RALEIGH,NORTH CAROLINA 27608 Subject: Notice of Violation and Notice of Intent to Enforce NOV-2018-PC-0458 NPDES Wastewater Treatment System Handee Hugo #96 6927 Buffalo Road, Raleigh COC No. NCG551475 Wake County Dear Mr. McDowell: On November 29, 2018, Cory Larsen from Wake County Department of Environmental Services, on behalf of the Division of Water Resources, performed compliance evaluation inspection of the subject NPDES wastewater treatment system. The purpose of the inspection was to evaluate compliance with the above permit to discharge treated wastewater. The following permit condition violations were observed at your facility and require your prompt attention(also refer to attached inspection report): 1) Effluent was observed ponding on the ground surface instead of draining off to the roadside ditch. The riprap outfall needs to be cleared of vegetation/regraded to remove effluent from the site. Item 1 constitutes a violation of Part I Permit Conditions (Operation & Maintenance) of General Permit NCG550000 which requires in part that, "All system components, including but not necessarily limited to, septic tanks, surface sand filters, other filter components, pump/recirculation tanks, controls and alarms, disinfection units, dechlorination apparatus, and the outfalls shall be maintained at all times and in good operating order." Please include in your response all corrective actions that you performed on the system to correct the violations. Failure to comply with conditions in a peirriit may result in a recommendation of enforcement action,to the Director of the Division of Water Resources who may issue a civil penalty assessment of not more that twenty-five thousand ($25,000) dollars against any"person"who violates or fails to act in accordance with the terms, conditions, or requirements of a permit under authority of-CS. 143-215.6A.
