In several emails sent on September 5, 2018 and January 8, 2019 (with communication between those dates), by Gwyn McCullough and Christyn Fertenbaugh, P.E., your engineer was asked to provide additional information (copy attached) in accordance with 15A NCAC 02T.0107(e). As of today, this information has not been received, therefore the Division must return your application as incomplete in accordance with 15A NCAC 02T.0107(e)(2). Please be advised that construction and/or operation of wastewater collection,treatment, and/or disposal facilities without a valid permit is a violation of North Carolina General Statute§143-215.1 and may subject the owner/operator to appropriate enforcement actions in accordance with North Carolina General Statute §143-215.6A-6C. Civil penalties of up to$25,000 per day per violation may be assessed for failure to secure a permit required by North Carolina General Statute§143-215.1. When you have obtained the requested information that is needed to make your application package complete,you may submit a new application package with the appropriate permit processing fee. While we will review the archived files when they are received for a historical perspective,this will not change the current permitting requirements for the requested additional connections.The additional 37 connections must be proposed via a complete application for a permit modification. Please see our request for additional documentation from September 2018, copied below. However,per 15A NCAC 02T.0107,the application must be complete prior to being entered for processing. I've taken the past few weeks to re-familiarize myself with what has been a long and complicated permit process As you may remember, in our most recent Permit Modification request,we had requested additional flow(37 simplex pumps/lots)to allow the developer to extend the sewers into future sections of the project. In response,you, in your below email, stated, "it would appear that any additional flow would also require additional connections to be added to this permit. The addition of connections requires all of the information as listed in Gwyn's email." (i.e. plans,specs, calculations ' ) In response to that, and after more study of the permit file, it appears that plans, specs and calculations for the section(s)the developer now wishes to construct have been previously reviewed and permitted by your office. While the 10/7/16 Permit Modification does not make that point abundantly clear, I think if you will review the older permits, on which that Modification was premised,that fact will become clear. While it is true that the 10/7/2016 only allows 228 simplex pumps (lots),that 228 figure was established solely on the basis of FLOW (per the 7/13/16 Flow Adjustment). If you will review the old permits, on which the new Permit is based, you will see that those permits allowed construction of collection lines serving a total of 309 Lots, (see attached Summary of Existing Permits) and plans, calculations, etc for all of those collection lines were approved by your office when those permits were issued. In summary, I think the situation may be summarized as follows: PERCS has already reviewed and approved the drawings, calculations, etc for collection lines serving a total of 309 lots, including the-37 we are now requesting flow Hopefully, if you can-review your files, you will have copies of those approved drawings and the calculations. Attached are pdf's of the drawings for the 2 sections we now hope to build that I hope demonstrate that these particular lines are already approved and permitted (see attached). If those lines are indeed already approved and permitted, it would appear that all we need to request now is additional flow, as supported by the Flow Actualization analysis we previously provided. If you will review your files, hopefully you have that documentation included therein, and the old permits in which Leggett approved those drawings, calcs. The recent hurricane has just put us desperately behind..... I am trying to get the information together to address the requested clarification. In the meantime a quick question if I may. I met with the Developer today in an effort to get some of my own questions answered They asked me the following question....a question that I was unable to answer directly. There original permit was premised on use of a positive displacement E-One pump.....and all the pumping units installed to this date have been that type. In future extensions,they want to consider switching to a conventional Myers centrifugal pump(i.e. mixing pump types within the system). It is my understanding that the Myers pump curve is almost identical to the E-One curve....although I have not yet actually seen that curve YET. Does PERCS have any restrictions or recommendations with regard to mixing pump types within a system? If the pump curves are almost identical as they suggest,from a hydraulic standpoint it would appear that system wouldn't"feel"the difference from one pump type to the other But I suppose step 1 is to confirm that is indeed the case. Please provide further clarification, as we are unclear as to how the existing flow could be nearing the permitted capacity without the number of connections being similarly near the permitted capacity. Ms. McCullough and Fertenbaugh, == Please note that the Permit Modification request includes NO NEW INFRASTRUCTURE. The Modification request is for Additional FLOW ONLY. The current permit,as written, allows the Permittee to construct additional collector sewers (Low Pressure Lines) and simplex pumping units. However,that permit, as written, also includes some flow restrictions that will in the near future, unless modified, prevent the Permittee from installing those previously permitted low pressure mains and pumping units. We met with Christyn and Ms. Gore back in March to discuss this situation, and they suggested we prepare a "Flow Actualization Analysis"to support a request for additional flow. We have submitted that Analysis for PERCS review and approval (hopefully). That is simply all we are requesting at this juncture a permit modification to increase to the allowable flow ONLY(i.e. no additional collector sewers or pumping units). That being the case, it would seem that the "additional information" requested below(plans, specs,calculations,Site Maps, Power Reliability, Operation Agreements) is not applicable to this request. 7 Please advise if we need to provide additional information....or if the information we have provided is not in the proper format. We will gladly provide PERCS whatever information you may require.
