groundwater staff in our Asheville Regional Office be consulted in the design and implementation of this monitoring well net- work. As to the sampling schedule and parameters, we would recommend that the initial sampling should be followed by a triannual sampling, during the months of March, July, and November, for the following: Nitrate, Total Ammonia, Total Dis- solved Solids, Total Organic Carbon, Chloride, Copper Cadmium, Zinc, Phenol, Total Coliform, Bacterial Oxygen Demand, pH and Water Levels. It would also seem reasonable, considering the similarities of the existing land- fill and the proposed expansion area, that an upgradient and at least one downgradient groundwater monitor well be constructed at the existing landfill.to indicate the amount,of groundwater contamination that may have been caused by it. I have summarized below my comments on the site. The property is bordered on its downgradient.side by the Little Tennessee River near the headwaters of Lake Emory; The site is presently a hog and cattle farm. There is a small stream near the central portion of the site and a lagoon for treating animal waste. There is sufficient available land for a 300 foot buffer area to be m4intained adjacent to surface waters. There is a private residence on the property with a water supply well located near the upgradient property boundary.; According to the well record, the drilled well is 200 feet deep with 55 feet of casing and a yield of 30 gpm. It is recommended that if refuse is placed within 100 feet of the well, the well should be properly abandoned according to NCAC Title 15 Subchapter 2C. There are some residences located adjacent to the property near the upgradient boundary that have water supply wells, but city water is available. It is recommended that the water supply wells be sampled for volatile organics, base/neutral/acid extractable organics, and metals for background purposes, prior to the initiation of landfill activities. - Memorandum Page 2 November 15, 1988 There were no rock outcrops noticed on the site and there appears to be adequate cover material available. I.have lived next to this property all of - my life and have walked almost every inch of this land. I feel that I know as much about the land as anyone else. There ;,re some decrepancies in the report that I want you to be aware of as the process continues. 1. Mr. Anderson speaks about existing vegetated buffers along Lake Emory. There are at least 2 acres or more of wetlands that have been filled in along the Tennessee River and Lake Emory. lie speaks of only one small strearn with one tributary on the property. There are 3 springs on this property; two of which have been covered with dirt. Mr. Anderson says that the site would not be visible to a great number of people. According to the Local Task Force report there are more than 440 residents living within a half mile of this site. In reference to a landfill being an im- provement over the hog farm, that is a matter of',opinion. 2. Jim Patterson speaks about no rock formation on the property. I can show you at least 2 rock formations. In reference to wells on the property --there are more than one home withirIi 100 feet of the property lines: Also, there area drilled wells on the property and 2 wells that have been filled. 3. In conclusion, I disagree with Mr. Davis, Mr. Link and Kay Dechant in regards to the limited potential for'off site groundwater contamination. It appears to me that there is a high potential for polluting the Tennessee River. The following are thought to be advantages of this site: 1. There is very little off-site drainage on to the property. 2. There are existing vegetated buffers along Lake Emory. "Wetlands" type vegetation growth should be encouraged. _�3., There appears to be only one small stream with one tributary on the property. The existing ponds which appear to be in this stream are part of a non -discharging agricultural wastewater treatment system, the stream by-passes the ponds. These ponds could be used for sedimentation control or other purposes; however the Division of Environmental Management should be consulted prior to allowing a dis- charge to occur from the ponds. 4,4. My conclusions are summarized in the following paragraphs. The Ledford farm consists of 208 acres, 100 of which Macon County feels is useable for landfill operations. The land for the most part consists of gently rolling hills and is bordered on the western property boundary by the Little Tennessee River. The terrain is such that even though the property borders the river,only a small amount of land would lie in the flood plain. City water would be available, if necessary, to this house Based on its location and proximity to the site, the county may wish to pursue the purchase of this residence. There is another house with a private well located on the Ledford tract of land. This ho!ise would be sold to the county along with the rest of the land. Most of the houses in the vicinity are located along the eastern boundary of the Ledford farm. The majority of these houses have private water supplies, but city water is available to them.X,,It appears that a large buffer zone could easily be created between disposal areas and the houses. November 9, 1988, I met with Jack Horton, the County Manager of Macon County, Jim Patterson of the Solid Waste Branch of DHR, Darrell Herndon of the Water Supply Branch of DHR, and Oscar Ledford, the property owner, to make an evaluation of the subject proposed landfill site. I have summarized below my comments on the site. Th(( property is bordered on its downgradient side by the Little Tennessne River near the headwaters of Lake Emory. The site is prespr►tly a hog and cattle farm. There is a small stream near the central.portion of the sits and a lagoon for treating animal waste. There is sufficient available land for a 300 foot buffer area to be maintained adjacent to surface waters. There is a private residence on the property with a water supply well located near the upgradient property boundary. According to the well record, the drilled well is 200 feet deep with; 55 feet of casing and a yield of 30 gpm. It is recommended that if recuse is placed within 100 feet of the well, the well should be properly abandoned according to NCAC Title 1.5 Subchapter 2C. There are some residences located adjacent to the property near the upgradient boundary that have water supply wells, but city w.it.er is available. Breaching of the existing hog farm wastewater lagoons is proposed. A discharge of this wastewater to the surface waters of the State is not acceptable. The water in the lagoons must be spray irrigated as the lagoons are filled in order to comply with the agricultural management practices under which these lagoons exist. It is recommended that the water supply wells located at the residences adjacent to the southeastern landfill boundary (upgradient of proposed Cell 1) be sampled prior to the initiation of landfill activities. It is also recommended that the water supply wells at residences adjacent to the eastern and southern landfill boundaries be sampled prior to landfilling in cell numbers 4 and S. For background purposes, the water supply wells should be sampled for volatile organics, base/neutral/acid extractable organics, and metals. A well construction permit shall be obtained from this office prior to the construction of any monitor wells. KD/dk
