Location description: The new water line is located along the east side of the North Fork Left Fork Road, near Black
Mountain, NC.
Description of projects area and activity: This permit authorizes excavation and mechanized landclearing associated
with the construction of a new water line. Impacts authorized by this permit total 0.175 acre of permanent wetland
impacts and 0.294 acre of temporary wetland impacts; as well as temporary impacts to 105 linear feet of stream
channel. Attached are recommendations from the North Carolina Wildlife Resource Commission for your
consideration. Please see special conditions below regarding protection of existing cultural resources, protection of
federally threatened/endangered species and compensatory mitigation requirements.

Special Conditions:
1. In order to avoid potential impacts to federally endangered bat species, tree clearing in the project area should occur
between October 15 and April 15.
2. In order to avoid potential impacts to the existing USGS gauging station which is considered an eligible structure for
listing on the National Register of Historic Places, a 5 -foot buffer with protective fencing as depicted on the Plan Sheet
C-101 shall be placed around the station. Routine and on-going inspections of the station by the engineer and/or
contractor during project construction is required to confirm that the structure has been undisturbed or if damaged has
occurred. The Corps should be notified immediately if it appears that on-going work has damaged or will damage this
structure. If any blasting/percussive activities are to occur near the structure then prior coordination with the Corps and
the North Carolina State Historic Preservation Office (SHPO) is required to determine any potential effects from the
percussive activities on the structure.
3. Bank stabilization activities are not authorized with this permit. Any work to stabilize the stream banks not included in
this permitted plan set may require additional/separate Department of the Army permit authorizations.
4. In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the
provisions outlined on the most recent version of the attached Compensatory Mitigation Responsibility Transfer Form.
The requirements of this form, including any special conditions listed on this form, are hereby incorporated as special
conditions of this permit authorization.
Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the
attached conditions, above noted special conditions, and your submitted application and attached information dated
October and January 2019. Any violation of the attached conditions or deviation from your submitted plans may
subject the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate
legal action.
This verification will remain valid until the expiration date identified below unless the nationwide/regional authorization is
modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide/regional permit authorization
is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies
with all requirements of the modified nationwide/regional permit. If the nationwide/regional permit authorization expires or is
suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the
nationwide/regional permit, activities which have commenced (i.e., are under construction) or are under contract to commence
in reliance upon the nationwide/regional permit, will remain authorized provided the activity is completed within twelve months
of the date of the nationwide/regional permit's expiration, modification or revocation, unless discretionary authority has been
exercised on a case-by-case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification.

This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required
Federal, State or local approvals/permits.

A. ® There are waters, including wetlands, on the above described project area that may be subject to Section 404 of the
Clean Water Act (CWA) (33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). This
preliminary determination is not an appealable action under the Regulatory Program Administrative Appeal Process
(Reference 33 CFR Part 331). However, you may request an approved JD, which is an appealable action, by contacting
the Corps district for further instruction. Please note, if work is authorized by either a general or nationwide permit, and
you wish to request an appeal of an approved JD, the appeal must be received by the Corps and the appeal process
concluded prior to the commencement of any work in waters of the United States and prior to any work that could alter
the hydrology of waters of the United States.

requirements of Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403) and Section 404 of the Clean Water

be relied upon for a period not to exceed five years from the date of this notification.

Basis for Determination:
See attached preliminary jurisdictional determination form. In general, the site contains wetlands as determined by the
1987 Corps of Engineers Wetland Delineation Manual and the Regional Supplement to the Corps of Engineers Wetlands
Delineation Manual: Eastern Mountain and Piedmont Region(version 2.0). These wetlands are adjacent to stream
channels located on the property that exhibit indicators of ordinary high water marks. The stream channels on the project
site is known as the Swannanoa River which ultimately drains to the French Broad River and eventually to the Gulf of
Mexico.
Remarks:
E. Attention USDA Program Participants
This delineation/determination has been conducted to identify the limits of Corps' Clean Water Act jurisdiction for the
particular site identified in this request. The delineation/determination may not be valid for the wetland conservation
provisions of the Food Security Act of 1985. If you or your tenant are USDA Program participants, or anticipate
participation in USDA programs, you should request a certified wetland determination from the local office of the Natural
Resources Conservation Service, prior to starting work.

