In accordance with your application received August 23, 1988, we are
forwarding herewith. Permit No. WQ0000195, dated November 30, 1988, to the Town of
Waynesville for the continued operation of the subject sludge disposal landfill.
This permit shall be effective from the date of issuance until October 31,
1993, and shall. be subject to the conditions and limitations as specified therein.
This permit is a renewal of the existing permit (#7972R) and does not include
your request for an alternate means of sludge disposal.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to request an adjudicatory hearing upon
written .request within 30 days following receipt of this permit. This request must
be in the.for_m of a written petition, conforming .to Chapter 150B of North Carolina
General Statutes, and filed with the Office of Administrative Hearings, Post Office
Drawer 11666, Raleigh, North Carolina 27604. Unless su�-h demands are made this
permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
continued operation of sludge disposal facilities consisting of land burial of dried
sludge from the Waynesville Wastewater Treatment Plant and the Waynesville Water
Treatment Plant to 12.15 acres with no discharge of sludge or wastewater to the
surface waters, pursuant to the application received August 23, 1988, and in
conformity with the project plan, specifications, and other supporting data. -
subsequently filed and approved by the Department of Natural Resources and Community
Development and considered a part of this permit.
This permit shall be effective from the date of issuance until October 31, 1993,
and shall be subject to the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities have been constructed in
accordance with the approved plans, specifications and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit shall become voidable in the event of the failure of the site to
adequately accept the wastes, and may be rescinded unless the facilities are
maintained and operated in a manner which will protect the assigned water quality
standards of the surface waters or groundwaters.
5. In the event that the facilities fail. to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take such immediate
corrective action as may be required by this Division, including the construction
of additional or replacement wastewater treatment or disposal facilities.
6.= Adequate provisions shall be taken to prevent wind erosion and surface runoff
from conveying pollutants from the sludge application area onto the arjacent
property or into the surface waters.
7. The issuance of this permit shall not relieve the Permittee of the respons_bility
for damages to surface or groundwaters resulting from the operation of this
facility.
8. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater resulting .from the opera ion of
this facility.
9. No type of sludge other_ than that from the Waynesville Wastewater and
Waynesville Water Treatment Plants shall be placed on the land appl_cation
disposal site.
10. No traffic or equipment shall be allowed on the disposal area except while
installation occurs or while normal maintenance is being performed.
11. A minimum 25 foot buffer shall be maintained between the sludge disposal area and
all property lines.
12. A suitable year round vegetative -cover shall be maintained.
1.3. The site shall be adequately limed to a soil pH of 6.5 prior to sludge
application.
14. The application rates shall not exceed 46,600 cubic feet/year of dried sludge.
15. Adequate records shall. be maintained by the permittee concerning sludge d-isposal
activities. These records must include, but are not necessarily limited to the
following:
a.. Date of sludge disposed
b. Volume of sludge disposed
c. Facility from which the sludge originated.
These records shall be maintained on a monthly basis and submitted to the Water
Quality Supervisor of the Asheville Regional Office annually on or before
January 15 of the following year.
16. Within 90 days°of permit issuance, one (1) downgradient monitor well shall be
installed to monitor groundwater quality. The location and construction retails
for this well shall be by approval of the Asheville Regional Office, from which a
well construction permit must be obtained.
17. The new monitor well and the three (3) existing monitor wells (total: 4 wells)
shall. be sampled every March, July and November for the following parameters:

Potassium Zinc
Sodium TOX (in Nov. only)
SO4 Copper
The measurement of water level must be made prior to sampling.
The new monitor well must be sampled (initially) immediately following
construction for the parameters specified above.
The analytical methods used for TOX must be capable of detecting the total of
all halogenated organic compounds present at a concentration of 5.0 parts per
billion (ppb) or greater. In the event that a TOX concentration of 5.0 ppb or
greater is detected, any individual halogenated organic compound(s) present at a
concentration at or above the method detection limit (MDL) must be identified and
quantified utilizing EPA methods 601, 602, 604 and 611.
The results of the sampling and analysis shall be sent to the N.C. Division of
Environmental. Management on Form GW -59 (Compliance Monitoring Report Form) every
April, August and December.
18. Any additional groundwater quality monitoring as deemed necessary by the
Department, shall be provided.

extensions.

