After our conversation I made contact with Jason Floyd of Bennick Grading. He will be doing our shore
stabilization. He did not think we would need to eliminate as many trees as I had in my count. I counted all the
trees that were on the very edge of the shoreline but he did not think any more than 5 or 6 trees over 3
inches would need to taken down. Any trees that are removed will be replaced inch for inch with a replant in
the 50' protected area.
We will likely be planting more hardwoods regardless. We have a lot of pines on our property and we would
like more hardwoods.
Regarding the the errors on the page 3 drawing, I just reversed my numbers by mistake. Page 3 on the drawing
are reversed - it should have been - 3 x 100 = 300 sf above normal water level and 2 x 100 = 200 sf below normal
water level

Mr. Ritter,
On November 26, 2018, the Division of Water Resources (Division) received your application dated November 26, 2018,
requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that
your application is incomplete and cannot be processed. The application is on hold until all of the following items are
addressed:

• The application is not clear regarding the proposed impacts. Please respond with the correct impact in writing.
o On page 2, the impacts are listed as being 300 sf above normal water level and 200 sf below normal
water level.
o On page 3, the impacts are shown to be 200 sf above normal water level and 300 sf below normal water
level.
• Please clarify whether you are proposing to remove trees from the Catawba buffer and describe what the
purpose and need to do so is. If you are proposing to remove trees greater than 3" DBH, replanting with native
hardwood tree species is required.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide a response by January 20, 2019. If you have any questions or
concerns, do not hesitate to contact me.