Instructions to Permittee: The Permittee must provide a copy of this form to the Mitigation Sponsor, either an approved
Mitigation Bank or the North Carolina Division of Mitigation Services (NCDMS), who will then sign the form to verify the
transfer of the mitigation responsibility. Once the Sponsor has signed this form, it is the Permittee's responsibility to ensure
that to the U.S. Army Corps of Engineers (USACE) Project Manager identified on page two is in receipt of a signed copy of this
form before conducting authorized impacts, unless otherwise specified below. If more than one mitigation Sponsor will be
used to provide the mitigation associated with the permit, or if the impacts and/or the mitigation will occur in more than one
8 -digit Hydrologic Unit Code (HUC), multiple forms will be attached to the permit, and the separate forms for each Sponsor
and/or HUC must be provided to the appropriate mitigation Sponsors.
Instructions to Sponsor: The Sponsor must verify that the mitigation requirements (credits) shown below are available at the
identified site. By signing below, the Sponsor is accepting full responsibility for the identified mitigation, regardless of
whether or not they have received payment from the Permittee. Once the form is signed, the Sponsor must update the bank
ledger and provide a copy of the signed form and the updated bank ledger to the Permittee, the USACE Project Manager, and

Conditions for Transfer of Compensatory Mitigation Credit:
• Once this document has been signed by the Mitigation Sponsor and the USACE is in receipt of the signed form, the
Permittee is no longer responsible for providing the mitigation identified in this form, though the Permittee remains
responsible for any other mitigation requirements stated in the permit conditions.
• Construction within jurisdictional areas authorized by the permit identified on page one of this form can begin only after
the USACE is in receipt of a copy of this document signed by the Sponsor, confirming that the Sponsor has accepted
responsibility for providing the mitigation requirements listed herein. For authorized impacts conducted by the North
Carolina Department of Transportation (NCDOT), construction within jurisdictional areas may proceed upon permit
issuance; however, a copy of this form signed by the Sponsor must be provided to the USACE within 30 days of permit
issuance. NCDOT remains fully responsible for the mitigation until the USACE has received this form, confirming that the
Sponsor has accepted responsibility for providing the mitigation requirements listed herein.
• Signed copies of this document must be retained by the Permittee, Mitigation Sponsor, and in the USACE administrative
records for both the permit and the Bank/ILF Instrument. It is the Permittee's responsibility to ensure that the USACE
Project Manager (address below) is provided with a signed copy of this form.
• If changes are proposed to the type, amount, or location of mitigation after this form has been signed and returned to
the USACE, the Sponsor must obtain case-by-case approval from the USACE Project Manager and/or North Carolina
Interagency Review Team (NCIRT). If approved, higher mitigation ratios may be applied, as per current District guidance
and a new version of this form must be completed and included in the USACE administrative records for both the permit
and the Bank/ILF Instrument.

