Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The project is located east of the Town of Mars Hill in Madison County. Land use within the project area consists of transportation facilities, residential yards, and a fallow field. The project area is bounded to the west by I-26 and to the east by Big Branch. The project vicinity is comprised of agricultural land, low-density residential areas, and undeveloped forestland. 4b. As an additional benefit, the project will improve residential safety by constructing a secondary means of north-south travel in the area which will alleviate local traffic on I-26. 4i. The 2-land road e#ension wrould provide the existing service road a logical terminus at Calvin Edney Road. The proposed riprap at these locations will be keyed in or countersunk to match the ebsting contours. Additionally, 160 linear feet of permanent impacts will result from the realignment and eutension of an existing culvert due to the construction of the proposed roadway fillslope. E. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Impacts to streams within the project area have been avoided and minimized to the eMent practical through design. The footprint of the proposed roadway was specifically aligned to avoid stream SB and Big Branch to greatest ex[ent possible. Where necessary and feasible, 2:1 slopes have been proposed to avoid impacts to the channels. All riprap that will be installed within the jurisdictional streams has been designed to match the ersting contours and preventloss of water. 1b. Specificallydescribe measures taken to avoid or minimize the proposed impacts through construction techniques: Impacts to streams within the corridor will be avoided and minimized to the eu[ent practical throughout the construction process. To avoid unnecessary impacts to streams within the project area, staging, storage, and construction access will occur in upland areas where feasible. Silt fencing will be installed along the construction limits to ensure all equipment and work areas stay within the permitted boundaries. Stormwater and erosion control measures will be utilized to avoid sedimentation impacts to downstream waters and control runoff from the construction site. 2. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat? The USFWS lists tv�,n federally protected species known to occur in Madison County: northern long-eared bat (NLEB) and gray bat. A review of the North Carolina Natural Heritage Program (NCNHP) element occurrence database records (updated October 2018) revealed no known occurrences of any federally protected species in or within 1.0 mile of the project limits. The NCDOT - Division 13 DEO, Roger Bryan, confirmed with Marella Bunick of the USFWS that the project study area is not located within a county or watershed known to contain NLEB hibernation or maternity roosting sites. Therefore, the project has met the criteria required for the USFWS 4(d) rule, and any associated take is exempt. Due to the exemption under the 4(d) ruling, it has been determined that the proposed project "May Affect, Not Likely to Adversely AffecP' the NLEB. The NCDOT - Division 13 DEO, Roger Bryan, confirmed with Marella Buncick of the USFWS that habitat for gray bat is not present within the study area. Since there is no habitat present, surveys for gray bat will not be required. Due to the lack of known occurrences and the lack of habitat present within the study area, it has been determined that the proposed project will have "No EffecP' on the gray bat. One National Register individual listing, two National Register Historic Districts, and one Study List individual listing were identified within a 1.0-mile radius of the study area: -Mars Hill School (Anderson Rosenwald School) is a National Register individual listing. The school is a 1927 frame 1-room Rosenwald school house located appropmately 0.8 mile south-southwast of the project. This National Register listing is separated from the proposed project by a large interchange and I-26. Due to the distance from the project area, the development between the project and the historic site, and the minimal impact which will result from the proposed project, it is anticipated that construction of the project will have no effect on this historic site. -Mars Hill College Historic District (late 19th and 20th century college campus) and the Mars Hill Commercial Historic District (1910-1930 brick commercial buildings) are National Register Historic Districts located approbmately 0.75 mile northwest of the project area in Mars Hill. These National Register Historic Districts are separated from the proposed project by I-26 and commercial developments. Due to the distance from the project area, the development between the project area and the historic districts, and the minimal impact which will result from the proposed project, it is anticipated that construction of the project will have no effect on this historic site. -The Mars Theater is a Study List individual listing. The theater is a 1947 brick, veneer building located approximately 0.8 mile northvsest of the study area on N. Main Street in Mars Hill. This Study List listing is separated from the project by I-26 and commercial developments. Due to the distance from the project area, the development between the project area and the historic site, and the minimal impact anticipated from the proposed project, it is anticipated that the proposed project will have no effect on this historic site. 7c.