operation of land application facilities to dispose of dried sludge from the
City of Waynesville's Wastewater Treatment Plant by land burial to 12.15 acres
of effective application area and no discharge to the surface waters of the State,
pursuant to the amendment request received February 4, 1986, and in conformity
with the project plan, specifications, and other supporting data, subsequently
filed and approved by the Department of Natural Resources and Community Development
and considered a part"of this permit.
This Permit shall be effective from the date of issuance until September 1,
1988, and shall be subject to the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in
accordance with the approved plans, specifications and other supporting data.
2. This permit is effective only with respect to the nature and volume of
wastes described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit shall become voidable in the event of the failure of the site
to adequately accept the wastes, and may be rescinded unless the facilities
are installed, maintained and operated in a manner which will protect the
assigned water quality standards of the surface waters, and prevent any
contamination of the ground waters which will render them unsatisfactory
for normal use.
5. In event the facilities fail to perform satisfactorily including the creation
of nuisance conditions, the Permittee shall take such immediate corrective
action as may be required by this Department.
6. Division of bypassing of the sludge from the disposal facilities is prohibited.

7. Any monitoring deemed necessary by the Division of Environmental Management
to insure surface and ground water protection will be established and an
acceptable sampling reporting schedule shall be followed.
8. Adequate facilities shall be provided to prevent surface runoff from carrying
any disposed or stored material into the receiving stream.
The issuance of this permit shall not relieve City of Waynesville of the
responsibility for damages to surface or ground waters resulting from the
operation of this facility.
10. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater into the.surface waters
of the State.
11. No type of sludge other than that from the City of Waynesville's Wastewater
Treatment Plant shall be placed in the landfill disposal site.
12. No traffic or equipment shall be allowed on the disposal area except while
installation occurs or while normal maintenance is being performed.
13. A minimum 25 -ft. buffer shall be maintained between the sludge disposal area
and all property lines.
14. The application rate shall not exceed 46,600 cubic feet/year of dry sludge.,
15. A suitable year round vegetative cover shall be maintained.
16. The site shall be adequately limed to a soil pH of 6.5 prior to sludge
application.
17. Report on the operations of the facilities shall be submitted to the Asheville
Regional Office at regular intervals such form and detail as may be required
by this Department.
18. The Permittee, at 'Least six (6) months prior to the expiration of the
Permit shall request its extension. Upon receipt of the request, the Com-
mission will review the adequacy of the facilities described there -in, and
if indicated, will extend the Permit for such period of time and under such
period of time and under such conditions and limitations as it may deem appropriate.

Monitoring wells shall be constructed in accordance- with 15 NCAC 2C .0100
and sampled during the months of March, July and November for the following
parameters: cadmium, calcium, copper, iron, lead, magnesium, sodium, zinc,
pH, chlorides, sulfate, nitrate, total ammonia (TA), total dissolved solids
(TDS), total organic carbon (TOC) and total coliform.
20. Within 90 days of permit issuance, one downgradient monitor well should be
installed to monitor groundwater quality. The location and construction details
for these wells should be by approval of the Asheville Regional Office, from
which a well construction permit must be obtained.

(one upgradient, one downgradient) should be sampled every March, July and
November for the following parameters:

Dear Mr. Sutton:
In accordance with the Town of Waynesville's sludge disposal landfill
Permit No. 7972, it is being required that Condition 17 of the Permit be
enacted. Condition 17 states that monitoring wells and a groundwater
monitoring program may be required of the Town of Waynesville at the
landfill as deemed appropriate by this Division.
On December 31, 1983, the Classifications and Standards Applicable
to the Underground Waters of the State of North Carolina were enacted with
the last revision becoming effective on September 1, 1984. In accordance
with these groundwater classifications, all facilities that may have an
impact on the groundwaters of the State are being required to have ground-
water monitor wells and must sample these wells at periodic intervals
deemed necessary by the Division of Environmental Management. These
monitor wells shall be installed by December 10, 1984.
The groundwater monitoring will consist initially of one well down -
gradient and one well upgradient of the landfill and shall be sampled
quarterly for the first year and semi-annually thereafter for the following
parameters*