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in the
review area, and the requestor of this PJD is hereby advised of his or her option to request
and obtain an approved JD (AJD) for that review area based on an informed decision after
having discussed the various types of JDs and their characteristics and circumstances when
they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a Nationwide
General Permit (NWP) or other general permit verification requiring "pre- construction
notification" (PCN), or requests verification for a non -reporting NWP or other general permit,
and the permit applicant has not requested an AJD for the activity, the permit applicant is
hereby made aware that: (1) the permit applicant has elected to seek a permit authorization
based on a PJD, which does not make an official determination of jurisdictional aquatic
resources; (2) the applicant has the option to request an AJD before accepting the terms and
conditions of the permit authorization, and that basing a permit authorization on an AID could
possibly result in less compensatory mitigation being required or different special conditions;
(3) the applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can accept
a permit authorization and thereby agree to comply with all the terms and conditions of that
permit, including whatever mitigation requirements the Corps has determined to be necessary;
(5) undertaking any activity in reliance upon the subject permit authorization without
requesting an AID constitutes the applicant's acceptance of the use of the PJD; (6) accepting a
permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in
reliance on any form of Corps permit authorization based on a PJD constitutes agreement that
all aquatic resources in the review area affected in any way by that activity will be treated as
jurisdictional, and waives any challenge to such jurisdiction in any administrative or judicial
compliance or enforcement action, or in any administrative appeal or in any Federal court;
and (7) whether the applicant elects to use either an AID or a PJD, the JD will be processed
as soon as practicable. Further, an AID, a proffered individual permit (and all terms and
conditions contained therein), or individual permit denial can be administratively appealed
pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to
make an official determination whether geographic jurisdiction exists over aquatic resources
in the review area, or to provide an official delineation of jurisdictional aquatic resources in
the review area, the Corps will provide an AJD to accomplish that result, as soon as is
practicable. This PJD finds that there "may be" waters of the U.S. and/or that there "may be"
navigable waters of the U.S. on the subject review area, and identifies all aquatic features in
the review area that could be affected by the proposed activity, based on the following
information:

NOTES: CONSTRUCTION MATTING BEST MANAGEMENT PRACTICES
INSTALLATION:
1. MATS SHOULD BE IN GOOD CONDITION TO ENSURE PROPER INSTALLATION, USE AND REMOVAL. OPERATING
HEAVY EQUIPMENT IN WETLANDS SHALL BE MINIMIZED, AND SUCH EQUIPMENT OTHER THAN FIXED EQUIPMENT
(DRILL RIGS, FIXED CRANES, ETC.) SHALL NOT BE STORED, MAINTAINED, FUELED OR REPAIRED IN WETLANDS
UNLESS THE EQUIPMENT IS BROKEN DOWN AND CANNOT BE EASILY REMOVED.
2. WOODY VEGETATION (TREES, SHRUBS, ETC.) SHALL BE CUT AT OR ABOVE GROUND LEVEL AND NOT UPROOTED
IN ORDER TO PREVENT DISRUPTION TO THE WETLAND SOIL STRUCTURE AND TO ALLOW STUMP SPROUTS TO
REVEGETATE THE WORK AREA.
3. WHERE FEASIBLE, PLACE MATS IN A LOCATION THAT WOULD MINIMIZE THE AMOUNT NEEDED FOR
THE WETLANDS CROSSING:
4. MINIMIZE IMPACTS TO WETLAND AREAS DURING INSTALLATION, USE, AND REMOVAL.
5. INSTALL ADEQUATE EROSION AND SEDIMENT CONTROLS AT APPROACHES TO MATS TO PROMOTE A SMOOTH

