REGAN Secretary LINDA CULPEPPER Director January 23, 2019 B Mack Farms, LLC B Mack Farms #2 308 Parker Heath Road Pink Hill, North Carolina 28572 Subject: Notice of Deficiency — Monitoring and Reporting Requirements B Mack Farms #2, #40-146 AWS4000146 Greene County NOD-2018-PC-0010 Dear B Mack Family Farms LLC: On December 13, 2018 a routine compliance inspection was conducted at this facility (40-146) in Greene County. At this inspection there were missing required Records and Documents. Please be advised that failure to maintain the required records & documents in accordance with the facility's Certified Animal Waste Management Plan and with Condition III. 11. of NC Swine Waste System General Permit could result in other actions being taken by the Division in response to compliance matters. Condition III.11. of the NC Swine Waste General Permit states: "A copy of this General Permit, the facility's COC, certification forms, lessee and landowner agreements, the CAWMP and copies of all records required by this General Permit and the facility's CAWMP shall be maintained by the Permittee in chronological and legible form for three (3) years. These records shall be maintained on forms provided or approved by the Division and shall be readily available at the facility (stored at places such as the farm residence, office, outbuildings, etc.) where animal waste management activities are being conducted." North Carolina Department of Environmental Quality (Division of Water Resources - Washington Regional Office 943 Washington Square Mall, Washington, North Carolina 27889 252-946-6481 Deficiency 1: On December 13, 2018, incomplete/missing records were as follows: change of ownership, Certificate of Coverage, CAWMP, soil and waste analyses, and sludge survey. Corrective Action for Deficiency 1: Take all necessary additional steps to ensure that all the required records are on site always and readily accessible at the time of a compliance inspection. You are required to take any necessary action to address the above violation. You are required to provide a written response to this Notice, including any additional information that you wish to provide related to this incident that you wish for the Division to consider, within 30 days of receipt of this letter. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed. Please work to ensure that your facility is managed in a way to maintain compliance with permit and animal waste management plan requirements. Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to the Director of the Division of Water Quality who may issue a civil penalty assessment of not more that twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with the terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A.