The parameters analyzed for may change as conditions warrant.
The monitor wells shall be constructed to a depth of ten feet into the
water -table. If bedrock is encountered during drilling or a water -table is
not present in the overburden, drilling should be stopped. If this occurs,
our office should be contacted so that arrangements for possible alternative
sites can be made. The monitor wells shall be constructed to the following
specifications:
A. The well should be constructed with thermoplastic water
well casing that:
1. shall be new;
2. the casing and joints shall meet or exceed all the
specifications of ASTM F-480-81, except that the
outside diameter will not be restricted to those
listed in F-480;
3. the maximum depth of installation for a given SBR
or Schedule number shall not exceed that listed
in Table 2 which is attached (suggest 2 -inch I.D.
Schedule 40); and
4. the top of the casing shall be terminated by the
drilling contractor at least twelve inches above
land surface.
B. The bottom of each well should be equipped with a ten -foot
section of well screen that:
1. is installed at a depth at which the bottom of the
well screen is ten feet below the top of the water -
table;
2. is constructed of thermoplastic pipe that conforms
to the specifications of the well casing used
(suggest 2 -inch I.D. Schedule 40 well screen or
slotted pipe);

3. shall be equipped with a screen that will adequately
prevent the entrance of formation material into the
well after the well has been developed and completed,
4. the openings shall be designed to prevent clogging and
shall be free of rough edges, irregularities or other
defects that may accelerate clogging;
5. has such fittings as are necessary to seal the top of
the well screen to the casing and to close the bottom
end; and
6. is packed with sand or gravel of size dependent on the
nature of the formation materials
The well should have installed around the well casing, at the top of
the well screen and sand or gravel pack, a two -foot section or plug of
bentonite clay. ,above the bentonite clay, the well should be grouted
with neat cement or sand cement to the land surface. The entrance to the
well shall then be secured with a lock and be permanently labeled with a
warning that it is for monitoring only and not to be used for water supply
purposes. Protective devices shall also be placed around the well to
prevent damages to it by operations around the landfill.

monitor wells and the applications for permits to construct them.

Thank you for meeting with me on April 28, 1992 at the
subject site. Following is a summary of our discussion on
that date and comments:
1. The entire extent (areal and vertical) of
groundwater contamination shall be delineated. Per
your request, I have enclosed a list of consultants
for reference.
2. A sample of the sludge shall be collected and
analyzed to the lowest method detection limit
according to EPA Methods 8240 and 8270. The purpose
of this requirement is to help determine if the
groundwater contamination is the result of the
sludge landfill, or from the former refuse landfill
at that same location.
3. A sample shall be collected from the water supply

For facilities permitted prior to December 30, 1983, the
Compliance Boundary is established at a distance of 500 feet
from the waste boundary, or the property boundary, whichever
is less. The Compliance Boundary is specified by regulations
in 15 NCAC 2L Classifications and Water Quality Standards
Applicable to the Groundwaters of North Carolina (enclosed).
When the concentration of any substance equals or exceeds
the maximum allowable concentration of that substance at or
beyond the Compliance Boundary, the permittee shall assess the
cause, significance and extent of the violation of groundwater
standards.
In order to comply with NCAC Title 15 Subchapter 2L, you
are required to construct two additional monitor wells for the
purpose of defining the extent of groundwater contamination.

With respect to item 16 of the permit conditions and
limitations which requires installation of one downgradient
monitor well within 90 days, we reserve the right to request
an adjudicatory hearing. Per our telephone conversation
today, I am attempting to contact Don Link with the Ground-
water Section to investigate the location and rationale for
this well. We believe that the Town has already complied
,with the necessary downgradient monitoring well needs with
the installation in June 1988 of a second downgradient well.
After clarification of this permit requirement by Mr. Link,
or recipt of approved plans showing the proposed monitoring
location a determination will be made regarding a demand
for a hearing.

US19/23 Bypass. The existing site is further bounded by the
Hillcrest Memorial.Gardens Cemetery to the Southeast. Access from
NCSR 1200. Land application.pite #1 is located adjacent to access
road to Waynesville WWTP, approximately 0.7 mile east of NC HWY
209 near I-40. Land application site #2 is located on same
property as existing wwtp, approx 0.8 mile east of NC HWY 209.