BOARDS ARE RESTING PERPENDICULAR TO THE DIRECTION OF TRAFFIC. NO GAPS SHOULD EXIST BETWEEN
MATS. PLACE MATS FAR ENOUGH ON EITHER SIDE OF THE RESOURCE AREA TO REST ON FIRM GROUND.
WETLAND/STREAM CHANNEL CROSSING:
1. AT 'DRY"CROSSINGS WHERE NO FLOW IS PRESENT OR ANTICIPATED DURING PROJECT CONSTRUCTION, THE
MATS MAY BE PLACED DIRECTLY ONTO THE GROUND IN ORDER TO PREVENT EXCESSIVE RUTTING, PROVIDED
STREAM BANKS AND BOTTOMS ARE NOT ADVERSELY ALTERED.
2. CONSTRUCTION MATS MAY BE USED AS A TEMPORARY BRIDGE OVER A STREAM TO ALLOW VEHICLES ACCESS
TO THE WORK SITE. SMALL SECTIONS OF MAT ARE PLACED WITHIN AND ALONG THE STREAM PARALLEL TO THE
FLOW OF WATER. MATS MAY THEN BE PLACED PERPENDICULAR TO THE STREAM, RESTING ON TOP OF THE
INITIAL CONSTRUCTION MAT SUPPORTS. IT MAY BE NECESSARY TO PLACE ADDITIONAL REINFORCEMENT FOR
EXTRA STABILITY AND TO MINIMIZE THE AMOUNT OF SEDIMENT THAT COULD FALL BETWEEN THE SPACES OF
EACH TIMBER.
3. MATS SHOULD NOT BE PLACED SO THAT THEY RESTRICT THE NATURAL FLOW OF THE STREAM.
4. MINIMIZE NUMBER OF STREAM/WETLAND CROSSINGS. WHERE FEASIBLE, LOCATE CROSSING SITE WHERE STREAM
CHANNEL IS NARROW FOR THE SHORTEST POSSIBLE CLEAR SPAN AND WHERE STREAM BANKS ARE STABLE
AND WELL DEFINED. FOR LARGE WETLAND COMPLEXES, CONSIDER ACCESSING STRUCTURES FROM OPPOSITE
SIDES WHERE POSSIBLE TO AVOID CROSSING THE ENTIRE WETLAND.
5. MORE THAN ONE LAYER OF MATS MAY BE NECESSARY IN AREAS WHICH ARE INUNDATED OR HAVE DEEP
ORGANIC WETLAND SOILS.
REMOVAL/RESTORATION:
1. MATTING SHOULD BE REMOVED BY "BACKING" OUT OF THE SITE, REMOVING MATS ONE AT A TIME. ANY
RUTTING OR SIGNIFICANT INDENTATIONS IDENTIFIED DURING MAT REMOVAL SHOULD BE REGRADED IMMEDIATELY,
TAKING CARE NOT TO COMPACT SOILS.
2. MATS SHOULD BE CLEANED BEFORE TRANSPORT TO ANOTHER WETLAND LOCATION TO REMOVE SOIL AND ANY
INVASIVE PLANT SPECIES SEED STOCK OR PLANT MATERIAL.
3. MATS SHALL BE CLEANED OF SOIL AND ANY INVASIVE PLANT SPECIES SEED STOCK OR PLANT MATERIAL FROM
BEFORE INSTALLATION.
4. CROSSINGS SHOULD BE INSPECTED FOLLOWING MAT REMOVAL TO DETERMINE THE LEVEL OF RESTORATION
REQUIRED.
SPECIAL PRECAUTIONS SHOULD BE TAKEN TO PROMPTLY STABILIZE AREAS OF DISTURBED SOIL LOCATED NEAR
WETLANDS AND STREAMS. MATTED AREAS WITHIN WETLANDS SHALL BE RESTORED TO THEIR ORIGINAL CONDITION AND

TEMPORARY BYPASS NOTES
1. Install all erosion control measures as shown on Erosion
Control Plan and in this detail.
2. Construct impervious dike (recommend sand bags or other
easily removable material) on upstream side of existing channel
and install temporary bypass pump to divert water around
construction area. All material must be completely removed
following construction.
3. Construct impervious dike (recommend sand bags or other
easily removable material) on downstream side of existing
channel to prevent backing up of stream water into the
construction area.
4. Dewater the construction area using another temporary pump
and discharge water into a dewatering basin until sediment has
settled and water can be discharged back into stream.
Dewatering basin must be outside of any restricted buffer areas,
use wattles instead of earth berm if reasonable.
5. Begin construction of cross -culvert. Contractor shall inspect
system daily before beginning any construction. No construction
shall continue if system is not fully operational.
6. Any wash material removed from bypass area should be
stoned outside the flood zone or regulated buffer area until
construction is complete.
7. Upon completion of culvert construction, remove bypass
system within (2) two calendar days.
8. Stabilize all areas disturbed during construction. Stream bed
and banks must be returned to pre -construction conditions.
9. Contractor shall receive prior approval from engineer if
choosing to use another method in lieu of bypass channel.

TEMPORARY BYPASS NOTES
1. Install all erosion control measures as shown on Erosion
Control Plan and in this detail.
2. Construct impervious dike (recommend sand bags or other
easily removable material) on upstream side of existing channel
and install temporary bypass pump to divert water around
construction area. All material must be completely removed
following construction.
3. Construct impervious dike (recommend sand bags or other
easily removable material) on downstream side of existing
channel to prevent backing up of stream water into the
construction area.
4. Dewater the construction area using another temporary pump
and discharge water into a dewatering basin until sediment has
settled and water can be discharged back into stream.
Dewatering basin must be outside of any restricted buffer areas,
use wattles instead of earth berm if reasonable.
5. Begin construction of cross -culvert. Contractor shall inspect
system daily before beginning any construction. No construction
shall continue if system is not fully operational.
6. Any wash material removed from bypass area should be
stoned outside the flood zone or regulated buffer area until
construction is complete.
7. Upon completion of culvert construction, remove bypass
system within (2) two calendar days.
8. Stabilize all areas disturbed during construction. Stream bed
and banks must be returned to pre -construction conditions.
9. Contractor shall receive prior approval from engineer if
choosing to use another method in lieu of bypass channel.

NOTES: NCDEQ GENERAL CONSTRUCTION CONDITIONS
1. THE CONTRACTOR SHALL MINIMIZE CLEARING WITHIN WETLANDS AND ACROSS
STREAMS TO THE GREATEST EXTENT PRACTICABLE AND SHALL NOT EXCEED 50' WIDE
FOR GAS UTILITY LINES AND 40' WIDE FOR ALL OTHER UTILITY LINES. EXCEPTIONS TO
THIS CONDITION WILL REQUIRE WRITTEN APPROVAL FROM THE PROJECT ENGINEER.
FOR CONSTRUCTION CORRIDORS IN WETLANDS AND ACROSS STREAM CHANNELS,
STUMPS SHALL BE GRUBBED ONLY AS NEEDED TO INSTALL THE UTILITY AND
REMAINING STUMPS SHALL BE CUT OFF AT GRADE LEVEL. THE GENERAL STRIPPING
OF TOPSOIL WITHIN WETLANDS ALONG THE CONSTRUCTION CORRIDOR IS NOT
PERMITTED.
2. PERMANENT MAINTAINED ACCESS CORRIDORS IN WETLANDS AND ACROSS STREAM
CHANNELS SHALL BE RESTRICTED TO THE MINIMUM WIDTH
PRACTICABLE AND SHALL NOT EXCEED 30' WIDE FOR GAS UTILITY LINES AND 20'
WIDE FOR ALL OTHER UTILITY LINES EXCEPT AT MANHOLE LOCATIONS. 15' X 15'