PART IV - EVALUATION AND RECOMMENDATIONS: The existing
sludge landfill was expanded August 7,1985 by State Permit No
79728 providing for disposal of dried sludge by burial in,
trenches One trench had been constructed in the expanded area
and was partially filled. Monitoring wells had been constructed
required by the permit (Condition 17). Essentially 4 to 4.5 acres
of effective application area still remain. It is recommended
that the existing landfill permit be reissued as requested. As
the Town has indicated a willingness to accept waste sludge in
this site from a sister town (Clyde, NC); see attached
letter, it is recommended that condition No 11 be reworded to
allow dewatered'sludge from other domestic type wastewater
treatment facilities presuming the Town in question supply
Waynesville with satisfactory results from an EP Toxicity Test
certified as noxi -toxic by the NC Dept of Human Resources.
Dewatered alum sludge from the Town's water treatment plant may
be added to the landfill as necessary and under guidance
conditions from this Division's Ground Water Section.
Sites 1&2: Applications incomplete. Due to sites being in flood
plain, a berm separating these sites from flood waters i.c
required. Buffering restrictions to off property dwellings
(400 ft) existing stream known as Jones Branch (100 ft),
property lines (100 ft), and public right of way,if appl.-.cable
(50 ft),severely limit applicability of site #1 unless
formal easements can be executed from off -property concerns.
Application should also include formal agreement by landowner
of site; #1 to accept sludge on site. Additional information
required to complete application isas follows:
1. Soil test report detailing evaluation of lawn, fescue,
and silage as cover crops.
2. Calculations showing,application of sludge at
non -agronomic rates as support for Site Assimilative

Review of compliance monitoring data previously submitted, indicates
violations of water quality standards for total coliform. In the future,
attention should be given to proper sampling procedures to prevent
contamination. It is advisable to collect the coliform sample first, to

On Wednesday, Febraury 5, 1986, the writer, accompanied by Don Link of this
Division's Groundwater Section, inspected the site proposed by the Town of
Waynesville to be used as expansion to the existing municipal sludge landfill
(Permit Number 79721.
The expansion site is free of natural or spring feed surface water. It is
sufficiently secluded and fenced from public access and off -property residental
usage and it is bounded by U.S. Highway 19/23, the existing sludge landfill,
and fenced pasture land. Use of this property will be consistent with existing
procedures followed by the Town in that the area will be trenched, filled and
covered. The slope of the property supports the proposed usage.
It is recommended that the Permit be amended as requested following receipt
of Comments and Recommendations of the Groundwater Section.

On Wednesday, February 5, 1986, Max Haner of this Division's Water
Quality Section, and I, made a site inspection of an area to be used as
an expansion to the existing municipal sludge landfill (Permit No. 7972).
The site is adjacent to an existing permitted landfill that currently
has two monitoring wells. However, this area drains to a different"erect
so an additional monitor well is recommended at the lower end of the
drainage area. It is recommended that it be sampled for the same parameters
as the existing wells at the same time intervals.

The following stipulations on groundwater monitoring should be included

a. Any monitoring deemed necessary by the Division of
Environmental Management to insure surface and ground-
water protection will be established and an acceptable
sampling reporting schedule shall be followed.
b. Monitor wells shall be constructed in accordance with
15 NCAC 2C .0100 and sampled during the months of
March, July, and November for the following parameters:
cadmium, calcium, copper, iron, lead, magnesium, sodium,
zinc, pH, chlorides, sulfate, nitrate, total ammonia
(TA), total dissolved solids (TDS), total organic
carbon (TOC) and total coliform.

Groundwater Monitoring Requirements

The Division of Environmental Management, in order to standardize the re-
porting of groundwater analyses data from monitor wells at sites where waste
is being disposed of in such a manner that groundwaters may be impacted, is re-
quiring the data be submitted on the enclosed forms. You will note most of the
parameters analyzed are reported in milligrams per liter (mg/1), or micrograms
per liter (ug/1). As a result, care should be taken in transferring data from
the laboratory analyses to the Compliance Monitoring Report Form, making con-
versions where necessary.
The wells should be sampled during the months of March, July, and Novem-
ber, which reflect the average high, median, and low water -table periods with
the static water levels being measured and recorded prior to sampling. The
monitor wells should be sampled for the following parameters: cadmium, calcium,
copper, iron, lead, magnesium, sodium, zinc, pH, chlorides, sulfate, nitrate,
total ammonia (TA), total dissolved solids (TDS), total organic carbon (TOC),
and total coliform.