PERPENDICULAR VEHICLE TURN-AROUNDS ARE ALLOWED IN ACCESS CORRIDORS BUT
MUST BE SPACED AT LEAST 500' APART. EXCEPTIONS TO THIS CONDITION REQUIRE
WRITTEN APPROVAL FROM THE PROJECT ENGINEER.
3. THE CONTRACTOR SHALL HAVE A SPECIFIC PLAN FOR RESTORING WETLAND
CONTOURS. ANY EXCESS MATERIAL SHALL BE REMOVED TO A HIGH GROUND
DISPOSAL AREA. THE MIXING OF TOPSOIL AND SUBSOILS WITHIN WETLANDS ALONG
UTILITY CORRIDORS SHALL BE MINIMIZED TO THE GREATEST EXTENT PRACTICABLE
DURING EXCAVATION. THE SOILS SHALL BE PLACED ON FABRIC TO MINIMIZE IMPACTS
WHENEVER POSSIBLE. TOPSOIL EXCAVATED FROM UTILITY TRENCHES SHALL BE PILED
SEPARATELY FROM SUBSOILS AND BACKFILLED INTO THE TRENCH ONLY AFTER THE
SUBSOILS HAVE BEEN PLACED AND COMPACTED.
4. NO WASTE, SPOIL, SOLIDS, OR FILL OF ANY KIND CAN OCCUR IN WETLANDS OR
WATERS BEYOND THE FOOTPRINT OF THE IMPACT AREA (INCLUDING TEMPORARY
IMPACTS) OR BEYOND THE PERMITTED THRESHOLDS WITHOUT WRITTEN AUTHORIZATION
FROM THE PROJECT ENGINEER. NO REMOVAL OF VEGETATION OR OTHER IMPACTS OF
ANY KIND CAN OCCUR TO STATE REGULATED RIPARIAN BUFFERS BEYOND THE
FOOTPRINT OF IMPACTS APPROVED IN A BUFFER AUTHORIZATION OR VARIANCE OR
AS LISTED AS AN EXEMPT ACTIVITY IN THE APPLICABLE RIPARIAN BUFFER RULES.
5. ALL EROSION CONTROL DEVICES SHALL BE MAINTAINED ON ALL CONSTRUCTION SITES,
BORROW SITES, AND WASTE PILE (SPOIL) SITES, INCLUDING CONTRACTOR OWNED OR
LEASED BORROW PITS ASSOCIATED WITH THE PROJECT. SUFFICIENT MATERIALS
REQUIRED FOR STABILIZATION AND/OR REPAIR OF EROSION CONTROL MEASURES AND
STORMWATER ROUTING AND TREATMENT SHALL BE ON-SITE AT ALL TIMES.
6. SEDIMENT AND EROSION CONTROL MEASURES SHALL NOT BE PLACED IN WETLANDS
OR WATERS EXCEPT WITHIN THE FOOTPRINT OF TEMPORARY OR PERMANENT IMPACTS
AUTHORIZED UNDER THE PERMITS. EXCEPTIONS TO THIS CONDITION REQUIRE WRITTEN
APPROVAL FROM THE PROJECT ENGINEER.
7. EROSION CONTROL MATTING THAT INCORPORATES PLASTIC MESH AND/OR PLASTIC
TWINE SHALL NOT BE USED ALONG STREAMBANKS OR WITHIN WETLANDS. EXCEPTIONS
TO THIS CONDITION REQUIRE WRITTEN APPROVAL FROM THE PROJECT ENGINEER.
8. AN NPDES CONSTRUCTION STORMWATER PERMIT (NCGO10000) IS REQUIRED FOR
CONSTRUCTION PROJECTS THAT DISTURB ONE OR MORE ACRES OF LAND. THE
NCGO10000 PERMIT ALLOWS STORMWATER TO BE DISCHARGED DURING LAND
DISTURBING CONSTRUCTION ACTIVITIES AS STIPULATED IN THE CONDITIONS OF THE
PERMIT. IF THE PROJECT IS COVERED BY THE PERMITS, FULL COMPLIANCE WITH
PERMIT CONDITIONS INCLUDING THE EROSION AND SEDIMENTATION CONTROL PLAN,

ACTIVITY.
11. APPLICATION OF FERTILIZER TO ESTABLISH PLANTED/SEEDED VEGETATION WITHIN
DISTURBED RIPARIAN AREAS SHALL COMPLY WITH ALL OTHER FEDERAL, STATE AND
LOCAL REGULATIONS. FERTILIZER APPLICATION SHALL BE ACCOMPLISHED IN A
MANNER THAT MINIMIZES THE RISK OF CONTACT BETWEEN THE FERTILIZER AND
SURFACE WATERS.
12. IF CONCRETE IS USED DURING CONSTRUCTION, THEN ALL NECESSARY MEASURES
SHALL BE TAKEN TO PREVENT DIRECT CONTACT BETWEEN UNCURED OR CURING
CONCRETE AND WATERS OF THE US. WATER THAT INADVERTENTLY CONTACTS
UNCURED CONCRETE SHALL NOT BE DISCHARGED TO WATERS OF THE US.
13. ALL PROPOSED AND APPROVED TEMPORARY FILL AND CULVERTS SHALL BE REMOVED
AND THE IMPACTED AREA RETURNED TO NATURAL CONDITIONS WITHIN 60 CALENDAR
DAYS AFTER THE TEMPORARY IMPACT IS NO LONGER NECESSARY. THE IMPACTED
AREAS SHALL BE RETURNED TO ORIGINAL GRADE, INCLUDING EACH STREAM'S
ORIGINAL CROSS SECTIONAL DIMENSIONS, PLANFORM PATTERN, AND LONGITUDINAL
BED PROFILE. ALL TEMPORARY IMPACTS SHALL BE RESTORED AND STABILIZED WITH
NATIVE VEGETATION.
14. ALL PROPOSED AND APPROVED TEMPORARY PIPES/CULVERTS/RIP-RAP PADS ETC. IN
STREAMS SHALL BE INSTALLED AS OUTLINED IN THE MOST RECENT EDITION OF THE
NC SEDIMENT AND EROSION CONTROL PLANNING AND DESIGN MANUAL OR THE NCDOT
BEST MANAGEMENT PRACTICES FOR CONSTRUCTION AND MAINTENANCE ACTIVITIES SO
AS NOT TO RESTRICT STREAM FLOW OR CAUSE DIS -EQUILIBRIUM DURING USE OF
THIS CERTIFICATION.
15. ANY RIP -RAP REQUIRED FOR PROPER CULVERT PLACEMENT, STREAM STABILIZATION,
OR RESTORATION OF TEMPORARILY DISTURBED AREAS SHALL BE RESTRICTED TO THE
AREA DIRECTLY IMPACTED BY THE APPROVED CONSTRUCTION ACTIVITY. ALL RIP -RAP
SHALL BE PLACED SUCH THAT THE ORIGINAL STREAM ELEVATION AND STREAM BANK
CONTOURS ARE RESTORED AND MAINTAINED, NOT RESULT IN THE DE -STABILIZATION
OF STREAM BED OR BANKS UPSTREAM OR DOWNSTREAM OF THE AREA, AND NOT
RESTRICT AQUATIC LIFE PASSAGE.
16. ANY RIP -RAP USED FOR STREAM OR SHORELINE STABILIZATION SHALL BE OF SIZE
AND DENSITY TO PREVENT MOVEMENT BY WAVE, CURRENT, OR STREAM FLOWS, AND
WILL CONSIST OF CLEAN ROCK OR MASONRY MATERIAL. RIP -RAP SHALL NOT BE
INSTALLED IN THE STREAMBED EXCEPT IN SPECIFIC AREAS REQUIRED FOR VELOCITY
CONTROL AND TO ENSURE STRUCTURAL INTEGRITY OF BANK STABILIZATION
MEASURES.
17. ALL MECHANIZED EQUIPMENT OPERATED NEAR SURFACE WATERS SHALL BE
INSPECTED, FUELED, LUBRICATED, AND MAINTAINED REGULARLY AND MAINTENANCE
PERFORMED IN A MANNER TO PREVENT CONTAMINATION OF STREAM WATER FROM
FUELS, LUBRICANTS, HYDRAULIC FLUIDS, OR OTHER TOXIC MATERIALS.
18. HEAVY EQUIPMENT WORKING IN WETLANDS SHALL BE PLACED ON MATS OR OTHER
MEASURES TAKEN TO MINIMIZE SOIL DISTURBANCE.
19. THE CONTRACTOR OR OTHER RESPONSIBLE ENTITY SHALL REPORT ANY PETROLEUM
SPILL OF 25 GALLONS OR MORE; ANY SPILL REGARDLESS OF AMOUNT THAT CAUSES
A SHEEN ON SURFACE WATERS; ANY PETROLEUM SPILL REGARDLESS OF SIZE THAT
